For the reasonsset out below, we havedetermined here s insufficient evidenceto conclude the Disttict did not provide you a prompt and equrtablegrievanceprocedure asalleged n allegation2 of your complaint.Specifically,you alleged he District:

1. discriminatedagainstyour daughterand other femalesfudentson the basisof sex byallowing them to be subjected o a sexuallyhostile environment at the high schooland failing to take prompt and effective action to remedy sexualharassment;and

2. did not provide you a prompt and equitablegrievanceprocedure to addressyourcomplaint regardirg the sexuallyhostile environment.

In reachinga determination n this complaint, OCR interviewedyou by telephoneand nperson and reviewedcorrespondence ou and the District submitted. On February71.,201.3,OCR visited the District and nterviewed he former superintendent, residentof the schoolboard, assistance uperintendent, igh school principal, and the assistant igh schoolprincipal. The legal and factualbases or OCR's determination are set forth below.ALLEGATION 1 - Request for Early Resolution - Voluntary AgreementPrior to the completion of OCR's investigation, the District submitted a signedAgreement(.opy enclosed)on Match 19, 201.3,that,when ully implemented,will addressallegation1of this complaint.l The Agreement requites the District to: 1) offet counseling services oyour daughter and he othet six femalestudents dentified in the 2071-12senior ist; 2) issuea statement, o all high school students,patents and staff and printed in the high school'sandf or Disttict's newsletterstating he District does not tolerateactsof hatassment,including actsof harassment asedon sex and watoirg that students ound to have engagedin actsof harassment r other acts hat createa hostileenvitonment basedon sexwill bepromptly disciplined and make clear hat suchdisciplinemay include, f circumstanceswarranq suspensionor expulsion;3) establisha studentcommittee to provide a forum forstudents o discussmattersconcerningdiscriminationor harassment n the basisof sex,increase tudent.awarenessf the District's antt-hatassment fogram, and suggestmeasuresfor improving the effectiveness f the Disuict's program; 4) develop and conduct a schoolclimate survey o be used on an annualbasis ot studentsand staff to assesshe presenceandeffect of harassment asedon sexwithin the high school; 5) developand delivetdiscrimination andharassment rairung for annualpresentationto the Disttict's high schoolstudents;and 6) ensurehigh school administrators,and other high school staff at theDistrict's discretion,receivetraining on what actions or behaviorsmay constitute unlawfulharassment.Please onsult the Agreement fot further details.OCR considers allegation L resolvedeffective the dateof this letter and will monitor theDistrict's implementation of the Agreement.
