We hereby request a variance to Article 17-8-201 of the Anne Arundel County Zoning Code -Development on Slopes of 15% or Greater on the above-referenced property. We are proposing a newtwo-story single-family dwelling with a covered porch with steps to grade and a 12'xl5' (irregular) deck.The property is located at 1530 Circle Drive in the Winchester on the Severn subdivision of Annapolis. Itis comprised of lot 149. It is located on map 39, block 23, parcel 176 and consists of 13,619 square feet.It is zoned R-2. The property is located in the Critical Area and has a critical area designation of LimitedDevelopment Area (LDA).
The property is undeveloped. The house wilt add 1,944 square feet of impervious coverage. Theproposed driveway and concrete sidewalk would add an additional 1,009 square feet of imperviouscoverage for a proposed total of 2,953 square feet of impervious coverage well below the allowablelimit of 4,255 square feet.
The 13,619 square foot property is well below the 20,000 square foot area for lots in the R-2 Zoningdistrict. Development on this property is severely limited due to the presence of steep slopes. Inaddition it is burdened with Anne Arundel County Department of Public Works storm drainage rip-rapon a portion of the property with an associated utility easement that travels along the southern side ofthe property and across the middle of the lot. Most of the property is burdened with steep slopes.There is also a Stream Restoration Project (Winchester on the Severn Outfall Restoration, Project 15-037, GP02017036) proposed on this property.
The proposed house and its footprint are very modest in size. The approved septic system and requiredseptic replacement systems consume all of the property in front of the proposed house and dictate theclosest point that the house can be constructed to the front yard property line. The house cannot belocated any closer to the road. A very modest house footprint has been proposed in an effort tominimally impact the slope. The Stream Restoration Project has a Limit of Disturbance as indicated onthe site plan that runs along the southern property line and through the middle of the lot. This limit ofdisturbance is for the construction of the Stream Restoration Project. In the "pre-file" meeting with theCritical Area staff it was recommended that the proposed house be located closer to the southernproperty line in an effort to keep the disturbance that will take place with the house construction withinthe limit of disturbance for the stream restoration project in an effort to minimize disturbance overall.Also the slope is less severe on that side. Therefore the house is shown twelve (12) feet from thesouthern property line with a rain garden on that side of the house while the northern side of the houseminimizes the disturbance to the steeper slopes.
The variance will provide necessary relief to an extraordinary hardship created by the Anne ArundetCounty Zoning Code. The proposed house is very modest in design and is in character with thecommunity. The property is burdened with steep slopes, the utility easement and the septic systemlocation. The house has been proposed in part in area that will already be disturbed with theconstruction of the Stream Restoration Project. There are many homes in the community of Winchesteron the Severn that are located on steep slopes so no special privilege will be granted by allowing thevariance.
