In 1865, the people of the South lay prostrate at the feet of victorious Union armies. Little did they realize at the time that they were about to lose much more than the Civil War. They were about to be shut out of the government of the United States. The result would be the Fourteenth Amendment, proposed by a Congress that had excluded representa- tives from almost one third of the states and ratified by reconstruction govern- ments in the South established at the proverbial point of a bayonet. Proposal and ratification of the Fourteenth Amendment were anything but constitutional. Due Process Denied explains why.
