Afer your marriage ends, do you andyour spouse each get hal o what youown? Are you also each responsible orpaying hal o your debts? Not necessarily.
Te Family Law Act came into play inBC on March 18, 2013. It empowers thecourt to order an unequal division o am-ily property (and debts) i splitting them50-50 would be “signi cantly un air.” Arecent case illustrates this.
Jack and Jenny (names changed) mar-ried in 1997 and had our children. Teyseparated in 2009. In early 2013, Jenny gotan order or sole custody o the kids, andJack was ordered to pay child support o$754 a month.
Jenny applied to the court in July, 2013to deal with the division o the moneyrom the sale o their house. (Jenny wasalso granted a divorce.)
Te court looks at several things to de-cide i an equal split o amily propertywould be signi cantly un air, including,but not limited to the ollowing:
• the length o your relationship• any agreements you’ve made with each
other• contributions made by you to the
other’s careerAs well, the court can look at “any other
actor … that may lead to signi cant un-airness.” Tat’s what the court did here.
Early in 2010, Jack and Jenny agreedbetween themselves that Jack would keepabout $100,000 worth o business equip-ment and vehicles, and Jenny would getthe house instead o child support. Jennyaferwards paid the mortgage on the housewith help rom her amily, but despite the“agreement” (and a later one where Jack“gifed” the house to her i she paid off
their amily loans to buy the house), thehouse was never trans erred to her.So in August, 2013, Jenny got a court
order to sell the house. Te sale resulted innet proceeds o about $70,000.
Explaining why splitting the house saleproceeds in hal would be signi cantlyun air here, the court said: “… there areelements to this case that clearly militateagainst dividing up the proceeds of saleequally between the parties. …[Jack] in-tended [Jenny] to have the equity from thematrimonial home in lieu of child support.While that might have made sense to the parties at the time, it re ects a view thatall of the [other] matrimonial property, in-cluding the equipment and vehicles worthapproximately $100,000, belonged to [Jack]to dispose of as he saw t without regardto [Jenny’s] interests... If the proceeds fromthe sale of the matrimonial home were di-vided equally …, [Jack] would be receivinga double bene t – giving [Jenny] the homein lieu of child support and then effectivelyclawing half of it back, while still retaining… the equipment and vehicles.”
Te court decided Jenny should get allthe house sale money. Tis would takecare o Jack’s outstanding child supportobligations rom the time o their separa-tion to March 1, 2014 (over $35,000). Hecould keep the roughly $100,000 worth obusiness equipment and vehicles that hegot in 2010.
In addition to an unequal split in somecases, certain property may be excludedaltogether rom the division o amilyproperty.

On a sunny afternoon in June, a memorial bench was unveiled tohonour the life of Bernice Gilbert, an active member of the
Victorian Hospital of Kaslo Auxiliary Society.The bench was built by Bernice’s husband,Graham Gilbert. It is made of beautiful
clear cedar. Placed in an area of theVHK courtyard grounds, the benchwill provide a shady place for visitorsand residents of the Long Term CareFacility to sit, to visit or simply enjoy
time in the garden. Honora Cooper, VHKAS past-president,at a short dedication ceremony.Various members of the communityspoke at the unveiling.
Bernice was a cherished member of the community of Kaslo anddedicated many hours of service to the VHKAS. She died suddenly on
August 16, 2013 when stuck by a tree in Wells Grey Provincial Parkwhile on a camping trip.

As a child, Anna lived in the Pend D’Oreille Valley;she moved to Fruitvale in her teens. She passedaway peacefully with her family by her side af-ter suffering a stroke and a battle with cancer.Anna was a very strong and hardworkingwoman who cared for her family very much.She was always loading up the grandkidsinto the motorhome and taking the kids toFort Steele or Rock Creek Fair or somewhereelse. Anna enjoyed curling, horseback riding,
slo-pitch and mostly her children and grandchil-dren. She looked after the family business, NDB
Trucking, until her health declined.Anna is survived by her husband Neil; sons Ron
of Fruitvale, Len (Donna) of Fruitvale; daughter Shelley (Sid) of Salmo; sis-ers Irene (Don) Hill of Robson, Kathy (Jack) Seville of Robson; brothers GaryDiane) Buckley of Camrose AB, Hugh (Shirley) Buckley of Pend D’Oreille
Valley; Fred (Janice) Buckley of Pend D’Oreille Valley; 8 grandchildren,
7 great-grandchildren and many nieces and nephews.There will be no service at her request. A family gathering will beset at a later date. She will be missed by all who knew her.

Healthcare Select Committee andKaslo Village Council met with
Interior Health Authority (IHA)CEO, Dr Halpenny and two seniormanagers, with regard to the VictorianCommunity Health Centre in Kaslo.Council advised that Drs Allen,Fontaine and nurse Robert Nelliswould be made ex-offi cio members othe Health Committee at their meetingthat night and IHA concurred that thatwas a good step towards improvingcommunication between themselves,local government and the community.
It was also recommended that IHAappoint a Medical Director or Kaslo’shealth centre, and IHA agreed todiscuss the leadership role that thedoctors could play afer both ull timecontracts begin on September 15th.As part o the ongoing improvementto community health care it was
recommended that an annual reportbe produced. Te Committee andCouncil will continue to providein ormation as needed.
10. Lardeau Wharf Park ApprovedTe provincial government has
approved a 30 year lease o landadjacent to Davis Creek ProvincialPark in Lardeau so that the RDCK can
create a regional park with a publicwhar . RDCK staff will now workwith local residents on the siting andbuilding o the whar , unds or whichwere put aside through a CommunityDevelopment grant several years ago.
