1.0 Interpretation

1.1 In these By-laws, unless otherwise specifically stated the

following meanings shall refer : -

“Club” means the Laguna City Resident Club House and/or according to the definition as defined in the Deed of Mutual Covenant of Laguna City.

“By-laws” means the By-laws of Laguna City Resident Club House issued by the Management Agent of Laguna City Resident Club House.

“Club Management” means “Citybase Property Management Limited”, the operator who shall operate the Club in any manner it deems fit .

“Club Manager” means the person appointed by the Club Management of the Club and the disposal of all membership affairs.

“Members” means those valid Resident Card holders.

“Visitors” means those who enter the Club and its associated facilities and/or use its facilities must be accompanied by members.

1.2 These By-laws may be altered, amended or deleted by the Club Manager when it deems necessary in the best interest of the Club.

1.3 A printed copy of these By-laws and any subsequent additions, alterations, amendments thereto or deletions therefrom shall be posted on a notice board in a conspicuous place within the Club. Failure to notify any person of any addition, alteration, amendment to or deletion from shall not negate its validity.

1.4 All Members/Visitors are subject to the By-laws of the Club and such other rules as may be introduced by the Club Manager from time to time in respect of the use of any particular facility. Any question as to interpretation shall be left to the Club Manager whose decision shall be final.

1.5 These By-laws are written in English only.

2.0 Objectives

2.1 The Club is managed and operated by the Club Management

to provide various kinds of recreational and educational

activities so as to flourish friendship and understanding

among Members.

3.0 Membership

3.1 Membership of the Club shall only confine to Residents of

Laguna City holding valid “Resident Cards”. Acting

always in the best overall interest of the Club and its

Members, the Club Management reserves the right to accept

or refuse any Resident Cards application.

3.2 The Resident Card shall be treated as identity of membership

which gives the right of the card holders on the use of the

Club facilities upon payment of any charges/fees which shall

be decided and imposed by the Club Management subject to

review from time to time when necessary.

3.3 Persons holding Resident Cards shall be regarded as

“Members” of the Club in the interpretation of the By-laws,

Rules and Regulations governing the use of the Club

facilities.

4.0 Visitors

4.1 Before any Visitor of any Member shall be permitted to use

any of the Club facilities, the Member may require providing

such information regarding the Visitors which the Club

Management and /or its staff may require.

4.2 A member introducing Visitor will be hold responsible for

their behaviour and for the observance by their Visitors of

the By-laws of the Club.

4.3 The Club Manager may from time to time, especially during peak periods, restrict the number of Visitors that a Member can bring to the Club and/or the use of Club facilities by Visitors.

4.4 Visitors shall be required to undertake to comply with any conditions, which may be attached to his permit, and to observe the By-laws of the Club while enjoying its hospitality ad its facilities.

5.0 Resident Card

5.1 The Club Management, the Club Manager and/or its staff and any other persons as authorised by the Club can require production of Resident Cards from Members at any reasonable time on request for the purpose of identification.

5.2 The use of Resident Card shall be subject to By-laws, Rules

and Regulations governing the use of the Club. 6.0 Opening Hours

6.1 The Club will normally open at 7: 00a.m. and close at 11:00p.m. daily. The Club Management may, as its discretion, change the time of opening or closing.

7.0 Procedures for Typhoon and Tropical Storm

The Club will follow the following procedures in the event of typhoons and tropical storms:

7.1 The Club will close as soon as a No.8 or higher signal is hoisted. Members and visitors on Club Premises should evacuate immediately.

7.2 When a typhoon or tropical storm has passed Hong Kong, i.e. a signal lower than No.8 is hoisted or all signals are removed altogether:

— before 5:00p.m. the Club will resume normal operation two (2)hours after such announcement is made by the Hong Kong Observatory :

— at or after 5: 00p.m. the Club will not open on the same

day.

7.3 Operations of the Club may be affected when the Black rainstorm Signal is in effect. Members are advised to phone to the Club in the event of rainstorms for necessary arrangements.

7.4 The Club Management reserves the right to close or temporarily suspend any of the facilities or services of the Club for reasons of safety at any time without giving prior notice.

8.0 Conduct of Members and Visitors

8.1 Members are responsible for the safety and conduct of their children if entry is permitted whilst they are on the Club premises and must monitor their children’s behaviour so as to ensure that they are in no physical danger and are not acting in an unruly manner.

8.2 No radios, cassettes, compact discs, musical instruments and/or equipment capable of making sound reproduction or other like objects which are audible to others shall be played within the Club without the prior consent of the Club Management and/or the Club Manager.

8.3 No subscription lists raffles or canvassing of any kind will be permitted within the Club unless the prior written consent of the Club Management and/or the Club Manager has been obtained.

8.4 No animals shall be brought onto the Club.

8.5 Any Member or visitor who breaks or damages the Club property shall be liable to pay to the Club the cost of replacement or repair of such Club property at the absolute discretion of the Club Manager.

8.6 The holding of any organised activity, irrespective of its nature, or the giving of lessons whether free of charge or for a fee or any form of reward is prohibited unless prior approval in writing by the Club Manager is obtained.

8.7 Certain areas of the Club may be classified as non-smoking zones at the discretion of the Club Management smoking is strictly prohibited or non-smoking zones.

8.8 Meals and refreshments shall only by consumed in the Poolside Lounge and Karaoke where such services are provided.

8.9 No Members or their visitors shall bring on to the Club, his own food, drink or other refreshments unless prior approval is obtained from the Club Management and/or the Club Manager.

8.10 In order to enforce the Club By-laws, Rules and Regulations, the Club Management and/or Club Manager reserves the right refuse entry to the Club or any part thereof to any person and shall reserve the right to demand that any person who has entered the Club, leave the Club or any part thereof forthwith. It shall not be necessary for the Club Management and/or the Club Manager to give reasons for such actions.

8.11 No member and visitor shall sell, let, hire, offer or expose for sale or let or hire any article or thing or any personal service or solicit gifts of contributions for charity within the Club except with the express written permission of the Club Manager.

8.12 No Member shall give any money or gratuity under any

pretext whatsoever to any staff or employee of the Club. 8.13 No person within the Club shall 1. Spit ;

2. Conduct himself otherwise than in a quiet, decent and

orderly manner ;

3. Do any act which is likely to endanger, obstruct, annoy

or causing inconvenience to any person ;

4. Throw or otherwise dispose of any litter, paper or rubbish, except into bins and containers provided therefore by the Club :

5. Bread, deface, foul, soil or otherwise damage any wall, building, fence, seat, or other equipment, apparatus or facility or place, or foul or pollute any water ;

6. Remove or interfere with any apparatus or equipment ;

7. Without reasonable cause, utter any cry or make any noise or cause any disturbance, with the intention of, including but not limited to, causing alarm or anxiety to other Members or Visitors;

8.14 No Member or any Visitor shall remove any items of the

Club for use elsewhere. 9.0 Dress

9.1 Members/Visitors is required to be dressed appropriately

when using a facility or generally on the Club premises. 9.2 No slippers are not allowed on the Club premises.

9.3 The Club Manager may amend rules regarding the appropriate dress requirements for each or any of the facilities.

10.0 Liability of the Club

10.1 The Club shall not accept responsibility for any loss, claims, injury or damage to any property or thing brought onto the Club whether such loss or damage is caused directly or indirectly by any act, negligence or omission of the Club or its employees.

10.2 All persons using the Club shall do so at their own risk. The Club will not accept any responsibility for any claims, losses, accident or injury which may be sustained by any accident by any person whether arising directly or indirectly out of, or in connection with the use of the Club and/or other amenities ancillary thereto even if such accident is caused directly or indirectly by any act, negligence or omission of the Club or its employees.

11.0 Termination of Membership

11.1 The rights and privileges granted to any Member pursuant to these By-laws shall cease in the case of a Member who ceases to be Residents of Laguna City.

11.2 The Membership of a Member will be terminated if he ceases to be an Owner, Tenant of Occupant of a Residential Unit in Laguna City.

12.0 Suggestions and Complaints

12.1 Any suggestions and Complaints may be put into “suggestion box” which placed at the Club counter with contact details of the writer.

13.0 Use of the Club Facilities for Functions and Programmes

13.1 The Club Manager may at his absolute discretion rent out a particular area of the Club for a private function/programme of a Member.

13.2 Members will be given at least 7 days notice of such function programme and closure of a facility by notice posted on the notice board in a conspicuous place within the Club.

14.0 Booking of Club Facilities

14.1 All facilities used should be subject to the adhering to the

booking procedure mentioned hereunder. 14.2 Valid Resident Card must be produced upon booking. 14.3 All booking should be made in person.

14.4 Booking will be on first-come-first-serve basis and available

7 days in advance.

14.5 To facilitate more members to enjoy the use of the court facilities, each member will only be accepted to book for one session each facility except Snooker Room, Function Room and Dancing Room and two facilities per day. If the facility is available, a second session may be made after first session has been played.

14.6 Booking by Visitors is not accepted.

14.7 All fees paid are not refundable or transferable in any

circumstances.

14.8 Should Tennis Court booked is not available for use due to weather condition, date of use could be deferred within 7 days of the original booking with acceptance from the Club Management and/or the Club Manager.

3.7 The Club Management and/or the Club Manager may at any

time mark rules not listed above for the proper running and

good management of the Karaoke and shall post details of

such rules in a conspicuous place within the Karaoke

precincts.

4.0 Multi-Purpose Hall

4.1 A fee will be charged for the use of the Hall for the

following activities :

a. Badminton,

b. Basketball,

c. Volleyball,

d. Private functions approved by the Club Management

and/or the Club Manager.

4.2 Dress in the Hall shall conform to the activities organised.

Dress will consist of white, off white or other suitable sports

clothing and rubber soled, non-marking sports shoes without

heels.

4.3 No smoking in the Hall.

4.4 No person shall remove any equipment in the Hall to

anywhere in the Club without the permission of the Club

Management and/or the Club Manager.

4.5 No food or drink is allowed in the Hall.

4.6 Courts shall be booked in advance by payment of appropriate

fees to secure the court(s).

4.7 The Club Management and/or the Club Manager may at any

time mark rules not listed above for the proper running and

good management of the Hall and shall post details of such

rules in a conspicuous place within the Hall.
