Samiti perused the letter dated 1 6 ~ ~ March 2013 received from Maharashtra Ur~iversity of Health Sciences, Nashik asking for approval to the verification report of Post Graduate Ayurved admissions for the Academic Year 2012-13, Said letter was circulated amongst the members of Samiti for urgent decision vide its circulatory submission.

After deliberation Samiti ratifies the decision of approval of the admissions of Post Graduate Ayurved and Unani courses on the basis of report submitted by the Maharashtra Ur~iversity of Health Sciences, Nashik for the Academic Year 2012-13, subject to various approvals from Central Council of Indian Medicine, New Delhi (CCIM), Department of AYUSH, New Delhi and Maharashtra University of Health Science, Nashik (MUHS) for academic year 2012-13, the details which are enclosed as Annexure - A.

Expert Committee i.e. Maharashtra University of Health Sciences, Nashik to notify the discrepancies wherever applicable. Where there are no discrepancies, all such admissions stand approved.

: To discuss, consider and ratifv the decisions taken on circulatow submission on 3d April 2013 reqardinq approval of admission ~rocess of first vear Health Science courses for the Academic Year 2012-13.

Samiti perused the email dated 2" April 2013 received from Directorate of Medical Education and Research, Mumbai regarding verification report of first year Medical and Dental Courses admissions for the Academic Year 2012-13, Said letter was circulated amongst the members of Sarr~iti for urgent decision vide its circulatory submission.

After deliberation Samiti ratifies the decision of approval of the admissions of first year Medical and Dental courses on the basis of report submitted by the Directorate of Medical Education and Research, Mumbai for the Academic Year 2012-13 (the details which are enclosed as Annexure - 6). The admissions are approved where there are no discrepancies, subject to various approvals from respective Council, Government of India, Government of Maharashtra and Maharashtra University of Health Sciences, Nashik.

Considering the suggestion of Expert Committee on the draft brochure, after deliberations, Samiti allows the Association of Muslim Minority's Medical Educational Institutions of Maharashtra, Pune to conduct PGU-CET-2013 for Post Graduate Unani course for Academic Year 2013-14, Subject to the Following:-

a) CET and CAP should be conducted in fair and transparent manner and as per the directives, orders, norms, rules and regulations laid down by the Hon'ble Supreme Court of India, New Delhi, 2) Hon'ble High Courts, 3) Central Council of Indian Medicine, New Delhi, 4) Department of AYUSH, New Delhi, 5) Maharashtra University of Health Sciences, Nashik, 5) Govt. of Maharashtra and 6) Pravesh Niyantran Samiti, Maharashtra State.

b) List of notified centers with details of seating arrangement made in each such centers and list of eligible candidates appearing for examination to be provided to Samiti. No. of seats available college wise to be provided to Samiti.

c) CET should be conducted at the centers located in non Unani course Colleges and staff of examination i.e. Supervisor, Invigilator, Center In-charge and other staff should be drawn from non Unani faculty.

d) Schedule of CET and CAP should be as per directives of Hon'ble Supreme Court of India, New Delhi, Central Council of Indian Medicine, New Delhi, Department of AYUSH and Maharashtra University of Health Sciences, Nashik, if any.

e) Result of CET should be displayed on website and the notice boards of the Association. Result of CET-2013 to be submitted to the Samiti office, within two days from the date of declaration of result.

f) Association should ensure that allotment of students to colleges is made strictly as per merit and as per the options of choices exercised. Association should also ensure that colleges submit Fee Approval proposals to Shikshan Shulka Samiti, Maharashtra State for finalization of fee structure for the Academic Year 2013-14. I t should also to be ensured that allotment of students is done only to the colleges who are permitted/affiliated to Counci l/University for the academic year 2013-14. Association should ensure that colleges submit the list of admissions within two days form the cut off date to Samiti's office.

g) Association conducting CET/ CAP should communicate to Samiti's office vacancy details immediately after the each round is over.

h) The Competent Authority of the Association and / or Representatives of Director, Directorate of Ayurved, Maharashtra State will be Grievance Redressal Authority who will take care of all complaints of students/parents during CET examinations and admission process. Association should further ensure appointment of appellate authority to hear and decide and dispose of grievances against the decisions of said competent authority.

i) All admissions to be done on the basis of CET conducted by the Association with the requisite mark.

j) Association/Colleges are directed to display details of their infrastructure available on their website.

k) Association should submit detailed information in respect of appointments of moderators/examiners their names qualifications, etc to Samiti immediately.

1) Samiti further directs the Association to submit the following information to office from time to time without fail:-

i > No. of students appeared

ii) No. of students qualified in the Exam. iii) No. of participating Colleges with subjects and their sanctioned intake

capacity.

iv) Course/Subject/category wise seat matrix of each round, before and after rounds.

v) List of selected candidates after each round.

vi) Details of complaints received during the process and details of action taken by Competent Authority and the Appellate Authority.

Samiti further directs, to incorporate following changes in final Rules and Information Brochure of PGU-CET-2813 as suggested by Expert Committee i.e. Directorate of AYUSH, Maharashtra State, listed in Annexure - C.

j 1 Samiti further directs the Association/Colleges/Institutes to follow following in the matter of refund of fees and incorporate the said c la~~se in the brochure:-

I) "If a candidate cancels his/her admission before the cut-off-date, then College/Institute has deduct only Rs. 1,800/- as administrative charges and balance amount of fees paid by a student be refunded within two days, otherwise the same amount to profiteering and charging of capitation fees. The Samiti further directs that the College/Institute should also return the original documents / certi,ficates collected from the students within two days.

11) I f a candidate expires within three months from the date of admission full refund shall be made after deducting Rs. 1,000/- as administrative charges.

111) After cut-off-date except as in (b) above no refund shall be made.

Samiti, subject to the incorporation of the aforesaid changes/conditions, grants its approval to the draft brochure of AMMMEI-PGU-CET-2013 of Association of Management of Homoeopathic Medical Colleges of Maharashtra for admissions to Post Graduate Unani course for Academic Year 2013-14.

Considering the suggestion of Expert Committee on the draft brochure and after deliberations, Samiti allows the Association of Management of Unaided Private Medical and Dental Colleges of Maharashtra to conduct Asso-CET-2013 for admission to first year Health Science courses for Academic Year 2013-14, Subject to the Following:-

a) CIT and CAP should be conducted in fair and transparent manner and as per the directives, orders, norms, rules and regulations laid down by the Hon'ble Supreme Court of India, New Delhi, 2) Hon'ble High Courts, 3) Respective Councils, 4) Maharashtra University of Health Sciences, Nashik, 5) Govt. of Maharashtra and 6) Pravesh Niyantran Samiti, Maharashtra State.

b) CET should be conducted at the centers located in non faculty Colleges and staff of examiliation i.e. Supervisor, Invigilator, Center In-charge and other staff should be drawn from non faculty.

c) List of notified centers with details of seating arrangement made in each such centers and list of eligible candidates appearing for examination to be provided to Samiti. No. of seats available college wise to be provided to Samiti.

d) Schedule of CET and CAP should be as per directives of Hon'ble Supreme Court of India, New Delhi, Hon'ble High Court order in Review Petition No. 120 of 2006 in Writ Petition No 6332 under of 2005 and Writ Petition No. 7799 of 2010.

e) Result of CET should be displayed on website and the notice boards. Result of CET-2013 to be submitted to the Samiti office, within two days from the date of declaration of result.

f) Association sho1.11d ensure that allotment of students to colleges is made strictly as per merit and as per the options of choices exercised. Association should also ensure that colleges must have submitted Fee Approval proposals to Shikshan Shulka Samiti, Maharashtra State for finalization of fees structure for the Academic Year 2013-14. It should also to be ensured that allotment of students is done only to the colleges who are permitted/affiliated to Council/University for the academic year 2013-14. Association should ensure that colleges submit the list of admissions within two days form the cut off date to Samiti's office.

g) Association conducting CET/ CAP should communicate to Samiti's office vacancy details immediately after the last round is over but within 7 days.

h) The Competent Authority of the Association and / or Representatives of Director, Medical Education and Research, Maharashtra State will be Grievance Redressal Authority who will take care of all complaints of students/parents during CET examinations and admission process. Association should further ensure appointment of appellate authority to hear and decide and dispose of grievances against the decisions of said competent authority.

i) All admissions to be done on the basis of CET conducted by the Association with the requisite mark.

j) Association/Colleges are directed to display details of their infrastructure available on their website.

k) Association should submit detailed information in respect of appointments of moderators/examiners their names qualifications, etc to Samiti immediately.

I) Samiti further directs the Association to submit the following inforniation to office from time to time without fail:-

i > No. of students appeared

ii) No. of students qualified in the Exam.

iii) No, of participating Colleges with subjects and their sanctioned intake capacity.

iv) Course/Subject/category wise seat matrix of each round, before and after rounds.

w) List of selected candidates after each round.

vii) Details of complaints received during the process and details of action taken by Competent Authority and the Appliate Authority.

m) Rule No. 13 - Process for fillinq vacant seats of MBBS and BDS courses m: After the last 'Common Admission Process" Asso-CET-2013 for filling vacant seats of only MBBS and BDS course Colleges/Institutes follow the following prograrnme strictly.

Samiti decides that those who fail to follow as above and those who fail to submit their admission details to Samiti, then the admission process of the aforesaid Colleges/Institutes will not be regularised for the Academic Year 2013-14.

n 1 Annexure A : It should be ensured that the Colleges incorporated in the lists are having all permissions, affiliations of their respective Councils, Central Government, Maharashtra University of Health Sciences, Nashik and Government of Maharashtra Students to be allotted to these colleges only.

Where seats are likely to be increased, Association to publish the details before hand in Local as well State Level News papers, notice boards and websites of association and/or respective College also and invite/call the fresh preferences / choices from the candidates for such seats.

o) Rule 19.2 : Refund of Fees : The Association/Colleges/Institutes are directed to follow following in the matter of refund of fees and incorporate the same clause as follows:

i) 'If a candidate cancels his/her admission before the cut-off-date, then College/Institute has deduct only Rs. 1,000/- as administrative charges and balance amount of fees paid by a student be refunded within two days, otherwise the same amount to profiteering and charging of capitation fees. The samiti further directs that the College/Institute should also return the original documents / certificates collected from the students within two days.

ii) I f a candidate expires within three months from the date of admission full refund shall be made after deducting Rs. 1,000/- as administrative charges.

iii) After cut-off-date except as in (ii) above no refund shall be made.

Samiti further directs, to incorporate following changes in final Rules and Information Brochure of CET-2013 as suggested by Expert Committee i.e. Directorate of IYedical Education and Research, Mumbai Maharashtra State, as follows:-

1) The time schedule of Asso-CET-2013 is in accordance with guidelines issued by Hon'ble Supreme Court of India as well as Hon'ble High Courts.

2) The rule of eligibility, Tie breaker, preparation of Merit list selection process, etc. are at par with rule of MHT-CET-2012 conducted by the Directorate of Medical Education and Research, Maharashtra State.

Samiti, subject to the incorporation of the aforesaid changes/conditions, grants its approval to the draft brochure of Asso-CET-2013 of Association of Management of Unaided Private Medical and Dental Colleges of Maharashtra for admissions to first year Health Science courses for Academic Year 2013-14.

Item No. 7: To consider and decide on the followinq letterslrepresentation received from various studentsl~arents requestina to review various decisions taken bv the Samiti in their earlier meetinqs held on ilth January, isth February and isth March 2013.

1. Samiti perused the applications dated 14/03/2013 and 5/4/2013 presented by Mr. Issadas Bhadke, father of a student i.e. Leny Esadas Bhadke. Samiti also perused its communication No. PDlulMC/SS/1684/2013 dated 16/04/2013 from the institute, sent through email.

2. Samiti went through the notification dated 22/09/2012 related to Notice for spot Admissions bearing no. PDlY IYC/SS/4253/2012 dated 22/09/2012 duly published by the institution.

3. Samiti observes that the merit list prepared from amongst applicants responding to said notification was duly published on 30/09/2012 at 12:30 p.m. Said merit list shows the name of applicant at Sr. No. 3 and is a topper amongst SC category students. There are about 10 SC applicants in the list alongwith other students.

Considering that the applicant was a topper in the merit list prepared and published by the institute and the request of the applicant being to correct the earlier orders passed by Samiti as a corrective measure to meet the ends of justice and in view of the fact that the said claimant student tops the merit, Samiti feels it appropriate, just and reasonable to approve the said admission as a corrective measure. The student and the institute to be informed accordingly.

Samiti perused all the submissions of the College/Institute viz. Dr. Vithalrao Vikhe PatiI Memorial Medical College, Ahmednagar in its meetings held on isth February 2013 and isth March 2013, Samiti also perused the submission of Dr. Dilip S. Asgaonkar dated 15/03/2013

After deliberation, Samiti concludes that the decision taken by Samiti in its meeting held on 1 5 ~ ~ February 2013 (at Item No. 3[d]) and isth March 2013 (at Item No. 8[d]) warrants no change. All decisions of the Committee those were taken herein

Item No.8: To consider and decide on the followins matter with the permission of the Chair.

Samiti perused the letter 110. YDCH 2107/3352/2013, dated /04/2013 received from the institute on 15/04/2013. Samiti also perused letter No. YDCH 2107/3307/2013 dated 23/03/2013 and No. YDCH 2107/3314/2013 dated 26/03/2013 received from the said institute. Samiti went through letters dated 15/01/2013 and 28/01/2013 received from the institute seeking revision of the order passed on 11/01/2013. Samiti observed that the said revisions were rejected. However the institute has again represented for correction of earlier decisions as corrective measures.

2. As per Government letter No. MED 1012/3T.*. 2 o / 3 o/ 9 9 , @w-7, dated 14/03/2013 a meeting was held on 18/03/2013 at 10.00 hrs before Hon'ble Minister (Medical Education) at his official residence Suruchi, Mumbai. I n furtherance of the discussions in the said meeting, the circulatory submission was submitted to Samiti on 18/03/2013 for its consideration. Samiti went through the office note along with the said circulatory submission.

3. Samiti observes that the Institute had an option of admitting students from either of the CET's (i.e. Asso-CET/MHT-CET). The Institute had opted in favour of Asso-CET during lSt and 2"d rounds. It considered students from merits lists of Asso-CET as allotted to it by the Association.

However, Samiti further observes that the Institute admitted 43 students on the basis of a combined merit list drawn from Asso-CET and MHT-CET results. I n view of the fact that the institute having opted for admission from amongst those who appeared and qualified in Asso-CET it would have been proper, just and reasonable for it to draw applicants students from amongst those who appeared for and qualified in Asso-CET. It is seen that the institute admitted 32 applicant students from amongst those who appeared and qualified in Asso-CET.

4. As far as admissions after the last CAP round was over are concerned, Samiti received four complaints from 1) Kum. Devyani Vivek Sthalekar, 2) Khan Faraz Shabbir, 3) Aayesha Liyankat Ali Khan (Deshmukh) and 4) Ruchi S. Malik. The institute vide its letter 18/03/2013 communicated that the applications from Kum Devyani Vivek Sthalekar and Ruchi S. Malik were not received by the institution. The institute also informed Khan Faraz Shabbir was in merit but was absent for counseling, therefore was not considered. The Institute further informed that

application of Aayesha I-iyankat Ali Khan (Deshmukh) was received on 21/09/2012 after the prescribed date i.e. 20/09/2012 hence was not considered.

However, Committee appointed under Government resolution No. &?- ? 0 P 3/g.%. 3 o~i/mWl- 3, dated 2gth November 2012 has found that meritorious students were denied admissions. Admissions were given to those having less niarks than Kum. Devyani Sthalekar and Aayesha Liyankat Ali Khan. It is stated that the Committee verified the claims of these corr~plainants and its findings have been confirmed in a meeting held on llth January 2013. It is also stated that in furtherance of these findings only 43 admissions were disapproved.

5. Samiti observes that the College had invited applications against the vacancies after last CAP round of admissior~ is over. The advertisement mentions therein that the prior permission will be obtained from PNS for admissions to be done from amongst the students qualified in MHT-CET. However the institute prepared a combined single merit list, admitted 32 candidates from amongst those appeared and qualified in Asso-CET. Further the institute admitted 11 applicant students from amongst those who appeared and qualified in MHT-CET.

Considering that the institute admitted students from the common merit list of Asso-CET and MHT-CET list, even otherwise it could have admitted the same students from Asso-CET even if separate merit lists were considered. We therefore come to the conclusion that it would be in the fittest of the things to consider the claim of students admitted on Asso-CET basis and whose admissions are merit based.

I n light of what has been observed in para 3, 4, 5 and 6 above, we think it fit, proper, just and reasonable to approve all the admissions those are merit based and admission of applicant students who were drawn from amongst those who were qualified in Asso-CET i.e. first 30 from the merit list of Asso-CIT. (Considering that the admissions of 02 meritorious complainants students having more marks were denied admissions as per the findings of the Enquiry Committee). Rest of the admissions stand disapproved as decided earlier. Inform all accordingly.
