GENERAL TERMS AND CONDITIONS OF PERMIT

1. Permits shall be valid for the term stipulated on the front of the permit unless otherwise suspended or cancelled. Extensions to the term of the permit, or other amendments, will be considered upon submission of a request to the Archaeology Branch at least 45 days prior to the expiry date of the permit.

2. The permit-holder shall provide the Archaeology Branch with one (1) bound copy, if longer than five (5) pages, and one (1) electronic copy in PDF format of a written report outlining the work carried out under the terms of the permit.

3. The title page of all reports must indicate the name(s) of the copyright owner(s) and, where agreed to, a Grant of License statement completed and signed by the copyright owner(s).

4. The permit-holder shall provide the Archaeology Branch with an updated British Columbia Archaeological Site Inventory Form for any site altered under authority of the permit.

5. A person appointed by the Branch may at any time inspect any aspect of a project conducted under the terms of this permit. To further their inspection, the appointee may request field data, or conduct excavations within the study area. Notwithstanding the expiration or earlier termination of the term of the permit this provision will remain and continue in full force and effect.

6. Where a condition for archaeological monitoring of development is attached to the permit, the permit-holder shall arrange for a secure repository to curate any materials recovered under authority of the permit.

7. Heritage objects and associated materials recovered under authority of the permit may not be sold or exchanged for financial gain. Any other transfer of heritage objects, materials and records, or changes to the conditions identified under the "Disposition of materials collected..." section of the permit, may only be carried out with prior consent of the Minister.

8. A permit does not authorize the holder of the permit to enter property, or to make any alteration to property, without the permission of the owner or occupier.

9. In the event that human remains are encountered, all work must cease in the vicinity of the remains and the Archaeology Branch must be contacted for direction, unless otherwise provided for in the permit application.

10. Where concurrent archaeological studies are required, per Section 5 of the application, an Eligible Archaeologist, as approved by the Branch, will be retained by the applicant. Any ground-altering activities must be conducted under the direction of the archaeologist.

PROJECT DESCRIPTION

1. TYPE OF SITE ALTERATION

Specify the nature of, and rationale for, alterations.

Details: Proposed alteration of EbQt-139 resulting from the Ministry of Transportation and Infrastructure’s proposed construction of an approximately 0.4 km road connecting the north end of 20th Street to the south end of Stickle Frontage Road (also known as Highway 97 Frontage Road) in Vernon. Proposed construction will impact the entirety of the lithic scatter site. Site matrices will be stripped and stockpiled within the project right-of-way. The former site area will then be preloaded to a height in excess of the required design grade. After soil stabilization, excess preload will be removed and the proposed roadway will be constructed on the remaining preload fill. After completion of construction, site matrices will be spread over the backslopes of the roadway within the site area.

Details: In April 2016, Terra Archaeology Limited (Terra) conducted an archaeological impact assessment (AIA) of proposed road construction, an extension to 20th Street, in Vernon (HCA Inspection Permit 2015-0133). Seventy–four shovel tests were excavated resulting in the recording of EbQt-139, a subsurface lithic scatter site. Twenty-eight of these shovel tests were positive, yielding 54 pieces of lithic debitage, 1 retouched flake, 3 utilized flakes, 1 non-diagnostic biface, and a Kamloops horizon projectile point in addition to unmodified faunal remains and historical debris. In late November 2016, Terra returned to the site to complete the AIA through the excavation of four 1 x 1 m evaluative units. The artifacts very closely mirror the AIA results. Fifty-six pieces of lithic debitage, 2 retouched flakes, 3 utilized flakes, 1 non-diagnostic biface, and 1 Kamloops horizon projectile point were recovered along with an assemblage of mostly historical fauna (e.g., horse, cow, sheep, and elk [with saw-cut marks]) and historical farmstead artifacts (e.g., nails, glass, and ceramic shards). Most artifacts were recovered in the uppermost 0.30 m depth below surface (dbs). The AIA indicates EbQt-139 is a moderately disturbed low-density lithic scatter with faunal remains; however, the potential for intact deposits cannot be discounted. The site is entirely within the proposed right-of-way. Proposed development activities within EbQt-139 will impact subsurface deposits, including lithic artifacts and faunal remains. Table 2. Borden Number Site Description EbQt-139 A moderately disturbed, approximately 100 m by 25 m low-

density, subsurface lithic and faunal scatter with historic refuse. Most prehistoric artifacts were identified in the upper 0.30 m dbs. Historic debris identified throughout the site suggests the area has experienced disturbance from agricultural and residential activities, and perhaps infilling with materials from the surrounding terrain. A possible occupational surface was identified in two of the four evaluative units. Both are in the northern half of the site. Artifacts collected include faunal remains, debitage, lithic tools, and two diagnostic bifaces, which have been attributed to the Kamloops horizon (200-1200 BP). The southern portion of the site is considered to be very disturbed, as the residential septic field was encountered in excavations.

5.1. Field Methods Monitoring All ground alterations occurring within site boundaries will be monitored by an on-site crew consisting of one or two archaeologists as well as members of the appropriate First Nations communities, if available and with permission of the proponent. The work will be supervised by a qualified field director. Ground alterations will be completed where possible by an excavator equipped with a finishing bucket (or smooth-edged scraping bucket). The archaeologist will guide the rate of machine excavation to allow adequate time for visual observation. Dependent upon observations made during the monitoring program, the archaeological monitoring crew may instruct the contractor to remove soil in controlled arbitrary levels (approximately 0.10 m increments). Monitoring will be terminated when the archaeologist is satisfied that basal soil horizons have been reached or sooner, if the contractor reaches depths necessary for preload operations. Matrices will be subject to careful visual examination as excavations proceed. The location for observing the excavation will be determined on an ongoing basis by the contractor in consultation with the archaeologist. Excavated materials will be moved to a location suitable to both the contractor and the archaeologist and isolated by level for inspection by the archaeological monitors. The monitoring program will include judgmental raking, trowel sorting, and screening of displaced site matrices. These activities will focus on the sediments yielding the highest density of archaeological materials: expected to be approximately 20-30 cm below surface in the northern, less-disturbed portion of the site. The approximate volume of matrices subject to raking, trowel sorting, and screening will be detailed in the report. All diagnostic artifacts identified during monitoring and associated screening will be collected. All excavated soils will remain within the project right-of-way (assessed during the AIA) until spread over the backslopes of the proposed roadway within the original site boundaries. Significant Intact Cultural Material Contingency Plan for Monitoring If significant concentrations of archaeological material or displaced elements of archaeological features are observed during any stage of ground disturbance, or closer inspection of disturbances is deemed necessary by the archaeologist, development activities will cease temporarily to allow inspection. Using a protocol to be established with the machine operator, the archaeologist will notify the operator of the need for a closer inspection of the excavation. If the inspection reveals isolated artifacts or they are deemed non-archaeological, excavation can resume. If significant deposits are encountered, the archaeologist will have the authority to temporarily halt disturbance and mitigate impacts to these significant site deposits. That is, hand tools (trowel and/or shovel) may be used to excavate the archaeological deposits in excavation units measuring at least 0.50 x 0.50 m. This will incorporate the recording of vertical and horizontal provenience of artifacts or archaeological deposits as much as is feasible. Hand excavation will be undertaken in arbitrary 0.05 m or natural levels and all material screened through 6 mm mesh. Provenience will be recorded

for all features and artifacts found in situ, and all subsurface artifacts (lithics and faunal remains) identified during emergency controlled excavations will be collected. If appropriate, stratigraphic wall profiles may be sketched for all units and a map of the distribution of these units (within the area identified as having significant deposits) will be produced. Photographic and written records of the excavation will be maintained by the field crew with all pertinent records provided to the repository. Once the archaeologist is confident the significant deposits have been collected and adequately recorded, ground disturbing activities can resume with further monitoring. Human Remains Contingency Plan for Monitoring In the unlikely event that elements of human skeletal remains are identified, all excavation activities in the vicinity of these remains will cease. The Archaeology Branch and the relevant First Nations communities will be contacted to determine the appropriate course of action. If fragmentary, isolated, intact, or semi-intact human remains are encountered, one or more meetings (either in person or via teleconference) will occur with all appropriate First Nations communities as well as the Archaeology Branch to determine a management plan for the remains which is acceptable to all stakeholders. It is important to note that management of human skeletal remains is dependent upon the condition and context of the remains as well as the wishes/requirements of the First Nations communities. In consultation with all concerned parties, efforts will be made to rebury the remains in an appropriate location near their original place of rest within the site boundary. The site record will be updated appropriately. If there is any suspicion that human remains are not archaeological, the RCMP/Coroner will be contacted immediately. 5.2. Data Analysis All subsurface artifacts (lithics and faunal remains) identified during monitoring or within emergency controlled excavations will be collected. All analysis will be conducted by suitably trained archaeologists, specialists, or technicians who will be named in the final report. Artifacts recovered during the project will be catalogued using accession numbers provided by the Royal British Columbia Museum. Relevant metrics of collected artifacts will be compiled and presented in the final report. Lithic material will be categorized according to material type and suspected function and analyzed by a qualified archaeologist. Determination of temporal and/or cultural affiliations will be made where possible. Lithic debitage will be categorized according to: material type; presence or absence of platform and cortex; and frequency. Lithic sourcing analysis may be carried out if exotic materials are encountered or if such studies are thought to provide new information regarding material types found in this area. Faunal remains will be identified to as specific a level as possible. Determination of use wear or processing indicators present within any faunal element or assemblage will be made. Determination of temporal and/or cultural

affiliations will again be made where possible. Faunal analysis will be carried out by Pacific Identifications Inc. under the supervision of Susan Crockford or by an equally qualified institution or person. If there is a reasonable expectation of the presence of ethnobotanical remains, column samples will be sub-sampled for macro- and microbotanicals (through flotation analysis) and sediment genesis studies (using sieves and/or hydrological columns). If an inventory of identified botanical remains is generated, analysis would be conducted by Dr. Sandra Peacock at UBC-Okanagan University (or by an equally qualified institution or person). When possible, dating samples (e.g., radiocarbon) will be taken if they are available in association with archaeological material, features, and/or specific strata. Samples collected may be sent outside of British Columbia for analysis. Fire altered rock will be recorded (weight or volume estimated) and reburied with the backfill. The metric and descriptive data will be compiled and presented in the final report.
