SCOPE OF WORKChemical Storage Room Rehabilitation Project (Construction): Construct a temporary hypochlorite storage & handling containment area, temporarily relocate existing hypochlorite storage system tanks and appurtenances into the temporary containment area, connect to temporary chemical feed system constructed by Owner, demolish existing hypochlorite piping and appurtenances, demolish existing tank and pump pads, and demolish top portion of concrete in hypochlorite containment area. Install temporary chemical feed system to maintain hypochlorite delivery into the treatment process during construction. Furnish and install structural repair concrete and non-skid epoxy coating to repair and protect containment area. Provide all other appurtenances and incidentals necessary to furnish a complete and operating system.

MARIN BUILDERS ASSOCIATION AND AGRICULTURAL INSTITUTE OF MARIN CELEBRATE PARTNERSHIPDecember 10th – The Marin Builders
Association (MBA) and Agricultural Institute of
Marin (AIM) finalize a partnership that will seek
to ensure the proposed permanent Farmers
Market will be locally sourced.
The two organizations recently formalized
a Memorandum of Understanding (MOU)
that will provide the foundation for the groups
working together on the future permanent home
for the Marin Farmers Market. Details of the
agreement include the MBA leadership working
with members to identify in-kind donations
and services to assist with the construction
of the new permanent farmers market. In turn
AIM plans to formally recognize the efforts
with a permanent inscription on the building
recognizing the organization and its members,
The permanent farmers market and
educational center will make healthy, locally
grown food more accessible to people of
all ages, abilities and economic capacities;
educate eaters and farmers about sustainable
food and farming; and promote healthy eating
and local living economies. The new facilities
will enhance economic opportunities for local
contractors and small local food producers
while promoting public health. Through
increased farmers market activities and
educational programs, AIM will elevate the
visibility of sustainable food and farms, and
increase community engagement around food,
nutrition and sustainability.

Which Would Replace Proposition 30
Bill Creating Penalty for Not Calling Dig
Alert to Be Re-Introduced
With the effects of the PG&E gas line explosion
still weighing heavy on his mind because the
San Bruno tragedy was in his district, Senator
Jerry Hill plans to re-introduce legislation in
early January that will create penalties in the
law for contractors who are caught excavating
without having contacted Dig Alert to have the
site marked properly. While the legislation is
not in print yet, his chief of staff Tony Marino
has informed me that the language will be
severe enough that “no one will like it!” It
will be the senator’s hope that because it will
be so draconian, the myriad stakeholders will
all ‘come to the table’ to re-write it in a way
that results in fines, penalties and possibly an
‘excavation oversight board’ that would be
charged with hearing each and every case in
which a citation was issued. The board would
then ultimately mete out the penalties and fines.
If this board were created, it would also be
responsible for hearing cases filed against
utilities who failed to come out and mark
despite being called by an excavator, and for
mismarking that resulted in damage costs to
contractors. The bill would also remove the
current exemption that Cal Trans’ ‘enjoys’
which allows them not to have to currently
participate in the marking requirements under
the law. There is also contemplation that
homeowners would be required to call prior to
digging in their own yards.

More Information on SB 8 (Hertzberg)
Which Would Replace Proposition 30
Several weeks ago I wrote about a new bill that
was introduced, SB 8, by newly-elected (and
former Assembly Speaker) Bob Hertzberg that
would replace Proposition 30 of two years’ ago
that increased sales and use taxes. Attached is
a copy of the bill.
Senate Bill 8, the Upward Mobility Act,
would raise $10 billion in sales and use taxes
to replace the $7 billion Proposition 30 raised
largely from taxes on the wealthy. Prop. 30
was passed by voters in 2012 and was heavily
supported by Gov. Jerry Brown. Prop. 30
expires in 2018. SB8 would take effect in 2019.
Oddly, SB8 largely would target such
Democratic Party constituencies as
professionals and service-sector businesses
with more than $100,000 in gross income.
Health care and education services would be
exempted.
The money would be spent this way: $3 billion
would go to K-12 schools and community
colleges, $2 billion to the university systems, $3
billion to local governments and $2 billion to a
new earned-income tax credit for poor families.
The reasoning behind SB8 was spelled out by
columnist George Skelton:
“California is relying less on the sales tax,
which applies only to purchased goods, while
leaning heavily on the richest 1 percent, whose
incomes fluctuate like a roller-coaster.
“In 1950, the sales tax generated 60 percent
of all state revenue, the income tax just 10
percent. Today, the sales tax brings in around
25 percent, the income tax more than 60
percent.”
Under current law, the sales tax is applied to
concrete items, such as a car or computer;
food is exempt. The reasoning behind not
taxing services is that what is offered – such
as business consulting or legal advice – is
intangible. Moreover, many such services

easily could be outsourced to another state
to avoid taxation – such as hiring computer
programmers in Texas or India.
The services tax also especially would hit
small- and medium-sized businesses, such as
independent real estate brokers, auto repairmen
and handymen.
Tax boost
By costing $10 billion to the $7 billion of Prop.
30, SB8 would be a 43 percent tax boost. And
although the California economy is performing
well now, it’s impossible to say how it will be
doing four years from now.
A services tax also would encourage the
growth of black markets. For example, in
September the Los Angeles Times reported:
“Nine people were arrested in raids targeting
75 locations, and $90 million was seized — $70
million in cash. In one condo, agents found $35
million stuffed in banker boxes. At a mansion
in Bel-Air, they discovered $10 million in duffel
bags.
“Federal officials said they believe that the
drug organizations have used businesses
throughout Los Angeles to convert their vast
earnings into pesos, turning the city into a hub
for ‘trade-based money laundering.”
People in black markets obviously don’t pay
sales, income or other taxes.
GOP minority
Although Republicans remain a minority in
both houses of the California Legislature, on
Nov. 4 they gained enough new seats to prevent
a two-thirds Democratic supermajority.
All Republicans are expected to oppose any tax
increase of any kind.
So it’s the lack of a supermajority that would
prevent SB8 from being passed.
Shift to non-profit economy
Oddly, SB8 is being advanced at a time when
some tax-generating assets are being taken
off the tax rolls, also benefiting the rich at the
expense of everybody else.
One is the current shift of private electric
utilities to non-profit municipal electricity-
buying cooperatives, called Community
Choice Aggregation. Such cooperatives tout
savings to customers for avoiding taxes paid by
such regulated electric utilities as Pacific Gas
& Electric, Southern California Edison and San
Diego Gas & Electric.
Currently, 16 cities in the South Bay area of
Southern California are planning to opt out
of Edison and set up their own cooperatives,
with the wealthy cities of Redondo Beach and
Manhattan Beach leading the way. That will
be lost corporate taxes to the state and property
taxes for local government. Effectively, the
wealthy people in those areas are sloughing off
their tax obligations to those in other areas.
As reported by CalWatchdog.com, electric
buying cooperatives not only avoid paying
corporate taxes but offload expensive green
power costs onto federal taxpayers by buying
heavily subsidized green power and Renewable
Energy Credits.
The long-term experience of the State of
Illinois with electric buying cooperatives is
that they show initial benefits to customers, but
don’t make economic sense in the long term.
Assembly Bill 2145 of 2014 proposed to make it
more difficult for cities to form electric buying
cooperatives. However, it died in the state
Senate in September.

Over 4200 bills were introduced by the California Legislature
in the 2013-2014 session. Below are summaries of some of
the more important bills affecting contractors in their roles as
contractors, effective January 1, 2015 unless otherwise noted.
Many other bills will impact them in other roles, such as being
businesses, taxpayers, and employers. For MLC’s Law Note
reporting on changes in the laws affecting employers in 2015,
please visit our website’s Employment Law Notes page. Each
of the summaries are brief, focusing on the gist of the bill, while
most of the bills have additional provisions that are not men-
tioned. Links are provided to the full text of each of the bills
for those wanting to know in detail the provisions of the new
law. Lastly, reference is made to failed bills that are likely to be
revisited next session.
Retention Cap Protection
5% retention cap loophole closed. AB 1705 (Williams D)
SB 293 last year capped, through the end of 2015, public works
retention at 5% with certain exceptions including a finding by
the public entity that the project is “substantially complex”.
Entities started immediately abusing this law by finding es-
sentially every project to be “substantially complex”. This law
extends the operation of these provisions to January 1, 2018
and requires that the bid documents include details explaining
the basis for any “substantially complex” finding. This transpar-
ency will allow contractors to challenge unfounded findings and
enforce the 5% retention cap.
Design-Build
Design-build projects continue to gain ground in California.
New health care district authorized to use design-build. SB 268
(Gaines R)
Each health care district has specific duties and powers re-
specting the creation, administration, and maintenance of the
districts, including to purchase, receive, take, hold, lease, use,
and enjoy property of every kind and description within and
without the limits of the district. This law authorizes the Last
Frontier Health Care District to use this design-build process
when contracting for the construction of a building and im-
provements directly related to a hospital or health facility build-
ing at the Modoc Medical Center.
Transit design-build authority extended. SB 1433 (Hill D)
The Local Agency Public Construction Act until January 1,
2015, authorizes a transit operator, as defined, to enter into a
design-build contract, as specified. Current law requires certain
information submitted in this regard to be provided under pen-
alty of perjury. This law extends the authorization for a transit
operator to enter into a design-build contract until January 1,
2017.
Payment Bonds
Specified deposits allowed lieu of surety payment bond. AB

This law allows all bonds and notes of the United States or the
State of California and cashier’s checks, payable to the officer,
to be deposited with the officer in lieu of a bond, as specified.
Payment bond claimants may have to deal with the entity’s con-
tracting officer instead of a surety in event of nonpayment.
Prevailing Wage Contractor Protection
Contractor protected from late prevailing wage notice. AB 1939
(Daly D)
This law empowers a contractor to sue a private owner for
increased costs, including labor costs, penalties, and legal
fees incurred as a result of any decision by the Department of
Industrial Relations, the Labor and Workforce Development
Agency, or a court that classifies the project or any part thereof
as a public work after bid acceptance, contract signing, or start
of work, except under circumstances specified. This law shifts
from contractor to owner the risk if improperly failing to classify
the project as public work.
Public Works Builder’s Risk Insurance
Notice of deductible on master builder’s risk policy required. AB
2376 (Weber D)
This law requires public entities to outline in requests for bids
or proposals the contractor’s deductible under the Director of
General Services’ master builders’ risk insurance program for
state construction projects during construction.
Licensure Enforcement
CSLB gains site access and citation authority. SB 315 (Lieu D)
This law requires employers to grant free access to all places of
labor to the CSLB’s enforcement division when participating in
the activities of the Joint Enforcement Strike Force on the Under-
ground Economy. Further, the CSLB’s authorized persons are
empowered to issue written notices to appear in court.
Contractor license applicants must provide tax ID numbers. SB
1159 (Lara)
No later than January 1, 2016, this bill requires the State
Contractors Licensing Board to require an applicant to pro-
vide the Board either an individual tax identification number or
social security number if the applicant is an individual. The bill
would require the CSLB to report to the Franchise Tax Board,
and subject a licensee to a penalty, for failure to provide that
information.
Lease-Leaseback
Prequalification process required for school lease-leasebacks.
AB 1581 (Buchanan D)
Requires, until January 1, 2019, the lease instrument and the
agreement with the lowest responsible bidder to include a
requirement for the person, firm, or corporation that constructs
a building to be leased and used by the school district upon a
designated site, including, but not limited to, the prime contrac-
tor and, if used, electrical, mechanical, and plumbing subcon-
tractors, to comply with the above-described prequalification
questionnaire and financial statement requirements when the

Many other bills will impact them in other roles, such as being businesses, taxpayers, and employers. Each of the summaries are brief, focusing on the gist of the bill, while most of the bills have additional provisions that are not mentioned. Links are provided to the full text of each of the bills for those wanting to know in detail the provisions of the new law. Retention Cap Protection 5% retention cap loophole closed. AB 1705 (Williams D) SB 293 last year capped, through the end of 2015, public works retention at 5% with certain exceptions including a finding by the public entity that the project is “substantially complex”. Entities started immediately abusing this law by finding essentially every project to be “substantially complex”. This law extends the operation of these provisions to January 1, 2018 and requires that the bid documents include details explaining the basis for any “substantially complex” finding. This transparency will allow contractors to challenge unfounded findings and enforce the 5% retention cap.
Design-Build Design-build projects continue to gain ground in California. New health care district authorized to use design-build. SB 268 (Gaines R) Each health care district has specific duties and powers respecting the creation, administration, and maintenance of the districts, including to purchase, receive, take, hold, lease, use, and enjoy property of every kind and description within and without the limits of the district. This law authorizes the Last Frontier Health Care District to use this design-build process when contracting for the construction of a building and improvements directly related to a hospital or health facility building at the Modoc Medical Center. Transit design-build authority extended. SB 1433 (Hill D) The Local Agency Public Construction Act until January 1, 2015, authorizes a transit operator, as defined, to enter into a design-build contract, as specified. Current law requires certain information submitted in this regard to be provided under penalty of perjury. This law extends the authorization for a transit operator to enter into a design-build contract until January 1, 2017.

Current law provides that where the Regents of the University
of California are of the view that a project of $100,000 or less
does not require the application of all provisions of law relating
to competitive bidding by the university, the regents shall solicit
bids in writing and award the work to the lowest responsible
bidder or reject all bids. This bill raises this dollar threshold
for the cost of a project to $640,000. This bill contains other
related provisions and other existing laws.
Gas Pipeline Work Notice
Gas pipeline work notice required. AB 1937 (Gordon)
Requires a gas corporation to provide not less than 3 working
days’ notice to a school or hospital prior to undertaking non-
emergency excavation or construction of a gas pipeline when
the work is located within 500 feet of the school or hospital.
Recycled Paving Materials
Recycled paving materials use requirements. AB 2355 (Levine)
Requires, by January 1, 2017, a local agency that has jurisdic-
tion over a street or highway to 1) either adopt the standards
developed by the Department of Transportation for recycled
paving materials and for recycled base, sub-base, and pervi-
ous backfill materials, or 2) discuss at a regularly scheduled
public hearing of the local agency’s legislative or other govern-
ing body why the standards are not being adopted.
OSHA Safety Violations
OSHA violations abatement rules. AB 1634 (Skinner)
Enacts various provisions of law related to an employer’s obli-
gation to abate an alleged workplace safety and health hazard.
Prohibits the Division of Occupational Safety and Health from
granting for serious violations, abatement or credit for abate-
ment unless the employer has abated the violation or has
submitted a statement to the division in accordance with exist-
ing law, and would additionally require supporting evidence
with the statement where necessary. The bill would authorize
the division to grant such a modification only if the violation has
been abated or the signed statement and supporting evidence
is received within 10 working days after the end of the period
fixed for abatement.
Failed Bills Likely to be Revisited
Los Angeles Unified School District: best value procurement:
pilot. AB 1971 (Bocanegra D)
Would establish a pilot program to authorize the Los Angeles
Unified School District to use, before January 1, 2017, a best
value procurement method for bid evaluation and selection for
public projects that exceed $1,000,000. The bill would establish
various requirements applicable to the use of the best value
procurement method under this authorization. These provisions
would be repealed on January 1, 2020. This bill contains other
related provisions.
Public contracts: change orders. AB 2471 (Frazier D)
Would require a public entity, as defined, when authorized
to order changes or additions to the work in a public works
contract awarded to the lowest bidder, to issue a change order
promptly, and no later than 60 days after the extra work is per-
formed and documentation has been submitted, as specified.
The bill would, if this requirement is not met, make the public
entity liable to the original contractor for the completed extra
work.

A Sunshine State contractor has a Golden
State dream that is a coast-to-coast wakeup
call on waivers. First, a General contractor
with another dream wants advice on how to
obtain specialty licenses for his children’s
future…
Q: I hold a General Building license. I know
that I can handle most trades with the “B” but
would like to do some specialty work by itself.
What I’m thinking about is getting a license
to install decks and another to do construction
cleanup. In both instances, my goal is help my
kids start up a contracting business and thought
this would be a good place. Will I need to take
a test? What are your thoughts?
A: Thank you for your email. You’re correct
that a “B” can “handle most trades” – as long as
they are a part of an overall General Building
project. If you want to perform only one trade
or craft, a specialty license would generally be
required.
Both Specialties trades you mentioned
fall under the “C-61” (Limited Specialty)
classification. By definition, the CSLB has
divided these into “D” subcategories for
administrative tracking (there are currently 30
such categories). The definitions for the “D”
subcategories were developed by staff and
approved by the Board as a matter of policy.
You could apply for the “D-41” (Siding and
Decking) and “D-63” (Construction cleanup)
license with no further testing. Since the
“C-61” class does not have a trade exam, all
you would need to show is 4 or more years of
full-time experience in each of these trades. If
you’ve been performing or supervising decking
and construction cleanup under your General
license you should have little problem in quickly
securing these additions.
As for the second half of your question, if your
goal is to start a new contracting business,
you’ll need to apply for a new contractor’s
license. This new entity can be a corporation,
LLC or partnership. You could also put your
kids into business as “Sole Owners” but this
would require that you inactivate your existing
license. As for the type of business you decide
on, I would suggest consulting with an attorney
or tax professional. If you have any additional
questions on this or any other licensing matter,

Winter Preparation
In cold, wet conditions, common dangers include slips and falls, as well as vehicle accidents. Taking simple precautions can prevent accidents and injuries.
Preventing slips:
Areas that may become slick and require extra caution include stairs, ramps, tile floors, parking lots and metal parts of equipment.
• Have an excellent snow and ice removal program in place.
• Place non-skid floor mats and caution signs in slippery, high traffic areas.
• Use traction devices that strap onto shoes when conditions require them.
• Use the right shoes. Anti-slip soles are essential. Shoe soles need to have thin cuts, often called siping, that disperse water and grip the ground.
Driving safety:
• Slips can happen when entering and exiting your vehicle, so be cautious. Use a three-point stance when getting in and out of your vehicle. Use a grab-bar or doorframe for stability.
• Be aware that the vehicle itself can lose traction, causing uncontrolled skids. − When roads are slick, slow down, leave extra following distance between
yourself and other cars and do not make sudden vehicular movements. − If you begin to skid, turn the wheel in the direction you want the vehicle to go.
Ease your foot off the accelerator, and do not hit the brakes.
• Know the weather conditions you will encounter and plan ahead.
• Inspect your vehicle for proper tires and other winter driving gear.
• Be sure that chains and cold weather gear are on board and ready for use.
• Assume that roads, bridges and exits are icy, and be ready for them.
• Keep lights, windows and mirrors clean. This is especially important in low visibility situations such as darkness, ice or fog.
• If pulling over due to an emergency, increase your visibility to passing traffic. Activate the vehicle’s hazard warning lights, wear your safety vest, set up a warning triangle or flares and assume that ongoing traffic does not see you.
Remember, ice is twice as slippery at 30˚F as at 0˚F.

Gas Powered Blowers are prohibited in the City of Mill ValleyGas-powered leaf blowers contribute to noise pollution, emitting tones at levels that could lead to hearing damage.
They also contribute to air pollution, causing smog and breathing problems such as asthma.
Mill Valley Municipal Code 7.16.090 states:
“It shall be unlawful for any person to operate a gas-powered device to blow leaves, dirt or other debris off sidewalks, driveways, lawns or other surfaces within any area of the City.”
Please discontinue the use of any gas powered blower in the City of Mill Valley immediately.

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.
