D. 1840 by and between P. T. Scruggs of the one part and John W. Jones of the other part both of the County of Fayette and State of Tennessee. Witnesseth: That whereas James Hunter, Lawrence McGinnis, and others did on this day of July A.D. 1839 execute a certain deed in trust to the said Scruggs which said deed is Registered in the Register’s Office of said County in Book I, page 54. By which said deed the said Hunter and McGinnis among other conveyances convey to said Scruggs a certain tract or parcel of land known as the Mount Comfort Store situated lying and being in the County and State aforesaid in the 10 th surveyor’s Dist. Range 5, Section 2 containing by estimation 69 ¼ acres and bounded on the east by the land Messrs. McKinley and Ingram on the North by the land of Simmons and Jernigan, on the West by the lands of Willie B. Jones and on the South by the land of the aforesaid Ingram for the purpose of securing and making certain the payment of a certain debt and from the said Hunter and McGinnis to said John W. Jones for the sum of Two Thousand Nine Hundred Twelve 83/100 Dollars. Now the said Scruggs in pursuance of the provision of said deed in trust and in consideration that the said Jones hath and doth release of the said debt the sum of Two Thousand Five Hundred Dollars deducting a sum

execute a certain deed in trust to the said Scruggs which said deed is

said deed in trust and in consideration that the said Jones hath and doth release

of the said debt the sum of Two Thousand Five Hundred Dollars deducting a sum

therefrom which shall be equal to the legal interest on the said $2500.00 from the

time that said Jones recovered a judgment on the same to the 25th day Dec.

1840 hath and doth by these presents sell transfer and convey to the said Jones

all the right title claim and interest which he has in and to the aforesaid land and

premises with all ways and privileges and all the appurtenances thereto

belonging to the said Jones his heirs and assigns forever.

In testimony whereof the said Scruggs hath hereunto set his hand and affixed

his seal the day and date above written.
