Due to the impending snowstorm that took over the eastern half of South Dakota on January 23rd, the Winter Board Meeting was cancelled. Earlier this month the SDA-DA Board of Directors held a conference call meeting to discuss items from that agenda. I would like to thank all that took the time to call in and be a part of the conference call Board Meeting.

As we followed through the Board agenda, topics that merited extra discussion were:

• SDADA Report: Is there a value to continuing monthly print-ing or would it benefit us to change the publication dates quarterly or bi-monthly? You’ll notice a bi-monthly publica-tion from here forward.

• Facebook Page: Is there more value to a well-maintained Facebook page? The Board decided that SDADA should vamp up their public Facebook page, but also create a private Face-book page for dealers only to share information.

• Initiated Measures 21 and 22: The unintended consequenc-es of these measures were discusssed. They talked about the effect on dealers’ ability to finance some deals.

• Design of New Dealer Plate: As you update your plates you will notice a new look and style from the current plates.

• Annual SDADA Convention: Anyone with convention ideas please get with Michelle in the SDADA office, as that time will be here before we know it.

As this Legislative Session comes to a close I’d like to thank Myron for his time and support while in Pierre. I believe most Bills came out of this Session as we had hoped they would.

As President Trump begins to make his changes in Washington, it will be interesting to see how it plays out. Can he really get Ameri-cans to rally and work together? Can he even get his fellow Republi-cans to back his agenda? I think the new Affordable Care Act (ACA) will be a tell tail sign of unity. It is always easy to criticize and find faults in anything. When it comes down to making the needed changes, doing it right the first time around is going to be critical.

I will start by discussing and complaining about the weather in South Dakota. We have certainly had a variety of winter weather across the state. At present, I am concerned that March will never let us go; we have teaser days with rather nice temperatures only to be fol-lowed by a very cold number of days. I am tired of being cold!Well, not only did I again mentally and physi-cally survive the legislative session, the SDADA

Membership did not lose anything either. We have no increase in taxes and no increased regulation.I would like to highlight the bills that specifically have a positive effect on SDADA Members. I am also proud to report that we had a very good legislative session with a great deal accomplished.HB 1090 - A part of this bill created a carve out of IM 21 for the sale of motor vehicles. If you remember, IM 21 was specifically aimed at Dollar Loan Cen-ters and created a 36% rate cap for loans. The unintended consequence was the affect this measure had on auto loans. The passage of this bill fixed that unintended consequence.HB 1055 - If you do not know what a Polaris Slingshot is, just Google it. Basi-cally, it is a unit licensed as a motorcycle but is operated like a car. The di-lemma for dealers was that a perspective buyer needed a motorcycle endorse-ment on their driver license in order to test drive or drive a Slingshot. Effective July 1st, drivers of this unit will only need a regular driver license.SB 79 - There are a few stock models of motorcycles and many customized motorcycles that display or can display the license plates in a vertical man-ner. This practice was illegal even though 29 states allow the practice. It was viewed as a “not so welcome to SD” during the Sturgis Rally. Effective July 1st, motorcycle license plates can be displayed in any manner other than upside down.SB 69 - This was the bill we drafted and submitted for approval. Presently, when a franchised dealer chooses to title and license a unit for a loaner or other use, excise tax is due on the MSRP of the vehicle. Effective July 1st, new vehicle dealers will pay excise tax on the actual dollar figure that was paid for the vehicle just like any consumer is required to do.Two bills were vetoed by the Governor; both of which dealt with concealed weapons. HB 1072 dealt with the necessity to get a permit to carry a concealed weapon and HB 1156 dealt with opening the state Capitol Building to con-cealed carry - in other words, certain permit holders could carry a concealed weapon in the State Capitol Building. The sustaining of the Governor’s vetoes or override of these two vetoes will be considered by the legislature on March 27th. It is certainly nice to be back in my office in Sioux Falls. The mounds of paper on my desk are starting to get smaller and the staff is again getting used to my presence. It is to be hoped that it will soon be time to put the golf clubs into the car and uncover the Harley Davidson (and of course put on a new coat of wax).Until next month, stay SAFE and think Spring!

In this space last month, you may recall that I hoped that President Trump would bring some common sense to the idea of clean air standards and fuel economy. I suggested that dealers just want affordable options that serve our customers needs. If those are electric, fuel cell or other alternative energy options, that is fine.

Well, in the "Be Careful What You Ask For" file, President Donald Trump recently ordered a review of U.S. vehicle fuel-efficiency standards put in place by Obama.

The move is viewed as a victory to the auto industry and it incited criticism from Democrats and envi-ronmental groups.

While this order is simply to review the industry-wide standard of more than 50 miles per gallon by 2025 that the Obama administration and the EPA called for, it is a move widely seen as a prelude to relaxing fuel standards.

The 2011 deal called for the EPA to conduct a “mid-term review” of rules for 2022-25 by April 2018. Just before leaving office, however, Obama decided to forgo the 2018 review and ruled that no change in the regulations was warranted for 2022-25.

While Trump took this action in the name of a larger movement to pursue tax and regulatory policies that would benefit U.S. manufacturers, it has a more direct impact on ag country dealers and our cus-tomers.

As I said in my column last month, there is not a 50 MPG pickup that will do what farmers, ranchers and other commercial customers need it to do - at least not at a price point that will work for them.

I think I speak for ALL automobile dealers when I say just let us sell what our customers want at a price they can afford!

Thune Backs Autonomous Cars: Senator Thune, chairman of the Senate Commerce Committee which oversees the auto industry, supports legislation that will remove hurdles for manufacturers of self-driv-ing cars. The Senator recently had the opportunity to ride in a driverless vehicle.

The auto industry is looking for federal regulations for autonomous vehicles to avoid a patchwork of laws state by state, which would make testing difficult. The federal regulation is deemed necessary for wide availability of the self-driving vehicles.

Thune appears to be a supporter of the technology saying, “I’m a big believer that things that are cur-rently being done, tests that are being run are going to lead us to a point where ultimately someday a lot of this technology is commercialized in the marketplace and is going to achieve safer roads and increase human productivity" after a recent "test drive" of an autonomous vehicle in Washington, DC.

To close the deal on a $30,000 vehicle, the customer wrote a $10,000 deposit check, and planned to finance the rest. The dealership released the vehicle to the customer, after which they tried to process the check. They discovered the account had been closed for three months. Attempts to contact the customer and recover the vehicle were unsuccessful.
