Legal Definition of Brownfields?

“…real property, the expansion, redevelopment, or reuse of which may be complicated by the presence or potential presence of a hazardous substance, pollutant, or contaminant.”*

Practical implication: Brownfields are everywhere! *(Public Law 107-118 (H.R. 2869) - “Small Business Liability Relief and Brownfields Revitalization Act”, signed into law January 11, 2002).

Our House Children’s Center – Little Rock, ARBrownfields Redevelopment Success Story

1.42 acre site on the SE corner of the former Veteran Admiration Hospital grounds.

Asbestos and lead-based paint abatement on 8,850 ft2 structure. Demolition followed – during site grading discovered three underground storage tanks (USTs).

USTs removed along with 576 tons of contaminated soil.

**Cleanup funded 100% by the EPA Pulaski County Brownfields Revolving Loan Fund Sub-grant.**

MisconceptionsOften it is the PERCEPTION of contamination or “Buyer beware;” “fear of the unknown” that keeps properties from being redeveloped, not the actual presence of contamination.

Once the “stigma” is gone, properties can be returned to productive use.

22-acre former rail yard constructed around 1914 – abandoned in the 1970s

Hispanic Economic Development Corporation (HEDC) purchased the property and enrolled in the Brownfields/Voluntary Cleanup Program to address contamination

HEDC teamed with DST Realty, Inc. to finish cleanup – Westside Business Park

$900,000 in Brownfields State Remediation and $4 million in State Historic Restoration Tax Credits

$100,000 due diligence grant

$7.1 million in HUD Section 8 Loans plus matching Economic Development Incentive Grant

$1.8 million in commercial loans

Investment and Results $2.3 million – remediation

$38.2 million – new infrastructure
