As I look out my window while writing this January article for the LIBA Magazine, it is pouring down rain. We had lots of snow in November and so little in December. The warmer weather we’ve had this last week reminds me of my grade school days. My

parents generally drove my brothers and I to and from school (2 ½ miles from home), although, during busy times, if no one arrived in ½ hour after school was out we would start walking home. This was the last day of school before the holidays. We had left home in the morning in heavy coats, scarves, and gloves. The day became very warm, almost hot, and we were shedding our coats and dragging them while walking home (not a good thing to do, I learned). The next day was December 23rd, and we were getting excited because Santa always came to our house on Christmas Eve…a day away. That evening the wind began to blow and by the time we came in from chores, it was getting colder and colder and starting to snow. Later that night, it began to sleet and snow harder. The wind howled, and you could hear sleet hitting against the windows. By morning, the snow was piled high in huge drifts,

our road was closed, and it looked like a winter wonderland. By late afternoon the snowplow had come through and opened a single path in the snow. Our church Christmas program was that night and we made it to church using dad’s old pickup with chains on. My dad told us, the weather was so bad he didn’t think Santa would make it this year. We were crushed.

When we arrived at home, we ran into the house, and low and behold there were presents under the tree. Santa made it somehow in all the bad weather. Of course, we left cookies for him, all of which were eaten along with the milk.

As I grew older, and discovered more about Santa, I still couldn’t figure out how our presents got there or how the sleigh tracks were in the driveway. My parents never would say how this happened. They just smiled. When I became an adult, I related this story to my aunt who lived just a short distance away. I discovered Santa had a helper. In the last few years, I’ve been Santa’s helper and loved every minute of it. I also keep a keen lookout for snowstorms after warm spells. Yes, everyone, there is a Santa Claus.

EMPLOYEE LAWFULLY FIRED AFTER 195 UNAUTHORIZED ABSENCES IN ONE YEAR

A recent opinion by Judge Steve Grazs of the U.S. Court of Appeals for the Eighth Circuit nominated by President Trump, recommended by Nebraska Senators Deb Fischer and Ben Sasse, and confirmed by the Senate on a vote of 50-48, found an employer’s work attendance policy did not discriminate against an employee because of her disability. Lipp v. Cargill Meat Solutions Corp., 8th Cir. Case No. 172152 (December 19, 2018).

BACKGROUNDSheena Lipp sued her former employer, Cargill Meat Solutions Corporation, for disability discrimination under the Americans with Disabilities Act (“ADA”) and the Iowa Civil Rights Act. Lipp appealed a district court’s decision granting summary judgment in favor of the employer. Lipp had an incurable lung disease which required several work restrictions, which she agreed her employer accommodated; at least until she was terminated.

ATTENDANCE POLICYUnder the employer’s work attendance policy, an employee is charged one “occurrence” point for each “unplanned” absence (as distinct from “planned” absences, such as vacation, jury duty, or family and medical leave). Lipp, after accumulating 194 occurrence points, was placed on Last Chance for attendance, which stated any call-ins, lates, and leave early without authorization will violate the last chance agreement and will terminate her employment. Lipp was absent again and failed to provide medical verification of her absence to the nursing department as required by the employer’s attendance policy verification provision. Lipp was terminated for violating the attendance policy after accumulating the 195th occurrence point without sufficient documentation in violation of the “Last Chance” notice.

ATTENDANCE IS AN ESSENTIAL JOB FUNCTIONThe court concluded that Lipp was not a “qualified individual” protected by the ADA. Lipp failed to demonstrate “that at the time of her termination she would regularly and reliably attend

work, an essential function of her employment.” The Eighth Circuit has “consistently stated that ‘regular and reliable attendance is a necessary element of most jobs.’” The employer maintained a written attendance policy stating that “regular attendance is crucial” to its operations. Lipp’s job activities as set forth in the Company’s written job description required Lipp to be present on the employer’s premises. Accordingly, the court was convinced that regular and reliable attendance was an essential function of Lipp’s job.

NO REQUIREMENT TO UNLIMITED ABSENCESThe court rejected Lipp’s argument that her 194 absences in a calendar year were not excessive. The court found her unauthorized absences far exceeded what qualified for termination under the Company’s policy. The court stated that it has recognized “persistent absences from work can be excessive ‘even when the absences are with the employer’s permission.’” The court found the “ADA does not require employers to provide an unlimited absentee policy.” Finally, the court stated it did not read the ADA as requiring the Company to give Lipp “another chance” after it already had continued to permit her to be absent for unverified absences.

CONCLUSIONThis decision provides guidance to LIBA members to include in their written job descriptions those functions of the job, which are essential, i.e., punctuality and regular attendance. In this case, the job descriptions required being present on the employer’s premises and as such regular and reliable attendance was an essential job function. In addition to having a written attendance policy stating that regular attendance is crucial to its operations, along with a system of progressive discipline culminating in termination after accruing a certain number of unauthorized absences, provided assistance to this employer in challenging whether it lawfully terminated an employee and for the court to find the employee was not a “qualified individual” protected by the ADA.

School Liaison Committee The School Liaison Committee hosted special guest Nola Derby-Bennett, the Director of the Lincoln Community Learning Centers (CLC). Ms. Derby-Bennett explained that CLCs offer after school programs that are operated and partially funded by a different lead agency organization at each CLC school. There are currently CLCs at 26 Lincoln Public Schools, and there are plans to add centers to three more schools: Lincoln High School, Northeast High School, and Randolph Elementary School. CLCs served 6,900 LPS students last year, including over 3,000 students for more than 30 days. Ms. Derby-Bennett listed supervision, academics and enrichment as the main reasons that parents enroll their children in CLC programs. The Lincoln CLC program is recognized nationally as a model program, and it often receives requests from schools across the country seeking guidance on best practices.

Legislative Action CommitteeThe Legislative Action Committee met and discussed a number of legislative issues that will come up for debate during the 2019 legislative session. The committee heard about a new legislative idea that would create a Workforce Diploma Program for Nebraska residents who were unable to receive their high school degree. Through the completion of a participating program, students would receive a high school diploma and learn career technical skills to prepare them for the workforce. The committee also agreed to refine its legislative priority on Joint Public Agencies by pushing for legislation that would require a vote of the people to establish new JPAs. In addition, the committee agreed to add the prevention of legislation to expand land banks statewide to its 2019 legislative priorities.

Elected Officials ForumThe Elected Officials Forum hosted County Commissioner Roma Amundson, City Councilwoman Cyndi Lamm, and LPS School Board member Matt Schulte. Ms. Amundson invited Ron Bohaty from the Engineering Department to discuss how the department was able to repurpose existing equipment to create a new mixing machine for brine and salt for only $700. Ms. Amundson also reported that the county saved $18,000 in six weeks from using a new purchasing card system for County employees, and the Correctional Facility JPA saved $391,000 through bond refinancing. Ms. Lamm raised concerns about a new form of borrowing, known as direct borrowing, which the city is trying to utilize to fund energy saving projects in Library and Parks and Recreation department buildings. Direct borrowing allows the city to borrow directly from a financial institution without a vote of the people. Lastly, Mr. Schulte spoke about the release of Lincoln Public Schools’ 10-year plan, which calls for a $334 million bond issue to fund three or four new elementary schools, a new middle school, at least one new high school, and a new athletic complex.

LIBA’S 2019 LEGISLATIVE PRIORITIES EMPHASIZE PRO-BUSINESS POLICIES

In the last week, the Nebraska Legislature started the 2019 legislative session. Over the next few months, LIBA will be hard at work at the State Capitol building advocating for the following legislative priorities for the benefit of Lincoln businesses:

• Reduce Nebraska’s Cell Phone Tax: At more than 25%, Nebraska ranks fourth highest in the country in terms of the tax

rate we pay to use our cellular telephones. This high tax has direct negative impacts on families and businesses. LIBA supports pursuing ways to reduce the cell phone tax imposed on Nebraska families and businesses.

• Prevent Statewide Land Bank Authority: Legislation to expand land bank authority statewide will lead to expanded government involvement in property development. Land banks can submit an automatically accepted bid on any available property and receive tax breaks and benefits that are unavailable to private developers. For example, land banks are exempt from paying taxes on a property they own, and they receive 50 percent of the property tax for five years upon the sale of a property.

• Require a Vote of the People to Establish New Joint Public Agencies: Under state statute, two public agencies can create a separate government agency known as a Joint Public Agency (JPA). There are currently seven JPAs in existence, three of which are in Lincoln. JPAs are an added level of bureaucracy that can levy and collect property taxes and issue bonds (with voter approval). LIBA supports amending state law to require a vote of the people to establish new JPAs.

• Eliminate the Personal Property Tax on Nebraska Businesses: The personal property tax not only costs businesses financially, but it is also costly in terms of the time and effort necessary to complete and file the appropriate tax returns. LIBA supports the elimination

of the personal property tax, which directly affects Nebraska’s existing and new businesses.

• Limit Taxing Authority to Property Tax Asking Plus Midwest CPI: LIBA supports requiring taxing authorities to limit their general/operating fund property tax asking to the previous year’s property tax asking, plus the Midwest Consumer Price Index (CPI) for the 12-month period ending in March of the current year, up to the maximum levy provided in statute.

• Support the Deployment of Small Cell Technology: The wireless industry is planning to deploy hundreds of thousands of small cells across the country to boost wireless services and prepare for the introduction of 5G. The annual small cell fee in Lincoln is $1,995 per device, compared to $50 or less in similar Midwest cities. LIBA supports legislation that would set reasonable statewide small cell deployment fees and streamline the permit process for attaching small cells.

• Utilize a National Test to Assess Nebraska Eighth Grade Students: Nebraska students are currently administered four tests in eighth grade under NeSA. If Nebraska eighth grade students were given a nationally recognized exam instead, we could better determine how our educational efforts match up with other states, and lower the burden on eighth grade students by reducing the number of required standardized tests.

• Increase Transparency for Schools: Nebraska’s schools receive a large portion of property taxes to make improvements to schools and keep them running smoothly. Adding a line-item budget or check register to public school districts’ websites would increase transparency in how property taxes and other funds are spent.

LIBA LUNCHEON HOSTBranched Oak Observatory is an astronomy park located ½ mile southeast of the Branched Oak Recreation Area and 20 miles northwest of Lincoln, Nebraska. This makes it not only a short convenient drive from the metropolitan area, but also far enough from city lights to enjoy dark wonderful skies. Over the past three years, Branched Oak Observatory has grown into the area’s premier source for astronomy education.

Co-founders Matthew Anderson and Michael Sibbernsen, with the help of nearly a dozen dedicated volunteer observatory staff, have hosted over 5,000 people on the observatory grounds, and thousands more though their extensive outreach programming. This last year, associates from Branched Oak Observatory facilitated programming at many different locations throughout the state during the Great American Eclipse.

The 1.5 acre Branched Oak Observatory campus currently has a dedicated 28-seat education classroom (sponsored by LaRue Coffee & Roasterie), a beautiful Visitor's Center, The Boller-Sivill Observatory, and the Everts S. Sibbernsen Memorial Observatory. The most recent addition was a large storage building to stow field telescopes, outreach equipment, and batteries for a future solar power station.

Hosting monthly "Star Parties," Branched Oak Observatory invites the local community to explore the night sky at absolutely no charge. While the observatory has a wide variety of optical instruments to view through, people are always encouraged to bring out their own telescopes for viewing, particularly if they need help learning how to use their equipment. The LaRue Coffee & Roasterie Astronomy Education Center offers extended opportunities for the general public, area schools, and local science camps.
