Subject: Sufferings of employees belonging to Administrative
Cadres working in Prasar Bharati.
Respected Sir,
On behalf of the Staff belonging to the Administrative cadres
recruited exclusively for Prasar Bharati i.e. Doordarshan and AIR, I
would like to bring your kind attention to the following facts which
will make it evident that the Ministry of Information Broadcasting
rather than observing the guidelines of the Government of India are
on the contrary inventing and cobbling new methods and
arrangements which has caused huge sufferings to the employees
working in Prasar Bharati especially the Administrative cadres which
has resulted in blocking the career progression of a large number of
employees, causing financial loss and also triggered numerous
litigations.
2. The Government and Prasar Bharati are aware that in terms of
the DoP T vide O.M. No. AB.14017 /37 /2009-Estt. (RR) dated

Annexure-I), in cases of convers ion of Government
Departments into PSUs/ Autonomous/Statutory body has laid
down a maximum period of 5 years for framing of rules and
another 2 years for phasing out repatriation to those opting to
come back to Government. This is in the context of persons on
deemed deputation to Prasar Bharati like the Administrative staff
cadres. However in brazen violation of the Government of India
instructions even after 16 years of formation of Prasar Bharati, the
Ministry of I
B has failed to frame the Rules and Regulations
under the Act at least to regulate the service conditions, promotions
etc. of the employees of Prasar Bharati. Such a serious lapse and
negligence on the part of officers, officials of Ministry of Information
Broadcasting has caused serious damage to the careers of
employees and should not be condoned. The responsibility lies with
the senior most persons in the Management.

2. The DoP T vide O.M. NoA/23/2013-P PW(D) dated21/10/2014
Annexure-II
in the context of compliance of provisions of Rule 37A
/37B on conversion of a Government Department into an
Autonomous Body created under the control of Ministry of I B /
Prasar Bharati had sought detailed information from the Prasar
Bharati.
3. It is also to be noted that the Cabinet in its meeting held on
29.1.2009 had decided as follows:
(iii) All the employees referred to in (i)
(ii) above shall be entitled
to the pay scales and all other benefits as per their entitlement as
Central Government employees. However they shall not be
entitled to any deputation allowance.

Unfortunately even after 16 years whereas subordinate
Programme and Engineering employees of Prasar Bharati are
enjoying incentives granted by Ministry of Information
Broadcasting with all pensionery benefits of non-Government
/Prasar
Bharati pay scales, the administrative staff exclusively
recruited for Doordarshan and AIR and who are not transferable
have been treated as common cadres similar to those serving in
other Government departments. This premise and concept is
entirely wrong and has caused irreparable loss to employees
belonging to these administrative cadres.
4. Further, abdicating their responsibility towards employees of the
Government like us working in Prasar Bharati, the Pay Commission
has also not made any recommendation on the posts of Prasar
Bharati since it is an autonomous body and outside the terms of
reference of the Commission. Annexure-IV The Government did
not point out to the Commission about the misconception regarding
our status i.e. of Government employees serving in the Prasar
Bharati. Even the Ministry of Information
Broadcasting has not
bothered to deal with the continuous problem faced by us.
5. In brief the Government or the management of Prasar Bharati is
not adhering to the norms and instructions issued by the
Government.
It is an example of developing an attitude of apathy for a large
number of employees of AIR and Doordarshan like us.

last 6 years may kindly be resolved under your personal
directions in terms of DoP T O.M. No.AB.14017/37/2009-Estt.
RR dated 8/10/2010 since the Ministry of Information
Broadcasting has totally failed to do so.
