EmergencyExecutiveOrders.Thegovernor'sauthorityisspecifiedintheConstitutionoftheStateofMinnesota,ArticleV,andin Minnesota Statutes§4.035.EmergencyExecutiveOrders,forprotectionfromanimminentthreattohealthandsafety,becomeeffectiveimmediately,arefiledwiththesecretaryofstate,andpublishedintheState Registerassoonaspossibleaftertheyareissued.OtherExecutiveOrdersbecomeeffective15daysafterpublicationintheState Registerandfilingwiththesecretaryofstate.Unlessotherwisespecified,anexecutiveorderexpires90daysafterthedatethegovernorwhoissuedtheordervacatesoffice.
Office of the GovernorEmergency Executive Order 20-03: Protecting Residents of Minnesota Veterans Homes during the COVID-19 Peacetime Emergency
I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:
TheCOVID-19pandemicpresentsanunprecedentedchallengetoourState.MinnesotahastakenproactivestepstoensurethatweareaheadofthecurveonCOVID-19preventionandresponse.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.InExecutiveOrder20-01,Idirectedallstateagenciestosubmitproposedordersandrulestoprotectandpreservepublichealthandsafety.
PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(1),theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthependencyofapeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.
SciencetellsusthatCOVID-19isparticularlydangerousforourelderlypopulationandthosewithchronichealthconditions.TheMinnesotaVeteransHomes,ownedandoperatedbytheMinnesotaDepartmentofVeteransAffairs,aredesignedtoensurethatournation’sheroesandtheirspousescanliveinacaringcommunitythatenrichestheirlives.TheMinnesotaVeteransHomesarelocatedinFergusFalls,Hastings,Luverne,Minneapolis,andSilverBay.
MinnesotaveteransandtheMinnesotaVeteransHomesfacemanychallengesduetoCOVID-19.ThereisanincreasedriskofrapidspreadofCOVID-19amongpersonswhoarelivingincongregatesettings,suchaslong-termcareandboardingcarefacilities,includingtheMinnesotaVeteransHomes.ThefederalCentersforMedicare&MedicaidServices(“CMS”)issuedmemorandumentitled“GuidanceforInfectionControlandPreventionofCoronavirusDisease2019(COVID-19)inNursingHomes(REVISED)”addressingthepreventionandcontrolofCOVID-19innursinghomesonMarch13,2020.CMShasrecommendedthat“facilitiesshouldrestrictvisitationofallvisitorsandnon-essentialhealthcarepersonnel,exceptforcertaincompassionatecaresituations,suchasanend-of-lifesituation.”CurrentlawandregulationspreventMinnesota’sVeteransHomesfromcomplyingwiththisguidance.
Forthesereasons,Iorderasfollows:
1. PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(1),toprotectresidentsandstaffofMinnesotaVeteransHomes,theCommissionerofVeteransAffairsisauthorizedtoimplementatemporaryvisitorpolicyconsistentwithanyoftheguidelinescontainedinCMS’sMarch13,2020“GuidanceforInfectionControlandPreventionofCoronavirusDisease2019(COVID-19)inNursingHomes(REVISED)”andanysubsequentrevisionsofthatdocument,uptoandincludingabanonallvisitation.Suchabanwillnotapplyinend-of-lifesituationsandtostateandfederalnursinghomeregulatoryauthoritieswhenrequestingaccesstoMinnesotaVeteransHomes.TheCommissionerisencouragedtosupportresidentsduringthistimeandfindwaystoreplace

Executive Orderspersonalvisitswithphonecalls,videoconferencing,orothermethodsofcommunicatingwithfriends,family,andotherwouldbevisitors.
2. MinnesotaVeteransHomesmaydenyadmissionorreadmissiontoanypersonwhomeetsthequalificationtobecomearesidentofaMinnesotaVeteransHomeunlessthatpersonhasbeenscreenedpriortoentryforsignsorsymptomsofCOVID-19,includinghighfever,cough,ordifficultybreathing,orcontactwithapersonwithaconfirmeddiagnosisofCOVID-19inthepast30days,orareunderinvestigationforCOVID-19.PrecautionarymeasuresmayberequiredforpersonsadmittedtoaMinnesotaVeteransHome.Precautionarymeasuresinclude,butarenotlimitedto,isolationorquarantine,wearingpersonalprotectiveequipment,socialdistancing,orvisitingindesignatedlocations.

Executive OrdersensurethatweareaheadofthecurveonCOVID-19preventionandresponse.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.
ConfirmedcasesofCOVID-19inMinnesotaarerapidlyincreasing.OnMarch15,2020,Minnesotadetectedthefirstconfirmedcasescausedby“communityspread”—infectionsnotepidemiologicallylinkedtooverseastravel.ThisdevelopmentrequiresMinnesotatotakeadditionalproactivemeasures,includingenhancedcommunitymitigation,toslowthespreadofthispandemic.SlowingthespreadofCOVID-19iscriticaltoensuringthatourhealthcarefacilitiesremainabletoaccommodatethosewhorequireintensivemedicalintervention.
Inthistimeofuncertaintyandpeacetimeemergency,Minnesotansmustcontinuetomaintaintheiressentialactivities.Iencouragesupermarkets,pharmacies,andotherestablishmentsprovidingessentialretailgoodsandservicestoremainopen,subjecttobestpractices,includingsocialdistancing,establishedbytheCentersforDiseaseControlandPreventionandtheMinnesotaDepartmentofHealth.Thatsaid,certainotherpublicaccommodationsinwhichMinnesotanscongregateposeathreattothepublichealthbyprovidingenvironmentsforthespreadofCOVID-19.
PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(1),theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthepeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.Anypersonwhowillfullyviolatessuchanorderorruleisguiltyofamisdemeanoranduponconvictionmustbepunishedbyafinenottoexceed$1,000orbyimprisonmentfornotmorethan90days.
Forthesereasons,Iorderasfollows:
1. BeginningnolaterthanMarch17,2020at5:00pm,andcontinuinguntilMarch27,2020at5:00pm,thefollowingplacesofpublicaccommodationareclosedtoingress,egress,use,andoccupancybymembersofthepublic:

PlacesofpublicaccommodationsubjecttothisExecutiveOrderareencouragedtoofferfoodandbeverageusingdeliveryservice,windowservice,walk-upservice,drive-throughservice,ordrive-upservice,andtouseprecautionsindoingsotomitigatethepotentialtransmissionofCOVID-19,includingsocialdistancing.Inofferingfoodorbeverage,aplaceofpublicaccommodationsubjecttothissectionmaypermituptofivemembersofthepublicatonetimeintheplaceofpublicaccommodationforthepurposeofpickinguptheirfoodorbeverageorders,solongasthoseindividualsareatleastsixfeetapartfromoneanotherwhileonpremises.
3. ThisExecutiveOrderdoesnotprohibitanemployee,contractor,vendor,orsupplierofaplaceofpublicaccommodationfromentering,exiting,using,oroccupyingthatplaceofpublicaccommodationintheirprofessionalcapacity.

PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(1),theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthependencyofapeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.
EconomicinsecuritybecauseofinvoluntaryunemploymentofworkersinMinnesotaisasubjectofgeneralconcern.Thepublicgoodispromotedbyprovidingworkerswhoareunemployedthroughnofaultoftheirownatemporarypartialwagereplacementtoassistunemployedworkerstobecomereemployed.Providingatemporarypartialwagereplacementtoassistunemployedworkersallowstheseworkerstoaccessbasicnecessitiesandsafeguardthehealthofthemselves,theirfamilies,andotherMinnesotans.CurrentlawandregulationspreventtheMinnesotaUnemploymentInsuranceProgramfromprovidingimmediaterelieftoemployersandunemployedworkersduringtheCOVID-19pandemic.
Forthesereasons,Iorderasfollows:
1. Effectiveimmediately,strictcompliancewithMinnesotaStatutes2019,Chapter268,MinnesotaUnemploymentInsuranceLawissuspended.
2. ForunemploymentinsurancebenefitaccountsestablishedbetweenMarch1,2020andDecember31,2020,IamsuspendingthenonpayableweekrequirementunderMinnesotaStatutes2019,section268.085,subdivision1,clause6,whichwillallowworkerstobecomeeligibleforunemploymentbenefitsasquicklyaspossible.
3. TofurtherensurethatunemploymentbenefitsareavailableforworkerswhoarenotabletoworkdirectlyorindirectlyasaresultofCOVID-19,IorderthatsuitableemploymentunderMinnesotaStatutes2019,section268.035,subdivisions23a(a)and(b)doesnotincludeemploymentthatputsthehealthandsafetyoftheapplicantatriskoremploymentthatputsthehealthandsafetyofotherworkersandthegeneralpublicatrisk.
4. TofurtherensurethatunemploymentbenefitsareavailableforworkerswhoarenotabletoworkdirectlyorindirectlyasaresultofCOVID-19,IorderthataleaveofabsencewillbepresumedtobeinvoluntaryinaccordancewithMinnesotaStatutes2019,section268.085,subdivision13a,when:
a. Adeterminationhasbeenmadebyhealthauthoritiesorbyahealthcareprofessionalthatthepresenceoftheapplicantintheworkplacewouldjeopardizethehealthofothers,whetherornottheapplicanthasactuallycontractedacommunicabledisease.
b. AquarantineorisolationorderhasbeenissuedtotheapplicantpursuanttoMinnesotaStatutes2019,section144.419tosection144.4196.
c. Thereisarecommendationfromhealthauthoritiesorbyahealthcareprofessionalthattheapplicantshouldself-isolateorself-quarantineduetoelevatedriskfromCOVID-19duetobeingimmunocompromised.

MinnesotaStatutes2019,sections169.80,169.823,169.824,and169.87provideweightlimitationsforvehiclesoperatingonMinnesotaroadways.MinnesotaStatutes2019,section221.0314,subdivision9,adoptsfederalsafetyregulations,includinghoursofservicerequirementsfordrivers.MinnesotaStatute2019,section221.0269,provides:“Thegovernormaydeclareanemergencyandgrantrelieffromanyoftheregulationsincorporatedinsection221.0314tocarriersanddriversoperatingmotorvehiclesinMinnesotatoprovideemergencyreliefduringtheemergency.”
Strictenforcementofcertainhoursofserviceandweightrestrictionregulationswouldpreventorhindereffortstoprovidenecessaryandtime-sensitiveassistancetoMinnesotans.Thecontinued,efficientmovementofessentialsupplies,includingfood,medicalsuppliesandhouseholditems,isvitaltothehealthandsafetyofallMinnesotans.
Forthesereasons, Iorderasfollows:
1. AstateofemergencyexistsinMinnesotathatrequiresassistancefrommotorcarrierstotransportsuppliestoaffectedareasofthestate.VehiclesanddriversprovidingdirectassistanceforemergencyreliefeffortsinresponsetoCOVID-19areexemptedfromcertainregulationsasdescribedinthisExecutiveOrder.Directassistancemeanstransportationbyamotorcarrieroritsdriver(s)incidenttotheimmediaterestorationand/ordeliveryofessentialsuppliesincludingfood,medicalsupplies,andhouseholditems,relatedtotheCOVID-19pandemic.
2. Theweight-relatedregulatoryprovisionsofMinnesotaStatutes2019,sections169.80,169.823,169.824,and169.87,aretemporarilysuspended,totheextentthatthoseprovisionsrequireaspecialpermitorrestricttheoverweightmovementofessentialsuppliesincludingfood,medicalsupplies,andhouseholditemstransportedinsupportofdirectassistancetoemergencyreliefeffortsinresponsetoCOVID-19.
3. Suspensionoftheseweight-relatedprovisionsappliestoloadstransportedonallroadswithinMinnesota.UnlesstheFederalHighwayAdministrationsuspendsthefederalweightlimitationsontheinterstatesystem,vehiclesover80,000poundsgrossweightmaynotusetheinterstatesystem.VehiclesoperatingunderthisExecutiveOrdermaynotexceedthemaximumaxleweightlimitsestablishedunderMinnesotaStatutes2019,section169.824bymorethantwelveandone-halfpercent(12.5%);themaximumaxleweightlimitof20,000poundsor90,000poundsgrossweight.Additionally,vehiclesoperatingunderthisExecutiveOrdermustcomplywithpostedlimitsonbridges.
4. PursuanttoMinnesotaStatutes2019,section221.0269,subdivision1,conditionsexistinMinnesotathatrequirerelieffromregulationsincorporatedinMinnesotaStatutes2019,section221.0314,subdivision9,pertainingtohoursofserviceforcarriersanddriversofcommercialmotorvehiclesprovidingdirectassistancetoemergencyreliefeffortsinresponsetoCOVID-19.
5. MotorcarriersanddriversprovidingdirectassistancetoemergencyreliefeffortsinresponsetoCOVID-19bytransportingessentialsuppliestoaffectedareasofthestateareexemptedfromtheCodeofFederalRegulations,title49,part395.3,whichisincorporatedinMinnesotaStatutes2019,section221.0314,subdivision9,pertainingtohoursofservice.
6. ThisExecutiveOrderdoesnotrelievemotorcarriersanddriversprovidingdirectassistancetoemergencyreliefeffortsfromregulationspertainingtodriverqualifications;drivingofcommercialmotorvehicles;commercialdrivers’licenses;drugandalcoholtestingfordrivers;orequipment,parts,andaccessoriesnecessaryforthesafeoperationofvehicles.

Executive Ordershours,workdaysandworkweekof,andannualandsickleaveprovisionsandpayrolllawsregardingallstateemployeesintheexecutivebranch,asnecessarytominimizetheimpactoftheemergency,conformingthealterationsoradjustmentstoexistingstatelaws,rules,andcollectivebargainingagreementstotheextentpracticable.UnderMinnesotaStatutes2019,section12.21,subdivision3(12),theGovernormaytransferthedirection,personnel,orfunctionsofstateagenciestoperformorfacilitateresponseandrecoveryprograms.Inaddition,underMinnesotaStatutes2019,section12.21,subdivision3(1),theGovernormaymake,amend,andrescindnecessaryordersandrulestoaddressthepeacetimeemergency.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthependencyofapeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.
InconsultationwiththeCommissionerofManagementandBudgetandotherstateagencies,Ihaveconcludedthatitisnecessarytoprovideformsofpaidleaveandotherbenefitstoexecutivebranchemployees,sothatstateagencyworkplacescanconformtotheextentpossiblewithguidanceonhowtobestpreventandreducecommunityspreadofCOVID-19,whilealsominimizingtheimpactofthepeacetimeemergencyongovernmentoperations.
IalsohaveconcludedthattoprotectthehealthandsafetyofMinnesotansandminimizetheimpactofthepeacetimeemergencyongovernmentoperations,stateagenciesrequiretheflexibilitytohirestaff,schedule,assign,andreassignemployeeswithoutadherencetoexistinglimitationsincollectivebargainingagreements,memorandaofunderstanding,compensationplans,statutes,administrativerules,administrativeprocedures,andpoliciesthatpresentbarrierstotheneedsofstateagenciestoefficientlyandeffectivelymobilizeanddeploytheirworkforceduringthispeacetimeemergency.Whencircumstancesallow,MinnesotaManagementandBudgetwillworkinpartnershipwiththelaborunionsaffectedbyanyadjustmentstotheprovisionsofcollectivebargainingagreementsormemorandaofunderstanding.
Forthesereasons,Iorderasfollows:
1. IauthorizeanddirecttheCommissionerofManagementandBudgettodevelopandimplementapolicytoprovidepaidleavetoexecutivebranchemployeeswhomustbeabsentfromworkforreasonsrelatedtoCOVID-19,includingbutnotlimitedtocaringfortheirchildrenduetoschoolclosureduetoCOVID-19.“Executivebranchemployees”forthesepurposesincludesallemployeesofagenciesintheexecutivebranch,asdefinedinMinnesotaStatutes2019,section43A.02,subdivision22,exceptforemployeesofconstitutionaloffices.“Executivebranchemployees”alsoincludesallemployeesoftheMinnesotaStateRetirementSystem,thePublicEmployeesRetirementAssociation,theTeacher’sRetirementAssociation,andtheMinnesotaStateCollegesandUniversitiessystem.PaidCOVID-19leavepursuanttothispolicymustbeavailableeffectivebeginningMarch18,2020andcontinueuntilthepeacetimeemergencyisterminated.TheCommissionerofManagementandBudgetisdirectedtoassistconstitutionalofficestoalsoadoptCOVID-19relatedleavefortheiremployees.
2. IauthorizeanddirecttheCommissionerofManagementandBudgettosuspendthe35-daywaitingperiodnecessaryfornewinsurance-eligibleexecutivebranchemployeestoreceivetheinsurancecoverageprovidedintheapplicablecollectivebargainingagreementorcompensationplan.
3. WithrespecttoallcollectivebargainingagreementsenteredpursuanttoMinnesotaStatutes2019,section43A.06,subdivision1(c)andsection179A.22,subdivision4,andallcompensationplansestablishedpursuanttoMinnesotaStatutes2019,section43A.18,subdivisions2,3,3a,3band4(c),andsection62V.05,subdivision1(b)(1),toensurestateagenciesareabletotimelyandeffectivelymobilizetheirworkforcetoaddressthepeacetimeemergency,thisExecutiveOrdersuspends,forthedurationofthepeacetimeemergency,allprovisionsregarding:limitationsontheappointingauthority’sabilitytodetermineemployeeworkschedulesandhoursofwork;noticeperiodsforchangesinworkschedules,workhours,orworklocations;limitationsonsupervisorrescissionofvacationapproval;seniorityrequirementsforfillingvacancies,reassignment,ordistributionofovertimeoron-callwork;restrictionsonappointment,assignmentorreassignment;andnoticerequirementsforseasonallayoffandrecall.Forthedurationofthepeacetimeemergency,executivebranchemployeesaresubjecttotheschedulingandassignmentdecisionsandworkdirectionoftheirappointingauthority.

PursuanttoMinnesotaStatutes2019,section4.035,subdivision2,thisExecutiveOrderiseffectiveimmediately.ItremainsineffectuntilthepeacetimeemergencydeclaredinExecutiveOrder20-01isterminatedoruntilitisrescindedbyproperauthority.

17,2020,theCentersforDiseaseControlandPreventionrecommendeddelayingelectiveinpatientandoutpatientsurgeriesandprocedures,whichincludedentalprocedures.OnMarch18,2020,theCentersforMedicareandMedicaidServices(“CMS”)issuedsimilarguidance.CMSrecognizesthatconservationofcriticalresourcessuchasventilatorsandpersonalprotectiveequipment(“PPE”)isessentialtoaggressivelyaddresstheCOVID-19pandemic.CMShasalsorecognizedthatnon-emergentorelectiveproceduresincreasepatientandprovidercontact,whichcouldincreasetheriskofCOVID-19transmission.Thisriskprovidesfurtherreasontodelayelectivesurgeriesandprocedures.ToensurethehealthandsafetyofMinnesotans,itisimportanttoestablishconsistencythroughoutourhealthcaresystemandensurethatourresourcescanbefocusedonrespondingtothispandemic.

Theseconcernsraiserisksofimmediateandirreparableinjury,loss,ordamagetoconsumers,andimmediaterisktothepublicinterestofensuringthatMinnesotanscanprepareforandrespondtothisemergencysituation.Thesemattersimplicatesafetyconcernsandmattersofpublicsafety,personalsafety,andeconomicsecurity.Asaresult,immediateresolutionoftheseconcerns(includingbutnotlimitedtonecessaryandpromptcourt-intervention)isinthepublicinterestandnecessarytoprotectthepublicpeace,health,andsafetyofMinnesotansduringthispeacetimeemergency.
Forthesereasons,Iorderasfollows:
1. BeginningMarch21,2020at5:00pm,andcontinuingforthedurationofthepeacetimeemergencydeclaredinExecutiveOrder20-01oruntilthisExecutiveOrderisrescinded,allpersonsareprohibitedfromselling,offeringtosell,orcausingtosellinthisstateanyessentialconsumergoodsorservicesforanamountthatrepresentsanunconscionablyexcessiveprice.
2. ForpurposesofthisExecutiveOrder,thefollowingtermsaredefinedasspecifiedbelow.
a. “Person”or“persons”hasthemeaninginMinnesotaStatutes2019,section325F.68,subdivision3.b. “Essentialconsumergoodsorservices”meansgoodsorservicesvitalandnecessaryforthehealth,
safety,andwelfareofthepublic,includingwithoutlimitation:food,water,fuel,gasoline,housing,shelter,transportation,healthcaregoodsandservices,pharmaceuticals,medicalsupplies,andpersonalhygiene,sanitation,andcleaninggoods.
c. “Unconscionablyexcessive”means:
i. Theamountchargedrepresentsagrossdisparitybetweenthepriceofthegoodorserviceandthepriceofthesamegoodorservicethatwassoldorofferedforsaleintheusualcourseofbusinessduringthethirty(30)daysimmediatelypriortothepeacetimeemergencydeclaredbyExecutive

iii.Theamountchargedgrosslyexceedsthepriceatwhichthesameorsimilargoodorserviceisreadilyobtainablebyotherpurchasersinthetradearea,unlessthepersondemonstratesthatthepriceincreaseissubstantiallyattributabletosignificantadditionalcostsoutsidethecontroloftheperson.
3. TheAttorneyGeneralmayinvestigateandbringanenforcementactiontoremediateandenjoinanyallegedviolationofthissection.TheauthorityoftheAttorneyGeneralunderthisExecutiveOrderincludesbutisnotlimitedtotheauthorityprovidedunderMinnesotaStatutes2019,section8.31.
4. PursuanttoMinnesotaStatutes2019,section12.45,anypersonwhoisfoundtohaveviolatedthissectionissubjecttoacivilpenaltyofnotmorethan$10,000persaleortransaction.TheAttorneyGeneralmayadditionallyseekanyreliefavailablepursuanttoMinnesotaStatutes2019,section8.31.

Effectiveimmediately,theCommissioneroftheDepartmentofHumanServicesmayseekfederalauthoritytochangeorwaiveallfederalrequirementsapplicabletoitsprogramsandservices,includingbutnotlimitedto,theMinnesotaFamilyInvestmentProgram,MedicalAssistance,andMinnesotaCare,asnecessaryinordertoensuremaximumfederalfunding,maintainenrolleecoverageandproviderparticipation,andotherwiseprotectandpreservepublichealthandsafety.TherequestsforfederalapprovalshallincludeanywaiversoramendmentsnecessarytocomplywithandimplementchangestostateorfederallawresultingfromexistingandforthcomingCOVID-19relatedExecutiveOrdersorlegislativeenactments.

I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:
TheCOVID-19pandemicpresentsanunprecedentedchallengetoourState.MinnesotahastakenproactivestepstoensurethatweareaheadofthecurveonCOVID-19preventionandresponse.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.InExecutiveOrder20-01,Idirectedallstateagenciestosubmitproposedordersandrulestoprotectandpreservepublichealthandsafety.
PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(1),theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthependencyofapeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.
ConfirmedcasesofCOVID-19inMinnesotaarerapidlyincreasing.OnMarch15,2020,Minnesotadetectedthefirstconfirmedcasescausedby“communityspread”—infectionsnotepidemiologicallylinkedtooverseastravel.ThisdevelopmentrequiresMinnesotatotakeadditionalproactivemeasures,includingenhancedcommunitymitigation,toslowthespreadofthispandemic.SlowingthespreadofCOVID-19iscriticaltoensuringthatourhealthcarefacilitiesremainabletoaccommodatethosewhorequireintensivemedicalintervention.
TheMinnesotaDepartmentofHumanServices(“DHS”)servesMinnesotansacrossthestate.DHSprovideshealthcarecoverage,programs,andservicesforover1millionMinnesotans,includinggroupslikelytobesignificantlyimpactedbyCOVID-19suchasolderadults,individualswhohavedisabilities,familieswithchildren,andindividualswithmentalillness.
TribalNations,counties,andMinnesotansservedbyDHSfacemanychallengesduetoCOVID-19.Thepublicgoodispromotedbytimelyandsafeaccessto,anddeliveryof,programsandservicesadministeredbyDHS.StrictcompliancewithlawsandregulationsrelatedtotheseprogramsandservicesduringthepeacetimeemergencywilllimittheavailabilityofessentialprogramsandservicesforMinnesotansandincreasetheriskforspreadofCOVID-19.ProvidingfortemporarywaiverormodificationoftheserequirementswillallowDHSanditshumanservicespartnerstocontinuetoprovideessentialprogramsandservicestoMinnesotanssafelyandwithoutunduedelayduringthepeacetimeemergency.CurrentlawandregulationspreventthetemporarymodificationorwaiveroflawsrelatedtoprogramsandservicesadministeredbyDHS.
Forthesereasons,Iorderasfollows:
1. Effectiveimmediately,theCommissioneroftheDepartmentofHumanServicesmaytemporarilywaiveormodifyanyofthefollowingprovisions,andapplicablerules:
a. The HumanServicesLicensingActinMinnesotaStatutes2019,chapter245A,andaccompanyingprogramstandardsgovernedunderMinnesotaStatutes,chapters245Dthrough245H;
b. TheHumanServicesBackgroundStudyActinMinnesotaStatutes2019,chapter245C,exceptthatthecommissionershallnotwaiveormodify:
i. DisqualificationstandardsinMinnesotaStatutes2019,section245C.14or245C.15;orii. Anyprovisionregardingthescopeofindividualsrequiredtobesubjecttoabackground study

a. Requirementofin-personassessment,applicationforservices,orcasemanagement;b. Applicationforeligibilityandeligibilityrenewaltimeframes,processes,andverification,exceptthat
thecommissionershallestablishprocessestoverifyaclient’seligibilityassoonaspracticable;c. Reportingandverificationrequirements;d. Assessmentrenewaltimeframes,verifications,andprocesses;e. Workorcommunityengagementactivityrequirementsforeligibility;f. Limitsontheuseoftelehealthorotherrestrictionsonelectroniccommunicationwithproviders;g. Servicedeliverystandards,locations,settings,orstaffratios;h. Providerstandards,includingstaffingratios;i. Timingofproviderreportingrequirements;j. Paymentprocedures,includingbutnotlimitedtotheuseofprepayments,partialpaymentfor
additionalabsentdays,andpaymentforcloseddays;k. Serviceagreementlength;andl. Provisionsrelatedtoappeals.
3. Effectiveimmediately,theCommissioneroftheDepartmentofHumanServicesmaywaiveormodifyanystatutesorruleswithinthedepartment’sexclusivejurisdictiontocomplywithfederallaw,orobtainfederalresources,relatedtothepeacetimeemergency.
4. ThisExecutiveOrdersuspendstherequirementsfortheCommissioneroftheDepartmentofHumanServicestocomplywithMinnesotaStatutes2019,Chapter14.
5. TheCommissioneroftheDepartmentofHumanServicesshallnotissueanywaiverormodificationpursuanttoparagraphs1,2,or3ofthisExecutiveOrderthataffectsstatutoryprovisionsorrequirementsregardingmattersoutsidethedepartment’sexclusivejurisdiction.
6. Anywaiverormodificationissuedpursuanttoparagraphs1,2,or3ofthisExecutiveOrdershallbepostedonthedepartment’swebsitewithin48hoursandshallincludeaplainlanguagedescriptionofthewaiverormodificationsmadeandtherationalefortheaction.
7. ForanywaiverormodificationofMinnesotaStatutes2019,section245D.04,oranyotherprovisionrelatingtolong-termcareservicesandsupportsunderMinnesotaStatutes2019,chapter256B,theCommissioneroftheDepartmentofHumanServicesshallcommunicatethewaiverormodificationandthecorrespondingplainlanguagedescriptioninwritingto:
a. Anyprovideraffectedbythewaiverormodification;andb. AnyindividualwhoserightsunderMinnesotaStatutes2019,section245D.04,areaffectedbythe
waiverormodification,ortheirlegalrepresentative,ifapplicable.

goesintoeffect,theCommissioneroftheDepartmentofHumanServicesshallprovidewrittennoticeofthewaiverormodificationtotheombudsmanforlong-termcare;theombudsmanformentalhealthanddevelopmentaldisabilities;andthechairsandrankingminoritymembersofthehouseofrepresentativesandsenatecommitteesoverseeingtheDepartmentofHumanServices.Iftwoormoreofthechairssubmitawrittenobjectiontoawaiverormodificationwithinsevendaysofreceivingthenotice,theCommissioneroftheDepartmentofHumanServicesshallceaseallactivitiestoimplementthewaiverormodificationanditshallnolongerbeineffect.Achairsubmittinganobjectionunderthisparagraphmaywithdrawtheobjection.
9. Beginning60daysafterthedeclarationofapeacetimeemergency,andevery60daysthereafterwhilethepeacetimeemergencyisineffect,theCommissioneroftheDepartmentofHumanServicesshallsubmitareporttothechairsandrankingminoritymembersofthehouseofrepresentativesandsenatecommitteesoverseeingtheDepartmentofHumanServicesdescribingthewaiversandmodificationsmadeunderthisExecutiveOrder.
10. TheCommissioneroftheDepartmentofHumanServicesshallsubmitafinalreporttothechairsandrankingminoritymembersofthehouseofrepresentativesandsenatecommitteesoverseeingtheDepartmentofHumanServicesbyJanuary15,2021,withspecificdetailsaboutstatestatutesandruleswaivedormodifiedasauthorizedinthisExecutiveOrderinresponsetoaCOVID-19outbreak,andthecosttotheDepartmentofHumanServicesandtoleadagenciestoimplementthewaiversandmodifications.
PursuanttoMinnesotaStatutes2019,section4.035,subdivision2,andsection12.32,thisExecutiveOrderiseffectiveimmediatelyuponapprovalbytheExecutiveCouncil.ItremainsineffectuntilthepeacetimeemergencydeclaredinExecutiveOrder20-01isterminatedoruntilitisrescindedbyproperauthority.

Executive OrdersensurethatweareaheadofthecurveonCOVID-19preventionandresponse.OnMarch6,2020weactivatedtheStateEmergencyOperationsCentertocoordinateourresponsetothispandemic.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.InExecutiveOrder20-01,IdirectedtheMinnesotaNationalGuardtoensurethatitbereadytoassistasneededduringthispeacetimeemergency.
Ensuringtheavailabilityanduseofpersonalprotectiveequipment(“PPE”)isessentialtooureffortstopreventthespreadofCOVID-19.Minnesota’shospitals,healthcarefacilities,andfirstrespondersreportthattheirsuppliesofPPEarecriticallylow.AdditionalPPEdeliveriesfromtheStrategicNationalStockpilehavebeendelayed.TheMinnesotaDepartmentofHealth(“MDH”)hasrequestedthatallPPEinstorageatCampRipleybetransportedtotheMDHwarehouseinSaintPaulimmediately.
TheStateEmergencyOperationsCenterhasrequestedassistancewithplanningandcoordinationtohelpensurethatMinnesota’shealthcaresystemandprovidershaveadequatesuppliesofPPE,criticalmedicalequipment,andsuppliestocareforpeoplesufferingfromthepandemic.TheNationalGuardlogisticsplanningteamhastheabilityandexpertisetoprovidethisassistance.
Forthesereasons,Iorderasfollows:
1. TheAdjutantGeneralwillordertostateactivedutyonMarch21,2020,thepeople,equipment,andfacilitiesneededtoprovideassistancethroughoutMinnesota.
2. TheAdjutantGeneralisauthorizedtoprocurethegoodsandservicesneededtoaccomplishthemission.
3. ThecostsofthisassistancewillbepaidfromthegeneralfundasallowedbyMinnesotaStatutes2019,section192.52.
