6. The following shall be submitted to the Commission within thirty (30) days after completion of work: /

a. Well completion report (Part I, attached). b . ./ Elevation (referenced to mean sea level, msl) survey by a Hawaii-licensed

surveyor. As-built sectional drawing of the well. Plot plan and map showing the exact location of the well. Complete pumping test records, including time, pumping rate, drawdown, chloride content, and other water quality data.

7. The permittee shall comply with all applicable laws, rules, and ordinances.

8. The well construction permit application and staff submittal approved by the Commission at its March 13, 1996 meeting are incorporated into the permit by reference.

9. The permit may be revoked if work is not started within six (6) months after the date of approval or if work is suspended or abandoned for six (6) months, unless otherwise specified. The work proposed in the well construction permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Commission upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Commission no later than three (3) months prior to the date the permit expires. If the commencement or completion date is not met, the Commission may revoke the permit after giving the permittee notice of the proposed action and an opportunity to be heard.

10. Special conditions in the attached cover transmittal letter are incorporated herein by reference.

Certificate of Pump Installation Completion for Well No. 5616-02 (TMK: 2-8-003:041)

Thank you for your letter dated May I, 2008, noting the transfer of the captioned well to you, and requesting a transfer of its certificate. We understand that you are now the current owner of the Hea'a'ula-Martin Well (Well No. 5616-02) and welcome you as a new member to the community of well owners and groundwater users in Hawaii. We have noted for the file that it is now the "Strini Well".

To protect Hawaii's natural ground water resources for the benefit of all, the following requirements apply to the use of your well:

I. If the well is not in use it must be properly capped.

2. If the well is to be abandoned then the landowner must cause a licensed contractor to apply for a well abandonment permit in accordance with §13-168-12(£) prior to any well sealing or pi ugging work.

3. In the event that the well operator and/or landowner changes, the Commission shall be notified of the change prior to the change, and all forms shall be transferred to the new owner.

4. In the event the benchmark in the concrete base of the well is altered in any way, an updated elevation survey (page 5 of the Well Completion Report Part I) shall be submitted to the Commission. The Well Completion Report Part I can be obtained by contacting staff or at www.hawaii.gov/dlnr/cwrrn/forms.htm.

5. Your approved pump has a capacity of 20 gpm at a head of 180 ft. In the future, pump replacements of equal or lesser capacity will not require an additional permit from the Commission, but will require the submission of a Well Completion Report Part II by the licensed pump installer. If the pump replacement is greater than the existing pump, you will need to apply for a new pump installation permit.

6. The landowner shall cause the well operator to maintain the installed meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on an annual basis, on forms provided by the Chairperson (attached), in accordance with § 13-168-7, HAR.

7. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. The authorization to drill a well and/or install a pump shall not constitute a determination of correlative water rights. The landowner and well operator are notified that the quantity of water taken from the well and/or the pump capacity could be reduced by the Commission in the future.

8. In the event that your installed pump is less than 70 gallons per minute, and no elevation survey has been completed, you may be required to do one in the future.

Because groundwater in Hawaii is a public trust, and adverse effects at one well may affect other water resources, any violation of the above conditions, or any other provision of the Hawaii Administrative Rules, may be subject to fines of up to $5,000/day. The Commission needs your help and asks that you to do your part in utilizing this shared resource. We prefer to work with you in meeting the goal of protecting our ground water resources together.

MEMO To File Illegal Well Drilling

Mike Robertson returned my call today, and commented at length on two matters

1) Illegal driller of at least three known wells where Mike has done work for others. This is the driller we have identified at Don Wilburn, who says he brought a rig from New Mexico and was "practicing" on his property in Honopou.

Mike says the other three wells were a) down Hanawana Road (no TMK or other specific ID; b) Ho'olawa (same lack of specific info); and c) the Donald O'Conner well in Manawai (TMK 2-4-3:44).

Mike is concerned and frustrated because well owners for whom Mike has done work are now at risk for contamination; and because the guy on the Big Island got fined big-time and this other guy is going free. [I mentioned that we're not done yet, and that getting the relevant info to move foreward has been frustrating. Wilburn was to have submitted WCRs for the well we identified, by 30 Sep 05, and they have not arrived.] Mike notes that improper construction standards means that three separate neighborhoods have been potentia II contaminated.

2) The current "test pumping" to remove pesticides from Peahi Farms wells. Mike drilled three wells for Ron Serle (Opana Pt. 1& 2, Stream Resources #3- 5617-02, 03, & 04) and these two wells for Rick Holt (Holt #1 & 2- 5517-05, 5617-05).

Before Mike was able to get started on the Holt Wells, the well owner was trying to get a test well done to draw a water sample for his investors' information [news articles place the purchase price of this development at $3.5 M.] As Mike was unavailable, the hydrologist Tom Nance was able to line up Tom Pica to do the work. The work was done without a permit [no WCPIA was ever received for such a well, described by Mike as -100 feet from the Holt Well #1 (Well No. 5517-05), at-400ft. el.]. About halfway down, around 200 feet, Pica got his gear jammed in a hard layer, and blasted it loose (not illegal), but Mike believes some of the gear is still down there, and that the well was not properly sealed. Bulldozing has since eliminated trace of the well's location.

Mike had done the Serle wells earlier and was aware that a hard rock layer above the basal lens had perched water with pesticide contamination. The water had been tested- that's how he knows. After grouting off that section, he continued drilling to basal water, and pumped for a period of time to clear the pesticides from the well bore and immediate vicinity. The subsequent testing showed the water to be clear of contamination.

Mike told Holt that it would be desirable to pump the wells continuously for a week to purge contaminants from the groundwater. He is concerned that the Pica well continues to conduct contaminants to the basal lens. [We are told that Holt's current pumping is actually the

second effort, and that if a third is required, he will do it again. This suggests that the contamination is not acute but chronic, suggesting that it is not from the properly grouted well bore but from another source, possibly the Pico well; it may also be directly from pineapple cultivation.

I've inquired with Safe Drinking Water Branch, and they indicate they have no rules against dynamiting in a well. We also have no prohibition in our standards.

PUMP INSTALLATION PERMIT

Heaaula-Martin Well, Well No. 5616-02

In accordance with Department of land and Natural Resources, Commission on Water Resource Management's Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works". this document permits the pump installation for Heaaula·Martin Well (Well No. 5616-02) at Heaaula, Maui, TMK 2-8-3:18, subject to the Hawaii Well Construction & Pump Installation Standards (1/23/97) which include but are not limited to the following conditions:

1. The Chairperson to the Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, at feast two (2) weeks before any work covered by this permit commences and staff shall be allowed to inspect installation activities in accordance with §13-168-15, Hawaii Administrative Rules.

2. The pump installation permit shall be for installation of a 20 gpm capacity, or less, pump in the well.

3. The permittee shall provide and maintain an approved meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on an annual basis, on forms provided by the Chairperson (attached).

4. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to pump water from a well shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a commitment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.

5. The permittee shall complete and submit as-built drawings and Part II -(Permanent) Pump Installation Report of the Well Completion Report (attached) to the Chairperson within sixty (60) days after completion of work.

6. The permittee shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation of this permit.

7. The pump installation permit application is incorporated into this permit by reference and is subject to the Hawaii Well Construction & Pump Installation Standards (1/23/97).

8. The permit may be revoked if work is not started within six (6) months after the date of approval or if work is suspended or abandoned for six (6) months, unless otherwise specified. The work proposed in the pump installation permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than three (3) months prior to the date the permit expires. If the commencement date is not met, the Commission may revoke the permit after giving the permittee notice of the proposed action and an opportunity to be heard.

9. If the well is not to be used it must be properly capped. If the well is to be abandoned then the permittee must apply for a well abandonment permit in accordance with §13-168-12(f) prior to any well sealing or plugging work.

MEMO To File Illegal Well Drilling

Mike Robertson returned my call today, and commented at length on two matters

1) Illegal driller of at least three known wells where Mike has done work for others. This is the driller we have identified at Don Wilburn, who says he brought a rig from New Mexico and was "practicing" on his property in Honopou.

Mike says the other three wells were a) down Hanawana Road (no TMK or other specific ID; b) Ho'olawa (same lack of specific info); and c) the Donald O'Conner well in Manawai (TMK 2-4-3:44).

Mike is concerned and frustrated because well owners for whom Mike has done work are now at risk for contamination; and because the guy on the Big Island got fined big-time and this other guy is going free. [I mentioned that we're not done yet, and that getting the relevant info to move foreward has been frustrating. Wilburn was to have submitted WCRs for the well we identified, by 30 Sep 05, and they have not arrived.] Mike notes that improper construction standards means that three separate neighborhoods have been potential! contaminated.

2) The current "test pumping" to remove pesticides from Peahi Farms wells. Mike drilled three wells for Ron Serle (Opana Pt. 1 & 2, Stream Resources #3- 5617-02, 03, & 04) and these two wells for Rick Holt (Holt #1 & 2- 5517-05, 5617-05).

Before Mike was able to get started on the Holt Wells, the well owner was trying to get a test well done to draw a water sample for his investors' information [news articles place the purchase price of this development at $3.5 M.] As Mike was unavailable, the hydrologist Tom Nance was able to line up Tom Pica to do the work. The work was done without a permit [no WCPIA was ever received for such a well, described by Mike as -100 feet from the Holt Well #1 (Well No. 5517 -05), at-400ft. el.]. About halfway down, around 200 feet, Pica got his gear jammed in a hard layer, and blasted it loose (not illegal), but Mike believes some of the gear is still down there, and that the well was not properly sealed. Bulldozing has since eliminated trace of the well's location.

Mike had done the Serle wells earlier and was aware that a hard rock layer above the basal lens had perched water with pesticide contamination. The water had been tested -that's how he knows. After grouting off that section, he continued drilling to basal water, and pumped for a period of time to clear the pesticides from the well bore and immediate vicinity The subsequent testing showed the water to be clear of contamination.

Mike told Holt that it would be desirable to pump the wells continuously for a week to purge contaminants from the groundwater. He is concerned that the Pica well continues to conduct contaminants to the basal lens. [We are told that Holt's current pumping is actually the

second effort, and that if a third is required, he will do it again. This suggests that the contamination is not acute but chronic, suggesting that it is not from the properly grouted well bore but from another source, possibly the Pico well; it may also be directly from pineapple cultivation.

I've inquired with Safe Drinking Water Branch, and they indicate they have no rules against dynamiting in a well. We also have no prohibition in our standards.

This includes ensuring that the pump installation contractor, or other party who installs the pump, submits a completed Part II of the Well Completion Report form (enclosed) within sixty (60) days after the pump installation work is completed. PUMP INSTALLATION PERMIT

Heaaula-Martin Well. Well No. 5616-02

In accordance with Department of Land and Natural Resources, Commission on Water Resource Management's Administrative Rules, Section 13-168, entitled 'Water Use, Wells, and Stream Diversion Works~. this document permits the pump installation for Heaaula-Martin Well (Well No. 5616-02) at Heaaula, Maui, TMK 2-8-3:18, subject to the Hawaii Well Construction & Pump Installation Standards (1123/97) which include but are not limited to the following conditions:

1. The Chairperson to the Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, Hl96809, shall be notified, in writing, at least two (2) weeks before any work covered by this permit commences and staff shall be allowed to inspect installation activities in accordance with §13~168-15, Hawaii Administrative Rules.

2. The pump installation permit shall be for installation of a 20 gpm capacity, or less, pump in the well.

3. The permittee shall provide and maintain an approved meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on an annual basis, on forms provided by the Chairperson {attached).

4. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to pump water from a well shall not constitute a determination of correlative water lights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a commitment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.

5. The permittee shall complete and submit as-built drawings and Part II - {Permanent) Pump Installation Report of the Well Completion Repcrt {attached) to the Chairperson within sixty {60) days after completion of work.

6. The permittee shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation of this pemit.

7. The pump installation permit application is incorporated into this permit by reference and is subject to the Hawaii Well Construction & PurT\' Installation Standards (1/23/97).

8. The permit may be revoked if work is not started within six {6) months after the date of approval or if work is suspended or abandoned fcf six {6) months, unless otherwise specified. The work proposed in the pump installation permit application shall be completed within two (2) years from the date of permit approval, unless otheiWise specified. The permit may be extended by the Chairperson upon a showing of goOO cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than three (3) rTK>nths pricr to the date the permit expires. If the commencement date is not met, the Commission may revoke the permit after giving the permittee notice of the proposed action and an opportunity to be heard.

9. If the well is not to be used it must be proper1y capped. If the well is to be abandoned then the permittee must apply for a well abandonment permit in accordance with §13-168-12(f) prior to any well sealing or plugging work.

10. Special conditions in the attached cover transmittal letter are incorporated herein by reference.

Enclosed are two (2) copies of your approved Pump Installation Permit for the captioned well(s). As part of the Commission's approval, the following special conditions were added and are part of your permit:

Special Conditions

I. No permanent monitor tube is required. 2. The long-term continuous test shall be at least 8 hours. 3. No step-drawdown test is required.

The Chairperson shall approve and issue a pump installation permit upon acceptance of aquifer pumping test results required in Condition 6e, subject to the standard permit conditions and the following special conditions:

1. The well should not be used for drinking water unless it is properly tested and treated.

2. If potable water is used to supply both domestic and irrigation purposes in a single system, the permittee shall eliminate cross-connections and baclcflow connections by physically separating potable and non-potable systems by an air gap or an approved backflow preventer, and by clearly labeling all non-potable spigots with warning signs to prevent inadvertent consumption of non-potable water.

In accordance with Department of Land and Natural Resources Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", this document permits the construction and testing of Heaaula-Martin Well (Well No. 5616-02) at Heaaula, Makawao, Maui, TMK 2-8-3:18, subject to the following conditions:

STANDARD PERMIT CONDITIONS

1. The Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, before any work by this permit commences.

2. The well construction permit shall be for construction and testing of the well only. A minimum one-inch diameter monitor tube shall be permanently installed, in a manner acceptable to the Commission, to accurately record water levels. The permittee shall coordinate with the Commission and conduct a pumping test in accordance with the attached Aquifer Pump Testing Procedure. The permittee shall submit to the Commission the test results as a basis for supporting an application to install a permanent pump and withdraw water for use. 3. The permittee shall incorporate mitigation measures to prevent construction debris from entering the aquatic environment, to schedule work to avoid periods of high rainfall, and to revegetate any cleared areas as soon as possible.

4. In the event that subsurface cultural remains such as artifacts, burials or concentrations of shells or charcoal are encountered during construction, the permittee shall stop work and contact the Department's Historic Preservation Division ( immediately.

5. The proposed well construction shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct the well shall not constitute a determination of correlative water rights.

7. The permittee shall comply with all applicable laws, rules, and ordinances.

Agency Review: The application was published in the Commission's Water Resource Bulletin in December 1995; review letters were sent to the Department of Health's Safe Drinking Water and Wastewater Branches. The Safe Drinking Water Branch recommends that potable water wells such as this one not requiring Department of Health approval be tested for bacteriological and chemical presence and be routinely monitored thereafter. In similar situations, that Branch has also specified that potable and irrigation applications using the same source be equipped to prevent backflow from non-potable to potable systems, and labelled to prevent inadvertent consumption of non-potable water.

Staff Submittal March 13, 1996

Staff review: The proposed well would tap fresh basal ground water. Proposed use is approximately 1000 gallons per day for household use and irrigation of a parcel covering acres. There are two mauka wells within one mile, one at one-third mile and one at one­half mile, on the opposite side of the ridge flat. The small withdrawal is not expected to impact these wells. The proposed well is near a gulch about one-third mile above the mouth; earlier comment from the Division of Aquatic Resources has resulted in a standard Condition #3 to prevent construction debris from entering the aquatic environment.

RECOMMENDATION:

A. That the Commission approve the issuance of a well construction/pump installation permit for Heaaula-Martin Well, subject to the standard permit conditions in Exhibit 3 and the following special conditions:

1. No permanent monitor tube is required.

2. The long-term continuous test shall be at least 8 hours.

3. No step-drawdown test is required.

B. That the Commission authorize the Chairperson to approve and issue a pump installation permit upon acceptance of aquifer pumping test results required in Condition 6e, subject to the standard permit conditions in Exhibit 3 and the following special conditions:

1. The well should not be used for drinking water unless it is properly tested and treated.

2. If potable water is used to supply both domestic and irrigation purposes in a single system, the permittee shall eliminate cross<onnections and backflow connections by physically separating potable and non-potable systems by an air gap or an approved backflow preventer, and by clearly labeling all non­potable spigots with warning signs to prevent inadvertent consumption of non-potable water.

STANDARD WELL CONSTRUCTION PERMIT COl\'DITIONS

I. The Commission shall be notified two weeks before work commences, to facilitate monitoring.

2. The well construction permit shall be for construction and testing of the well only. A minimum one-inch diameter monitor tube shall be permanently installed, in a manner acceptable to the Commission, to accurately record water levels. The permittee shall coordinate with the Commission and conduct a pumping test in accordance with the attached Aquifer Pump Testing Procedure (Exhibit 4). The permittee shall submit to the Commission the test results as a basis for supporting an application to install a permanent pump and withdraw water for use. No permanent pump may be installed until a pump installation permit is approved and issued by the Conunission.

3. The permittee shall incorporate mitigation measures to prevent construction debris from entering the aquatic environment, to schedule work to avoid periods of high rainfall, and to revegetate any cleared areas as soon as possible.

4. In the event that subsurface cultural remains such as artifacts, burials or concentrations of shells or charcoal are encountered during construction, the permittee shall stop work and contact the Department's Historic Preservation Division (587 -0045) inunediately.

5. The proposed we11 construction shaH not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct the we11 shaH not constitute a determination of correlative water rights.

6. The fo11owing shaH be submitted to the Commission within thirty (30) days after completion of work:

a. We11 completion report. b. Elevation (referenced to mean sea level, msl) survey by a Hawaii-licensed

surveyor. c. As-built sectional drawing of the well. d. Plot plan and map showing the exact location of the well. e. Complete pumping test records, including time, pumping rate, drawdown,

chloride content, and other water quality data.

7. The permittee shall comply with alJ applicable laws, rules, and ordinances.

I. The Conunission shall be notified before work conm1ences.

2. The pump installation permit shall be for installation of a 20 gpm capacity, or less. pump in the well.

3. The permittee shall provide and maintain an approved meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured and report to the Commission on a monthly basis, on forms provided by the Commission (attached).

4. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to pump water from a well shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a commitment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.

5. The pump installation portion of the Well Completion Report and as-built sectional drawings of the pump installation shall be submitted to the Commission within thirty (30) days after completion of work.

The pwnJ? test procedure for new wells shall consist of a step-drawdown test followed by a long_-term contlnuous aquifer test. Testing the well and aquifer in the presmbed manner should result in the hydrologic information needed to determine: 1) the well's performance with re&ard to yield and water quality (chloride concentration), and' 2) the nearby hydraulic propemes of the aquifer.

General Recording Requirements

Discharge from the well shall not fluctuate beyond ~ 10 percent.

Depth to water measurements in the pumped well shall be accurate to 0.01 feet.

Time shall be accurate within ~ 1 percent.

Water discharged from the well during the step-<irawdown and long-term test shall be carried away from the well to a distance sufficient to preclude circulation of the discharge water downward to the ground-water table.

Recording of data should be on a form sinu1ar to Table 1. All information shown in Table 1 shall be provided. In addition, data shall be plotted on Graph 1 and provided.

Step-Drawdown Test

The purpose of the step-drawdown test is to establish the efficiency of the well and to provide prellmiitary information on the yield of the well, borh from a quantity and quality standpomt.

1. Measurement of water level in the pumped well shall be made evezy 12 hours for a period of no less than two days prior to the initiation of the step-illawdown test in order to obtain the pretest trend in water levels.

2. The step-drawdown test will consist of continuously pumping the well for four hour; at four different rates.

Each pumping rate should be continued for one hour, af1er which the new rate should be instituted as rapidly as possible.

Pumping should begin at tl1e lowest rate and conclude with the highest rate.

Pumping should be continuous through the entire step-drawdown test.

Measurement of chloride concentration and temperature of the discharge water shall be measured at least five times:

a. at the end of each pumping rate during the step-drawdown test, and

b. at the very beginning of the test.

A sufficient number of water level measurements shall be made in the pumped well following_ the termination of the step-drawdown test to establish that the water level fully recovers from each test to pretest levels.

Long-Term Continuous Test

The purpose of the long-term continuous test is to determine the hydraulic properties of the aquifer to explore for and tdentify nearby aquifer boundaries such as streams or dikes, and to observe the trend in chloride concentration of the discharge water.

The lopg-term test should not commence until the water level in the pumped well has fully recovered from the step-drawdown test. Generally, the time required for this recovery will be slightly greater than four hours. The water level in the pumped well should be measured immediately before initiation of the long-term test.

The pump rate for the long-term test should be sufficient to create an observable drawdown.

The test should be run 24 hours per day for at least seven days. If during the test, the water level remains the same for a period of 24 hours, the test can be terminated.

Measurement of chloride concentration and temperature of the discharge water during the long-term test shall be made at the beginning of the test and every six hours thereaf1er.

Depth to water in all wells shall be measured with sufficient frequency that each lo11arithmic cycle in time on the data plots (Graph 1) contains at least 10 data ~mts spread through the cycle. Thus, depth to water should be made at t=O (immediate!)' prior to start of the test), and as close as possible at t=l, 1.51 2, 2.5, 3, 4, 5, 6, 7, and 8 minutes for the first ten minutes and at all succeedmg decimal multiples of these numbers to the end of the test (t=lO, 15, 20{ 25, 30, 40, SO, 60, 70, and 80 minutes for the log cycle 10 to 100 minutes, etq

Thank you for the opportunity to review and comment on the Well construction/Pump Installation Permit Applications for:

l) Ulupalakua-Esty Well (Well No. 3723-01)

2) Kipahulu-Nicoll Well (Well No. 3904-06)

3) Heaaula-Martin"Well (Well No. 5616-02)

Federal and state regulations define a public water system as a system that serves 25 or more individuals at least 60 days per year or has at least 15 service connections. All public water system owners and operators are required to comply with Hawaii Administrative Rules, Title 11, Chapter 20, Rules Relating to Potable Water Systems.

The application indicates that this will be a new source of potable water. section 11-20-29 of Chapter 20 requires that all new sources of potable water serving a public water system be approved by the Director of Health prior to its use. Such an approval is based primarily upon the submission of a satisfactory engineering report which addresses the requirements set in Section 11-20-29.

The permit application indicates that the source will be used for potable water and irrigation. If the well doesn't provide water to a public water system, I recommend the private owner perform bacteriological and chemical analyses prior to useage as a drinking water source and thereafter perform routine analyses to monitor the water quality. The potable water system shall be protected with proper backflow prevention devices to prevent cross connections between the potable water and irrigation water line.
