HydroEnvironmental Solutions, Inc. (HES) was retained by the Town of North Castle to review the Oamic Ingredients LLC (Oamic) Application for a proposed food chemical and flavoring warehouse storage facility located at 6 Labriola Court in Armonk, New York. As part of our review process, HES reviewed the following documents provided by the Town and the Applicant:

1. The Applicants Submission of November 6, 2017 which included a summary letter from JMC Site Development Consultants, LLC (JMC), a building architectural plan, a Statement of Oamic’s Statement of Environmental Safety of its Stored Products and information onthe stored products.

2. Site Layout (SP-4) dated 10/11/17 prepared by JMC Consulting. 3. A summary table of chemicals to be stored at the site prepared by JMC. 4. An MSDS Sheet Summary prepared by JMC dated September 25, 2017. 5. A November 17, 2017 letter from the New York City Department of

Environmental Protection (NYCDEP) to Mr. Adam Kaufman, AICP.

Based on our review of the materials provided and our December 1, 2017 site visit and meeting with the Applicant’s engineer, Paull J. Dumont of JMC, we offer the following:

Project Background The Applicant proposes to renovate the existing 24,000 (approximately) square

feet warehouse building for the purposes of storing chemical compounds related to food flavoring and preservation. Initially, the Applicant proposed using the facility to store Class I, II and III chemical compounds (according to the International Code Council [ICC] Fire Code Classification) and submitted a site plan and drawings to accommodate this proposal in May and October 2017. However, after appearing before the Town of North Castle Planning and Conservation Boards, and corresponding with the NYCDEP, the Applicant has changed their proposal to only store Class IIIA and Class IIIB combustible liquids and flammable and non-flammable solids.

The site is located immediately adjacent to Bear Gutter Creek and a pond and

wetland that are part of the creek watershed. Bear Gutter Creek is a direct tributary to Kensico Reservoir; therefore, the Town of North Castle and the NYCDEP expressed concerns over the storage of bulk chemicals in very close proximity to an environmentally sensitive watershed. Additionally, the Town of North Castle expressed concerns over the proximity of the facility to sensitive receptors such as restaurants and residential properties. The site location is shown on Figure 1. Regulatory Applicability

As stated by the Applicant, the site is no longer being proposed as a Class I and

II chemical bulk storage facility. Thus, the New York State Department of Environmental Conservation (NYSDEC) Chemical Bulk Storage Regulations, specifically 6 NYCRR Parts 595 through 599 are generally not applicable except for one compound that is proposed to be stored, Benzoic Acid Natural. It should be noted that the chemicals that are proposed for bulk storage on the premises are considered hazardous chemicals by federal regulation under the Occupational Safety and Hazard Administration (OSHA), and several of which are considered hazardous chemicals by the Superfund Amendment and Reauthorization Act (SARA) Parts 311/312. As outlined in the November 17, 2017 NYCDEP letter to the Town, the presence of hazardous chemicals that are stored in bulk in reservoir watersheds are regulated under Rules and Regulations for the Protection from Contamination, Degradation, and Pollution of the New York City Water Supply and its Sources. Therefore, based on the presence of Benzoic Acid Neutral, a NYSDEC regulated hazardous waste, it is HES’ opinion that all applicable NYSDEC Chemical Bulk Storage Regulations and NYCDEP Water Supply Protection Regulations for this compound must be adhered to.

The chemicals that are proposed for bulk storage at the facility are listed on the

attached Table 1. Table 1 lists the twenty-six (26) chemicals the Applicant proposes to store in bulk at the warehouse facility after renovation. As noted on the table, none of the chemicals listed are regulated by the NYCDEP, with the exception of Guaiacol.


Only one chemical, Benzoic Acid Neutral is regulated by the NYSDEC as a hazardous substance. However, all the chemicals listed on the table are listed as hazardous chemicals by OSHA, and nineteen (19) of twenty-six (26) of the chemicals listed are listed as hazardous under SARA 311/312. Thus the health and safety and handling requirements listed under OSHA and SARA must be followed at all times at the facility.

Safety Data Sheets for Stored Chemicals The Material Safety Data Sheets (MSDS) for the proposed stored chemicals

were provided by the Applicant. It is important to note that as of December 1, 2015, chemical manufacturers are required to provide Safety Data Sheets as MSDS’s are no longer applicable to chemical bulk storage, use, and related health and safety. The Applicant provided MSDS’s that mostly originate from China, the company’s country of origin. The majority of the MSDS’s provided were compiled by Bestally whom is located in Xiamen, China and by Science Lab.com located in Houston, Texas.

As part of the application review process, HES compiled SDSs produced by VIGON

International (VIGON) located in East Stroudsburg, Pennsylvania. The VIGON SDS sheets for all of the chemicals to be stored at the facility are included in Attachments. VIGON SDS were chosen due to the thoroughness, detail, and readability as compared to the majority of the MSDS provided by the Applicant. The Applicant provided MSDS were not uniform. Some of the MSDS did not provide sufficient detailed information related to the chemicals storage and use and health and safety standards as they relate to Regulations and Guidelines in the USA (for example National Institute for Occupational Safety [NIOSH] and OSHA). Based on this information, HES recommends that the Applicant include a comprehensive SDS binder (with uniform SDS) for all proposed chemicals that will be stored at the facility. The Regulations and Guidelines of the USA and its respective agencies must be adhered to for all stored chemicals as they are drastically different than those promulgated in China. Proposed Site Plan

Surrounding Land Use The subject property is immediately surrounded by commercial properties.

These properties include H. Weiss, LLC, a food service equipment and supplies company; Morgan Manhattan Moving and Storage; Standing Ovation Studios and Lighthouse Youth Theatre, performing arts centers; and Gavi Restaurant. Residential neighborhoods exist to the west and northeast of the subject property. Additionally, commercial properties within ¼ mile including restaurants and children’s centers exist to the northeast of the subject property. The subject property location and surrounding land use is shown on Figure 2.


Sensitive Receptors Bear Gutter Creek, which is situated directly behind the warehouse building,

flows from the northeast to the southwest. The Bear Gutter Creek is tributary to the Kensico Reservoir, which is the “last stop” in the NYCDEP waterway before the water goes to New York City (NYSDEC website). The creek and a small pond that are adjacent to the subject property are shown on Figure 2. According to the VIGON SDS, several of the proposed chemicals are toxic to aquatic life. This information is summarized on Table 1.

From the warehouse building, the land slopes downward to the northeast

towards the pond, and to the northwest and west towards the creek. Additionally, storm drains are located in the asphalt parking lots to the southwest and southeast of the warehouse building. These storm drains likely discharge to Bear Gutter Creek and the associated wetlands. No floor drains were observed in the warehouse building. The surface water flow directions for the site are shown on Figure 1.

Spill prevention and mitigation measures should be taken to avoid the possibility

of potential discharges of chemicals to the exterior of the building, given the surrounding waterways. All VIGON SDS claim the following in Section 6: “Prevent further leakage or spillage if safe to do so. Do not contaminate water. Avoid release to the environment. Retain and dispose of contaminated wash water. Contact local authorities in case of spillage to drain/aquatic environment.”

General Recommendations

• All applicable NYSDEC Chemical Bulk Storage Regulations and NYCDEP Water Supply Protection Regulations for Benzoic Acid Natural must be adhered to.

• Health and safety and handling requirements listed under OSHA and SARA must be followed at all times at the facility.

• Spill prevention and mitigation measures should be taken to avoid the possibility of potential discharges of chemicals to the exterior of the building, which could subsequently reach the surrounding waterways. HES recommends that the Applicant compile a Spill Prevention Control and Countermeasure Plan (SPCCP) for the site once it is constructed.

• According to the Oamic Statement (item 8), dated October 30, 2017, Oamic will adopt a procedure to notify the NYCDEP and the North Castle Town Planner of the addition of any new ingredient to the list. HES


recommends that this statement be expanded to include the required notification of the Town Engineer, Fire Chief, and Building Inspector in case of the addition of new ingredients.

• All Oamic employess that work in the warehouse area of the facility must be properly Health and Safety trained including 40-hour HAZWOPER training. The training must be updated annually in accordance with OSHA requirements.

• The Applicant should compile a comprehensive Health and Safety Plan and maintain it at all times for the facility.
