TWUA PRESIDENT: Meet, Jesse Flores, City of Amarillo Norma Clark, President

Recently I had the pleasure of attending the 34th Annual TWUA Panhandle Regional School. As always, the officers (Jesse Flores, Cindy Proffitt, Larry West, Ruben Arias, and Jim Stover) and all of the volunteers did an excellent job. Thank you to all of the students and exhibitors who attended and supported this school.

Seeing the quality work that was done at the TWUA Panhandle Regional School reaffirmed my plan to use this space to feature TWUA members throughout the state. This month I would like to introduce you to Jesse Flores, who is employed with the City of Amarillo. In addition to his job, family, and being actively involved in the TWUA Panhandle Region, Jesse recently received his master’s degree.

Why did you choose this industry as your profession?

It was by luck that a friend asked me to apply when I was without a job.

What about this industry do you find the most challenging?

I feel that the most challenging thing in this industry is the number of different hats that you have to wear when working. As you grow, you find out that providing safe water to the customer is not as easy as turning on a pump and letting it do its job. You find yourself becoming proficient in areas that you never dreamed of. You have to understand a little of everything such as state regulations, federal regulations, easements, safety, maintenance, electricity, operating procedures, new designs, old designs, pumps, types of pumps, SCADA, purchasing, budgeting, drought contingency, geology, hydraulics, heavy equipment, etc. You do all of this and still maintain a professional image that is acceptable to the public.

What contributions do you feel that you have made to this industry (professional or personal)?

Personally, I think that this industry has put me at a level that I wouldn’t have been at if I worked somewhere else. Other industries usually have the resources and the

staff necessary to complete some or all of the tasks that I discussed in the previous question. Cities such as Amarillo usually operate in a lean fashion that forces staff to become proficient in areas that other industries can afford to pay individuals for.

How many years have you been in this industry?

Currently, I have 21 years with the City of Amarillo. What challenges do you see facing this industry?

There are a number of challenges that face this industry such as droughts, new regulations, old regulations, and

limited water resources. Drought is probably on the forefront more so than the others due to last summer’s drought. I don’t know how to combat drought other than to pray for rain and ask citizens to minimize their use.

What do you want to be remembered for from your involvement in this industry?

Ask me in another 20 years. I’m still working on it.

How long have you been a member of TWUA?

I have around 21 years with TWUA.

How has TWUA assisted you in this industry?

Education, education, education. TWUA has provided me the resources necessary to become knowledgeable in my field and has given me the support to keep progressing.

What changes can TWUA implement to become a better organization for our members?

I don’t see many changes needed because TWUA does a great job in educating water and wastewater operator employees. I would like to see them market the value that water and wastewater employees give to city governments.

EXECUTIVE DIRECTOR NEWS: Russell Hamilton, TWUA ED

The Austin area and parts of Texas has been very blessed by rainfall this past month.

Lake Travis is now sitting at about 46 percent. Buchannan is now sitting at about 49 percent. The lakes in the Panhandle and West Texas remain unchanged and could definitely benefit from a significant rain event and that continues to be our prayer.

I indicated last month that I would have more about Annual School. TWUA was blessed by participation and we want to thank all those who attended. The mood was positive overall. We had great instructors who volunteered their time and efforts. The Last Board Meeting, Committee Meetings, Opening Session, Awards Presentation, and the First Board Meeting all came together and was a success. Tony Salinas from San Marcos was named the incoming Vice President. We congratulate Tony and we look forward to working with him and having his input in the management committee and the association.

I want to encourage everyone to take advantage of the TWUA Regional Training opportunities in your area. The regional boards do a fantastic job bringing all the schools together and providing the operator training. The amazing thing to outsiders is these training opportunities are provided by volunteers. In some instances the instructors even donate their time and efforts. It makes you proud to be associated with this level of commitment. Thank you to all our regional officers and to those who instruct for TWUA. We absolutely could not make these training opportunities happen without you. A successful businessman with a thriving company was growing old. His health was beginning to fail and he knew it was time to name a successor to take over the business. None of his children or family had ever show any interest in the business so the businessman carefully considered his options of who should be named his successor.

His second in command was only a few years younger than the business owner and he too had health issues, so instead of choosing one of his Directors or Vice Presidents he decided to do something totally different and unexpected. He called all the management staff and young executives in his company together.

He said, “Soon it will be time for me to step down and choose the next CEO. I have decided it should be one of you.” The executives were shocked, but the boss continued. Experience, education, devotion, and knowledge wise, there are many who qualify to run this company. In addition to these areas, ”I am going to give each of you a SEED today - one very special SEED. If you desire to be considered for the CEO position, I want you to plant the seed, water it, care for it and come back here one year from today with what you

have grown. I will then judge the results and this competition will help me choose who will be the next CEO.”

One up and coming executive for the company named Jim, was there that day and he, like the others, received a seed. He went home and excitedly told his wife the story. She helped him select a beautiful pot, soil and compost. Together they planted the seed. He placed the flower pot on the window sill just above the sink so it would receive sun, and every day he would water it and watch it grow. After about three weeks, some of the other executives began to talk about their seeds and the plants that were beginning to grow.

Jim kept checking, but nothing ever grew. He even went to the store and purchased a grow light, pH meter, and plant food just to make certain that he was doing everything in his power to produce a beautiful plant from the seed that would impress the current CEO.

Three weeks, four weeks, five weeks went by, still nothing.

By now, most of the others were talking about their plants, but Jim didn’t have a plant and he felt like a failure.

Six months went by and still nothing in Jim’s pot. He just knew he must have killed his seed. Everyone else indicated they had trees and beautiful flowering plants, but he had nothing. Jim didn’t say anything to his colleagues, however, he just kept watering and fertilizing the soil - he so wanted the seed to grow.

A year finally went by and all the executives of the company brought their plants to the CEO for inspection.

Jim was very depressed and told his wife that he wasn’t going to take an empty pot. he would be the laughing stock of the company. But she encouraged him to be honest about what happened and relay all the steps he had taken. Jim felt sick to his stomach, it was going to be the most embarrassing moment of his life, but deep down he knew his wife was right. He took his beautiful, but plantless, pot, swallowed his pride and headed to the boardroom.

When Jim arrived, he was amazed at the variety of plants grown by the other executives. There were beautiful plants in all shapes and sizes. Jim put his empty pot on the floor and many of his colleagues laughed, made jokes about his “green thumb,” and a few even felt sorry for him and offered support!

When the CEO arrived, he surveyed the room and greeted his young executives.

Jim just tried to hide in the back. “My, what great plants, flowers, and trees you have grown,” said the CEO. “This is exciting; because today one of you will be appointed the next CEO!"

All of a sudden, the CEO spotted Jim at the back of the room with his empty pot on the floor in front of him, looking like someone has just shot his favorite dog. The CEO asked one of his assistants to bring Jim to the front. Jim was terrified. He thought, “The CEO knows I’m a failure! He is no doubt going to point out my failure to the entire company! Probably he will just fire me on the spot!”

When Jim got to the front, the CEO pulled him off to the side so as not to embarrass or draw attention and asked him what had happened with his seed? Jim told the story, and spared no detail as to the steps he had taken to attempt to grow something as impressive as the others there on display.

The CEO asked everyone to take a seat except Jim. He looked at Jim and then announced to everyone, It is my privilege and pleasure to introduce the company's next Chief Executive Officer!

His name is Jim! Jim couldn’t believe it. Jim couldn’t even grow his seed. “How could he be named the new CEO?” the others said.

Then the CEO said, “One year ago today, I gave everyone in this room a seed. I asked you to take the seed, plant it, water it, nurture it, and bring it back to me today. But what I did not tell you was, I gave you all boiled

seeds; they were all dead. There is no possible way for the seed that I gave you to germinate and grow. Silence filled the room and all eyes were glued to the floor.

"All of you, except Jim, have brought me beautiful plants, flowers, and trees. Sadly, when you found that the seed I provided would not grow, you substituted another seed or simply purchased a healthy plant from a nursery. Jim was the only one with the courage and integrity to bring me a pot with my seed in it. Therefore, he is the one who will be the new Chief Executive Officer and lead this company!

"Now for the part that really causes me disappointment; my final action as CEO. All of you who brought anything other than a barren pot, you have until the end of business today to pack up your personal effects and report to HR for your termination papers. Because of your actions, you have betrayed my trust and your services with this company will no longer be needed”.

Remember – We do not need all the operators in Texas to be a member of TWUA – JUST YOU ! ! !

PES NEWS: Pretreatment Standards By, Alphonse Newton, REM City of Fort Worth

The National Pretreatment Program regulations identify specific requirements that apply to all IUs, additional requirements that apply to all SIUs, and certain requirements that apply only to CIUs. There are three types of national pretreatment requirements:

• Prohibited discharge standards (include general and specific prohibitions on discharges)

• Categorical pretreatment standards

• Local limits,

Prohibited Discharges Standards

All IUs regardless of whether they are subject to the general and specific prohibitions identified in 40 CFR 403.5(a) and (b), respectively. General prohibitions forbid the discharge (the regulations use the term introduction) of any pollutant(s) to a POTW that cause pass through or interference. Pass through and interference are terms with very specific meaning in the regulations. Pass through is defined as a discharge that exits the POTW into waters of the United States in quantities or concentrations that, alone or in conjunction with a discharge or discharges from other sources, is a cause of a violation of any requirement of the POTW’s NPDES permit. Interference is defined as a discharge that, alone or in conjunction with a discharge or discharges from other sources, both (1) inhibits or disrupts the POTW, its treatment processes or operations, or its sludge processes, use, or disposal and (2) therefore is a cause of a violation of any requirement of the POTW’s NPDES permit. Specific prohibitions in 40 CFR 403.5(b) forbids the following eight categories of pollutant discharges:

• Discharges containing pollutants that create a fire or explosion hazard in the POTW, including wastestreams with a closed-cup flashpoint of less than 140oF (60oC) using the test methods specified in 40 CFR 261.21

• Discharges containing pollutants causing corrosive structural damage to the POTW, but in no case discharges with a pH lower than 5.0, unless the POTW is specifically designed to accommodate such discharges

• Discharges containing pollutants in amounts causing obstruction to the flow in the POTW resulting in interference (i.e. oil & grease)

• Discharges of any pollutants released at a flow rate or concentration that will cause interference with the POTW

• Discharges of heat in amounts that will inhibit biological activity in the POTW resulting in interference, but in no case heat in such quantities that the temperature at the POTW treatment plant exceeds 104 oF (40oC) unless the approval authority, at the POTW’s request, approves alternative temperature limits

• Discharges of petroleum oil, nonbiodegradable cutting oil, or products of mineral oil origin in amounts that will cause interference or pass through

• Discharges that result in the presence of toxic gases, vapors,

or fumes within the POTW in a quantity that could cause acute worker health and safety problems

• Discharges of trucked or hauled pollutants, except at discharge points designated by the POTW

Compliance with the general and specific prohibitions is mandatory for all IUs. The prohibited discharge standards are intended to provide general protection for POTWs. To address site-specific conditions, POTWs might also need to develop more specific limitations or additional controls to prevent pass through and interference. In addition to the prohibitions described above, IUs are also subject to categorical pretreatment standards and local limits.

Effluent Guidelines and Categorical Pretreatment Standards Development

Effluent limitation guidelines, also referred to as effluent guidelines, are national standards developed by EPA on an industry-by-industry basis, and they are intended to represent the greatest pollutant reductions economically achievable for an industry. To develop these technology-based regulations, EPA first gathers information on the industry’s practices; characteristics of discharges (stormwater flows and pollutants); technologies or practices used to prevent or treat the discharges; and economic characteristics. EPA identifies the best available technology that is economically achievable for that industry and sets regulatory requirements based on the performance of that technology. The effluent guidelines do not require facilities to install the particular technology identified by EPA; however, the regulations do require facilities to achieve the regulatory standards that were developed based on a particular model technology. Effluent limitations guidelines are implemented through the NPDES Permit Program. Discharges from direct dischargers (i.e., facilities that discharge wastewaters directly into waters of the United States) are regulated in permits that specify limits using Best Practical Control Technology Currently Available (BPT), Best Available Technology Economically Achievable (BAT), Best Conventional Pollutant Control Technology (BCT), and New Source Performance Standards (NSPS).

Pretreatment standards are implemented through the National Pretreatment Program. Discharges from indirect discharges (i.e., facilities that discharge their wastewaters to a POTW) are regulated through categorical standards issued based on Pretreatment Standards for New Sources (PSNS) and Pretreatment Standards for Existing Sources (PSES).

Industries identified as major sources of pollutants are typically prioritized for effluent guideline and categorical standards development. EPA

typically summarizes the industries it is investigating for potential rulemakings and the related data collection and reviews in its Effluent Guidelines Program Plan. The biennial plans are published in the Federal Register, and EPA solicits public comments before finalizing them. If limits are deemed necessary, EPA initiates a rulemaking, investigates affected industrial sectors, and gathers information regarding process operations and treatment and management practices, accounting for differences in facility size and age, equipment age, and wastewater characteristics. Subcategorization within an industrial category is evaluated on the basis of variability in processes employed, raw materials used, types of items produced, and characteristics of wastes generated. Availability and cost of control technologies, non-water-quality environmental effects, available pollution prevention measures, and economic effects are evaluated before EPA presents its findings in proposed development documents and publishes a notice of the proposed regulations in the Federal Register. After making any revisions reflecting public comments on the proposed rule, EPA promulgate (publishes) the standards. EPA encourages all stakeholders, including pretreatment professionals, to review EPA’s proposed categorical standards and provide data and comments during the public comment period.

As noted earlier, categorical pretreatment standards may be developed for both existing sources (PSES) and new sources (PSNS). Facilities are classified as either PSES or PSNS on the basis of the definition of new source set forth in 40 CFR 403.3(m) of the General Pretreatment Regulations. Dischargers subject to PSES are required to comply with those standards by a specified date, typically no more than 3 years after the effective date of the categorical standard. Users subject to PSNS however, are required to achieve compliance within the shortest feasible time, not to exceed 90 days from commencement of discharge. PSNS are often more stringent than PSES because of the opportunity for new sources to install the best available demonstrated technology and operate the most efficient production processes.

EPA typically does not establish pretreatment standards for conventional pollutants (e.g., BOD, TSS, oil and grease) because POTWs are designed to treat those pollutants. EPA has, however, exercised its authority to establish some categorical pretreatment standards for conventional pollutants as surrogates for toxic or nonconventional pollutants or to prevent interference. For example, EPA established categorical pretreatment standards for new and existing sources with a 1-day maximum concentration of 100 mg/L oil and grease in the Petroleum Refining Point Source Category (40CFR Part 419) based on “the necessity to minimize the possibility of slug loadings of oil and grease being discharged to POTWs.

Definition of new source[40CFR 403.3(m)]

A new source is defined at 40 CFR 403.3(m)(1) as any building, structure, facility, or installation from which there is or may be a discharge of pollutants, the construction of which commenced after publication of proposed pretreatment standards under section 307© of the act which will be applicable to such source if standards are thereafter promulgated in accordance with that section, provided that:

i. The building, structure, facility, or installation is constructed at a site at which no other source is located; or

ii. The building, structure, facility, or installation totally replaces the process or production equipment that causes the discharge of pollutants at an existing source; or

iii. The production or wastewater generating processes of the building, structure, facility or installation are substantially independent of an existing source at the same site. In determining whether these are substantially independent, factors such as the extent to which the new facility is integrated

with the existing source should be considered.

iv. 1. Construction on a site at which an existing source is located results in a modification rather than a new source if the construction does not create a new building, structure, facility, or installation meeting the criteria of paragraphs (m)(1)(ii), or (m)(1)(iii) of this section but otherwise alters, replaces, or adds to existing process or production equipment.

2. Construction of a new source as defined under this paragraph has commenced if the owner or operator has:

i. Begun, or caused to begin as part of a continuous onsite construction program (A) any placement assembly or installation of facilities or equipment, or (B) significant site preparation work, including clearing, excavation, or removal of existing buildings, structures, or facilities which is necessary for the placement, assembly, or installation of new source facilities or equipment; or

ii. Entered into a binding contractual obligation for the purchase of facilities or equipment which are intended to be used in its operation within a reasonable time. Options to purchase or contracts which can be terminated or modified without substantial loss, and contracts for feasibility, engineering, and design studies do not constitute a contractual obligation under this paragraph.

EPA has established the following types of categorical pretreatment standards for certain industrial sectors: Concentration-based standards that are implemented directly as concentration limits

Mass limits based on production rates

Both concentration-based and production-based limits

Mass limits based on a concentration standard multiplied by a facility’s process wastewater flow

Standards that allow for the use of best management practices (BMPs)

Standards that prohibit discharge of any kind.

EPA generally establishes concentration-based categorical pretreatment standards when production and achievable wastewater flow cannot be normalized on a national basis. Production-normalized, mass-based standards are calculated from production-normalized flows(volume of wastewater/production unit) and incorporate wastewater flow reductions representing BAT (which is the technology basis for PSES) or best available demonstrated technology (which is the technology basis for PSNS).

Flow-normalized, mass-based, and concentration-based standards can consider flow reduction when estimating the PSES and PSNS incremental compliance costs; however, the standards themselves do not specifically require flow reductions to maintain compliance.

The last type of mass limits described can be calculated by using a reasonable measure of the IU’s actual long-term daily production (for production-normalized, mass-based standards) or the IU’s actual long-term average daily flow rate (for flow-normalized, mass-based, concentration-based standards). EPA prefers setting production-normalized, mass-based standards, where feasible, because production-normalized limitations can account for flow reduction and reduce the potential for using dilution instead of actual treatment to reduce a concentration value in the effluent. It is interesting to find out more about who planted those footprints that we follow. I recently had a wonderful opportunity to visit a lady who has seen, first hand, how our industry was created in Texas. I speak of Marrion Ehlers Ballard. She is the daughter of V.M. Ehlers and the widow of “Doc” Ballard. My time with her was only a couple of hours, but I left her company with a much richer perspective of TWUA and theTexas water and wastewater industry.

My journey began at the 2011 TWUA Annual School in our Double A club meeting. Gene Chisum announced that Mrs. Ballard had gotten word to him that she had all of her father's and husband's old books and original notes (some dating around the turn of the century). Gene was searching for a volunteer to digitize the records for future access and archival purposes. I happened to be sitting by Joe Goodman who saw an opportunity to “thank me” for nominating him recently to be an officer in our Double A club, so he promptly raised his hand and the job was mine. I got the necessary information from Gene and I finally had the opportunity to make a trip to Tyler, Texas to meet Mrs. Ballard.

Mrs. Ballard now lives in an assisted living facility in Tyler, just a couple of miles away from where she and Doc lived. I met her in her apartment; it was complete with all the family photos you would expect to see in a proud great-grandmother’s home. Among the photos, were just a few of the multitude of awards given to Doc and her father. She and I visited for a while about the current status of TWUA, about the current challenges in the state water and sewer industry, and the status of the education of our operators. She asked if the “short school” was still at Texas A&M- I told her no, but we still maintain a good relationship with the university. After our initial visit, we headed to her home to look at the books and records.

Mrs. Ballard, I assume, is in her 80's, so I tried to be helpful by putting her address into my smartphone to use the GPS function so we wouldn’t have any trouble getting to our destination. She was very polite and admired the capability of today’s new technology and promptly guided me to her house in a more efficient way than the GPS, I then swallowed a bunch of humble pie while smiling. During the drive, she began relaying stories of her father working as the first Sanitation Engineer for Texas and how he helped build the sewer and fresh water infrastructure of communities around the state. We arrived at her home (a nice but unassuming place) and I began taking in the history of the place.

The first set of records I opened had a copy of the original blueprints of the sewer plant at Mexia from 1916; I knew this was going to be good. One by one, I opened these 90 year old records and marveled at the detail and thought that was given to all the projects listed. I saw records that detailed a typhoid outbreak and a yellow fever outbreak, and how each was remedied by installation of sewer collection and treatment. I looked through the library of text books that Doc kept. I took a look and snapped photographs of (literally) an entire wall of awards given to both of the men. When she saw my excitement over the records, my host said she had been waiting for someone to come along and truly appreciate this history and was glad TWUA could use it.

Mrs. Ballard offered to let me borrow any of the books in the library but I declined, for now, and just took the old records home with me for the project

at hand. I took this wonderful living link to our history back to her apartment and promised her I would come back to visit again.

I have been in this industry for 22 years and have been a member of TWUA for just as long. I have always seen year after year, deserving folks win the Doc Ballard award and the V.M. Ehlers scholarships, but never really gave two thoughts as to who these men were. Some of you, I may guess, actually knew or worked with them as a young professional.

All of us need to stop sometimes and take into account that there are paths blazed for us in our critical, public protecting industry. Someone had to be the first one to discover the proper way to bed a joint of pipe, or find the proper number of degrees of temperature you could safely change per day in an anaerobic digester (without having to clean up a nasty upset). V.M. Ehlers and Doc Ballard were just two of these pioneers and because of their hard work and passion for education, Texas continues to be a trendsetter in the education of water and wastewater operators.

One day, hopefully soon, I will be able to digitize some of these records and make them available to all interested operators.

Nedderman Hall is located at 406 Yates Street on the UTA Campus in Arlington, TX Course Times: Surface Water I and Pumps & Pumping are 24 hour courses and will begin on Monday, May 14th at 1:00 P.M. Effective Instructional Techniques is a 40 hour course and will be held Monday - Friday 8 am - 5 pm. All other classes will begin on Tuesday, May 15th at 8:00 A.M.

Examinations: Application forms for all examinations, except for A license exams, will be tentatively approved on-site by TCEQ personnel

on Tuesday and Wednesday until 3:00 pm in Nedderman Hall room 100. o Applications for Class A exams must be approved through the TCEQ in Austin 30-60 days prior to the Regional

School. To obtain an “A” application, call TCEQ: Water - (512) 239-6133; Wastewater - (512) 239– 0176 Exams for Classes B, C, and D, Classes I, II and III, water and wastewater licenses, as well as for Laboratory Analysts will

be given Thursday, May 17, 2012, at 1:00 PM in Nedderman Hall. o Applications for the Lab Analysts exams must be submitted to TWUA prior to the school.

Class A examinations will be offered Wednesday, May 16, 2012, at 8:00 AM in Nedderman Hall. Checks for examinations may be made payable to TCEQ-OCP. No cash will be accepted. No one will be admitted to the exams without prior submittal and approval of application, payment and positive state issued

identification. NO WALK-INS will be allowed. Water Contest: Entries for the Best Tasting Water Contest, sponsored by the North Texas Laboratory Analysts’ Chapter must be submitted at the information desk in Nedderman Hall Tuesday, May 15th before 9:00 a.m. The winner will be announced at the luncheon on Tuesday, May 15th. The winner of this contest will be eligible to compete in the statewide contest held at the TWUA Annual School the following March.
