NEW SECTION. Sec. 70. It is the intention of the legislature
that after January 1, 1975 no warrant issued by the state in payment
of salary and wages or reimbursement of expenses paid state officials
or employees shall contain any statement, representation, contract,
or commitment that requires the payee to consent thereto as a
condition of endorsement or receiving payment of such warrant.
NEW SECTION. 'Sec. 71. All acts of the Legislative Budget
Committee and of the House and Senate Committees on ways and Means in
approving proposed expenditures from unanticipated receipts under
subsections (2) and (3) of section 67, chapter 142, Laws of 1974 1st
ex. sess. (uncodified) and in approving exceptions to subsection (1)
of section 67, chapter 142, Laws of 1974 1st ex. sess. (uncodified)
are hereby approved and ratified.
NEW SECTION.. sec. 72. If federal funds become available for
use in capital improvements at the schools for the retarded, such
federal funds will be used in lieu of state funds appropriated for
that purpose in chapter 142, Laws of 1974 1st ex. sess.
NEW SECTION. Sec. 73. It is the intent of the legislature
that to the extent any district received funds through the state
apportionment formula in excess of the amount anticipated when such
district established its excess levies for the 1975 collection which
relieves special levy burdens, the local district should place a
first priority on reducing such special levies.
NEW SECTION. Sec. 74. All personal services contracts except
those which the director of the office of Program Planning and Fiscal
Management may exempt after consultation with the Legislative Budget
Committee shall be filed with the office of Program Planning and
Fiscal Management and the Legislative Budget Committee prior to
obligating any portion of the appropriations approved in this 1974
amendatory act.
NEW SECTION. Sec. 75. In order to carry out the provisions of
this 1974 amendatory act, the director of the Office of Program
Planning and Fiscal management with the approval of the governor,
may:
(1) Allot all or any portion of the funds herein appropriated
or included in this budget, to state executive agencies subject to
allotment requirements for such periods as he shall determine and may
place any funds not so allotted in reserve available for subsequent
allotment. The aggregate of allotments shall not exceed the total of
applicable appropriations, local funds available and unanticipated
receipts approved for expenditure. It shall be unlawful for any
officer or employee to incur obligations in excess of approval
allotments or to incur a deficiency and any obligation so made shallbe deemed invalid. Nothing in this section or in chapter 328, Laws of

efficiency and conserve funds.

held invalid, the remainder of the act, or the application of the

8. Pog of Prison Terms and Paroles
on page 61, lines 22 through 28, I have vetoedthe entire section 49.
This appropriation of $211,297 was intended tofund the costs of reorganizing the Board ofPrison Terms and Paroles under t he provisions ofEn rossed Substitute House Bill No. 647. Thisbill was not approved by the Legislature, and theappropriation is unnecessary.
9. D@_artment of Revenue
On page 62, section 50, I have vetoed the provisostarting on line 3 and ending on line 6.
Under this proviso the Department of Revenuewould be reyuires to use 1972 values instead ofthe 1973 va ues which would be contrary tolegislativq intent. The confusing language inthis se~tion wa* a result of an qrror inlegislative drafting, and removal of this provisois supported by the Department of Revenue toclarify the basis of distribution to librarydistricts as contained in this section.
10. Dqpartment of Revenue
On page 62, 1 have vetoed the entire section 51.
This appropriation is intended to reimbursecertain taxing districts in Pierce County forlosses they might suffer under the recentWashington State Suprm or eiin iValentine v. Johnsto, 83 Hn. 2d 390 11974) . Iam VieTBIffg -Thi-9tc~on in its entirety forseveral reasons. First, the language used in~theappropriation may be technically in grror sinceit provides for a payment to the Pierce CountyRefund Fund for amounts paid to certain 'taxingdistricts. Payments from fl~e VgfuRU-Pu are noUipq~ T neTaxing districts but rather to theindividual taxpayeV. Second, the necessarymechanics already exist in the present propertytax laws (RCW 84.68.030 and 84 .68.040) for thecounty to reimburse itself for payments from theCounty Refund Fund. County officials also haveseveral other alternative courses of action tomake the necessary adjustments. Third, thisa ppropriat ion discriminates against certain unitsof local government such as the county and portdistricts in that they are excluded from theproposed reimbursement. Fourth, thisappropriation requires taxpayers all over thestate to provide the necessary funds to resolve aproblem unique to a single county. This is notequitable nor is it necessary given the fact thatlocal officials have ample means to resolve theproblem.
11. DeRartment of ECologyl
on page 63, I have vetoed the entire section 54.
This section appropriates $680,400 from federalsources to the Department of Ecol ogy and directsthat this amount be granted by the Department toactivated air pollution control authorities.
Presently the Environmental Protection Agencydirects the manner and designates agencies whic hmay ur~ceive federal funds avai la le for air
p1ution control. The effect of the langua qe inthis section could bring the state in conflictwith federal req ulations and jeopardize thereceipt of any of t ese federal funds. Federalfunds *are made available to the state for astatewide air pollution control proq ram withavailable funds directed to be used by thoseagencies which th6 Environmental ProtectionAq ency considers can contribute the most tostatewide control. if the Environmental

Protection Agency were to require that a lesser vetoamount than that contained in the appropriation Messa.should go to local authorities and a greateramount to the Department of Ecology, thisap proprIat ion could result in withholding of allfederal- air pollution control funds from thestate. Further, should any local authority ceaseto function which is a possibility, theDepartment of Eco logy is required by statestatute to carry out the air polution controlefforts in that area. Federal funds desi qnatedfor that area should reasonably be available tothe Department to carry out thoseresponsibilities. This would not be possibleunder the terms of this section.
12. Apportionment Formula Funds
on page 70 1 have vetoed the entire section 73.
The section would require local school districtsto place a high priority on reducing speciallevies to the extent that any districts receivestate apportionment formula funds in excess ofthose anticipated when the districts establishedtheir excess levies for collection in 1975.
This section purports to direct that the twenty-five million dollars ayprogriated in section 13of this bill be* employed foar relief of speciallevies. In fact, it does nothing of the kindinasmuch as the referenced appropriat ion was nomade through the apportionment formula. To saythat this constitutes s pecial levy relief is acruel hoax to beleaguered taxpayers across thestate.
It now appears that the twenty-five milliondollars appropriated in section 33 may bechannelled to fund salary. increases forcertificated personnel . I init ially contemplatedvetoin? both sections 33 and 73 on the groundsthat he purported special 1evZ relief gase bythe Le qilature was purely fictitio us. I haveinstead sdetermined to veto only section 73 andallow the section 33 appropriation to be used forsalary increases for certificated personnel. Anysuch increases will be taken into account whenInext present a request to the Legislature to dealwith the question of salary increases for stateemployees and employees in the higher educationsector.
13. Leqislative ajRRval retguirements.
For the reasons set forth below, I havedetermined to veto certain items appearing asfollows:
1. Page 8, section 21, beginning on line 30 andending on pae9 line 1;2.Page 10 seclion 24, beginning on line 15 and
ending on line 22;3. Page 40, section 25, beginning on line 20 andending on line 21;4 . Page 43, section 26, line 5.
Each of the referenced items provides for thereview and approval by the Legislature ordesignated legislative committees of actionsand/or expenditures authorized in theirrespective sections. This requirement violatesthe fundamentals of goodi government byinterposinq legisl ative interference in theadministrative process. Thq Legislature willalways have th e prerogative to set, bylegislation, basic policy and such guidelines asmay be needed for its. implementation. Havingdone so, however, administrative agencies must beentrusted to carry out its functions withouthaving to seek legislative approval at every turnof the decision-making process.
With the exception of the sections and itemsdescribed above, the remainder of En rossedSubstitute Senate Bill No. 3253 is aprove.
