KCAG TECHNICAL ADVISORY COMMITTEE

Wednesday, April 10, 2019

CALL MEETING TO ORDER The regular meeting of the KCAG Technical Advisory Committee was called to order by Terri King, at 1:33 p.m. on Wednesday, April 10, 2019 in the Conference Room, 339 West “D” Street, Suite B, Lemoore, California. B. MINUTES It was moved and seconded (Camara / Beyersdorf) to approve the Minutes of March 13, 2019. The motion carried with McAlister abstaining.

TRANSPORTATION:

A. Congestion Mitigation and Air Quality Apportionment Exchange Memorandum of

Understanding Yunsheng Luo stated that at the January 2019 California Federal Programming Group (CFPG) meeting, staff was informed that a Federal Rescission that would affect Congestion Mitigation and Air Quality (CMAQ) funds available to Kings County based on September 30, 2019 unobligated apportionment balance may take place. Based on our current apportionment balance and the project obligation progress, the expected remaining CMAQ unobligated apportionment balance that would be subject to the Federal Rescission is $1,070,609, and represents a permanent loss to KCAG member agencies. Staff explored options to preserve the unobligated CMAQ apportionment balance to allow projects be funded when they are ready to proceed. KCAG staff has been coordinating with other

regions on this matter, and the Sacramento Area Council of Governments (SACOG) expressed their interest in the CMAQ exchange opportunity with KCAG. SACOG would take our unobligated CMAQ apportionment at the amount of $1,070,609 and pay KCAG back in the same amount in FFY 2020-21 that KCAG can use to reprogram existing projects and/or program new projects. KCAG has previously participated in exchange of funds opportunities. Furthermore, once the exchange of funds is completed there will not be any funds available for post programing changes in this federal fiscal year. There was a question whether the Buy America waiver process could delay and not allow funds to be obligated for a project. The reply was affirmative that a delay in the Buy America Waiver could be one reason funds would not be obligated. In addition, would a rescission affect the ability to advance an apportionment? The response was that the guidelines are not clear. Kevin McAlister asked for clarification regarding condition five in the Memorandum of Understanding, where it appears that if the state modifies the apportionment, then the borrower would not have to pay back the entire exchanged amount. The reply was that KCAG staff would seek clarification on this issue. It was moved and seconded (Camara / McAlister) to recommend that the KCAG Transportation Policy Committee approve the exchange of $1,070,609 CMAQ apportionment with SACOG with repayment of this amount in FFY 2020-21 and authorize the Executive Director to execute the attached KCAG-SACOG Memorandum of Understanding for the CMAQ Exchange. The motion carried unanimously.

B. Highway Infrastructure Program Funding Yunsheng Luo said that Regional Agencies were notified by Caltrans of the availability of funding from the Highway Infrastructure Program (HIP), a new program created by Congress in the 2018 Appropriation Act. For the Kings Region, KCAG is expected to receive two apportionments: $396,846 in FFY 2018 and $559,128 in FFY 2019. The FFY 2018 apportionment must be obligated by FFY 2021 and be fully expended by FFY 2026. The FFY 2019 apportionment must be obligated by FFY 2022 and fully expended by FFY 2027. HIP apportionments can be programmed in one fiscal year or be divided into multiple years to match the total apportionment. Projects using HIP funds need to be federalized by meeting all federal requirements, and HIP requires an 11.47% local match. Some of the Valley MPOs have acted on the programming or use of their HIP fund apportionments. KCAG staff recommends using these funds toward already federalized projects. KCAG is requesting that local jurisdictions provide a list of potential projects that may qualify for HIP funds. Possibly, a swap with Regional Surface Transportation Program (RSTP) funds where local city jurisdictions interested in the HIP funds can take all of the apportionment and return a certain percentage of the amount in exchanged RSTP share, or other eligible funding source. There was further discussion on how an HIP-RSTP swap may play out within local jurisdictions. However, KCAG will research the possibility of an exchange with agencies outside of Kings County. Lou Camara asked for clarification regarding how up-to-date is the RSTP distribution formula. The reply was that the RSTP formula has not changed for some time, but is based partly on federal-aid route mileage within each jurisdiction. KCAG will research other possible HIP-RSTP swap options.

C. FY 2018-19 Overall Work Program – Amendment No. 2 Mary Madrid presented Amendment No. 2 to the FY 2018-2019 Overall Work Program (OWP) as a redistribution of available funds among work elements. Caltrans will not approve reimbursement of federal funds for over expenditures. In order to correct the anticipated over expenditures of programmed federal funds, staff is proposing an amendment to the FY 2018-

2019 OWP to redistribute available federal planning funds among work elements. The OWP adjustments are summarized in the agenda packet. The total federal planning amount remains unchanged. It was moved and seconded (McAlister / Camara) to recommend that Amendment No. 2 to the FY 2018-2019 Overall Work Program be approved by the KCAG Transportation Policy Committee with the adoption of Resolution No. 19-05. The motion carried unanimously.

D. FY 2019-20 Transportation Development Act Fund Review Teresa Nickell reported that Transportation Development Act (TDA) funds are composed of Local Transportation Funds (LTF) and State Transit Assistance (STA) funds and that KCAG administers the funds available to Kings County. Allocation amounts will be revised following the release of the 2019 population estimates by the California State Department of Finance (DOF) on May 1st and any changes from previously proposed budgets. Revised claim forms will be sent to claimants after that time. KCAG has received claims and other required documentation from all member agencies. The Kings County Area Public Transit Agency (KCAPTA) held unmet transit needs public hearings during January and February 2019 meetings. The City of Corcoran held public hearings in February and April 2019. KCAG is holding unmet needs public hearings during the April and May KCAG Transportation Policy Committee (TPC) meetings. The Social Services Transportation Advisory Council (SSTAC) will hold a public meeting at the end of April to review unmet transit needs testimony. The unmet transit needs testimony received to date is included in the staff report. Approval of the TDA apportionments and allocation instructions to the County Auditor will be made by Resolution during the June Transportation Policy Committee meeting. Notices of public hearing have been posted where required and other locations. A summary of the LTF source and claims review process was provided. Available estimated FY 2019-20 LTF is $4,300,000. Lou Camara asked how it was that Corcoran has a separate bus system. The reply was that, early in process (c.1979), Corcoran decided to have their own transit system.

REGIONAL PLANNING:

A. San Joaquin Valley Annual Policy Conference

Terri King stated that the San Joaquin Valley Annual Policy Conference will be hosted by KCAG this year, at the Tachi Hotel, May 8-10, 2019. The conference will have a full program of speakers, engaging panelists, and a site visit. Attached is a registration form and flyer that provides the schedule during the conference. The session schedule will start with a presentation from the local Surf Ranch facility and end with local comedian Paul Rodriguez. Newly elected legislators, Anna Caballero and Melissa Hurtado are scheduled to be present. There will be a session on High Speed Rail pros and cons. Lou Camara asked if the Hanford station plan is final. The reply was that the state rail plan shows Amtrak service moved to the High Speed Rail line. In that case, the Corcoran and current Hanford stations are lost, and a new Hanford station would be at another location.

MISCELLANEOUS

Terri King indicated that in line with the TDA audits, KCAG has not received the audit report from the City of Corcoran, and therefore TDA funds for Corcoran are being withheld until the audit report is received. The invoice for the FY 2018-19 RSTP exchange will be submitted soon and funds should be received soon thereafter. The minutes for the STIP quarterly meeting were handed out.

The notes include work updates for the SR 41 and Bernard Dr. intersection; the Kings River bridge replacement in Stratford; completed project have been removed from the list; Caltrans is now responsible for the 19th Ave. and SR 41 interchange landscaping maintenance; and the paving of the gore area, and bridge embankment along SR 41 bridges and exits between Hanford and Lemoore. Caltrans provided a map of existing and proposed 10-year SHOPP projects for information. Some MPO will be submitting comments regarding SB152, which is about redistribution formula of Active Transportation Program fund. The bill calls for 75% distribution to ten large MPO’s, 10% statewide and 15% to rural areas. There is another housing bill that blocks grants for cities that do not meet the housing needs. Based on the release of white papers at the CSAC conference, there was a question regarding talk on whether LTF monies should be spent on streets and roads. The reply was that KCAG will monitor the issue. Christopher Xiong spoke regarding the Pavement Management System (PMS) project. Due to the weather, the project should start in early May 2019. The contract for the Electric Vehicle Readiness plan is being finalized. Yunsheng Luo talked about the Regional Corridor Study involving SR41, SR43, and SR198. Caltrans is assisting with finalizing the Request for Proposal (RFP). KCAG requests that staff from Hanford, County of Kings, and Lemoore sit on the RFP review committee. Teresa Nickell reported that a consultant is working on the Regional Transit Asset Management Plan. Staff is reviewing draft audits for the Triennial Performance Audit. Project lists for the State of Good Repair funds are due July 2019. The RFP for the Corcoran Fixed Route Study is being reviewed. Today there was a demo of an electric bus at the KART bus yard in Hanford. Mary Madrid mentioned staff is waiting on the Corcoran audit report and is working on the Caltrans Third Quarter report. In addition, staff is working with Caltrans to obtain the funds for the cooperative agreement related to the SR198 and 9th Ave interchange. Terri King stated that the monitoring reports for prior years (FY 2017-18) need to be submitted before the RSTP exchange funds can be distributed. Amanda Champion, the new Lemoore Management Analyst, introduced herself. She has been working for the City of Lemoore for over five years. Linda Beyersdorf stated that she is now the Finance Manager for Lemoore and noted that Lemoore is out to bid on the Public Facilities Maintenance District. Kevin McAlister reported that there is ongoing construction at the County Government Center for a project to bring the sidewalk in compliance with ADA standards. The project will later extend to Armona and Stratford. The county is installing overhead solar panels in parking lots. The 16th Ave. and Tulare Lake Canal bridge project is moving forward under protest that the Federal Fish and Wildlife are claiming jurisdiction on this irrigation canal as a tributary of the San Joaquin River, 40 miles away. The 17th Ave. and Houston Ave. traffic signal progress is being monitored. The county will soon release a Request for Proposal on the roundabout project at Grangeville Blvd. and 22nd Ave. Lorena Mendibles thanks KCAG staff for the Overall Work Program submittal. Caltrans has submitted their comments on the OWP. Lou Camara said the FY 18-19 fiber seal project, estimated to cost $1.5 million, will be presented to City Council. The 13th Ave. and Grangeville Blvd. traffic signal project will be awarded soon. The utility relocation for the Hanford Armona Road and Irwin Street traffic signal project will start this month. The Hanford Airport runway will be resurfaced later this fall. Hanford is working on a feasibility study for the Grangeville Blvd. and BNSF Railroad grade separation project. It was suggested to research possible funding through federal INFRA grants for the grade separation

project. The city continues work on the Lacey Blvd. master street plan and right-of way acquisitions. Anthony Lopez reported that Avenal is starting construction on the outdoor fitness court, next to the boxing gym. The city is planting 155 trees throughout the city. Avenal anticipates starting construction of the community center this summer. The main water line will be replaced this year. Troy Hommerding stated that Environmental Health Department continues to work with Hazardous Material issues. The department is working on mobile vendor parking issues with city limits. High Speed Rail route may pass through closed landfill areas, but it is too early to know. Kevin McAlister asked if any other agency had received the PG&E bankruptcy filing papers. The bankruptcy may affect franchise payments. No other agency had received any information. There is the question of whether franchise agreement transfers will be honored with the sale of any utility line.
