Subp.3.Drawing procedure. A. ThecommissionermustusearandomdrawingfromapoolconsistingofgeneraldrawingapplicantstodistributelicensesthatareofferedintheKittsonCountyCentralandNortheastElkZones. A.B.Ifone ormorethan eight qualifiedlandownersineitherzoneapply,adrawingtoselectonelandownerinthePrimaryandSecondaryGryglaElkZones,combined,andonelandownerintheKittsonCountyCentralElkZoneshall occurfirst.Theremainingpartiesshallthenbeselectedinageneraldrawingtofinalizesuccessfulparties.Ifnoqualifiedlandownersapply,alllicensesshallbedrawnfromthegeneralpoolofapplicantsapply,thecommissionermustfirstconductadrawingtoselectupto20percentofavailablepermitsforlandownerlicensees. I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:

TheCOVID-19pandemiccontinuestopresentanunprecedentedandrapidlyevolvingchallengetoourState.SincetheWorldHealthOrganization(“WHO”)characterizedtheCOVID-19outbreakasapandemiconMarch11,2020,confirmedcasesofCOVID-19inMinnesotahaverapidlyincreased.OnMarch15,2020,Minnesotadetectedthefirstconfirmedcasescausedby“communityspread”—infectionsnotepidemiologicallylinkedtooverseastravel.ByMarch17,2020,allfiftystateshadreportedaconfirmedcaseofCOVID-19,andonMarch21,2020,theMinnesotaDepartmentofHealth(“MDH”)announcedMinnesota’sfirstCOVID-19fatality.


Executive OrdersThePresidentdeclaredanationalemergencyrelatedtoCOVID-19onMarch13,2020.Sincethen,andforthefirst

timeinhistory,thePresidenthasapprovedmajordisasterdeclarationsforallfiftystatesandtheDistrictofColumbia.Inconcertwiththesefederalactionsandtheactionsofstatesacrossthenation,MinnesotahastakenproactivestepstoensurethatweareaheadofthecurveonCOVID-19preventionandresponse.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,endangersthelivesofMinnesotans,andlocalresourceswere—andcontinuetobe—inadequatetoaddressthethreat.AfternotifyingtheLegislature,onApril13,2020andagainonMay13,2020,IissuedExecutiveOrdersextendingthepeacetimeemergencydeclaredinExecutiveOrder20-01.

OurresponsetoCOVID-19hasrequiredsharedsacrifices.Earlyexamplesfromothercountriesandstatesshowedthat,withoutdrasticpreventivemeasures,theviruswouldrapidlyspreadandquicklyoverwhelmhealthcareresources.Slowingthevirus’sspreadinMinnesotatoallowforpreparationsrequiredustostayhomeandavoidcherishedactivities.Minnesotanshavetakentheirresponsibilityseriously,andindoingso,wehaveprotectedourneighborsandsavedlives.

InlightofourincreasedpreparednesstotreatthosemostvulnerabletoCOVID-19,wehavetakenslowanddeliberatestepstosafelygetMinnesotansbacktoworkandtheirmostmeaningfulactivities.InExecutiveOrder20-56,whileliftingageneralorderforMinnesotanstostayathome,Isetalimitongatheringsovertenpeople.ThismeasureremainsanimportantpartofourCOVID-19mitigationstrategy.ConsistentwithpublichealthguidancefromtheCentersforDiseaseControlandPrevention(“CDC”),includingreportsofCOVID-19outbreaksinfaith-basedsettings,thegatheringlimitationinExecutiveOrder20-56appliedgenerallyacrossavarietyofactivities,includingsocial,civic,community,faith-based,leisure,andrecreationalactivities.

AsIexplainedinExecutiveOrder20-56,largegatheringsofpeople—whethersecularorreligious—forextendedtimeperiodsraisetheriskofCOVID-19transmissionfromhouseholdtohousehold.Thisbasicsciencehasnotchanged,andthedecisiontolimitgatheringswasnecessarytomitigatethespreadofCOVID-19atatimeofincreasingdeathrates.

BeforeandafterissuingExecutiveOrder20-56,IhavemetwithfaithleaderstodiscusstheimpactofthislimitationonMinnesotans.OnMay22,2020,theCDCnotedthat,formany,worshipisanessentialpartoflife.OurfaithcommunitiestendtomanyMinnesotans’mentalandspiritualhealthandthereforeplayaspecialroleinoursociety.Inaddition,worshipservices,weddings,andfuneralsofferamorepredictableandcontrollableenvironmentthanothersocialsettingsinwhichpeoplemaygather.Inmanycases,faithcommunitiesareawareofandcanmonitorattendeesatservicesandceremoniesandtakeappropriateactionsintheeventofillness.

Recognizingtheuniqueandessentialrolethatfaithcommunitiesplayinoursociety,theCDCreviseditsguidelinesrelatedtocommunitiesoffaith.TheCDCalsoreiteratedtheunfortunatetruththatgatheringspresentariskforincreasingthespreadofCOVID-19.Acknowledgingthatdecisionsandstrategiesonreopeningareimplementedatthestate,tribal,andlocallevels,theCDChasdevelopednewguidanceforfaithcommunitieswishingtocongregatesafely.ThroughconsultationwithMinnesotafaithleaders,MDHhasdevelopedadditionalguidanceforfaith-basedcommunities,placesofworship,services,weddings,andfunerals.

Minnesotanshavemadesacrificestoprotecttheirneighborsbydeferringlargegatheringsforin-personservicesandceremonies,bothreligiousandsecular.IcontinuetourgeallMinnesotanstolimittheirin-personinteractionswithpeopleoutsideoftheirhouseholds.And,asIhaveemphasizedinpreviousExecutiveOrders,IstronglyurgeMinnesotansatheightenedrisktostayhomeexceptforessentialactivities,andIurgefaithcommunitiestocontinuetoprovideremoteservicestothemaximumextentpossible.Andnofaithcommunityshouldfeelcompelledtoopentheirfacilitiesorprovideservicesiftheyarenotcomfortabledoingso.Nonetheless,toensurethementalandspiritualhealthofMinnesotans,whilecontinuingtoprotectthepublichealth,itisnecessarytotakeanothersteptoallowforweddings,funerals,andservicestocontinuewithlargergroups.Tobeclear,eachstepwetakebringsriskandresponsibilityforall.Thosewhodisregardpublichealthguidanceendangernotonlythemselves,buttheirfamiliesandneighbors.

InMinnesotaStatutes2019,section12.02,theMinnesotaLegislatureconferredupontheGovernoremergencypowersto“(1)ensurethatpreparationsofthisstatewillbeadequatetodealwithdisasters,(2)generallyprotectthepublicpeace,health,andsafety,and(3)preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesota


Executive OrdersStatutes2019,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontrolthestate’semergencymanagementaswellascarryouttheprovisionsofMinnesota’sEmergencyManagementAct.

MinnesotaStatutes2019,section12.21,subdivision3(7),authorizestheGovernortocooperatewithfederalandstateagenciesin“matterspertainingtotheemergencymanagementofthestateandnation.”Thisincludes“thedirectionorcontrolof...theconductofpersonsinthestate,includingentranceorexitfromanystrickenorthreatenedpublicplace,occupancyoffacilities,and...publicmeetingsorgatherings.”Pursuanttosubdivision3ofthatsamesection,theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes2019,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthepeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency

TheCOVID-19pandemiccontinuestopresentanunprecedentedandrapidlyevolvingchallengetoourState.SincetheWorldHealthOrganizationcharacterizedtheCOVID-19outbreakasapandemiconMarch11,2020,confirmedcasesofCOVID-19inMinnesotahaverapidlyincreased.OnMarch15,2020,Minnesotadetectedthefirstconfirmedcasescausedby“communityspread”—infectionsnotepidemiologicallylinkedtooverseastravel.ByMarch17,2020,allfiftystateshadreportedaconfirmedcaseofCOVID-19,andonMarch21,2020,theMinnesotaDepartmentofHealth(“MDH”)announcedthefirstconfirmedfatalityduetoCOVID-19inMinnesota.

ThePresidentdeclaredanationalemergencyrelatedtoCOVID-19onMarch13,2020.Sincethen,andforthefirsttimeinhistory,thePresidenthasapprovedmajordisasterdeclarationsforallfiftystatesandtheDistrictofColumbia.Inconcertwiththesefederalactionsandtheactionsofstatesacrossthenation,Minnesotahastakenproactivestepstoensurethatweremainaheadofthecurve.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,endangersthelivesofMinnesotans,andlocalresourceswere—andcontinuetobe—inadequatetoaddressthethreat.AfternotifyingtheLegislature,onApril13,2020andagainonMay13,2020,IissuedExecutiveOrdersextendingthepeacetimeemergencydeclaredinExecutiveOrder20-01.

Theneedtoslowthespreadofthevirusrequiredtheclosureofcertainnon-criticalbusinessesinoureconomy.AlthoughMinnesota’sAprilunemploymentratewasthesecondlowestinthecountry,over700,000MinnesotanshaveappliedforunemploymentinsurancesinceMarch16,2020.InExecutiveOrder20-33,seekingtobalancepublichealthneedsandeconomicconsiderations,webeganplanningtoallowmoreMinnesotaworkerstosafelyreturntowork.Wedraftedguidelinesandrequirementsforappropriatesocialdistancing,hygiene,andpublichealthbestpractices.ExecutiveOrder20-38expandedexemptionsforoutdoorrecreationalactivitiesandfacilities,andExecutiveOrders20-40,20-48,and20-56allowedforthegradualreopeningofcertainnon-criticalbusinessesthatplannedforandprovidedsafeworkplaces.

OurincreasedpreparednesstotreatthosemostvulnerabletoCOVID-19allowsustocontinueslowlyandsafelyreopeningoureconomyinaccordancewithguidancefromMDH,theDepartmentofEmploymentandEconomicDevelopment(“DEED”),andtheDepartmentofLaborandIndustry(“DLI”).BusinessesreenteringtheeconomymustensurecompliancewiththeMinnesotaOccupationalSafetyandHealthActof1973,MinnesotaStatutes2019,Chapter182(“MinnesotaOSHAStandards”),inadditiontoguidelinesrelatedtoCOVID-19setforthbyMDHandtheCentersforDiseaseControlandPrevention(“MDHandCDCGuidelines”).

DespitetheprogresswehavemadesincedeclaringtheCOVID-19peacetimeemergency,certainestablishments—includingthoseinwhichpeoplegatherandlinger,thosewithcommunalfacilities,andthoseinwhichclosephysicalcontactisexpected—continuetoposeapublichealthrisk.Wecontinuetocarefullyconsiderandprepareforthereopeningofsuchbusinesses.

Likewise,certainnon-workactivitiesoutsideofthehomeareconducivetosocialdistancingandhygiene,whileothersraisesignificantpublichealthrisks.Indooractivitiesposehigherrisksthanoutdooractivities.Unpredictablesettingsareriskierthanmorepredictablesettings.Largesocialandothergatheringsofpeopleforextendedtimeperiodsincreasetheriskoftransmissionbetweenhouseholds,buttherisksoftransmissionarediminishedintransitorysettings,suchasretailestablishments,whereindividualinteractionsandcontactaremorelimitedinduration.

b. “Worker”and“workers”arebroadlydefinedtoincludeowners,proprietors,employees,contractors,vendors,volunteers,andinterns.

c. “Business”and“businesses”arebroadlydefinedtoincludeentitiesthatemployorengageworkers,includingprivate-sectorentities,public-sectorentities,non-profitentities,andstate,county,andlocalgovernments.

a. Guidelines.IndividualsengaginginactivitiesoutsideofthehomemustfollowtherequirementsofthisExecutiveOrderandMDHandCDCGuidelines.IndividualsengaginginoutdoorrecreationalactivitiesmustfollowtheMinnesotaDepartmentofNaturalResources(“DNR”)andMDHguidelinesonoutdoorrecreationandguidelinesforfacilitiesandthepublic(“OutdoorRecreationGuidelines”)availableatDEED’swebsite(https://mn.gov/deed/guidance).

b. Unnecessary travel strongly discouraged. Consistentwithfederalguidanceandtoprotectourneighbors,Minnesotansareencouragedtostayclosetohomeandarestronglydiscouragedfromengaginginunnecessarytravel.

c. Gatherings. Allgatheringsofmorethan10peopleareprohibited,exceptassetforthbelow.Gatheringsaregroupsofindividuals,whoarenotmembersofthesamehousehold,congregatedtogetherforacommonorcoordinatedsocial,civic,community,faith-based,leisure,orrecreationalpurpose—evenifsocialdistancingcanbemaintained.Thisprohibitionincludesplannedandspontaneousgatherings,publicandprivategatherings,andindoorandoutdoorgatherings.Examplesofprohibitedgatheringsinclude,butarenotlimitedto,social,civic,community,faith-based,orleisureevents,sportingorathleticevents,performances,concerts,conventions,fundraisers,parades,fairs,andfestivalsthatbringtogethermorethan10peoplefrommorethanonehousehold.ProhibitedgatheringsdonotincludecommercialactivitybyworkersandcustomersofCriticalandNon-CriticalBusinesses.

i. Legislative and other governmental meetings. ThelimitsongatheringsinthisExecutiveOrderdonotapplytolegislativeandothergovernmentalmeetings. Remotemeetingsarestronglyencouragedwheneverpossibleaspermittedbystateorlocalauthority.

ii. The Judicial Branch.ThelimitsongatheringsinthisExecutiveOrderdonotapplytoproceedingsheldbytheMinnesotaJudicialBranch.ProceedingsheldbytheJudicialBrancharesubjecttothepoliciesestablishedbythechiefjusticeandwilloccurasdirectedbycourtorder.IndividualsmayappearasdirectedbyaMinnesotastatecourt,includingtoserveasajuror,appearasaparty,asawitness,oraslegalcounselonbehalfofaparty,orotherwisetocomplyasdirectedbyacourtorder,subpoena,orsummons.

iii. Federal activities.NothinginthisExecutiveOrderwillbeconstruedtolimit,prohibit,orrestrictinanywaytheoperationsofthefederalgovernmentorthemovementoffederalofficialsinMinnesotawhileactingintheirofficialcapacity,includingfederaljudicial,legislative,andexecutivestaffandpersonnel.

iv. Drive-in gatherings.Toenablesafecongregationofmorethan10people,drive-ingatheringsarepermitted,providedthatallparticipantsremainwithintheirownvehiclesandfollowtheapplicableguidanceavailableatDEED’swebsite (https://mn.gov/deed/guidance).

v. Weddings, Funerals, and Services.Placesofworship,funeralhomes,andothervenuesthatoffergatheringspaceforweddings,funerals,orplannedservicessuchasworship,rituals,prayermeetings,orscripturestudies,mayhostsuchweddings,funerals,orserviceswithover10people,providedthattheyadheretothefollowingrequirements:

SinceMr.Floyd’sdeath,thousandsofMinnesotanshaveexpressedtheirfrustrationinapeacefulandconstructivemanner.DemonstratorshavegatheredinMinneapolis,St.Paul,andsurroundingcommunitiestoprotestMr.Floyd’sdeath.Peacefuldemonstrationsareakeystoneofourdemocraticsystem.Wemustalsoallowthosewhowishtoprotestpeacefullytodososafely.

Unfortunately,someindividualshaveengagedinunlawfulanddangerousactivity,includingarson,rioting,looting,anddamagingpublicandprivateproperty.TheseactivitiesthreatenthesafetyoflawfuldemonstratorsandotherMinnesotans,andbothfirstrespondersanddemonstratorshavealreadybeeninjured.Manybusinesses,includingbusinessesownedbypeopleofcolor,havesuffereddamageasaresultofthisunlawfulactivity.

TheCityofMinneapolishasexhausteditsresourcesandcalledforassistancefrommutualaidpartnerstoensureimmediateresponsetoprotectlife,safety,andproperty.Thesemutualaidpartnershavefullycommittedtheiravailableresources.TheCitiesofMinneapolisandSt.Paulhaveactivatedtheiremergencyoperationsplan,andtheMayorsofbothcitieshaverequestedtheassistanceoftheMinnesotaNationalGuardtohelpprovidesecurityandrestoresafety.

TheStateEmergencyOperationsCenter(“SEOC”)iscurrentlyactivatedfortheCOVID-19responseandhasimplementedtheMinnesotaEmergencyOperationsPlan.Stateagenciesareprovidingassistancetolocalgovernments.TheSEOCwillconcurrentlysupportboththeCOVID-19responseandtheCityofMinneapolis,theCityofSt.Paul,andsurroundingcommunitiesduringthissituation.

Forthesereasons,IdeclareapeacetimeemergencyintheCityofMinneapolis,theCityofSt.Paul,andsurroundingcommunitiesandorderasfollows:

1. TheAdjutantGeneralwillordertostateactivedutyonMay28,2020thepersonnel,equipment,andfacilitiesneededtosupportemergencyoperationsandresponse.

2. TheAdjutantGeneralisauthorizedtoprocurethegoodsandservicesneededtoaccomplishthemission.

3. TheDepartmentofPublicSafety’sDivisionofHomelandSecurityandEmergencyManagementwillcontinuetocoordinatetheprovisionofon-sitesupportandassistancetoaffectedlocalgovernmentandassesstheneedforsupplementaryemergencyassistance.

4. Stateagencies,incooperationwithappropriatefederalagencies,willprovideassistancetolocalunitsofgovernmentastheyrespondtoandrecoverfromthisemergency.

OnMay25,2020,GeorgeFloyddiedwhileincustodyoftheMinneapolisPoliceDepartment.OurstatewatchedMr.Floyd’shumanitybeerased.SinceMr.Floyd’sdeath,thousandsofMinnesotanshaveexpressedtheirfrustrationinapeacefulandconstructivemanner.DemonstratorshavegatheredinMinneapolis,SaintPaul,andsurroundingcommunitiestoprotestMr.Floyd’sdeath.Peacefuldemonstrationsareessentialtoourdemocraticsystem.

Unfortunately,someindividualshaveengagedinunlawfulanddangerousactivity,includingarson,rioting,looting,anddamagingpublicandprivateproperty.Theseactivitiesthreatenthesafetyoflawfuldemonstrators,thesurroundingcommunities,andfirstresponders—andMinnesotanshavealreadybeeninjured.Manybusinesses,includingthoseownedbypeopleofcolor,havesuffereddamageasaresultofthisunlawfulactivity.

InresponsetothewidespreadcivilunrestandunlawfulactivityinMinneapolis,SaintPaul,andsurroundingcommunities,IdeclaredapeacetimeemergencyandactivatedtheMinnesotaNationalGuardonMay28,2020.Destructiveanddangerousactivityhascontinued.Individualshavelootedbusinesses,destroyedresidentialbuildings,andsetaprecinctpolicestationonfire.Thissenselessviolencetearsatthefabricofoursociety.IndiscriminatedestructionisnotthetributeowedtoMr.Floyd,anditdoesnotreflectourvaluesasMinnesotans.Wemustrestorepeaceandsafetyimmediately.

Becausemuchofthedestructionandviolencehastakenplaceunderthecoverofdarkness,wemustimplementatemporarynighttimecurfew,incoordinationwiththeCitiesofMinneapolisandSaintPaul,toensurepublicsafety.

InMinnesotaStatutes2019,section12.02,theMinnesotaLegislatureconferredupontheGovernoremergencypowersto“generallyprotectthepublicpeace,health,andsafety”andto“preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesotaStatutes2019,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontrolthestate’semergencymanagementandtocarryouttheprovisionsofMinnesota’sEmergencyManagementAct.

MinnesotaStatutes2019,section12.21,subdivision3(7),authorizestheGovernortocooperatewithfederalandstateagenciesin“matterspertainingtotheemergencymanagementofthestateandnation.”Thisincludes“thedirectionorcontrolof...theconductofpersonsinthestate,includingentranceorexitfromanystrickenorthreatenedpublicplace,occupancyoffacilities,andthemovementandcessationofmovementofpedestrians,vehiculartraffic,andallformsofprivateandpublictransportationduring,prior,andsubsequentto...actualemergencies.”Thisauthorityalsoextendstothedirectionandcontrolof“publicmeetingsorgatherings.”

PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(1),theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes2019,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthepeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.


1. Nighttime Curfew. AcurfewisimposedinallpublicplaceswithintheCityofMinneapolisandtheCityofSaintPaulduringthefollowingtimes:

TheCOVID-19pandemicpresentsanunprecedentedchallengetoourState.MinnesotahastakenproactivestepstoensurethatweareaheadofthecurveonCOVID-19preventionandresponse.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.InExecutiveOrder20-01,Idirectedallstateagenciestosubmitproposedordersandrulestoprotectandpreservepublichealthandsafety.AfternotifyingtheLegislature,onApril13,2020andagainonMay13,2020,IissuedExecutiveOrdersextendingthepeacetimeemergencydeclaredinExecutiveOrder20-01.

InresponsetotheCOVID-19pandemic,theFederalMotorCarrierSafetyAdministration(“FMCSA”)issuedanationalemergencydeclarationonMarch13,2020,providingrelieffromcertainsafetyregulationstocarriersprovidingdirectassistancetosupportemergencyreliefefforts.Duetothecontinuedemergencyconditions,FMCSAhastwiceextendedtheexpirationdateoftheinitialdeclaration.BasedonthelanguageofthedeclarationandFMCSAguidance,livestockfeedisconsideredaprecursormaterialtoessentialitems.

AnimalfeedisacommodityneededtoensurethecontinuityofessentialfarmingactivitiesandthesupplyoffoodinMinnesotaandthroughoutthecountry.TheagriculturalindustryandcommunityinMinnesotaandneighboringstatesarefacingasignificantdecreaseintheemployeeworkforce,includingcommercialtruckdriversandemployeesoffarmsandprocessingplants,duetoimpactsrelatedtoCOVID-19.Additionally,manycarriersanddriversarebeingdivertedfromtransportingfeedtoassistwiththetransportationoflivestockandanimalcarcasses,whichiscreatingfurtherdisruptionsintheefficientmovementoffeed.

ThelivestockmarketsinMinnesotahavebeenandwillcontinuetobeimpactedbyCOVID-19.ThesuspensionofoperationsatmeatprocessingfacilitiesinMinnesotaandneighboringstateshasresultedinareductionofthenormalprocessingcapacity,leavingfarmerswithlimitedoptionsforplacestobringtheiranimalsandcreatingaregionalandnationwideprocessingbacklog.Becauseoftheprocessingbacklog,farmersandmeatproducersareholdinganincreasednumberoflivestockonfarmsforlongerperiodsoftime.Reliableaccesstolivestockfeediscriticaltomaintaininghealthyanimals,whichareessentialtotheeconomicsecurityandviabilityofmanyfarmingoperations.

MinnesotaStatutes2019,section221.0314,subdivision9,adoptsfederalregulations,includinghoursofservicerequirementsfordrivers.MinnesotaStatutes2019,section221.0269,subdivision1,providesthattheGovernor“maydeclareanemergencyandgrantrelieffromanyoftheregulationsincorporatedinsection221.0314tocarriersanddriversoperatingmotorvehiclesinMinnesotatoprovideemergencyreliefduringtheemergency.”

OnApril3,2020,IissuedExecutiveOrder20-27declaringanemergencyinMinnesotaandprovidingtemporaryrelieffromcertainhoursofserviceregulationsformotorcarriersanddriverstransportinglivestockfeedandfertilizerusedforspringcropplanting.OnMay1,2020,underauthoritygrantedinMinnesotaStatutes2019,section221.0269,subdivision2,theCommissionerofTransportationissuedanorderextendingExecutiveOrder20-27foranother30days.TheneedforreliefidentifiedinExecutiveOrder20-27andtheCommissioner’sOrderwithrespecttothetransportationoflivestockfeedstillexists,andanewexecutiveorderisnecessary.

Strictenforcementofcertainhoursofserviceregulationswouldpreventorhindertheefficienttransportationoflivestockfeed.ThecontinuedandefficientmovementofthiscommodityisvitaltothehealthandsafetyofMinnesotans.


1. AstateofemergencyexistsinMinnesotathatrequiresassistancefrommotorcarrierstotransportlivestock

NothinginthisExecutiveOrdermaybeconstruedtorelievemotorcarriersanddriversprovidingdirectassistancetoemergencyreliefeffortsbytransportinglivestockfeedfromtherequirementsunderparagraph(a)oftheCodeofFederalRegulations,title49,part395.3,whichstates,inpart,thatadrivermaydriveonly11hoursduringaperiodof14consecutivehoursaftercomingondutyfollowing10consecutivehoursoffduty.

5. ThisExecutiveOrderdoesnotrelievemotorcarriersanddriversprovidingdirectassistancetoemergencyreliefeffortsfromregulationspertainingtodriverqualifications;drivingofcommercialmotorvehicles;commercialdriver’slicenses;drugandalcoholtestingfordrivers;orequipment,parts,andaccessoriesnecessaryforthesafeoperationofvehicles.

6. NomotorcarrieroperatingunderthetermsofthisExecutiveOrdermayrequireorallowafatiguedorilldrivertooperateacommercialmotorvehicle.Adriverwhoinformsacarrierthatheorsheneedsimmediaterestmustberelievedofalldutyandresponsibilitiesandgivenatleast10consecutivehoursoffdutybeforethedriverisrequiredtoreturntoservice.

Office of the GovernorEmergency Executive Order 20-68: Extending the Temporary Nighttime Curfew in the Cities of Minneapolis and Saint Paul


OnMay25,2020,GeorgeFloyddiedwhileincustodyoftheMinneapolisPoliceDepartment.SinceMr.Floyd’sdeath,thousandsofMinnesotanshaveexpressedtheirfrustrationinapeacefulandconstructivemanner.Peacefuldemonstrationsareessentialtoourdemocraticsystem.Unfortunately,someindividualshaveengagedinunlawfulanddangerousactivity,includingactsofarson,rioting,looting,anddamagingpublicandprivateproperty.Thissenselessviolencetearsatthefabricofoursociety,doesnotreflectourvalues,andpresentsaclearandpresentdangertolifeandpropertyinMinnesota.

TheCitiesofMinneapolisandSaintPaulhaveactivatedtheiremergencyoperationsplans,andthemayorsofbothcitieshaverequestedassistancetohelpprovidesecurityandrestoresafety.InresponsetothoserequestsandtothewidespreadcivilunrestandunlawfulactivityinMinneapolis,SaintPaul,andsurroundingcommunities,IdeclaredapeacetimeemergencyandactivatedtheMinnesotaNationalGuardonMay28,2020.IalsoimposednighttimecurfewsinMinneapolisandSaintPaulonMay29and30,2020.Conditionshaveimproved,butthreatstopublicsafetyremain.Becausemuchofthedestructionandviolencehastakenplaceunderthecoverofdarkness,wemustcontinueatemporarynighttimecurfew,incoordinationwiththeCitiesofMinneapolisandSaintPaul,toensurepublicsafety.

InMinnesotaStatutes2019,section12.02,theMinnesotaLegislatureconferredupontheGovernoremergencypowersto“generallyprotectthepublicpeace,health,andsafety”and“preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesotaStatutes2019,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontrolthestate’semergencymanagementandtocarryouttheprovisionsofMinnesota’sEmergencyManagementAct.

MinnesotaStatutes2019,section12.21,subdivision3(7),authorizestheGovernortocooperatewithfederalandstateagenciesin“matterspertainingtotheemergencymanagementofthestateandnation.”Thisincludes“thedirectionorcontrolof...theconductofpersonsinthestate,includingentranceorexitfromanystrickenorthreatenedpublicplace,occupancyoffacilities,andthemovementandcessationofmovementofpedestrians,vehiculartraffic,andallformsofprivateandpublictransportationduring,prior,andsubsequentto...actualemergencies.”Thisauthorityalsoextendstothedirectionandcontrolof“publicmeetingsorgatherings.”

PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(1),theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes2019,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthepeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.


Executive OrdersForthesereasons,Iorderasfollows:

1. Nighttime Curfew. AcurfewisimposedinallpublicplaceswithintheCityofMinneapolisandtheCityofSaintPaulfrom8:00pmonSunday,May31,2020until6:00amonMonday,June1,2020.

2. Travel Prohibited.Duringthecurfew,allpersonsmustnottravelonanypublicstreetorinanypublicplace.

3. Exemptions.Alllawenforcement,fire,medicalpersonnel,andmembersofthenewsmedia,aswellasotherpersonnelauthorizedbytheCityofMinneapolis,CityofSaintPaul,MinnesotaDepartmentofPublicSafety,MinnesotaStatePatrol,orMinnesotaNationalGuard,areexemptfromthecurfew.Individualstravelingdirectlytoandfromwork,seekingemergencycare,fleeingdangerouscircumstances,orexperiencinghomelessnessarealsoexempt.

4. Definitions.

a. ForthepurposesofthisExecutiveOrder,“travel”includes,withoutlimitation,travelonfoot,bicycle,skateboard,scooter,motorcycle,automobile,publictransit,oranyothermodeoftransportingapersonfromonelocationtoanother.

b. ForthepurposesofthisExecutiveOrder,a“publicplace”isanyplace,whetheronprivatelyorpubliclyownedproperty,accessibletothegeneralpublic,includingbutnotlimitedtopublicstreetsandroads,alleys,highways,driveways,sidewalks,parks,vacantlots,andunsupervisedproperty.

5. Enforcement.IurgeallMinnesotanstovoluntarilycomplywiththisExecutiveOrder.PursuanttoMinnesotaStatutes2019,section12.45,anindividualwhowillfullyviolatesthisExecutiveOrderisguiltyofamisdemeanoranduponconvictionmustbepunishedbyafinenottoexceed$1,000orbyimprisonmentfornotmorethan90days.

PursuanttoMinnesotaStatutes2019,section4.035,subdivision2,andsection12.32,thisExecutiveOrderiseffectiveimmediatelyuponapprovalbytheExecutiveCouncil.ItexpiresonJune1,2020at6:00amoruntilitisrescindedbyproperauthority.

3.
