If you are wondering if you need a guardianship for a loved one, like an elderly parent, there are a few key points you should consider. These include first deciding whether you or someone else can qualify under the Texas Probate Code to be a guardian. If you will be seeking a guardianship for your loved one’s (termed the proposed ward’s) estate, then you need to think about whether or not the proposed guardian can qualify for a bond. Finally, the applicant will be required to provide to the Probate Court evidence that the proposed ward is in fact “incapacitated.” To be “qualified” to serve as a guardian for a proposed ward, the proposed guardian must not be “disqualified” under §681, Tex. Probate Code. A proposed guardian cannot owe the proposed ward money, the proposed guardian cannot have an adverse claim against the proposed ward, or for any other good reason, the proposed guardian cannot be incapable of properly or prudently managing and controlling a ward or a ward’s estate.

In Texas, there are two types of guardianships. There is the “guardian of the person” of the proposed ward and the guardian of the “estate of the proposed ward.” The guardian of the “person” may be appointed by the Court to care for the well being of the proposed ward. This could include medical care, living arrangements, medications, and day-to-day living decisions that need to be made for the proposed ward.

The “guardian of the estate” of the proposed ward manages the proposed ward’s financial affairs, monetary issues, and, in general, the proposed ward’s assets and property.

Every proposed ward’s circumstances will be different and you will have to decide if your proposed ward is in need of either or both types of guardianship. The Tex. Prob. Code §3(p) defines “incapacity” which will help you to determine what type of guardianship is necessary.

In every guardianship, a bond is required where the court appoints someone as the guardian of the proposed ward’s “estate.” It is a good idea to contact a bonding company, or a local insurance company, about pre-approval. The amount of the bond will be up to the probate judge and depends on the character and amount of the proposed ward’s income and assets.

In order for the Court to appoint any type of guardian, the Court must find that the proposed ward is “incapacitated.” The applicant will need to file with the clerk a Doctor’s Certification Letter as described by §687, Tex. Prob. Code. You probably want to seek out and use the proper form required by the probate court. Only a Doctor’s Certification Letter prepared by the physician within 120 days of the application

for guardianship may be used to determine the proposed ward’s incapacity.

Guardianship in Texas can be complicated. The statutes are designed to make sure the court only intervenes in those cases where an individual is truly “incapacitated” and in need of guardianship. To be successful, you will want to hire an experienced probate and guardianship lawyer to help you with the process. In most cases, the costs including attorney fees may be charged to the proposed ward’s “estate” by order of the Court.

Giving Wounded Warriors and their Families a Second Chance That imagined scene is all too real and Retired Army Colonel Tony Arnold wants to change it—with the help of Operation Second Chance and our local community. Operation Second Chance is a national non-profit organization of patriotic citizens committed to serving our wounded, injured, and ill combat veterans.

“We can be proud of how our citizens here have recognized and honored our Wounded Warriors. These recovering Service members have a choice of activities almost every weekend,” says Tony. “But very few of these activities include their families.”

This situation is changing as Tony, his wife Cynthia, and a planning committee of nearly twenty locals organize the first annual Kerr County Wounded Warrior Family Hill Country Adventure. This summer, July 10-14, six Wounded Warriors, their spouses and children will gather for a unique opportunity to sample an assortment of diverse Kerr County activities.

Creating a Hill Country Adventure Festivities begin Wednesday night at Mamacita’s with a dinner and welcome by the Mayors of Kerrville and Ingram for the Wounded Warrior families, volunteers, and donors. Inn of the Hills serves as home-base for the five fun-filled days and four nights.

“Each family will receive a directory of great activities to choose from,” according to Tony. “The children six to sixteen years of age will enjoy time at Camp Stewart for Boys and Heart O’ the Hills Girls Camp. The younger ones, ages one to five, will be entertained by the First United Methodist Church’s child care.

The exciting mix of donated activities for the Wounded Warriors and their spouses include:

• Golf clinics, play, and lunch at the Scott Schreiner Golf and the Riverhill Country Clubs

• Guadalupe River trip and picnic with Kerrville Kayak and Canoe

• Fly fishing casting lessons from the Hill Country Fly Fishers on Thursday

• Hill Country Shooting Sports Center’s clinics, activities, and lunch

• Guided tours of local wineries by Hill Country Wine Tours

• Local museums and art galleries tour • Exotic game hunt led by Darrin Potter, with breakfast

and lunch on Thursday and Friday • Artist Donna Lafferty’s water color classes and lunch

on the scenic Guadalupe with a take-home watercolor “toolkit”

• Relaxing, restorative sessions with Reiki Master Anne Schneider

• Saturday scenic and shopping tour of Kerr County—begins at Camps Heart O’ the Hills and Stewart, goes through Ingram and continues on for lunch in Camp Verde; return to Kerrville to tour downtown and end with tour of James Avery Craftsman Inc. (a $300 credit card per family will be provided)

Additional fun includes a fish-fry by the Ingram Bass Club, a BBQ by Kerr County Commissioner Bruce Oehler and the project Committee Members, a Saturday afternoon of activities and dinner at CampCAMP, and a Sunday farewell luncheon by First United Methodist Church with a send-off from the Kerr County Commissioners Court. “We want these families to get a genuine taste of the Texas Hill Country,” explains Tony.

Sgt. Jack Williams, one of more than three dozen Wounded Warriors who experienced the thrill of exotic game hunting in Kerr County with Darrin Potter of Ingram, Texas.

Going Beyond the NumbersOperation Second Chance cites the staggering post-9/11 figures as of December 1, 2012: 50,291 wounded, an estimated 400,000 with the invisible wounds of war including combat-related stress, major depression, and post-traumatic stress disorder, and about 320,000 with traumatic brain injury. And because most of the wounded are in their early twenties, they will need decades of help, some of it intensive care by health care professionals.

“By offering a variety of activities in a beautiful Hill Country setting, we can provide a brief escape from the hospitals and a welcomed retreat as our wounded and ill Service members and their families adjust to their new normal,” suggests Tony.

The vets spend months (and sometimes years) in outpatient care, many at the Brooke Army Medical Center in San Antonio. The BAMC encompasses the Center for the Intrepid—home to the largest inpatient medical facility in the Department of Defense. The hospital is the DOD’s only burn center and Level 1 trauma center in the US.

Volunteer—Make a DifferenceHey neighbors, the BAMC is in our own backyard! What better place than here to lend a hand in making a powerful difference in the lives of our Wounded Warriors and their families? Operation Second Chance cites the striking fact that we have ten percent of the population protecting the other ninety percent of us.

“We’ve already received an enthusiastic response from the Kerr County Commissioners Court, the Mayor, the Rotary, and the Lions Club,” Tony reports. Additionally, the Alamo Area Council of Governments’ Alamo Regional Transit will provide three large vans for the five days of activities.

“We’ve been blessed with generous local financial support for the Wounded Warrior family adventure—the late Ruby Stevens of the Stevens Foundation was our major donor,” continues Tony. “What we need now are volunteers to help us with logistics during the five-day event.”

Volunteers need to be willing to run errands—things like picking up items and providing supplemental transportation to the Wounded Warriors and their families so they can fully enjoy the many activities offered. “These volunteers will be critical to the success of the first annual Wounded Warrior Family Hill Country Adventure,” assures Tony.

Tony concludes, “One of the wives I’ve spoken with had tears in her eyes when she described the feeling of being alone with all the responsibilities of caring for her Wounded Warrior. We want her to know she’s not by herself and that her sacrifices are recognized and appreciated, as well as her spouse’s.”

Stuck in the credentialing, coding and billing quagmire?Tia Aspra Tia first noticed the problem as the office manager for the medical director of a small hospital here in the Hill Country. Due to the complexities of the commercial insurance system and the government red tape associated with Medicare and Medicaid, many of the bills were in jeopardy of not being paid by the carriers. The daily task of submitting clean claims and the follow up necessary requires 100% of the time of the billing person or billing company to ensure a healthy accounts receivable.

What Every Doctor Needs to Know


Billing ServicesShe saw a trend developing in medical offices. One person handled the billing aspects of the business. That same person was also responsible for handling many other important responsibilities of a busy medical practice (making appointments, patient care, chart retrieval, managing payroll, and other office duties). This person simply did not have enough hours in the workday to devote to filing the claims and doing the follow up for optimal reimbursement.

“Physicians and their staff often get caught between the tasks of ensuring timely medical billing and providing patient care,” Tia says. “They submit the medical claims on behalf of the patient to the carrier and have to wait 30 to 45 days for reimbursement. Or worse, a denial of payment from the carrier. They need someone who will swiftly and aggressively fight for their money.”

For Tia, the solution was simple: Billing brings in money, and billing requires one person or a team of people to exclusively handle the task. Tia realized she could provide the focused energy doctors needed and help them collect the money they deserved. Thus the FIRM (Financial Investigation and Reimbursement Management, Inc) was born. Chris and Tia Aspra, along with business partner Pam Kendricks, have devoted a combined total of nearly 30 years’ experience to building a powerhouse medical billing, credentialing, and consulting firm.

With changes in the healthcare system, including a contemplated cut of about 26 percent in doctors’ fees, doctors will be working harder than ever for the same or even smaller paychecks. “That means you’ve got to fight for every penny,” Tia says. “An office staffer gets paid the same, regardless of the billing cycle. We get paid on commission, so we are motivated to work hard to collect that money. Despite paying a small commission to The FIRM, the doctor enjoys much higher revenues.”

Mandates on EMR/EHR (Electronic Medical Records/Electronic Health Records) systems can take advantage of many physicians. “Salespeople pitch doctors a system that supposedly can do everything, but it’s just not true,” informs Tia. “After purchasing the system, many physicians wind up disappointed or angry because they find that the software still requires a human element. If you don’t know all the ins and outs of the insurance system, the software isn’t going to do it for you. Tech support is often lacking, the system is not what it’s built up to be. In the end doctors lose money.”

Highlights—coloring some of the hair strands lighter than the natural or all over color to add the illusion of sheen and depth. There are several ways to achieve this "special effect."

One way is weaving, one is slicing, and another is balayage or free form. The technique/terminology most commonly used in salons is weaving. So when you go to have your hair done say that you want a weave. That should lead your stylist to ask, "How much of a weave do you want?"

Then you can discuss how much of your head you want covered. Face frame only,

partial weave, or full weave. This will also determine your cost. Then discuss the size of the weave. Chunky/heavy/thick, light/natural/thin, or somewhere in between. You can also ask for lowlights, which would be alternating in a darker color so that you get a lot of depth to your color. As for fashion, it depends on you. Do you like the big, chunky high contrast look, or a classic blended natural look? You face shape makes no difference in this process, that is in the realm of the cut.

Each stylist has strong and weak points. Some are no good at all with weaving but are incredible with cutting and styling. In general, not a rule, less expensive salons will

have less experienced stylists or stylists who are not that great at color. I recommend that you choose a stylist by word of mouth. Pay attention to what you see on other people and do not be afraid to ask who does their hair. Also, go to a book store and get some hair magazines. Look at the color on the models to see what you like and take it in to your stylist. That will help you to be more on the same page as her when discussing your color. Hope this helps.

A Lost Chapterof Kerrville History Found

the past two years I have been corresponding with Dana Lowe, a friend in Rockvale, Tennessee who has family connections to Kerrville. While we are not related by blood, we share relatives in common (we refer to each other as long-lost step-cousins) and are both incurable genealogy geeks. Together we have been delving into the lives of two early Kerrville families: the Steagalls and the Gregorys.

Through our shared interests we have been able to identify unknown individuals in our family photo collections, learned about the lives of these two families, and brought a forgotten image of downtown Kerrville back into the public eye. The story I am about to tell you is about one of Dana’s relatives, William V. Gregory, an early Kerrville resident who helped shape our town but has been (literally) lost in the annals of local history. The pictures come from both our collections and if we hadn’t been working together, neither of us would have known the treasures we each held.

William Vandyke Gregory (December 12, 1846 - January 29, 1931) was 29 years old in 1875 when he left his native home in Marshall County, Tennessee, and moved to Kerrville. Within the first three to five years of his residency here, Mr. Gregory proved his entrepreneurial spirit: He established a shoe shop, a hotel called The Gregory House and had a horse trading business as a sideline.

In October, 1878 Mr. Gregory was a witness to the aftermath of the Dowdy Family Massacre, one of the last known Indian raids in Kerr County. He was a family friend of the Dowdy’s and was riding to the family’s home on Johnson Creek for a visit—two miles south of the Dowdy home he learned of the attack. Gregory raced to the scene and arrived as the bodies of the Dowdy children were laid before the family. His account of the tragedy was published in the October 7, 1878 issue of the San Antonio Express. “Alice lived long enough to recognize her mother—spoke the dear name of ‘Mama,’ and expired,” his account said.

He was very much a part of small town life. Gregory was remembered in a column by J.J. Starkey in the August 6, 1931 issue of the Kerrville Times, a memoir of life in early Kerrville:

“While going to school at the old building then on the Secor Hospital Corner (now John Miller’s National Car Sales), the teacher being Professor Ryan, the boys got together their nickels and dimes and bought a round rubber football. A jury, out on a case, borrowed our football and started a

game near the old stone courthouse. One of the jurors struck the ball with a stick and punctured it. They had W.V. Gregory, who was a shoemaker then, mend it; but as I remember the ball never held air so well thereafter.”

1880 was the year that changed Mr. Gregory’s life. He injured his left knee while working and it became so infected that the leg had to be amputated. The amputation was performed by four doctors—Drs. White, Nowlin, and Harwell from Kerrville and one other (un-named) physician from Comfort. The operation took place in the home of Joe Robinson, a “little residence situated in the southeast corner of the Starkey Farm.”

Joe Robinson’s sister-in-law, Julia Kernodle (August 1851 - Nov. 6, 1930), another 1875 transplant from Tennessee, lived in the home and helped take care of Mr. Grego-ry. As Julia nursed Gregory back to health, love bloomed and they were married later that year.

After the couple’s marriage in 1880, Mr. Gregory’s hotel gained a second story and they eventually branched into the mercan-tile business. In studying the photo of the Gregory House hotel, rooms were $1 a day and meals $.25 per day.

Sometime around 1900 the property was sold to J.L. Pampell and the building became a confectionary. After their retirement from the hotel and mercantile business, William and Julia built a home on a 20 acre plot of land in the southeast corner of the D.A. Rees tract and raised chicken and dairy stock. In the early 1920s the Gregorys sold this farm and built a home in the Lowry addition (near present-day Riverside Nature Center).

On Thursday, Nov. 6, 1930, Julia died of a sudden heart attack at the age of 81. Her obituary in the Kerrville Daily Times read, “On Tuesday, November 4, at the general election, she accompanied her husband to

the polls and cast her ballot. The election officers and others remarked concerning her apparent good health, giving promise of more years of life. Thursday morning she was stricken with heart trouble and passed away about nightfall.”

Gregory died only three months after his “beloved” Julia’s passing, on January 29, 1931. In his obituary, the Kerrville Daily Times wrote, “He had very little education but was energetic, a keen trader and suc-ceeded better than many men with two legs to walk upon. He was of a kindly and peace-able nature and had many friends.”

A sad footnote to this tale: While Gregory’s obituary says that he and Julia are lying side by side in Glen Rest Cemetery, due to an un-fortunate series of circumstances, the loca-tion of their graves has been lost and cannot be located. After searching for old church registries, courthouse records, and talking to numerous cemetery and funeral home per-sonnel, I am still hoping for a miracle that will one day point me to their final resting place. Mr. Gregory’s name is also misspelled on the Pampell Building’s historical marker.

It has been a lot of fun researching William and Julia Gregory with Dana and I would like to thank him for his generosity in sharing the fantastic image of the Gregory House Hotel with us. It is an amazing photo! Who would have guessed the Pampell’s building ever looked like that?

Wall décor is essential in creating a well balanced space. It’s usually your first and lasting impression of a room. It can be a little overwhelming when it comes to actually hanging your wall décor—no one wants to mess up, so it gets put off. Here are a few tips that might give you the confidence to go for it and get it off the floor.

When hanging art, start by defining your display space. It might be between two doorways or an area as wide as a sofa’s arms.As a rule, position the most prominent piece at eye level in the center and work outward.

It is visually stimulating to create interest by mixing contrasting shapes. Hang round plates over a straight back sofa, mix frames of different shapes and sizes or hang thin vertical objects on a long wall. Use color or themes to unite the pieces.

There is no rule saying that you can only hang framed pieces on a wall—add some dimension by mounting decorative ledges to display vases, candles, and other accessories.

Hanging wall décor too high or too low is a common mistake. Your center piece should really be at eye level. If it’s over a low sofa, hang your pieces about 6 inches above the top of the sofa so it doesn’t feel like it’s floating.

The last thing to consider is scale. When hanging wall décor over a sofa, mantle or any significant piece, make sure the art or grouping has a width of between one-half and two-thirds of the item below it. As always, have fun with the process, there is very little that can’t be changed or fixed.

Garden pests and diseases are so com-monplace in the gardening scene this time of year that between watering

and weeding these others can almost make you want to throw in the trowel. Most gar-den pests can be controlled by keeping weeds down and removing debris. Closely monitoring your plants before they become too infested to treat is a must.

Aphids are especially hard to control—they can produce 600 billion descendants in a season—aphids can even be born pregnant. Other bugs, such as box elder bugs seem to come in droves, although not particu-larly harmful to most plants, these bugs can spread viruses to other plants. If you have grown squash in the past, you may have had the culprit squash bores, which can kill a per-

fectly healthy plant almost overnight. Worms are always ever-present pests, not only to vegetables but on many ornamental plants as well. By spraying organic products such as B.T. worm killer, you can control them and still eat your garden vegetables.

Another great organic control for most soil-borne pests is beneficial nematodes. These microscopic unsegmented roundworms eat grubs, fleas, ticks and even fire ants. Simply mix them in a container of water and spray these beneficials onto your garden area. These wonders take care of most pests by killing, eating, and procreating inside the pests. A Title Company’s CommitmentAfter signing a contract to purchase a home or piece of land and escrowing the contract with a title company, you will receive a title commitment. We get frequent calls from buyers asking, “What did you just send me?” or “What do I do with this document?” Below is some basic information about the commitment.

ABCs of the Title Commitment

Schedule A This portion of the title commitment contains basic information about the proposed transaction, including proposed policy amount, current owner of record, and legal description of the property. Make sure each of these items is consistent with your signed contract.

Schedule B Here you will find exceptions from coverage. These items were discovered during the title search and include property restrictions. Standard exceptions such as mineral and water rights can be found here. The title policy will not insure against loss from problems listed in Schedule B. Check Schedule B for restrictions on the use of the property. Talk to the title company if you have concerns.

Schedule CThis section lists requirements that must be met before closing. Common requirements include paying taxes and recording a release of lien. Existing liens that must be paid at closing are listed here. You will also find any title defects—such as federal or state tax liens, abstracts of judgment, and pending lawsuits. Talk to the title company about fulfilling unusual requirements to avoid a delay in closing.

Nesting Season is in full swing here in the Hill Country and we would like to pay homage to the moms and dads of the bird world.

Like humans, birds are just as diverse at courting, monogamy, homesteading and raising their young. Watching your birds closely, you might get to see the courting process. The Black-crested titmouse and Cardinal males will often feed the female while the black-chinned hummingbird male will fly in a “u” trying to attract the female. Once thought that many birds were monogamous, a recent study showed not so much. The male black-chinned hummingbird is not. In fact, the female should win the mother of the year award. She does everything—from building the nest, to tending to hatchlings and flight lessons.

Most birds do the nest making together, with females getting the last word on decorating. Females sit on eggs for 12–14 days. Males generally feed the female during incubation. Once born, both parents take turns bringing food to the nest. Think you had a hectic time with a newborn? Watch a pair of new bird parents for a day. Mom on the nest, dad goes for food, when he returns, mom goes for food, when she returns he goes again. This goes on all day. It’s exhausting. Feeding suet products during nesting season makes it is easy for them to grab and go.

Now it’s time for flight lessons. Watching fledglings leave the nest is amazing to see. Dad calls for his kids to follow as mom coaxes them and keeps a watchful eye. Most fledglings don’t really fly the first time out, they kind of hop and flit. Once the brood is all together, they are then taught how to get food and water—another enchanting experience to see. After this they get to start all over again. Whew!

The PRMC Auxiliary PRMC Volunteers

Carol Chidley from Junction, Texas, was most grateful for the “Hip Pocket” holders attached to her walker in Rehabilitation Services.

Quietly working from home, a number of individuals with skillful hands and caring hearts are giving back to their community through PRMC’s Auxiliary. A Bear Brigade, coordinated by Mildred Barton, cut and stitch, stuff and paint bears which are given primarily to children in the Emergency Department(ED). A few bears are kept at the PRMC Outreach Lab on Bandera Highway and a few in the Post Acute Care Unit at the hospital. It takes about an hour and fifteen minutes to make one bear and the team delivers 45 to 60 bears each month to the hospital’s ED. So, it really does “take a village to make a bear.” (Coincidently, many of the Bear Brigade live in Vicksburg Village.)

A long-time volunteer, Elouise Huff, works with the Bear Brigade but also designed and sews the “Hip Pocket” accessory for walkers for patients on the Acute Rehabilitation Unit.

A Blanket Team, coordinated by Ann Livengood, provides beautiful, hand-crocheted and/or knitted blanket and cap sets for each newborn, and in 2012, there were 405 babies born at PRMC. Some volunteers knit the little pom-poms for the top of the tiny caps.

Pictured are some of the dedicated team members who give so freely of their time and talent “behind the scene,” but others not pictured include Linda Hipskind, Sally Jackson, Beverly Nyitrai, Maxine Nielsen and Lana Tatsch. You won’t see most of them working a shift in the hospital (although some do) but, the Auxiliary thanks each and every one for their devoted and skillful service.

Besides providing great meals and stimulating activities, the Center also has an Independent Living Program which offers services for those who are less active, as well as their caregivers. Dietert’s Information and Referral office fields a myriad of calls and visits, dispensing information about area services and resources. There’s help finding everything from home health agencies to senior housing and more.

Dietert’s PAL emergency response systems provide peace of mind 24/7. Just the push of a button summons help from the PAL operators, who stay on the line until help arrives. More than 240 PAL units help seniors throughout the Hill Country.

The Reception Desk volunteers operate our free Call Reassurance service. Folks who are enrolled call the Center each weekday morning to check-in before 10:00 a.m. If the call is not received by the deadline, volunteers call the client. If there’s no answer, they call the emergency contact in the client’s record for instructions.

Dietert’s free medical equipment lending program is recycling at its finest. We accept clean, gently used equipment, such as

walkers, canes or wheelchairs, and lend it out to those who need it.

Caregiving for an elder loved-one is an awesome and loving task. We have a variety of services, including our caregiver resource center, caregiver support groups and our on-site respite service, the Take Five Club.

So it’s a surprise to no one (except maybe him) that this year’s recipient of the WKC’s Citizen of the Year Award is Tony Gallucci. Tony wears so many hats that it’s a challenge to name them all, but we’ll give it a go. In addition to the friend, mentor, teacher, and coach so many of us know him to be, Tony is an award winning actor, director, producer, writer, filmmaker, photographer, business person, and social media guru.

Locally Tony’s name is associated with Hunt School, Our Lady of the Hills, Ingram Tom Moore High School, Tivy High School, Schreiner University and Hill Country Youth Ranch. He graduated from Texas A & M where he coached the Men’s Soccer Team and founded the Texas A&M Women’s Soccer Team that went on to win a national championship.

A founding member of Poets for Human Rights, Artists Without Frontiers, Texas Motion Picture Alliance, and the Texas Association of Soccer Coaches, Tony has earned outstanding service recognition from Camp Rio Vista, was voted recipient of Kerrville ISD Student’s Choice award, and was bestowed the Life’s Treasure Award by the Kerrville Daily Times.
