Patankar (Retd.) on Tuesday, the llth November 2014 at 11.30 a.m. in the Conference Hall, Ofice of the Samiti, 305, 3rd floor, Government Polytechnic Building, 49, Kherwadi, Bandra (E), Mumbai 400 051. I tem No. 3 : To decide on the proposals received for a ~ ~ r o v a l of fees structure for the courses started durinq Academic Year 2014-15:

I tem No. 3(a) : To consider and decide on ~roposals where there are no discrepancies.

The Samiti considered the proposals of the following Colleges/Institutes for finalization of fee structure for the students who joined the course started during Academic Year 2014-15. After deliberations, The Sarr~iti decides to approve the final fee structure of the following Colleges/Institutes for the students who joined the course started during Academic Year 2014-15, subject to final approval/affiliation/permissions from respective Authorities. Figures are arrived at after considering the calculations drawn in the worksheet - calculation sheets of the respective colleges/institutes prepared by a Chartered Accountant. The students admitted in Acaderr~ic Year 2014-15 and there after continuing their studies will pay an enhanced fee of 5% each successive year as per the norms for 2014-15 till completion of the course. For example if the fee approved is Rs. 1,00,000/- then from 11" years onward till completion of the course i.e. say 11, I11 and IV year the fees will be Rs. 1,05,000/- per @. I n case the students take V th years for completing the course then he shall pay the fee approved in that year. Worksheet - Calculation sheets are available in the office.

Item No. 4(il: To consider and decide on letter dated 26/9/2014 received from Swatantra Senani Uttamraoii Patil Nursing Colleqe, Auranaabad reauestinq for reduction in penalty amount for AY 2014-15 as per Item No. 4(iv) of minutes 16/10/2014.

Considered the report of the office as per Item No. 4(iv) of the meeting held on 16/10/2014. I t is concerning 3 different courses 1) Basic Bsc. Nursing 2) Post Bsc. IYursing 3) RANM. The Institute has submitted on line proposals on 28/7/2014 in respect of these courses. Further hard copies were submitted on 1/10/2014. As far as the courses regarding the Basic Bsc. Nursing and Post Bsc. Nursing are concerned, the hard copy of the online proposal submitted on 1/10/2014 is the same. Therefore they are to get back the penalty/late fee of Rs. 60,000/- paid for these courses. The office to refund the same immediately. As far as RANM course is concerned, the. online proposal submitted on 28/7/2014 was different from the hard copy submitted on 1/10/2014. Now the Institute wants this to be considered .There is therefore delay. The penaltyllate fee was Rs. 30,000/-. Therefore the office has correctly collected the amount of Rs. 30,000/- in respect of this course.

Item No. 4(ii): To consider and decide on letter dated 22/10/2014 received from Davanand School of Nursinq reqardinq submission and proposal for the AY 2014-15.

This is concerning RANM course. The Institute is situated at Village Vadoli, Talasari which is totally tribal area. It is pointed out that all the students are tribals. I t is pointed out that it has no online facility or availability of any modern gadgets. I t is


also pointed out that there is no electricity even available for more than '/2 a day every day. For the first time they are coming before the Samiti. It is pointed out that they were not aware that they are required to get the fee approved from the Samiti. It is stated that it may not be possible to run the institute without the help of the Government. The hard copy is already submitted. It is prayed that there may not be any late fee and the proposal made be evaluated considering all this aspects. We feel that it is better to waive the late fee and also to approve the fees. Office to communicate it.

Item No. 4fiii): To consider the letter dated 30/10/2014 bearinq No. KMED 1011 / Pra.Kra. 22/11. EDN2. Medical Education & Druq Dept. askinq an opinion of Samiti reqardins caption fees in respect of a complaint aqainst Tilak Maharashtra University.

Considered the letter dated 30/10/2014 received from Deputy Secretary Medical Education and Drug Department Maharashtra State. It is in respect of Tilak Maharashtra University, Pune. It is a deemed University. It does not come within the purview of this Samiti. This Samiti has passed the resolution in the meeting held on 5/8/2014 (H&T) in respect of similar querry. It is in Item No. 6(a). It is resolved as under:

"Item No. 6fal: To consider and decide on letter dated 14/7/2014 received from Mr. Dinesh Sethi submittinq an affidavit as per Item No. 4fiii) of minutes 16/6/2014.

Consklered the le!ter dated 14/7/2014 and the Amdavit fled along with the same by Mr. Dhesh Sethi, It is in respect of NMIMS Shhpur College. It requli-es to be noted that it has been granted Deem University Status. The question is whether this Samiti can approve the fee of the course B. Tech Computer Engineering run by it, The complahant is pointing out to the GR dated 24/9/2003 under which the Samiti was constituted and in Para 3 there is mention of Deem University. But the University Grands Commission Act 1956 in sec 2(i7 defines University. It covers deemed University or an Instiute run by it as well Section 3 thereof is about application of the Act to institutions for Higher studes other than universities. It reads as under:

"The Central Government may, on the advie of the Commission, declare by notification in the Official Gazette, that any institution for higher education, other than a University, shall be deamed to be a University for the purposes of this Act, and on such a declaration being made, all the provisions of this Act shall apply to such institution as if it were a University within the meaning of clause (I7 of section 2':

Therefore the courses run by the Deemed University are governed by the same Act. Section 12 (A) came in to existence by Act 59 of 1984, It deals with powers and functions of the commission, This Act makes provision regarding the inspection, teaching standard and fees etc, Section 12 (A) provides for Regulation of fees and prohibition of donation in certain cases, Certainly this will prevail over the said GR dated 24/9/2003. Hence this S a m shall have no jurisdiction to approve the fee in such cases.

It requires to be noted that we have not approved the fee of the said Institute. Furfher no Institutes conducting Higher Studies in a Deem Universities is coming to this S a m and we are not approving the fee, Hence the complaint is rejected Ofice to communicate. ."

Therefore the fees of Tlak Maharashtra University, Pune are not approved by the Samiti. Further the question is in respect of students making complaints about collection of high fee or capitation fee prohibited under "The Maharashtra Education Institutional (Prohibition Of Capitation Fee) 1987". The complaint of the students that the said University is collecting higher fees, it is for the Medical Education Department to investigate this complaint about the capitation of fee and not this Samiti.
