HUNTINGTON LANDMARK SENIOR ADULT COMMUNITY ASSOCIATION Board of Directors

Dear Huntington Landmark Member:We have become aware of a Facebook Page titled The Hun-tington Landmark Voice where certain members of our com-munity have taken to publicly criticizing the Association and its Board of Directors about community operations and gover-nance, some of which is rather harsh and one sided. Although Association Board members are not permitted on this site, the Board is well aware of the conversation. At the outset, we support fully the public sharing of points of view on all matters affecting the Huntington Landmark Com-munity. Disagreement and debate are healthy for any orga-nization and can be a productive positive force provided it is done so honestly, accurately and with respect. In the interest of full disclosure, and transparency, we offer the following points to correct some of the misstatements that have been made. • The Huntington Landmark Voice is operated by commu-nity members and is not an official Association media page. Comments made on the site represent the personal views of certain members or residents and are not representative of the Huntington Landmark Senior Adult Community Association. • The Huntington Landmark Senior Adult Community Asso-ciation (the Association) is a nonprofit mutual benefit corpo-ration governed by California and the Governing Documents which consist of the Recorded CC&Rs, the Bylaws and the rules and regulations. The Board’s primary responsibility is to preserve, protect and enhance the value of the Community for the Association and its members. One way in which the Board does that is by fully, fairly and consistently enforcing the Governing Documents. • In that regard, the CC&Rs provide that the Association (through its Board of Directors) “shall have the authority to make, establish, promulgate, adopt, amend, and repeal reason-able rules not inconsistent with this Declaration relating to the use and occupancy of the residential Common Areas, the Mas-ter Common Area, and all other property located within the Community.” Similarly, the Bylaws provide that the Board shall have the power “after notice and a hearing…”to impose fines and penalties, and suspend the voting rights of a Mem-ber…for violation of any other provision of the Declaration, the Articles, Bylaws and Association Rules.” • In fact, it may be a breach of duty for the Board not to enforce the Association rules. Failure to do so may subject the Association, and the directors to claims of discrimination, selective enforcement and breach of duty of care and fiduciary duty. • Many of the rules presently in place are not new to the Community. They were adopted years ago by prior Boards.

Nevertheless, they are in effect and must be enforced, un-less amended or repealed. The rules are not stagnant. They evolve over times as the demands and needs of the Communi-ty change. From time to time, the Board reviews and re-eval-uates the rules in places and, if appropriate, proposes changes to those rules. • Rule enforcement is not arbitrary. It is governed by Civil Code and Article X of the Bylaws which require notice and a hearing before any fines or other enforcement is handed down. Every Owner is provided notice and a full and fair opportunity to be heard. No enforcement can take place without these procedures. • Among the comments made public is that the Association is a “society” with guidelines. This statement suggests that compliance with the Governing Documents is optional or vol-untary. To the contrary, the Association is a Corporation and bound by the nonprofit Corporate Law, the Civil Code the re-corded CC&Rs, and rules and procedures. That is what every member expects when they buy into this Community and what the Board is obligated to uphold. • The Association Governing Documents are not based upon what this Board “decided”. They have been in place for years. Some from the beginning of the Association’s existence. • Perhaps the most offensive of the comments in recent weeks is the reference to the Board as applying “Nazi” tactics. Such vulgar reference to World War II atrocities hardly compares to an elected Board of Directors carrying out its duty to the Asso-ciation to enforce its Governing Documents. Such emotional-ly charged rhetoric does not legitimize the argument. It shows a lack of support for the statement made, does little to further the healthy debate and only breeds resentment and animosity.• Some have called for “sweeping change” without speci-fying what change or why. Some have advocated that each rule and regulation needs to be evaluated in order to ensure a comfortable life for those that live here.” While we do not see the need to evaluate each rule and regulation, we welcome any Owner input on rules that could be more effective. All should be reminded that the Association’s role is not to ensure a com-fortable life for all but to preserve the value of the Community by maintaining a clear, consistent and reasonable set of rules that all members and residents follow for the betterment of all residents. The Board will continue to work toward this goal, making changes as appropriate or required. The Board of Directors and Association Management en-courages all members to attend Open Board meetings and share your thoughts and concerns with the Board during the open forum portion of the meetings. Or, you can submit any suggestions or concerns to the Board via email to the Manage-ment Office. We sincerely hope that each of you will join in our effort to work together toward a better Community for all. PHASE #9 POST TENSION SLABS:We are actively working to correct the post tension issues in phase 9 based on the Engineers recommendations. We have also requested from staff and expedited orders to correct the sprinkler conditions.

PHASE #4 Phase 4 gutters and diverters are completed. Proposals for gutters and diverters at buildings 901 thru 906 have been sent to the staff by Rainstoppers. Phase 4 painting is completed.

PREMAX Painting - Phase 9 residential and garage painting proposals have been approved.

REPIPES:The association has experienced 7 slab leaks this last month along with the additional 4 which were pro active. In the month of June 8 more proactive repipes are scheduled.

CONTRACTS APPROVED:1. Prosurface: Repair of tennis court windscreen is pending.2. Parrish Electric: Inspect and make necessary repairs on 291 exterior elec-trical panels and 62 garages. *Dates are pending and will be reported in the August newsletter.

LANDSCAPE REPORT

Turf: Workers continue on the summer schedule, mowing weekly. Lawn re-seeding has taken place in many areas requir-ing extra water to be programmed to germinate seed as required. Reseeding will be on hold during the summer months and will start up again in October.

Trees: Trimming of Flowering Pear trees continues this season. It should be noted that not all trees (this species) required trimming last year. Comment: This species is especially susceptible to disease which can be observed by a scorched appearance in some limbs. This problem can lead to severe tree mortality.The approved list of 12 dead trees were removed. Olive trees have been sprayed for fruit control.

Irrigation: Necessary replacements were completed to the irrigation timer controllers at Buildings 215, and 411 with two new 24-station timer controllers installed, replacing the original timers which were not able to be repaired. Irrigation valves continue to require replacement. Valve conditions deterio-rate as they age from constant use and replacement is neces-sary. The last valve replacement was at Building 221.

Special Issues: A change in landscape worker scheduling was implement-ed this month. All gardeners now work at the same area completing the work schedule in a more timely manner. Workers have begun this schedule at Phase 11 and will proceed to Phase 3, 7 and 8. This is a test program we hope will work more efficiently for the community.Flowers were planted to replace dead plants around the Club House pool area. Workers removed wood chips and added top soil and re-seeded areas where trees were removed. New plants were added to pots at the Recreation entryway. Plant species “African Daisies” at the Manager’s office were trimmed back to encourage new growth.

Next: Selected Phase trimming by gardeners will continue on the schedule noted above, now described as “Sections” and not by Phases as work continues. Watering schedule has been changed to two days per week, Monday and Thursday.

EXTERIOR ELECTRIC PANEL INSPEC-TION & POWER SHUT OFF NOTICE Edward Olson, Asst. General Manager

Starting in July and ongoing throughout the rest of the year Parrish Electric will be conducting exterior electric panel inspections and making the necessary repairs. The homeowner will be given notice prior to the power being shut off and the inspection takes place. The power will be off for approximately half an hour depending if repairs are needed, if repairs are needed the power may be off a little longer. The CC&Rs (4.18 & 5.05) set forth maintenance and repair guidelines for both the Association and unit Own-ers. The last sentence of 4.18 autho-rizes Association’s Rules be promul-gated or amended to modify those guidelines. Addendum D to the 2010 Rules & Regulations was last updated 6 years ago. Since then, a number of maintenance responsibilities that had never been defined have been addressed. Addendum D has been revised to include those previously undefined responsibilities and was approved by the Board of Directors on June 2, 2016. Please replace Addendum D in your 2010 Rules & Regulations booklet with the revised version included on page 9 of this issue of Landmark Living. Additional copies are available in the Management Office.

UPDATE ON COYOTE INFORMATION FOR LANDMARK RESIDENTSJeanne Kerr, BOD Vice President Huntington Beach Police Department --

Coyote Reporting Update: The City of Huntington Beach has adopted a Coyote Management Plan. The goal of the plan is to support coexistence with urban coyotes using education, behavior modification, and development of a tiered response to aggressive coyote behavior. To reach this goal, the City has developed three primary strategies: public education, enforcement of laws and regulations prohibiting the feeding of wildlife and ap-propriate tiered responses to coyote and human interactions. These strategies require active participation on the part of the entire community. An on-line form to the City of HB will enable reports of sighting of and/or actions of coyotes. These reports will be used to enable officials to take the appropriate public safety responses. The on-line Coyote Incident Reporting form can be ac-cessed via the City’s website (www.huntingtonbeach.gov) by going to the “I Want To” link followed by the “Report” link and then the “Coyote Issue” link. The Coyote Incident Re-porter link can also be found under the City’s website “Web Spotlights” section. The City of Huntington Beach Coyote Management Plan, Preventing Coyote Conflicts and Coyote Hazing Guidelines can also be found through this link. Coyote behavior, Coyote Attractants in Urban Areas, Hazing and Behavioral Change, Monitoring and Collecting Data, Response and Attack Plan and much more information can be found in the Coyote Management Plan. NEW MINIMUM WAGE LAWS WILL SIGNIFICANTLY AFFECT LANDMARKWalt White, BOD Secretary

The California Legislature has recently mandated two increases in the state minimum wage. First, an increase from $9 to $10/hour in January 2016. Secondly, a further increase from $10 to $15/hour over the next 6 years. That is a total increase of $6 an hour, a 67% increase over 7 years! Since labor costs represent about 50% of our budget, those mandated increases in the minimum wage will have a significant effect on Landmark! Many of our service providers employ low-wage workers whose wages will be increased the most. However, high-er-wage workers are expected to demand wage increases as well. In order to continue to provide the current level of service to our community, the cost of operating and reserve (repairs/replacements) expenses would need to be increased. Although all efforts will be taken to minimize increased costs, members should be prepared for an increasein monthly assessments and/or a decrease in services. Q. Why are we not going by the 2013 Realtor Rules?A. Civil Code 4350 was not followed when the revision of the 2010 Realtor Rules took place in 2013.Q. What is the management office doing about residents who are not picking up after their dogs?A. A rules violation will be issued to them following a fine.Q. What is the minimum lease period that an owner can lease out their property?A. 3 month is the minimum.Q. Do I have to register my vehicle?A. Yes, per Rules & Regulations, page 16, section Vehicles: All resident vehicles must be registered with the Manage-ment office and must display the current official windshield decal in order to gain entry into the community.Q. Do I need ACC approval for a satellite dish?A. Yes, per the CC & R’s, pg.22 item 4.12 states you need approval from the ACC. Also, there is only one contractor allowed to install satellite dishes here at Landmark.Bob Allen 203D- What was the nature of the emergency Board Meeting regarding Realtor Rules? Why weren’t the residents notified?Bob Crossley: The reason for the emergency meeting had to do with the Realtor issue of allowing anyone to come into the community. The problem with that is that you have land-mark being a public accommodation under the ADA Act. If at any time you are public accommodation you are subject to the ADA act and anyone coming in are not sponsored or unaccompanied and on their own with that pass. That will expose the community to ADA liabilities. One of which is a 55,000 for an ADA public violation. So the idea is to stay away from a public accommodation because we just can’t afford to be at risk of a $55,000 fine. I was the one who called for the meeting and it was to be held immediately with no time to send out a notice.Q. Trudy Boim 314C: Are we allowed to let people in? The whole thing needs to be reviewed?A. Bob Crossley: With the published rules and regulations the year 2010 these are the rules and regulations that are in a blue binder and the open house Realtor rules are in there and there is no situation where I will expose the community to a $55,000 dollar fine and if we are allowed to let people come in under any condition to roam around you are then exposing yourself to an ADA fine. Now that’s not to say the rules are not meant to be changed, we’ve changed them be-

fore but right now there is no change in the works and right now the 2010 rules are the ones we are going to emulate.Kimberly: what I would like to do is if residents have suggestions take them to the management office and I will get a meeting together to look at these comments so that the rules can be looked at again and modifications can be made.Q. 313B: Can you explain to us what the significance of the ADA, How does it affect us?A. Bob Crossley: We have an opinion from our attorney and that is what kicked all of this off about five or six months ago. One of the points the ADA makes is if you as an association allow voters come on through during that voting period are public accommodation you have to respond to that. It’s the American Disabilities Act. Q. Lynn Buckley 222B: If this is ADA, if a person with a disability, why can’t a non ADA person be allowed to an open house?A. Bob Crossley: You cannot discriminate someone with a disable or someone without. As far as coming in for an open house with the status that can’t be done. Q. Denise Norman G7: I was asked to remove my Amer-ican Flag. It is on her patio above my patio. I received an ACC letter with items listed and asking it to be removed. There are over 45 flags mounted throughout Landmark. I want my flag back where it belongs.A. Ted Moore: Everyone should have a right to have a flag but you attached your flag bracket to your neighbor’s patio and you are not allowed to do that. That is the issue and the only issue. Q. Linda 11F: We have been here for a year and a half, we used the company HL provided for the garage door open-er and it opens by itself. Am I the only person that this is happening to?A. Kimberly: We will take note of it. We will have mainte-nance take a look at it. Walt White: All the door openers are responsible of the homeowner not the association and should go through the company that provided the service.Q. Bob Allen 203E: This is on the 2010 R&R. I was on the board then, the rules were never approved. During that time there would have been a motion to approve those rules and regulations. I would like someone to look into this?A. Dayton La Grua: The final R&R was submitted in 2009 if we do not find these R&R were approved we will use 2004 R&R.Q. Mary LeBoeuf 17G: Currently we have to ride our bikes through the pedestrian gate and it’s difficult to open the gate and ride through. Is there any way we can get in line behind the cars and pass through?

Since the last newsletter your Board has been busy making decisions bene-ficial for the improvement of our com-munity. There were 3 BOD Executive Sessions and the June BOD Regular Meeting (General Meeting Minutes Draft printed on a separate page). Your Board met in Executive session on May 20th to decide on a foreclosure and to renegotiate a contract. An Exec-utive Committee was formed to enter into contract negotiations. On May 25th during Executive ses-sion a contract proposal was consid-ered and a decision was made regard-ing a legal item. On June 1st In Executive Session the Board approved a contract amend-ment to the management contact, approved the proposals to inspect the exterior main electrical panels, repair a damaged tennis court wind screen and made a decision on a contract cost change. Your Board continues to be busy finding ways to maintain our commu-nity while holding down costs. Until next month; be safe, be healthy, and enjoy the Landmark Life.

They have also arranged for another shredding day – September 10th in the manager’s parking lot from 9 am to noon.A reminder to all residents: The news-paper collection bins, located near the trash bins, are for the recycling of newspapers, mail inserts, magazines and telephone books. Window enve-lopes (with the plastic window re-moved) are accepted. Shredded paper can be left at the collection bins in ei-ther paper or plastic bags. However if dropping off at the dumpster (in the RV lot) the paper must be emptied from the plastic bag, dumping the paper directly into the dumpster ... no plastic bags are allowed in the dumpster. Also be sure to drop the canvas flap back down on the collection bins after dropping off your “donations”... to keep the rain out. Thank you.

On June 4th the recyclers were guests at the semi -annual dinner ac-knowledging their efforts. The dinner, catered by Jolanda’s, was superb. Several lucky door prize winners walked away with terrific gifts that had been supplied by local businesses and Realtors. The recyclers’ work continues on a daily/weekly basis. They also sponsor special events, such as the ones held in June – the electronics recycling day and the dumpster “for anything” days.

DISASTER PREPAREDNESS COMMITTEE

Are you ready for a power outage? Whether caused by a disaster or a more localized event, we will be in the dark — literally. Even if the outage starts in the daytime, areas of our homes can be dark — do you have battery-pow-ered lights ready? Do you have that special key to manually open your ga-rage door? How about keeping ready-to- eat food available as your electric stove won’t work and you won’t want to open the refrigerator and let the cold out. A battery radio will allow you to keep updated on when service will return or how widespread the problem is. Telephones and answering machines probably won’t work. Keep your cell phone charged. All our electric clocks will be out. Do you have a wind-up or battery clock? If the outage begins during the day, don’t assume all will be well by night. It will be much harder to maneuver around in the dark so pre-pare yourself. Wear shoes. Put flash-lights or other battery-powered lights in each room you will be using — bed-room, bathroom, and kitchen. Get the manual can opener out of the drawer and leave it on the counter for quick access. You may need to open some canned goods for you or your pet. The next Disaster Preparedness meeting will be July 18 at 2:30 p.m. in MPR 1. Bill Clausen will present Part 2 of the Disaster Plan Overview. Even if you missed Part 1, you will still get valuable information from Bill’s pre-sentation. Karen Clausen is continuing to request volunteers for the Building Steward program. As soon as you list a property for sale within Huntington Landmark, please contact the M

ber below) to arrange for an escrow inspection of the property by the ACC. An appointm

ent will be arranged convenient to you and the ACC, at which tim

which notates all changes to the property since original construction and indicates that ACC approval (and HB City perm

its, if applicable) had been obtained for all changes. This will ensure that the new owner is aware of what alterations have been m

MEDICATION DISPOSALSylvia Widmeyer

Medication Disposal Follow up: What a fantastic turn out we had for the Medicine Disposal Day. Approximately 50 residents dropped off their unused/expired medication, June 8 disposal day. Although we don’t have an exact weigh in for the amount collected, the detective car-rying the box of medications out said it was very heavy. Many, if not all of the residents, expressed appreciation for the event and inquired about when the next one might be held. Watch for information in the newsletter if we are able to schedule another event, probably in late fall. For those that were unable to drop off their medications at that time, the Huntington Beach Police Department still collects expired/unused medica-tion at their 2000 Main St., location. No liquids, syringes or inhalers are accepted. Medications are to be re-moved from their original bottles anddumped together into a zip lock bag. They DO NOT take the empty bottles. Thank you again for participating and until the next event remember to dispose of properly. Never discard medications by flushing them down the drain. When disposing of them in the trash mix the medications together in a zip lock bag with coffee grounds or kitty litter or egg shells, etc.

The ACC would like to thank all homeowners for their cooperation in complying with the application process rules for architectural changes submitted to us to process. Occa-sionally, problems can occur when homeowners are not aware of regula-tions that bring about issues for us to resolve. One of those issues involves Satellite dishes. We have observed that there are a number of satellite dishes that were not authorized or improperly installed. For example, in some instances, dishes have been mounted directly atop roofing shin-gles by unauthorized installers, caus-ing damage to HOA property & potentially costing all owners. As a result, beginning August 15, 2016, notifications will start being sent to homeowners who have improperlyinstalled dishes. As with all ACC applications & issues that stem from them, the ACC is more thanwilling to assist in correcting issues with all homeowners in order that we can all harmoniously work to main-tain high standards and high values for our properties. If you are considering applying for a satellite dish, The ACC wants to remind homeowners that the HOA has selected one installer of satellite dishes, Interstar Communications. No other dish companies are allowed to install satellite dishes in Huntington

Landmark. There are costs and home-owner responsibilities for the main-tenance of the satellite dishes. An application for a satellite dish must be submitted and be approved by the ACC prior to any installation. Look for future ACC articles of interest in Landmark Living.

Mulching LawnmowersHuntington Landmark landscape vendor O’Connell Landscape Main-tenance currently utilizes mulching lawn mowers in our community. These ‘mulching mowers’ are de-signed to cut the grass into fine pieces which fall back easily onto the lawn surfaces. These clippings are rapidly broken down by soil microorganisms and release nutrients from the plant material back into the soil. Clippings that are accidentally propelled onto sidewalks are blown back onto grass surfaces to achieve the same effect. Another benefit of utilizing mulching mowers is that clippings no longer re-quire to be picked up and removed to a county dump since grass clippings are not considered “green waste” by most facilities, and are not generally recycled. All of this adds up to a sav-ing of time, money and benefits the environment.

The Mat Maker (meeting Mondays from 2 to 4 pm in the art room) are gearing up production to create a num-ber of mats for the “STAND DOWN” coming in September. “Stand down” is a military terms for when troops on the front lines are relieved so they can rest, clean up and receive medical treatment. At this three day event, to be held at a historic blimp hangar at Tustin’s Marine Corp Air Station, the homeless can get similar relief. There are approximately. 300 homeless persons expected to attend this event where they will receive medical atten-tion, personal care services (haircuts, fresh clothing), meals, financial and housing assistance. The organizers of the “STAND DOWN” are hoping to have enough mats to give to all who want one.
