INVESTMENT IN KOH SAMUI
Whether you are looking to buy a property in Samui as a rental investment, a holiday home
or to relocate on a permanent basis, it is essential to know how the Tourism Industry is
performing.
The island has longer high season periods than most other islands in Thailand.
Koh Samui has experienced a real estate expansion in the past few years. Unlike other
Thai destinations, such as Phuket, the island of Samui still has huge potential to grow.
The number of investors keeps on increasing. If in the past they were mainly British,
French, German, Australian and Russian, the market is now at its peak for Chinese, Indian,
South Korean and Middle Eastern investors.
Due to the potential to generate high returns, Samui became one of the top places to invest.

THAILAND PROPERTIES LAWS
Real Estate in Thailand is open for foreigners and can be secured reliably as long as the
purchase is made within the legal rules and with the assistance of a local lawyer.
There is no restriction for foreigners to own a property (buildings, structures, villas and
apartments) in their own name.
However, there are certain restrictions imposed on the ownership of the land by foreigners.
Purchase of a land in Thailand
There are two possibilities explained here but kindlye note that the option 1 is not
applicable in this real estate project; the only way is the option 2.
Option 1 : Lease the Land
The Lease Agreement offers you the right to use and access the land while it still belongs
to the owner.
The maximum registered lease term is 30 years but this can be renewed for 2 further
periods of 30 years each.
Option 2 : Setting up your Thai Company to own the land
As foreigners are not permitted to own a land in their personal name, the solution is to set
up a Thai Limited Company.
Indeed, a foreigner is allowed to own 49% of the shares in a Thai Limited Company. The
rest of the shares must be held by Thai juristic people. As the managing director, you will
have the voting majority and you will have the ultimate control of the company. This legal
situation gives you the right to own a land in Thailand under the name of the company.

purchase agreement, the construction contract and the setting up of your Thai Company,
making this experience easy and carefree.

PURCHASE PROCEDURE
The payment will be spread out in 5. 30% of 4.9M THB have to be paid upon
signing the due diligence. The deposit can be transferred to the Escrow bank
account of the lawyer until the begining of the constuction in February 2018.
Afterwards, the remaining amount will be spraid over 1 year time in tranches of
20% , 20%, 15% and 15% respectively. The exact deadlines and others specificities
will be discussed and specified in the construction contract.
