1 MASSACHUSETTSThe information within this report highlights Department of Homeland Security and Emergency Response (DHS) information specific to the state of Massachusetts. Each section contains details specific to DHS governance, funding, and procurement, respectively. Relevant Points of Contact for Massachusetts’ DHS initiatives are provided throughout the document.

1.1 EXECUTIVE OFFICE OF PUBLIC SAFETY AND SECURITY (EOPSS)The Executive Office of Public Safety and Security (EOPSS) is responsible for strategic planning as well as the administration and management of homeland security projects and funding. The EOPSS is the designated State Administrative Agency (SAA), and as such, oversees the development and implementation of homeland security policies and the management of funds. The EOPSS collaborates with other entities in the public safety sector; private organizations; and regional and local state offices. They serve as the liaison with federal security departments including DHS and FEMA.1

The EOPSS collaborates with a wide range of stakeholders, including ten federally designated first responder disciplines in order to coordinate priorities, solicit input for homeland security strategies, and strengthen relationships:

The Executive Office of Public Safety and Security maintains the Massachusetts State Homeland Security Strategy (SHSS), which articulates a vision for homeland security and emergency preparedness in the Commonwealth of Massachusetts. “The SHSS was informed by the Threat, Hazard, Identification and Risk Assessment (THIRA) and State Preparedness Report (SPR) and it serves as a guide for state, regional, and local preparedness activities.” 3 The process is guided by three goals to assist the regions in streamlining and appropriating funds for specific planning and activities that are consistent with the state’s priorities and federal requirements. These include:4

Engage stakeholders to maintain, enhance, formalize, and integrate the various components of the homeland

Increase the ability to effectively provide prompt and accurate public information and alerts

Protect the commonwealth from intentional acts of violence and terrorism Enhance resilience across the commonwealth by preparing for and mitigating against

acts of terrorism, and natural, technological, and intentional hazard Increase capacity across the commonwealth to effectively respond to acts of terrorism,

and natural, technological, and intentional hazards Enhance capacity across the commonwealth to recover from acts of terrorism, and

natural, technological, and intentional hazards.

1.1.2 “COMPREHENSIVE EMERGENCY MANAGEMENT PLAN”The “Comprehensive Emergency Management Plan,” (CEMP) a document by the EOPSS, provides the Commonwealth of Massachusetts with a comprehensive security strategy. The CEMP is “an all hazards plan, developed, with input from stakeholders, to address the natural and man-caused hazards that threaten Massachusetts. The CEMP describes the system that will be used in Massachusetts to prevent, prepare for, respond to, and recover from an emergency or disaster. It also identifies and assigns specific areas of responsibility for coordinating resources to support the response to an emergency or disaster.”5

Within the CEMP, the “Massachusetts Emergency Support Function 13 (MAESF-13) Public Safety and Security” provides a framework for the coordination of state and local law enforcement personnel and equipment to support impacted local law enforcement agenciesin the event of an emergency or disaster.6

In planning for large-scale emergencies, a unified effort has been adopted in various initiatives including: interoperable communications; information sharing; resource management database; chemical, biological, radiological, nuclear, and explosive preparedness; and port security.

1.1.2.2 FUNDING STREAMSSince 2010, the State’s Homeland Security Grant Program (HSGP) funding has decreased significantly, creating a need to refine how grant funding decisions are made, and providing an opportunity to be strategic. The number of priority investments has been narrowed to be able to address a number of issues that can be sustained. 7

To support the state strategy and specific initiatives, Massachusetts has determined five categories to streamline funding in 2008: 8

1.1.3 EOPSS DEPARTMENTSEOPSS coordinates and funds, statewide efforts to prevent, protect, respond to, and recover from the consequences of a critical incident.9 EOPSS is comprised of numerous agencies and departments some of which are listed below. 1.1.4 OFFICE OF GRANTS & RESEARCH (OGR)This office is the arm of the EOPSS that serves as the State Administrative Agency for homeland security funds, federal criminal justice, and highway safety. They grant awards based on national and state priorities; foster collaborations by delivering grant monies with a regional approach; and they ensure that the grant awarding process is open, competitive, and compliant. The Office of Grants & Research is made of five divisions including the Homeland Security Division.10

1.1.5 HOMELAND SECURITY PLANNING REGIONSThe Regional Homeland Security planning regions were created in 2004. Five homeland security planning regions were created to receive U.S. Department of Homeland Security grant funds designated to support local governments and first responders. “Each region has a multi-disciplinary and multi-jurisdictional advisory council of first responders to ensure these funds meet the planning, organization, equipment, training, and exercise needs of the region. Funded activities must be regional in scope and must build or enhance capabilities that enable a region to prevent, protect against, mitigate, respond to, and recover from the threats and hazards that pose the greatest risks.”11

There are five councils divided by region across Massachusetts: Northeast, Southeast, Central, Western, and Metro Boston (UASI). The Metro Boston Region has been defined as one of the ten highest risk urban areas and is designated as a Tier 1 Urban Area by the Urban Areas Security Initiative (UASI). The Councils spearhead all grant program expenditures for their region in compliance with the financial and administrative requirements implemented by the Federal Office for Grants and Training and EOPSS. These councils plan and purchase investments for homeland security priorities by creating detailed project plans that are then approved by the EOPSS. Each investment has a state agency ‘driver’ who provides guidance to the councils, and in addition, reviews and gives recommendations for proposed projects.12

The main focus for these councils include:

Identification of threats and vulnerabilities within the region Plan regionally to protect critical infrastructure and key assets Training first responders and local officials Improve interoperability Intelligence gathering and information sharing Multi-jurisdiction exercises13

The Metropolitan Area Planning Council is the current fiduciary agent that oversees the expenditure of four of the regional councils; the Metro Boston Area region council receives funding from UASI monies, and thus maintains a separate fiduciary agent to manage and dispense those monies.14 The Massachusetts Homeland Security Planning Regions and Advisory Councils Newsletter of 2011 provides additional information pertaining to each regional council.

“The Western Massachusetts Region Homeland Security Advisory Council (WRHSAC) is a fifteen member, volunteer Council charged by the Executive Office of Public Safety and Security to administer and coordinate the State Homeland Security Grant for the four counties of Western Massachusetts: Berkshire, Franklin, Hampshire and Hampden. Funded activities are regional in scope and build and enhance capabilities that enable the region to prevent, protect against, mitigate, respond to, and recover from the threats and hazards that pose the greatest risks.”16

1.1.5.3 NORTHEAST HOMELAND SECURITY REGIONAL ADVISORY COUNCIL (NERAC)

The Northeast Homeland Security Planning Region contains 85 communities stretching from Ashby in the Northwest to Salisbury on the Northeastern coastal border with New Hampshire and Holliston in the Southwest. The region skirts the immediate urban, inner core of metro-Boston but also includes communities such as Arlington, Malden, Medford,

Melrose, Saugus, and Watertown, which are immediately outside of the urban inner core. In the Northeast Region, there are 1,971,945 people (747,313 households) in 1,310 square miles for an average population density of 1,505 people per square mile.18

The Southeast Regional Advisory Council Homeland Security (SRAC) is located under the Southeastern Regional Planning and Economic Development District (SRPEDD). SRAC encompasses 96 communities in the southeastern portion of Massachusetts.

“The Homeland Security Department offers administrative and fiduciary support to the Southeast Regional Advisory Council (SRAC). MOEP’s initiatives focus on enhancing the City of Boston and MBHSR’s capabilities by preventing, protecting against, responding to, and

1.1.6 MASSACHUSETTS EMERGENCY MANAGEMENT AGENCY (MEMA)

The Massachusetts Emergency Management Agency (MEMA) is responsible for coordinating federal, state, local, voluntary and private entities during emergencies. MEMA provides leadership by developing plans in response to hazards, threats or disasters; training emergency personnel; informing the public about situations; and assist the public in preparing and responding to emergencies.20

MEMA’s roles in accordance with the DHS focus on:

Perform statewide emergency management planning Advise councils on status of ongoing MEMA operational plans/projects relative to

homeland security Report on specific emergency management projects and provide resources, as

necessary, to support homeland security efforts; and Link Council homeland security goals and activities with MEMA efforts21

The reason that we are providing state allocation amounts for FY 2016 and not the most recent fiscal year (FY 2017) is because the most recent data available appears to be for FY 2016. A synopsis of each grant has been provided, including references to eligible applicants and facilitators, overall grant program funding, as well as detailed state-specific information. Urban Area Security Initiative (UASI) – Embedded within the Homeland Security Grant Program

About Grant Program: “The UASI program funds addressed the unique risk driven and capabilities-based planning, organization, equipment, training, and exercise needs of high-threat, high-density urban areas based on the capability targets identified during the THIRA process and associated assessment efforts; and assists them in building an enhanced and sustainable capacity to prevent, protect against, mitigate, respond to, and recover from acts of terrorism.”28

Fire Management Assistance Grant ProgramThe Fire Management Assistance Grant Program (FMAGP) supports states, local governments, and tribal governments in the mitigation, management, and control of fires on public or private forests or grasslands. Flood Mitigation Assistance Grant ProgramThe Flood Mitigation Assistance (FMA) program provides funding to states, territories, federally-recognized tribes, and local communities for “projects and planning that reduces or eliminates long-term risk of flood damage to structures insured under the NFIP [National Flood Insurance Program].”83

Pre-Disaster Mitigation Grant ProgramThe Pre-Disaster Mitigation (PDM) program is “designed to assist states, U.S. territories, federally-recognized tribes, and local communities in implementing a sustained pre-disaster natural hazard mitigation program. The Repetitive Flood Claims (RFC) grant program “provides funding to reduce or eliminate the long-term risk of flood damage to structures insured under the National Flood Insurance Program (NFIP) that have had one or more claim payments for flood damages.” 85 The “long-term goal of the RFC grant program is to reduce or eliminate the number of reoccurring flood insurance claims, through mitigation activities that are in the best interest of the National Flood Insurance Fund (NFIF).”86

Reimbursement for Firefighting on Federal PropertyThis program provides reimbursement to fire departments that have responded to fires on federal property.87

Public Assistance (PA) Grant ProgramThe Public Assistance program provides grants to state, tribal, territorial, and local governments, as well as certain types of private nonprofit organizations, so that communities can respond to and recover from major disasters or emergencies.88

Emergency Food and Shelter National Board ProgramThe Emergency Food and Shelter Program (EFSP) provides funding for emergency assistance in the event of a disaster situation.89

The table above highlights several preparedness grant programs offered by the federal Department of Homeland Security and FEMA. Based on our research, it appears that the Commonwealth of Massachusetts at least $35,302,501 in federal grant funding (for FY 2016) due to awards connected with these DHS/FEMA preparedness grants. The Executive Office of Public Safety and Security may have also received federal funding from other grant programs.

In addition to the preparedness grants listed in the previous table, the Assistance to Firefighters Grant is another grant that can provide funding to states for the procurement of goods and services for first responders (firefighters). The following table briefly outlines this DHS grant program.

Grant: Assistance to Firefighters Grant

Objective: “The primary goal of the Assistance to Firefighters Grant (AFG) is to enhance the safety of the public and firefighters with respect to fire-related hazards by providing direct financial assistance to eligible fire departments, nonaffiliated Emergency Medical Services (EMS) organizations, and State Fire Training Academies (SFTA). This funding is for critically needed resources to equip and train emergency personnel to recognize standards, enhance operations efficiencies, foster interoperability, and support community resilience.”90

Uses and Restrictions: “Competitive grants for the AFG program are awarded to support firefighting and EMS operations and safety, vehicle acquisition, and regional projects. Specific activities funded include professional training, wellness and fitness programs, equipment, personal protective equipment, modifications to facilities for first responder safety, other equipment and supplies that support firefighting and EMS operations and safety; firefighting vehicles, and emergency vehicles. Grants also are awarded for the Fire Prevention and Safety (FP&S) program which supports activities to protect the public from fire and fire-related hazards. Specific activities funded include general public education and awareness; code enforcement and awareness; fire and arson investigation; national, state, and regional programs and studies; and firefighter safety and research and development. Grants for the Staffing for Adequate Fire and Emergency Response (SAFER) grant program are awarded to help fire departments and

volunteer firefighter interest organizations to increase the number of frontline firefighters in their community and to enhance the capabilities of local fire departments to comply with staffing, response, and operational standards established by the NFPA and OSHA (NFPA 1710 and/or NFPA 1720 and OSHA 1910.134). Grantees must adhere to the restrictions stated in the guidance and application kit for the program and fiscal year in which they receive the award. Furthermore, as a condition of receiving an award, grantees also must agree to adhere to the award articles of agreement that require grantees to use the funds for the purpose stated in the awarded grant applications, and to meet the special conditions specified in the articles of agreement.”91

Could the Commonwealth of Massachusetts Qualify? Yes. Eligible applicants include fire departments and nonaffiliated EMS organizations operating in the 50 States, Washington D.C., the Commonwealth of the Northern Mariana Islands, the Virgin Islands, Guam, American Samoa, and Puerto Rico.92

Current FEMA records (dated April 21, 2017 at the time this report was written) report that 91 grants have been awarded nationally, to date, for the AFG grant program (FY 2016 funds). FEMA anticipates approximately 2,500 awards through this grant program and the period of performance is listed as March 2017 through March 2018.94

As of April 2017, organizations within the Commonwealth of Massachusetts claimed 65 AFG grants in Award Year 2016, totaling $11,629,175.00.95

funding directly to fire departments and volunteer firefighter interest organizations to help them increase the number of trained, “front line” firefighters available in their communities.”96

Fire Prevention & Safety Grants“The Fire Prevention & Safety (FP&S) Grants are part of the Assistance to Firefighters Grants (AFG) and support projects that enhance the safety of the public and firefighters from fire and related hazards.”97

Organizations, agencies, or entities operating within the state of Commonwealth of Massachusetts are eligible to apply for these federal grant programs. Most of these grants can be used to procure goods and services for DHS end users. The Department of Homeland Security has released an Authorized Equipment List that details the types of equipment that can be procured using grant money from various federal DHS/FEMA preparedness grant programs. For example, grant money that is associated with the State Homeland Security Program may be used to procure only certain types of equipment.

Historically, the Authorized Equipment List has been set up in a hierarchical list format. Users can navigate through the list in order to find a specific type of equipment. Each equipment record includes an Authorized Equipment List (AEL) identification number, a title, a description of the item, and a list of grants that allow for the procurement of the item. There are many different types of equipment procured by homeland security agencies and entities. Though the equipment list is quite extensive, the various commodities/equipment generally fall into the following product categories:

DHS STATE FUNDING SUB-GRANTEESThis section will discuss the pass-through requirements, relative to federal homeland security grants. In addition, sub-grantees within the state will also be addressed.

PASS-THROUGH REQUIREMENTSThe governor of each state designates a State Administrative Agency (SAA). This SAA takes on the role of a “middleman” by working with the U.S. Department of Homeland Security in order to get federal DHS grant funding to the appropriate local governments and organizations within the state. Many of the DHS grants have specialized pass-through requirements. Pass-through is defined as “an obligation on the part of the SAA to make funds available to local units of government, combinations of local units, tribal governments, or other specific groups or organizations.”99 For many of the grant programs that fall within the scope of the Homeland Security Grant Program (State Homeland Security Program, Urban Area Security Initiative, Operation Stonegarden), the state must pass-through funds within 45 days of the receipt of funds. In addition to this time constraint, each SAA must pass-through at least 80% of the grant award funding associated with the State Homeland Security Program and the Urban Area Security Initiative to local units of government. This rule applies to all states, but it does not apply to the District of Columbia, Guam, American Samoa, the U.S. Virgin Islands, and the Commonwealth of the Northern Mariana Islands.100

In addition to the Homeland Security Grant Program, there are other federal homeland security grant programs that exercise pass-through requirements, as well. This information varies from grant to grant, but these are just a few examples of pass-through requirements for well-known DHS grants. The Nonprofit Security Grant Program requires the SAA to pass-through 100% of grant funding to successful non-profit applicants within 45 days of receipt of the funds.101 With the Emergency Management Performance Grant (EMPG)

program, each state needs to obligate 100% of its total EMPG program allocation amount to the designated state-level EMA. If the SAA is also the EMA, this requirement is automatically met. If the SAA is not the EMA, then EMPG funds must be obligated to the EMA within 15 days of the grant award date.102 The Port Security Grant Program mandates that a maximum of 5% of the total award may be retained by the applicant for M&A purposes (the remaining 95% of funds is passed through to local sub-grantees).103 The same policy goes for the Transit Security Grant Program104 and the Tribal Homeland Security Grant Program105, as well.

Some federal homeland security grant programs are awarded directly to local jurisdictions, tribal organizations, and municipalities, while others are first awarded to the state and then passed down to these local entities. For those grants that are first awarded to the state (SAA) and then passed down to local sub-grantees, there are often pass-through requirements that have been established by the U.S. Department of Homeland Security to ensure that the funding gets to the right place.

1.3 PROCUREMENT INFORMATION

This section highlights Massachusetts’ process for procuring homeland security-related goods and services.

1.3.1 OPERATIONAL SERVICES DIVISION (OSD)

The Operational Services Division (OSD) is an oversight agency responsible for the procurement process for goods and services within the Commonwealth of Massachusetts. Its primary responsibilities include establishing statewide contracts on the behalf of Commonwealth public purchasers; and providing technical assistance and compliance auditing to departments in their procurement process. OSD works collaboratively with departments on Procurement Management Teams (PMTs) in sharing the responsibility for developing best value contracts for equipment and services. 106

OSD procurement groups, Procurement Team Leaders and their PMTs, manage these procurement groups through the procurement’s life cycle. This includes: initiation, RFR development, evaluation and award and monitoring contract performance. 107 Further

1.3.1.1 SMALL BUSINESS PURCHASING PROGRAM (SBPP)The SBPP’s mission is to oversee the management and acquisition for non-construction goods and services to eligible businesses. The SBPP of the Commonwealth of Massachusetts is administered by the Operational Services Division (OSD) with the support of the Executive Office for Administration and Finance.108 The OSD implements SBPP policies which direct Executive Departments to supply special consideration for the Small Business Purchasing Program’s (SBPP) development and implementation including policies, training, and annual benchmarks.109

The OSD implements SBPP guides to Executive Departments in directing notifications and awards of non-construction procurements that are valued between $5,000-$150,000 to businesses in Comm-PASS that are identified as small business program participants. 110

An SBPP-eligible business is defined as a business that:

Currently employs a combined total of 50 or fewer full-time equivalents (FTEs) Has gross revenues of$15 million or less, based on a three-year average Is independently owned and operated Has been in business for at least one year Is organized/registered to do business in Massachusetts Has its principal place of business in Massachusetts111

1.3.1.2 SUPPLIER DIVERSITY PROGRAM (SDP)The Supplier Diversity Program (SDP) is a program that was created in 2010 to promote supplier diversity in public contracting. It is housed under the Massachusetts Supplier Diversity Office (SDO) within the OSD. The program’s mission is to increase business opportunities for minority-owned (MBE), women-owned (WBE), and minority-women-owned (M/WBE), including minority-controlled (M/NPO). The SDP accomplishes this by facilitating their participation in business and economic opportunities such as certification, enforcement, business assistance and advocacy.112

1.3.2 OFFICE OF THE COMPTROLLER (CTR)The Office of the Comptroller (CTR) is an oversight department that is responsible for various aspects of the Commonwealth’s fiscal operations. CTR works collaboratively with OSD, the Executive Office for Administration and Finance, and other oversight departments to identify how financial and contractual operations are conducted between contractors and the respective departments. CTR also establishes guidelines on funds and payments for the procurement of commodities and services. 113

Grants and Subsidies: The Office of the Comptroller is the oversight department for grants and subsidies; 815 CMR 2.00 is the governing regulation. If the federal grant will result in a named partner, other than the Commonwealth, then the process for selecting the named partner must be subject to competitive procurement regulations. 114

1.3.3 PROCUREMENT MANAGEMENT TEAMS (PMTS)A Procurement Manager Team (PMT) is a team formed around broad procurement groupings. These PMTs determine how a procurement will be accomplished by conducting research, developing the procurement scope and specifications, conducting the solicitation, developing evaluation criteria, and negotiating the contract. Most members of PMTs come from departments that have an interest in those specific commodities or services. 115

1.3.4 PROCUREMENTSProcurement is the process in which the Executive Departments use to purchase commodities, equipment or services through an outright purchase, license, lease-purchase, lease, rental, fee-for-service or other method authorized by law or approved by OSD. 116

1.3.4.1 COMPETITIVE PROCUREMENTSCompetitive procurements are required for the acquisition of any commodity or service or both unless it qualifies as a competitive procurement exception under 801 CMR 21.05. 117 Authorized exceptions include emergency contracts. 118

The Commonwealth of Massachusetts does not recognize sole source procurements as they are found to be counterproductive due to the elimination of potential competitors, as well as preventing small business or minority contractors from competing. Departments must post an RFR (Request for Response) unless a procurement meets the requirements for an authorized competitive procurement exception. If the RFR elicits only one response, the department may go ahead with the contract. If more than one qualified bidder responds, then a foundation for a competitive procurement has been established. 119

1.3.4.1.1 COMMONWEALTH PROCUREMENT ACCESS AND SOLICITATION SYSTEM (COMM-PASS)

The Commonwealth Procurement Access and Solicitation System, known as Comm-PASS, is the sole vehicle through which all-public purchasers within eligible public entities and executive agencies in Massachusetts carry out transactions against statewide contracts.120 This system provides constant access to public solicitations and contract documents. In doing so, Comm-PASS has increased the amount and quality of competition for state procurements. This system expanded the number of opportunities to bid by offering all eligible public organizations access to the site’s document creation, posting and management tools for free.121

Departments are required to post the following records on Comm-PASS: 122

Announcements which are created using the Solicitation Intent to Publish (ITP) template to advise bidders of the department’s intention to bid 40 days prior to the deadline/close date for any Request for Response (RFR) for commodities and services for amounts subject to the World Trade Organization/ Government Procurement Agreement (WTO/GPA) signed by the United States and applicable to all public entities. This 40 day period can be covered by any combination of the time periods that the ITP and the RFR are posted. OSD also encourages departments to use the ITP template to publish Requests for Information (RFI).

Requests for Responses (RFRs) , which are created using the Universal template or Line-Item template to seek bids from vendors for commodities and services, including human and social services, with a total value of over $50,000 (large procurements). OSD encourages departments to publish RFRs with total values of $50,000 or less (small procurements) in order to benefit from increased competition and data management capabilities.

Contracts, which are created using the Contract template to announce awards issued by departments that result from any RFR posted on Comm-PASS.

The process is as follows: OSD issues solicitations, a vendor may bid for the contract, and then those vendors who are awarded the contract, will get listed on the Contract records Vendor(s) tab.

1.3.5.1 STATEWIDE CONTRACTSThe Operational Services Division (OSD) has developed a standard guide for how to use each statewide contract. 124

Statewide Contracts are written agreements between the Commonwealth of Massachusetts and contractor awardees to supply various commodities and services to departments and other eligible entities. Statewide contracts are developed to meet the needs of public purchasers, which include but are not limited to: Executive and Non-Executive Branch departments, municipalities, counties, public colleges and universities, local schools, state facilities, public purchasing cooperatives, public hospitals, certain non-profit organizations, independent authorities, political sub-divisions and other states. 125

1.3.5.2 EMERGENCY CONTRACTSUnforeseen circumstances as cited in regulation 801 CMR 21.05(3) may require departments to purchase commodities or services on an emergency basis. Some reasons include the avoidance of harm to the government as well as providing provisions for the health, welfare, or safety of persons.126

1.3.5.2.1 EMERGENCY RESPONSE SUPPLIES, SERVICES AND EQUIPMENTOSD has compiled a reference guide that could be used in an emergency situation called the Emergency Response Supplies, Services and Equipment: A Reference Guide to Statewide Contracts for Emergencies. It is to be utilized by departments and eligible entities to obtain supplies, services or equipment for emergency or non-emergency situations from existing statewide contracts or multi-department contracts. 127

1.3.5.3 GRANTSA grant is defined as financial assistance for a public purpose to benefit the public. Grantees are usually public, quasi-public or private non-profit entities established for the public. Grants can be used to allow departments to use resources to achieve mandates without
