The Executive Board met in the office of the Kansas State High School Activities Association on Tuesday and Wednesday, Sep- tember 16-17, 2014, with the following in attendance: President Ken Thiessen, Doug Glenn, Annette Gonzales, David Kraft, Justin Lockwood, Juan Perez, Monte Stewart, John Whetzal, Rod Wittmer, Paul Zuzelski and Gary Musselman, Executive Director. Assistant Executive Directors Cheryl Gleason, David Cherry, Francine Martin, Reggie Romine, Mark Lentz, and Jeremy Holaday were also present. Carolyn Wims-Campbell was absent both days due to attendance at state board of educa- tion meetings and her obligations as a member of the Kansas State Board of Education. The Minutes of the June 11-12, 2014, meeting were approved. NOTE: In the following listing, middle/junior high schools are indicated in all capital letters. INFORMATION ONLYPer Bylaws, Article VI, Powers and Duties of the Execu-tive Board, Section 1h, the Executive Board designates the duties of the Executive Director and adopts regulations neces-sary for the effective operation of the office. One of the duties delegated to the Executive Director is to handle and process certain violations. The Executive Board asked that a synopsis of some of these be listed in the Minutes as “case book” studies for the member schools to follow in applying the specific rules or policies identified.

Rule 21-1-1 – Amateur: A senior high school cross country runner was presented with a cash prize for winning a road race in July. Upon discovering the fact, the school athletic director contacted the event organizer and the athlete and promptly returned the cash to the event director. Upon confirmation of the return of the cash, the KSHSAA directed the school to reinstate the student’s amateur status and eligibility.Rule 30 – Seasons of Activities: A member middle school principal self-reported a violation by his football coach who permitted players to wear helmets at a conditioning only session on the Friday prior to the start of practice on Monday of SCW #7. The head coach received a written reprimand and the school barred the team from one practice in full pads on the Friday of SCW #7.

ADMINISTRATIVE REPORTS AND UPDATES

The Board received financial and administrative reports from Executive Director Gary Musselman, Assistant Executive Di-rectors Cheryl Gleason, David Cherry, Francine Martin, Reg-gie Romine, Mark Lentz and Jeremy Holaday.

2013-14 AUDIT REPORT APPROVEDMr. Musselman presented the Executive Board with the an-nual certified audit report prepared by Wendling, Noe, Nelson, & Johnson L.L.C. of Topeka. Following Mr. Musselman’s re-view of the audit, the Board voted unanimously to accept the audit. The report will be printed in the October 2014 issue of the KSHSAA Activities Journal.

2014-15 BUDGET APPROVEDFollowing a hearing held on Wednesday, September 17, 2014 at 1 p.m. in the office of the KSHSAA, the Executive

Board unanimously approved the KSHSAA budget for the 2014-15 school year and authorized its publication and distri-bution to the member schools.

ELIGIBILITY REQUSTParents of a student and the student from USD #458 Basehor-Linwood appeared to request the Executive Board overturn an eligibility ruling made by the Executive Director. Mr. Mussel-man’s ruling was based on the “consecutive semesters” clause of Semester Requirements Rule 16-1-1. The student was withdrawn from school by the parents and repeated three academic semesters of grades 7 and 8 despite having success-fully completing them previously. Following testimony by the parents, student and the administration of Basehor-Linwood Middle and Senior High Schools and extensive discussion, the Executive Board voted unanimously to uphold the Executive Director’s eligibility ruling.

Effective 2014-15 an ejected coach must complete the “NFHS Teaching & Modeling Behavior Course” prior to the next regularly scheduled contest.

7. Should the KSHSAA adopt the following as an addition in Handbook Rule 11 – Athletic Officials?

Proposed Rule Regarding Assault and Battery of an Official

Art. 7 For purposes of this rule the following terms shall have the indicated meanings.Assault shall mean to take any action or make any statement that either appears to be intended to or actually does place an official in apprehen-sion of bodily harm.Battery shall mean knowingly or recklessly caus-ing bodily harm to an official; or knowingly caus-ing physical contact with an official when done in a rude, insulting or angry manner.

a. A participant, who is determined to have commit-ted an Assault or a Battery of an official before, during or after a competition, shall be ineligible for the remainder of the season of the sport in which the competition occurred, including post-season contests.

b. A coach, who is determined to have committed an Assault or a Battery of an official before, during or after a competition, shall not be permitted to coach for the remainder of the season of sport in which the competition occurred, including post-season contests.

In considering these regional meeting topics, the Executive Board noted the following considerations:

• KSHSAA programs are education based sports with high expectations of staff and students.

• Support for our officials.• More coaches from non-teaching backgrounds are being

employed by necessity.• Increasing number of school administrators who may

lack activities administration experience in their career history.

• Prevention in a sports culture that is becoming increas-ingly volatile.

• Eligibility and participation is a privilege students earn to represent their school and community.

GOLF & WRESTLING REGIONAL MEETING TOPICS FINALIZED

Last June the Executive Board approved topics for regional meeting discussion concerning golf and wrestling, but directed staff to develop specific language for the regional meeting. The following were approved for the agenda of the October regional meetings:Golf:

1. Should the KSHSAA change the current policy allowing head coaches to “offer advice” from green to tee, by allowing head coaches more contact time to “offer advice” to their golfers from tee to green during regular and post-season tournaments?

SUMMER ACTIVITY TRANSPORTATION CHANGE

PROPOSEDThe Pioneer League submitted a request to change the current KSHSAA Executive Board policy regarding transportation for students attending camps, clinics, workouts, scrimmages, etc. during the summer months. The league has requested KSH-SAA member schools be allowed to provide transportation at their own discretion. Current KSHSAA policy does not permit use of school owned vehicles in transporting students to sum-mer athletic camps, clinics and competitions. (Note: KSHSAA catastrophic and liability insurance does not cover these non-school summer activities.) The schools of the Pioneer League cite safety concerns for students driving themselves and oth-ers and feel schools would be better served to establish their own policies. The Executive Board agreed to place this topic on the agenda for discussion at the October regional meetings.

SPLIT SEASON JUNIOR HIGH/MIDDLE SCHOOL BASKETBALL

Harold Oliver, Athletic Director of Riley County Jr/Sr. High School and Daniel Thomson, Ph.D., DVM, and former Board of Education member of USD #378 met with the Executive Board to present a proposal for discussion at regional meetings. As a school with a split season for junior high basketball, resulting in a shorter season for girls, the school proposes a modification to Basketball Rule 33-1-4 in the Handbook to create a more equitable situation for schools.

The Executive Board agreed to include the following question for the regional meeting agenda.

Should the KSHSAA modify Rule 33-1-4 to include the following exception:

There are no player limits on 7th and 8th grade students from SCW #17 through SCW #34 on non-school basketball teams. During the school season players may not participate on non-school teams. School coach restrictions still apply. (See Rule 22-1-1 – Outside Competition & Rule 30-1-3 – Seasons of Activities.)

THREE SCHOOL COOPERATIVE AGREEMENT REQUESTS

Representatives of Cimarron, Ingalls and South Gray High Schools appeared before the Executive Board to request their schools be allowed to participate together in a three-school co-operative agreement in the sport of wrestling.

Administrators from Stafford, Langdon-Fairfield and Saint John also presented information to request their schools be combined into a three-school cooperative agreement in the sport of wrestling.

Under the new provisions of Cooperative Agreements Rule 29, Section 2, Article 3, allowing approval of three school cooperative agreements in quasi-team/individual sports, the Executive Board voted to approve both requests for 2014-16.

NFHS CONCUSSION SUMMIT TASK FORCE

Mr. Musselman reported that he represented the NFHS Board of Directors along with NFHS President Tom Mezzanotte of Rhode Island, on a 28 member Concussion Task Force. This group was assembled for the purpose of developing NFHS “Recommendations for Minimizing Head Impact Exposure and Concussion Risk in Football.” Once the final document is vet-ted through the NFHS Sports Medicine Committee and ap-proved by the NFHS Board of Directors, it will be available for state associations to use as they so choose. Plans are for the NFHS guidelines to be available for discussion at the upcom-ing KSHSAA regional meetings.

HEAT ACCLIMATIZATION ANALYSISBrent Unruh, staff liaison to the KSHSAA Sports Medicine Ad-visory Committee and representative of Section 5 states on the NFHS Sports Medicine Advisory Committee, presented a re-port to the Executive Board on current KSHSAA rules govern-ing fall sports. As a certified athletic trainer (ATC), Unruh has firsthand experience with Kansas schools, their athletes and coaches. His report was based on his comparison of Handbook rules governing early season practice requirements in Kansas as compared to a 2009 consensus statement, “Preseason Heat-Acclimatization Guidelines for Secondary School Athletics,” released by an inter-association task force which included the National Athletic Trainers Association and the American Col-lege of Sports Medicine among others.

In the discussion following Mr. Unruh’s report, it was agreed making this information available to member schools for the purpose of discussion at regional meetings would be helpful. School administrators should watch for this information to be forthcoming in October with the regional meeting agenda. Schools are encouraged to share the information with appropri-ate personnel to enhance the discussion at the upcoming KSH-SAA regional meetings.

EXECUTIVE SESSIONTuesday afternoon, Lockwood moved to enter executive session for matters pertaining to non-elected personnel for twenty min-utes. Second by Gonzales. The motion was unanimously ap-proved. The Board entered executive session at 5:10 p.m. and reconvened in open session at 5:30 p.m.

REGGIE ROMINE ANNOUNCES RETIREMENT

Assistant Executive Director Reggie Romine announced his plans to retire July 1, 2015. Mr. Romine will complete his tenth year of service to the Association in 2014-15. His edu-cational career spans thirty-seven years in service to Kansas schools as a classroom teacher, high school principal and KSH-SAA Assistant Executive Director. The Executive Board went on record thanking Mr. Romine for his exemplary work, dedi-cation and service to the member schools of the KSHSAA as well as the youth of Kansas.

President Ken Thiessen advised members an item could be added to the agenda provided three-fourths of those present (67) agreed. (51 votes would be required.) No additions were requested.

Following public hearings, discussion and voting of all agenda items, the Board recessed at 6:45 p.m.

PUBLIC FORUMNo speakers were present to address the Board.

EXECUTIVE DIRECTORS REPORTGary Musselman, Executive Director, called roll, presented remarks on the Association’s financial position, and updated the members of the Board of Directors on business and policy matters of the Association.

MAY 2014 MINUTES APPROVEDFollowing the Call to Order by President Ken Thiessen and the roll call, Whetzal moved, second by Sharp, to approve the Minutes of the May 2, 2014, Board of Directors’ meeting. The motion passed (65-1).

All agenda items passed become effective immediately upon publication of these minutes unless otherwise specified. NOTE: Words or phrases which appear underlined in the following sections indicate the changes which were made.

PROPOSED RULE 10 LANGUAGE UPDATES PASSED

An agenda item was submitted to revise Rule 10, Qualifications of Coaches, Section 1, Article 2, as follows:

Art. 2: A local board of education/governing board of a member school must employ all coaches or coaches’ aides by written agreement supplemental contracts. Volunteers shall not coach, with an exception pro-vided for individuals who are certified staff employed by the member school’s district. All compensation to coaches and sponsors/directors, shall be provided by the employing school/district.

During discussion it was proposed to amend the language to include governing boards in addition to boards of education in the first sentence of the Article. The amendment was moved by Zuzelski, second by Morford and approved unanimously (67-0). Zuzelski moved adoption of the proposal as amended, second by Crouch. The vote was 67 in favor, none opposed. The amended proposal was approved, effective July 1, 2015.

PROPOSED RULE 17 REGULATION CHANGES APPROVED

Motion by Glenn, second by Kraft, to approve modification of Rule 17, Age Requirements, Section 2-3 as follows:

Section 2: Senior High RegulationsArt. 1: Any student who reaches nineteen on or before Sep-

tember 1 August 1, shall be ineligible for interscho-lastic activities. Any student who reaches nineteen after September 1 August 1, shall be eligible for the remainder of that school year.

Section 3: Middle/Junior High School RegulationsArt. 1: Any student who reaches fourteen for the seventh

grade, fifteen for the eighth grade, or sixteen for the ninth grade, after September 1 August 1, shall be eligible for the remainder of that school year. (Excep-tion: See Rule 29-3-1, Cooperative Agreement.)

Art. 2: Any student who reaches fourteen on or before Sep-tember 1 August 1, shall be ineligible for seventh grade competition, but may compete on a mixed grade team (any combination of middle/junior high school grades).

Art. 3: Any student who reaches the age of fifteen on or before September 1 August 1, shall be ineligible for eighth grade competition, but may compete on a mixed grade team (7th, 8th and 9th, or 8th and 9th, but not 7th and 8th grades).

Art. 4: Any student who reaches the age of sixteen on or before September 1 August 1, shall be ineligible for any middle/junior high school competition.

Art. 5: A seventh or eighth grade junior high school student in a two-year junior high school, who has reached the age of 15 on or before September 1 August 1, or a ninth grade junior high school student, may participate on a senior high school team with the approval of both principals provided both schools are under the same board of education or school board. A student who moves up under the regulation shall be ineligible for further middle/junior high competition in that sport.NOTE: If this rule is to apply, the middle/junior high school must be a member of the KSHSAA, as it relates to moving students from the 8th (due to age) or the 9th grade up to the high school.

The vote was 67 in favor, none opposed. The proposal was approved, effective July 1, 2015.

The meeting of the Appeal Board was held in the office of the Kansas State High School Activities Association on Monday, September 8, 2014.

Call to Order: Shannon Haydock, chairperson, called the meeting to order at 1:00 p.m. Mike Burgan served as recording secretary.

Roll Call: Members present were: Mike Burgan, Jerry Flanagan, William Ford, Shannon Haydock, Gregg Noel, John Purvis and Gary Teel.

In accordance with Bylaw Article VIII, Section 6, no members of the Appeal Board were excused due to conflict of interest.

All Appeal Board members signed an Oath of Office.

Shannon Haydock served as chairperson, William Ford as vice-chairperson, Mike Burgan as recording secretary and Gregg Noel as alternate recording secretary. These officer positions will remain in place until such election is necessary.

Purpose of Appeal: Wendy Sachen, mother of an 8th grader who transferred from Leavenworth-Xavier Middle School to Leavenworth-Warren Middle School, requested the hearing with the Appeal Board seeking full transfer eligibility by hardship rule exception for her daughter. The Executive Director previously denied a hardship request but has approved limited eligibility for the student who is currently participating at the non-varsity level.

Appeal Board Decision: Motion by William Ford, second by Gregg Noel, to enter into Executive Session for the purpose of deliberating for a period of 10 minutes beginning at 2:04 p.m. Motion approved unanimously. The Board resumed open session at 2:14 p.m.

Motion by Gary Teel, second by Jerry Flanagan, to uphold the ruling of the Executive Director in accordance with Transfer Rule 18, Section 1.

The vote was unanimous (7-0) in favor of upholding the ruling by the Executive Director. The student is denied immediate eligibility under the Transfer Rule.

The meeting was adjourned at 2:19 p.m.
