RIGHTS OF A FILIPINO CHILD

What is a child? A person who is

eighteen (18) years old or younger

A person who is above eighteen years old but is unable to fully take care or protect himself from abuse, discrimination, exploitation, neglect, or cruelty because of physical or mental disability or condition

Role of the state

To provide special protection to children from all forms of abuse, neglect, cruelty, and discrimination, and other conditions prejudicial to their development including child labor and its worst forms

To provide sanctions for their commissions & carry out programs for prevention and deterrence of & crisis intervention insituations of child abuse, exploitation and discrimination

Role of the state

To intervene on behalf of the child when the parent, guardian, teacher, or person having care or custody of the child fails or is unable to protect the child against abuse, exploitation and discrimination, or when such acts against the child are committed by the said parent guardian, teacher, or person having care and custody of the same

To protect and rehabilitate children gravely threatened or endangered by circumstance which affect or will affect their survival and normal development and over which they have no control

EMPLOYABLE AGE

No child below 15 years of age shall be employed.

Any person between 15 and 18 years of age may be employed for such number of hours and such periods of the day

No child below 18 years of age shall be employed in hazardous or deleterious nature of work

EMPLOYABLE AGE

Child works directly under the sole responsibility of his parents/ legal guardian

Employment shall not endangers life, safety, health and morals or impairs the child normal development

The child shall be provided with the prescribed education

EMPLOYABLE AGE

Child shall work for not more than 20 hours a week

The work shall not be more than 4 hours at any given day

The child does not work between 8pm and 6am the following day

A work permit from DOLE shall be secured in exceptional cases where any child may be employed

The employment contract is concluded by the child’s parent or legal guardian, with express agreement of the child concerned

A child below 15 years of age maybe allowed to work for not more than 20 hours a week

A child 15 years of age but below 18 shall not be allowed to work for more than 8 hours a day an in no case beyond 40 hours a week

alcoholic beverages intoxicating drinks tobacco and its by-products gambling any form of violence or

pornography
