I. Background

1. The Government of Lao People’s Democratic Republic (Lao PDR), with assistance from the

Asian Development Bank (ADB), is implementing the Second Northern GMS (Greater Mekong

Sub-region) Transport Network Improvement Project under ADB Grant 0234-Lao and OPEC Fund

for International Development (OFID) Loan 1392P/1650P. The Project (referred hereinafter as

ADB12) is part of the Second Northern GMS Transport Network Improvement Project that aims

to connect the northern provinces of Lao PDR to Vietnam. ADB12 includes upgrading of 3 national

roads (NR) in Huaphanh Province, namely, NR6A, located in Viengxai District and in Sopbao

District (61 km long); NR6B, located in Sopbao District (26 km long); and, NR6-1 in Viengxai

District (55 km long). The Department of Roads (DOR) and ADB in 2017 agreed to extend the

scope of NR6A by an additional 9 km, starting from Ban Samphanxay (i.e., km 0+000 of NR6A)

going towards Viengxai Town until it joins with NR6-1 in Ban Longkhou. This road section is

referred to as NR6A+9km. (See Figure I-1 for the Project Location Map).

2. The goal of ADB12 is to improve NR6A, NR6A+9km, NR6B, and NR6-1 to a modified Class

IV road with a minimum of 5.5 m carriageway, a shoulder of 0.5 m to 2 m, and a design speed of

40 km/hour. ADB12 also includes pavement strengthening, shoulder restoration, embankment

improvement, provision and improvement of drainage structures and bridges. The indicative

corridor of impact (COI)1 ranges from 15 m from the road centerline in built-up and flat areas to

50 m in mountainous sections. (See Figure I-2 for the Typical Section of the Project Roads).

3. The Ministry of Public Works and Transport (MPWT) is the executing agency (EA), while

the DOR is the implementing agency (IA). The DOR set up a Project Management Unit (PMU)

each for NR6A, NR6B, and NR6-1. The PMU of NR6A covers NR6A+9km also. A manager from

DOR heads each PMU with an assistant manager from the district Office of Public Works and

Transport (OPWT). A task force has been formed within the PMU to oversee the preparation,

updating, and implementation of the resettlement plan (RP) prepared for each road section,

including monitoring RP implementation. This task force provides overall guidance and technical

support to the Provincial Resettlement Committee (PRC) and to each of the District Resettlement

Committee (DRC) set up in Viengxai District and Sopbao District.

4. The PRC is responsible for (i) conducting consultation meetings; (ii) establishing

compensation rates at replacement cost for affected assets; (iii) conducting, reviewing and

confirming the results of the detailed measurement survey (DMS); (v) approving final agreement

with the affected households (AHs) on their compensation; (v) managing funds for compensation

disbursed by the PMU through the Provincial Department of Finance; (vi) monitoring all RP

activities; and (vii) acting as grievance officer. The DRCs provide support to the PRC.

II. Objectives of the Social Monitoring Report

5. The agreed 2010 resettlement framework tasks the PMU to look into the following concerns

in its monitoring activities:

a. Compensation and/or other entitlements are provided as per final RP, with no

discrimination according to gender, ethnicity, vulnerability, or any other factor;

b. Livelihood restoration measures are designed and implemented including modifications

in the programs and provision of additional cash and in-kind assistance to the

participating affected households as and when necessary;

c. Public information, public consultation and grievance redress procedures are followed;

d. APs/AHs are able to restore/re-establish livelihoods and living standards. Special

attention is given to severely affected and vulnerable households;

e. Affected public facilities and infrastructure are restored promptly; and

f. The transition between relocation or site clearing and commencement of civil works is

smooth and that sites are not handed over for civil works until affected households

have been satisfactorily compensated, assisted and relocated.

III. Scope and Methodology

6. This document is the third social monitoring report for ADB12 and it covers the period July

2018-January 2019. It should be read as a sequel to the preceding monitoring reports covering

the period July-December 2017 and January-June 2018.

7. The third social monitoring report checks on the status of (i) payment of compensation for

affected assets, including special allowances to eligible affected households (AHs), resolution of

complaints from AHs, and (iii) the status of completion of construction works. It also looks at

actions taken on issues raised in the January-June 2018 social monitoring report.

8. Information for this report came mainly from (i) payment records of AHs that received

compensation in the first 6 villages of NR6-1, (ii) revised list of AHs and their losses in NR6-1 per

re-survey done by DRC based on the construction drawings of the contractor, (iii) discussion with

the community mobilizer (CM) on resettlement issues that cropped up in July 2018-January 2019,

including complaints from stakeholders and their resolution, (iv) quarterly progress reports QRN15

and QRN16 prepared by the Project Implementation Consultants (PIC), and (v) site visits and

informal talk with AHs and residents.

IV. Highlights of the January-June 2018 Social Monitoring Report

9. Key findings and issues discussed in the January-June 2018 social monitoring report were

as follows:

a. In NR6A, NR6B, NR6A+9km, and NR6-1:

• Displacement of people from homes and income sources was drastically reduced

during the construction of NR6B, and in the ongoing construction of NR6A and

NR6A+9km. The actual construction limits in road widening works were defined by

the construction drawings prepared by the civil works contractor.

• As of June 2018, the cumulative progress of construction work in NR6A was 94.46%,

38.04% in NR6-1, and 20.13% in NR6A+9km. In NR6B, construction work was 100%

complete as of December 2017; however, the civil works contractor had to carry out

additional protection works during the first half of 2018.

• The unit rates used in calculating compensation were within the range provided in

the agreed updated RP.

• AHs that had to relocate their houses and shops were provided plots on which to

rebuild their homes and shops.

• No compensation was paid for recovered cultivated and occupied plots of ROW land,

in addition to affected trees inside the COI.

• Unlike occupied and tilled plots of land in the ROW, however, the DOR requested

AHs, to which they consented, to donate their affected timber and fruit trees in lieu

of cash compensation; occupied plots of land in the ROW could not be donated

because the same did not belong to the AHs. (the promulgation of the National Road

Law in 1999 that set a 50 m right-of-way (ROW) for national roads, such NR6, all

landholdings within the ROW ceased to be part of village lands that could be

allocated to villagers on a rotational basis. Thus, allocated production landholdings

of villagers do not include paddies or garden lands in the 50 m road ROW).

• There were no outstanding complaints in all the project road sections.

b. In NR6-A:

• Without double counting, a total of 208 households, 7 village governments, and the

Electricite du Laos (EDL) were adversely affected by the loss of various assets in

NR6A.

• By April 2017, DOR paid a total of 760,656,246 LAK in compensation for affected

structures to 131 AHs, 3 village governments, and the EDL. By May 2017, DOR paid

a total of 64,400,000 LAK in transition allowance to 19 relocated AHs, including

560,000 LAK to a poor AH affected by the partial loss of its house.

c. In NR6B:

• Without double counting, a total of 36 households and 2 village governments were

adversely affected by the loss of various assets in NR6B.

• By April 2017, DOR paid a total of 179,166,730 LAK in compensation for affected

structures to 36 AHs and 2 village governments. By May 2017, DOR paid a total of

17,360,000 LAK in transition allowance to 5 relocated AHs, including 560,000 LAK

to a poor AH affected by the partial loss of its house.

d. In NR6-1:

• In April 2018, ADB took notice of the ongoing road construction works in NR6-1,

ahead of the approval of the URP. ADB advised DOR to carry out a due diligence

review (DDR) of the ongoing civil works in NR6-1.

• DDR: road widening works have been confined within the unencumbered sections

identified during the DMS; roadside canal excavation has resulted in damaged

access to homes and shops; no outstanding complaints.

• At of the end of June 2018, ADB has yet to give it concurrence to the updated RP

for NR6-1, while DOR has also not yet commenced payment of compensation and

allowances to the AHs.

e. In NR6A+9km:

• The first draft of the RP for NR6A+9km was submitted to ADB in April 2018, and

was revised and resubmitted to ADB in the first week of June 2018. The cost of

resettlement for this road section was calculated at 2,631,086,112 LAK.

• The demarcation of the construction limits resulted in a much reduced resettlement

impacts. From the 222 AHs identified during the 2017 DMS, the number of AHs

affected by the loss of structures decreased to 27 AHs and 1 government vocational

school.

• The District Resettlement Committee (DRC) of Viengxai and the DOR on 7, 21, and

23 May 2018 delivered the compensation and applicable cash allowances of the

AHs in their respective homes.2

• Clearing of the construction limits immediately followed after the AHs and 1

government vocation school were paid their compensation and allowances.

V. Status of LAR Implementation as of December 2018

10. Land acquisition and resettlement has been completed in NR6A and NR6B since the first

half of 2018. A compensation completion report each for NR6A and NR6B was submitted to ADB

in September 2018.

11. The unusual heavy rains in August 2018 did cause damages to the newly rehabilitated

NR6B and to NR6A where, until the second half of 2018, finishing construction works were still

being done. An ADB mission in October 2018 confirmed that the damages caused by the rains in

August 2018 were attributable to nature and not due to defects in the road rehabilitation works.

A. NR6-1:

12. ADB on 31 July 2018 gave its concurrence to the updated resettlement plan for NR6-1.3

As of the end of December 2018, the cumulative progress of work was placed at 58.28%.4

13. In September 2018, the District Resettlement Committee (DRC) paid compensation to 48

AHs for their affected structures in Longkhou, Navid, Xienglouang, Namone, Poungnakhao, and

Nakhao. No compensation was paid for affected trees. (See Appendix 1 for the pictures of the

APs and receipts of compensation).

14. However, AHs that lost houses and shops were only paid for the floor area inside the COI

regardless of whether or not the affected area was 40% or more of the total floor area of the

structure; in other words, no distinction was made between marginally affected houses and shops

and those that are no longer viable for continued use. In addition, no repair allowance (i.e., 15%

of the acquisition cost of the affected floor area as mandated by the updated RP) was paid for

any partially affected houses and shops. Further, the following cash allowances were not paid to

eligible AHs: (i) disruption allowance for AH losing entire house (LAK1,920,000/AH), (ii) transport

allowance for AH losing entire house (LAK1,600,000/AH), (iii) income loss for entirely affected

shop (LAK600,000/shop), and (iv) transport allowance for entirely affected shop (LAK120,000).

None of the 48 AHs in the 6 villages was eligible to receive an allowance of LAK640,000/AH for

the vulnerable. In all, the outstanding amount due to the 48 AHs is estimated at

LAK71,324,490.50. (See Appendix 2)

15. One AH affected by the loss of a brick wall and a cyclone wire fence in Longkhou Village,

in addition to 2 AHs each in the villages of Navid and Nakhao that are affected by the entire loss

of their wooden houses refused the compensation amounts proffered by the DRC (see Appendix

3).

16. During the due diligence review carried out by consultants of DOR and the Project

Implementation Consultants (PIC) in January 2019 in connection with the preparation of this SMR,

it was learned that all AHs affected by the total and partial loss of their structures in the villages

of Longkhou, Navid, Xienglouang, Namone, Poungnakhao, and Nakhao could reorganize behind

the corridor of impact (COI). Only 1 AH requires assistance from the civil works contractor in

leveling the plot behind the present location of its houses (see Appendix 4 for the status of

resettlement of the 48 AHs).

17. Relatedly, the DRC in third week of January 2019 provided the community mobilizer (CM)

a revised list of AHs and their affected assets in the remaining 15 villages of NR6-1 (see

Appendix 5 for the list). The CM in February 2019 will verify the situation of each AH in the

villages and, together with the PMU and DRC, will prepare a household-level relocation plan for

each AH losing entire house or shop. However, it might take the PMU, DRC, and the CM until

March 2019 to complete this relocation plan.

B. NR6A+9km

18. ADB gave its concurrence to the land acquisition and compensation plan (LACP) for

NR6A+9km on 9 August ADB. As of the end of December 2018, the cumulative progress of work

was placed at 97.64%.5 In September 2018, DOR submitted to ADB the compensation completion

report for the road section.

C. Corrective Action Plan

19. At the conclusion of the 10-13 December 2018 ADB Special Project Administration Mission,

a corrective action plan (CAP) was agreed upon between DOR and ADB. Below gives the status

of actions in the CAP relative to resettlement.

D. Grievance resolution

20. There were no outstanding complaints as of the end of December 2018. In August and in

September 2018, the respective village chiefs of Samphanxay and Nathean called the attention

of the community mobilizer regarding dust pollution caused by construction activities in

NR6A+9km. The matter was referred promptly to the site inspectors and was resolved. (During

those occasions, the sprinkler truck of the contractor was out of service).

E. Other specific resettlement concerns

21. Table below reviews specific areas of concern that PMU is mandated to monitor.

Shortcomings were noted in Section V.A in the compensation paid.

Construction works in Longkhou, Navid, Xienglouang, Namone, Poungnakhao, and Nakhao were allowed to commence even if the AHs thereat have not been paid their compensation and allowances in full. Further work in this villages need to be suspended until all AHs have received their compensation and allowances in full.

22. Table below provides the status of unresolved matters (as of end of June 2018) in the

corrective actions agreed on 7 December 2017 by the Project Management Unit (PMU) and ADB

in connection with the 13-15 November 2017 ADB Resettlement Mission.

The matter is expounded in the URP for NR6-1 and RP for NR6A+9km. This was discussed in the compensation completion reports for NR6A/NR6B and NR6A+9km.

VI. Conclusion

23. The implementation of land acquisition and resettlement that is consistent with the agreed

updated RP for NR6-1 remains the biggest challenge that has to be overcome by the DOR,

Viengxai District Resettlement Committee (DRC), and the PMU. The 48 AHs that earlier received

their compensation in September 2018, in addition to the 5 AHs that refused the amount proffered

by DRC, have to be paid their compensation and allowances in full at the soonest possible time.

Appendix 2 can serve as a template to be used by DRC when preparing the compensation plan

of AHs in the remaining 15 villages. Moreover, DRC should allow the national resettlement

specialist to review the compensation plan of the AHs in the 15 villages before the same is

finalized and submitted to higher authorities for approval. This way, errors are minimized, if not

avoided.

24. Moreover, the PMU and the DRC, assisted by the community mobilizer, should prepare a

relocation plan for AHs that are affected by the entire loss of houses and shops in the 15 villages.

The plots on which the AHs will relocate, arrangements for the leveling of the relocation plots, and

the date of transfer to the relocation plots should be firm and doable and with the concurrence of

the AHs, DRC, and the civil works contractor. The PMU and DRC must realize that road works

cannot commence at places where (i) AHs have not been paid their compensation and allowance

in full, and (ii) where the COI has not been cleared of all obstructions.

25. The PMU should demonstrate the will and determination in seeing to it that the civil works

contractor strictly follows the agreed environmental management plan (EMP). Infractions of the

EMP will not only do damage to the environment but will likewise have social impacts. Relatedly,

signboards that provide the names and contract numbers of key personnel of the contractor and

of the PMU should be put up at construction sites and camps, and posted on public notice boards

at affected villages. Residents should be able to contact relevant personnel of the contractor and

of the PMU for any query, suggestion, and complaint. Moreover, the PMU, assisted by the

community mobilizer and site inspectors, should document and tract until its resolution, any

complaint received from residents and village officials, written or verbal.

26. Furthermore, site inspectors, resident engineers, and the community mobilizer should

ensure that damaged access to homes and shops, gravity water lines, and irrigation canals are

promptly repaired.
