John Bell, representing the Montana Sheriff's and Peace Cfficer's Association, referred to the Montana Constitution re- garding salary setting.
Darlene Hughes, president of the Montana Clerk and Recorders Association, stated her support of the bill and offered some amendments.
R. F. Fisher, representing the Montana Sheriff's and Peace Officers, offered a letter from Dale Dye, president of the Mon- tana Sheriff's and Peace Officer's Association. (See attachment.)
Bill Burley, Lake County Commission, stated his group feit that this was a very good bill. It would take the Legislature
I out of the salary setting business. Mr. Eurley asked the Committee to pass the bill. (See attachment.) 8
John Muster, Sanders County Commissioner, stated that elected officials need a better system of having their salaries set. I
Edith Cox, representing the Montana County Treasurer's Assoc iation, stated they would accept the proposed amendments and favor the bill.
Claire Gilreath, representing the Clerk of Courts, stated that they would accept the proposed amendments and favor the bill.
Sheriff Walter Hammermesiter offered an amendment which he handed out to the Committee and thoroughly explained. (See attach- ment. )
Ray White, Gallatin County Assessor, stated that he felt 11 8 members could be very cumbersome and the meeting would be costly. Mr. White stated that he is very confused by the bill. He stated the only thing good about the bill is that there is an attempt being made to improve county government. 1
Mike Stephens, representing the Xontana Association of Coun- ties, stated that the bill is a step in the right direction, how- ever, it sY.ould be done on the local level completely.

Ray White, G a l l a t i n County A s s e s s o r , spoke a g a i n t o s a y h e had j u s t r e a d t h e amended v e r s i o n o f t h e b i l l and he would sup- p o r t i t now.
Glen Osborne, a s h e r i f f , s t a t e d t h a t he a g r e e d w i t h Sheriff R i e r s o n and w i l l s u p p o r t t h e amended b i l l . M r . Osborne s t a t e d t h a t h e f a v o r s t h i s amended b i l l b e i n g s t u d i e d f o r two y e a r s .
Bonnie Miller made t h e c l o s i n g remarks f o r S e n a t o r Rasmus- sen . She s t a t e d t h a t she would go a l o n g w i t h t h e o f f e r e d amend- ments and asked t h e Committee t o g i v e SB 352 a do p a s s recommend- a t i o n .
The m e e t i n g was opened t o a q u e s t i o n and answer p e r i o d from t h e Committee. D i s c u s s i o n was h e l d .
A motion was made by S e n a t o r Thomas t h a t t h e amendments pro- posed f o r SB 352 b e adop ted . Not ion c a r r i e d .
Dennis T a y l o r , s t a f f r e s e a r c h e r , w a s i n s t r u c t e d t o d r a f t t h e amendments. I t w a s p o i n t e d o u t t h a t t h i s b i l l needs a f i s c a l n o t e .
DISPOSITION OF SENATE BILL 229 : Dennis T a y l o r e x p l a i n e d t h e p roposed amendments. The amendments w i l l p r o t e c t t h o s e whose t a x base has dropped.
A motion was made by S e n a t o r Thomas t h a t t h e amendments pro- posed be g iven a "DO PASS" recommendation. Motion carried.

SENATE BILL 290 REOPENED: Because of l a c k of t i m e a t the - p r e v i o u s h e a r i n g , it w a s d e c i d e d t o a l l o w S e n a t o r Dover t o f i n i s h h i s h e a r i n g on S e n a t e E i l l 2 9 0 .
S e n a t o r Dover s t a t e d t h a t he had g o t t e n t o g e t h e r w i t h t h e power companies and worked o u t some of t h e q u e s t i o n s which had a r i s e n . H e handed o u t proposed amendments t o t h e b i l l .
A mot ion w a s made by S e n a t o r O'Hara t o a c c e p t t h e proposed amendments. Motion c a r r i e d .
M r . Dave Menter s t a t e d t h a t t h e f i g u r e o f 2 0 0 f ee t above ground would g i v e t h e p i l o t s scnet 'hing t o work on. He stated one problem i s on Boulder P a s s . The power l i n e s a r e less t h a n 2 0 0 f e e t , however, it i s v e r y haza rdous .

Bob Gannon, representing the Montana Power Compnay, I stated that he felt the amendments definitely help the bill.

A notion was made by Senator O'Hara that SB 290 receive a "DO PASS, as amended" recomendation from the Committee.
Senator Story stated that he agrsas with Mr. Lable that the power companies wi1.l have to pay for this costly project and in order to do so the rates will probably be increased on the con-
1 suers. Perhaps the pilots should heip pay for this. 1
Senator O'Hara withdrew his motion.
DISPOSITION O F SENP-TE BILL 354: This b i i l deals with sala- ries of city judges an2 county justices. Everyone felt the bill
I needed to be clearer. The amendments were discussed.
A motion was made by Senator Watt that the proposed amend- I

A motion was made by Senator Watt that Senate Bill 355 be -1
given a "DO PASS, as amended" recommendation from the Convittee. Xotion carried. 1

t ana . P a r t i c u l a r l y i n unincorpora ted a reas ad jacent t o t h e S t a t e ' s l a r g e r c i t i e s ,
t h e r e i s a c r i t i c a l need f o r sound management of development p a t t e r n s . I t i s EICts
b e l i e f t h a t most persons c u r r e n t l y l i v i n g i n such a reas a r e anxious f o r t h e imple-
mentat ion of some type o f land-use c o n t r o l s i n t h e i r a r eas . While voca l oppos i t i on
t o p lanning and zoning can always be expected t o a r i s e i n most such i n s t a n c e s , oppo-
nents t o p lanning a r e a small minor i ty . 6y br ing ing zoning p l ans be fo re t h e e l e c t o r s ,
c i t i z e n i n t e r e s t and involvement i n t h e planning process would be enhanced. County
commissioners would be provided a t r u e measure of t h e planning and zoning d e s i r e s
of t h e i r c o n s t i t u a n c i e s .
h71ile we support passage of SB 353, t h e r e a r c some problems with t h e b i l l ~ h i c h
t h e committee should be aware o f . The i n i t i a l e f f e c t of t h e b i l l would l i k e l y be t o
motivate adoption o f zoning i n many unincorporated urban a reas . Much of t h i s new
zoning would l i k e l y be h igh ly r e s t r i c t i v e - t y p e zoning ( i . e . low d e n s i t y - s i n g l e
family homes o r a g r i c u l t u r a l zoning) . As urban a reas grow, t h e s e i n i t i a l zoning
c l a s s i f i c a t i o n s might become inappropr i a t e , r e s t r i c t i n g land from be ing used i n t h e
most a p p r o p r i a t e manner ( i . e . commercial o r i n d u s t r i a l ) . The zoning amendment pro-
cedure of SB353 i s cumbersome and might make zoning i n f l e x i b l e . Logical develop-
ment p a t t e r n s might be r e s t r i c t e d from occuring as r e s i d e n t s of an a r e a could r e fuse
t o g r a n t a l l land-use changes. A l e s s c r i t i c a l cons idera t ion regard ing SB 353 is
who would pay f o r s p e c i a l e l e c t i o n s r equ i r ed by a zoning change r eques t - t h e county
( i . e . t h e taxpayers ) o r t h e developer reques t ing t h e zaning change. Another mir,or
ques t ion involves how an a f f e c t e d person would be def ined i n t h e i n s t a n c e of a zoning -..

justment i s q u a s i - j u d i c i a l - that i s , t h e board i n t e r p r e t s a zoning ordinance*
i n a manner s i m i l a r t o how a cour t might i n t e r p r e t a law. The Board o f adjustment d e x i s t s t o i n s u r e t h e r i g h t s of i nd iv idua l c i t i z e n s . Present law recognizes t h i s
j u d i c i a l r o l e of t h e Board - provid ing t h a t board dec i s ions should be appealed t o I
t h e d i s t r i c t c o u r t . The p e t i t i o n procedure provided f o r i n SB 353 i s no t c o n s i s t e n t
with h i s t o r i c ca se law regard ing t h e Board of Adjustment and may be s u b j e c t t o l e g a l

Wish to thank you for sponsoring S.B, 752. It is ~ o s t imperative that S.S. 229 be passed aloag with 23.3. 352 so that we will receive a increase this year as weil as next year while the salazy coimission is beirg formed.
May I suggest the following changes to S.B. 352:
page 5, line 7 delete the word "If" and also delete "fails to pass the". Following the word body, insert "shall pass a". --
page 5, line 8 insert a period (.) after April, - DeTete the rest of the sentence (no salary, etc.),
page 5, line 9 (new) The governiog body must set - the salaries of all county elected o f f i c l a i s ~ ~ o y e e s - -- - using tine same factoraa'll county saia~ies In a uniforn -- -- - - Ioanner. (This is very important as it insures miform salaries between offices in each courthouse.)

This p rov i s ion of g u i d e l i n e s f o r t h e county governing body allows them t o be f l e x i b l e i n t h e i n d i v i d u a l coun t i e s i n a reasonable manner, and r e l i e v e s them of undue p ressu re frcm s p e c i a l i n t e r e s t groups.
For budgetary p r o t e c t i o n we recommend anending l i n e (71 page 5 t o read "The governing body s h a l l pass a r e s o l u t i o n f i x i n g compen- s a t i o n by t h e second Tuesday of Apr i l annual ly" . The o l d law pro- v ides t h a t a r e s o l u t i o n be passed each year and r e g a r d l e s s what happens t o s a l a r i e s t h i s i s good. That way each department knows what t o budget without any guesswork.
The b i l l provides f o r the f i r s t meeting of the board t o be c a l l e d t h e second Monday of each November, t h e r e f o r e , we a r e d e s i r o u s of S . B . 2 2 9 t ak ing precedent u n t i l t h i s b i l l could be a c t i v a t e d , and since t h e r e was unanimous and favorable testimony given by a l l e l e c t e d county o f f i c i a l s w e be l i eve it i s a reasonable r eques t .

Dear Senator McCallum:
As an elected County official, I really do appreciate you and your committee's concern about our salaries. However. I do not endorse Senate Bill 352, for the reasons listed below:
(1) Section I. A board of eleven members could be cumbersome and meeting would be costly. I question why the Clerk and Recorder is designated as one of the elected official members.
(2) Section 4. Paragraph 3 does not state that a vacancy would be filled by a person representing the same group.
(3) Section 5. The only responsibility that this bill gives to the Compensation Board, is to set miniz:um and maximum salaries.
(4) Section 6. This section is almost identical to the MAC0 supported House Bill 387, which all elected officials of the Association object to. The governing body could freeze all salaries if they fail to act on the resolution.
(5) Section 7. This section gives the governing body power to set all deputy salaries.
(6) Section 9. The present law Section 7-4-2503 is repealed. This law specifically names the Treasurer, Clerk and Recorder, Clerk of Court, Attorney, Assessor, Superintendent of Schools, Sheriff, and Surveyor. These officers shculd be contained within Senate Bill 352 in order that the salaries be identified with the appropriate officers. The present law Section 7-4-2505 specifies the salaries of deputies. They would lose salary . 1 protection if it is repealed.
I feel that the salary structure for the elected coonty officials in i!ontana is well over-due for a change. But I
I feel it's important enough for good county governmen;, that a legislative study be made of this problem, to be presented to the next session of legislature.
