    y T.V. Channels irrespective of the ownership or management control touplink from India provided they undertake to comply with the broadcast(programme and advertising) code.

    C. Setting uphardware facilities, such as up linking,HUB, etc.

    y Private companies incorporated in India with permissibleFII/NRI/OCB/PIO equity within the limits (as in the case of telecom sectorFDI limit up to 49% inclusive of both FDI and portfolio investment) to setup linking hub (teleports) for leasing or hiring out their facilities tobroadcasters.

    y Foreign investment allowed up to 49% (inclusive of both FDI andportfolio investment) of paid up share capital. Companies withminimum 51% of paid up share capital held by Indian citizens areeligible under the Cable Television Network Rules (1994) to provide

    cableTVservices.

    E.Direct-to-Home

    y Company with a maximum of foreign equity includingFDI/NRI/OCB/FII of 49% would be eligible to obtain DTH License.

    Within the foreign equity, the FDI component not to exceed 20%.

    F. Terrestrial TV

    y No private operator is allowed in terrestrial TVtransmission.

    GOVERNMENT POLICIES

    1. Duties, structure/concessions applicable to IT sector toextend to broadcast industry as technology isconverging.

    2. Exemption from service tax on advertisement revenuesimilar to that given to print sector.

    3. Removal of anomalies on service tax on subscription.

    4. Fringe Benefit Tax may be at same level as in

    pharmaceuticals and computer software industry to giverelief to TVnews channels.

    5. Inclusion of Broadcasting Industry in section 72A of theIncome-Tax Act, 1961 to provide for carry over ofdepreciation and losses incases of merger and

    acquisition of companies.

    GOVERNMENT POLICIES

    6. Soft loans may be made available to broadcast industry fordigitalization. Creation of national fund for total digitalization/zeropercent import duty on equipment import for 5 years/zero percentexcise duty for local production.

    7. Government of India may recommend to State Governments to haveuniform entertainment duty on cable/DTH services.

    8. Set up special entertainment zones/TVcities for software productionand higher export earnings.

    9. GOI to support quality training facilities in universities/institutesaround the country for HR development of media/ entertainmentindustry.
