Greetings! I want to give a big thank you to Katie Marcum for planning another successful conference! I had the joy of standing in front of you and taking all the glory, but Katie was the real workforce behind everything, from booking the facilities and speakers to coordinating all the logistics. Having done it for two years, I fully appreciate all the hard work and stress that it requires. Planning a conference for a group with such diverse styles and preferences is difficult, but Katie did it well! Next year’s conferences are already scheduled and details about speakers and events will come later. If there are topics you would like us to address, feel free to send an email to me or to Katie. If you have heard great speakers that would be wonderful for KACM, let us know! In the meantime, mark these dates on your calendar:

Your court should have received an email notice from OJA announcing the spring judge’s conference. Be sure to forward that to your judge. If you didn’t receive it, something went wrong and you will want to contact them (the Office of Judicial Administration) at [email protected]. I also want to give a special acknowledgement to Gail Garrett, who has served as legislative chair since 2009 but has stepped down from that responsibility. She has worked many hours to keep us posted and I

Iowa Supreme Court to Hear $75 Speeding Ticket In 2015, Marla Leaf was driving on Interstate 380 through Cedar Rapids, Iowa and was clocked at 68 mph in a 55 mph zone. The result was a $75 speeding ticket. Leaf insists she was driving between 50-55 mph and is not guilty. To court clerks, this will sound pretty familiar so far. What is unusual about this case is that the “officer” who caught her on radar is no officer at all, but rather an automated traffic camera operated by a private company that receives $25 per citation.
Leaf’s attorney argues that it is unlawful to delegate authority to issue speeding tickets – this is police work and cannot be handed over to a private party. Leaf’s attorney argues that using the private company violates the equal protection and due process clauses of the Iowa Constitution. So far, the lower appellate courts have been satisfied with the arguments in defense of the traffic cameras. While the company’s cameras record traffic activity, it is the police department that ultimately decides whether to issue the ticket. “There is never a citation issued that does not get reviewed and approved by a police officer,” argues the company’s attorney. Right now Iowa is the only state that allows cities to install automated speeding cameras on interstate highways. While these cameras are the direct object of this case, Leaf’s attorney is also raising a bigger question about the city’s authority to issue speeding tickets on federal interstate highways. If this argument is embraced by the Supreme Court, it would have implications for municipalities that have interstate highways passing through the city limits.

Newsoftheweird.com got bumped this month. One of the Newton, Kansas probationees who ALWAYS owes money to the court, posted his rap video sporting handfuls of $100 bills. For those who appreciate fine lyrics: “Gotta get the gwop, get the gwop, get the gwop – Get dough.” “Gotta get the gwop, get the gwop, get the gwop – Let’s go. “ Did you know?: GWOP is slang for George Washington On Paper?

Kansas DUI Trend
The number of DUI cases in Kansas has dropped over the past few years by approximately 25%. This is good news and yet still too early to celebrate victory as over 10,000 people are killed annually by alcohol-impaired driving crashes in the US, according to the Center for Disease Control. The decline in DUI cases is sometimes attributed to the effects of increased social stigma against people who drive drunk and to public campaigns such as “You drink. You drive. You lose.” Our gains in Kansas may also be due in part to our strict laws against impaired driving. WalletHub created a comparison chart ranking us as the 4th strictest state. This ranking combines the strictness of our criminal penalties with the ambitiousness of our prevention measures. The criminal penalty rankings look at factors such as amounts of jail and fines, additional penalties for high BAC, and child endangerment provisions. The prevention rankings come from factors such as required ignition interlock requirements, administrative license suspensions, sobriety checkpoints, and required alcohol abuse assessment/treatment. Kansas also has strong advocates for DUI enforcement. Many of you remember Karen Whittman, who was a favorite guest at KACM conferences during her tenure as the Attorney General’s Traffic Safety Resource Prosecutor. She is now fiercely fighting the battle against DUI’s as Wyandotte County’s Deputy District Attorney. Her recent blog entitled “These Crashes Are Not Accidents” is worth reading. It tells the story of her fight and includes a heart-wrenching account that serves as a sober reminder of why the battle is of the utmost importance. As municipal courts, we see new offenders and hopefully we can keep them from becoming more serious, chronic offenders. Our work processing DUI cases and seeing defendants through their treatment programs pays dividends every time we drive our families safely home.
Spotlight on Legal Terminology
SKIP TRACING \ˈskip trās ēŋ \ Not officially a “legal term,” but skiptracing is a term used to describe a process of debtor and fugitive recovery. It can correctly be used to describe the process of locating a person's whereabouts for any number of purposes. Collection agencies use this term commonly to describe their processes.
A skiptracer is someone who professionally performs this task. The term "skip" (as a noun) refers to the person being searched for, and is derived from the idiomatic expression "to skip town", meaning to depart (perhaps in a rush), leaving minimal clues behind to "trace" the "skip" to a new location.

Legislative Committee NEW CHAIR Gail Garrett has served as our legislative chair since 2009. We owe her a huge debt of gratitude for all her hard work keeping on top of the ever-changing legislation. The legislative process is full of quirks and surprises. It is impossible to track without having resources like Gail helping out over these past 8 years. THANK YOU GAIL, for all your work. You were a life-line to courts across the state! Nicole Armstrong, the court administrator from Lenexa, has agreed to take over the legislative committee. Nicole has been a member of OJA’s education committee and trains new clerks. She has also been instrumental in updating the clerk’s manual, having revised entire chapters in need of updating. WELCOME, NICOLE. Thank you for your willingness to keep us all updated.
Clerk of the Year: Traci Dockery!
Traci Dockery was awarded Clerk of the Year at the fall conference this year! She has been a member of KACM almost as long as she’s been a court clerk. Since joining KACM in 2000 she has worn many hats. She has served on the Hospitality Committee and later served as Hospitality Chair. She has served as a Region Ambassador and as Ambassador Chair. She took over as Membership Chair when Rod Edmondson left and has developed this role significantly. In this role she has collected data from member courts across the state, compiling it into various reference sheets that are available online. Because of her work, municipal courts have access to comparative data on job titles, court fees, software providers, collection agencies, and more. She was appointed to the Education Committee on January 10, 2014 by the Supreme Court of Kansas, which means she is a trainer of new court clerks across the State, assists in planning the Spring Conference every year, and has been a part of keeping the Court Clerk’s Manual up to date on a continual basis. She's been a very active member with 17½ years of experience. Her service speaks for itself in how she willingly shares her knowledge with clerks across the State and always willing to help where needed.

Legislative – Gail Garrett (Lansing): Gail will be stepping down from the Legislative Chair and Nicole Armstrong,
Lenexa, will be replacing her.
Manual – OJA Education Committee Member: OJA Education Committee Member stated that the manual is still in
review/revise mode. They are also in discussion about creating a “Clerk’s Role”. Also, if you come across any errors
please let them know. The manual will be available online.
Newsletter – Greg Nickel (Newton): Greg reported that the Newsletter will be going out sometime in the middle of
October.
Past President – Amy Spitler (Hutchinson): Nothing new to report.
Promotion/Sales – Amy Spitler (Hutchinson): Amy stated to come and check out the Promotions Table.

OFFICERS
Section 1. Principal Office. The principal office for the transaction of business of the Corporation is
hereby located in Wichita, Sedgwick County, Kansas.

Section 2. Registered Office. The Corporation, by resolution of its Board of Directors, may change the
location of its registered office as designated in the Articles of Incorporation to any other place in Kansas. By
like resolution, the resident agent at such registered office may be changed to any other person or corporation,
including itself. Upon adoption of such a resolution, a certificate certifying the change shall be executed,
acknowledged and filed with the Secretary of State, and a certified copy thereof shall be recorded in the office
of the Register of Deeds for the county in which the new registered office is located (and in the old county, if
such registered office moved from one county to another).
Section 3. Other Offices. Branch or subordinate office may at any time be established by the Board of
Directors at any place or places where the Corporation is qualified to do business.

Section 10. Meetings of Voting Members and Other Membership Matters. The Association
meetings shall be held in the Spring and in the Fall of each year. The Fall meeting An association meeting
shall be held in the Fall of each year which shall be designated as the Annual Meeting. The designated place,
date and time of the Fall meeting shall be determined by the Board of Directors or by consent of a quorum of
members as set out in Article II, Section 13. The Spring meeting will be held in conjunction with the Kansas
Supreme Court, Office of Judicial Administration. This meeting will be planned by the Municipal Court Clerk
Education Committee (appointed by the Supreme Court) and the Kansas Supreme Court Office of Judicial
Administration. Non-business meetings may be held for informational session with the approval of the
President.
Written notice of each semi-annual meeting shall be given to each member entitled to vote…
Section 4. Vacancies. Vacancies on the Board of Directors shall first be filled from the Alternate
Trustees, other members of the board, or committee chairs, or second by members in good standing if any, and
may be filled by a majority of the remaining Directors present at a meeting for such a purpose, although less
than a quorum, or by a sole remaining Director. If at any time, by reason of death, resignation, or other cause,
the Corporation should have no Directors in office, then a regular member may apply to the district Court for a
decree summarily ordering election as provided for by the Kansas Corporation Code. Each Director so elected
shall hold office until his successor is elected and qualified. A vacancy(s) on the Board of Directors shall be
deemed to exist in the case of the death, resignation or removal of any Director, or if the authorized number of
Directors be increased, or if the members fail at any annual or special meeting of regular members at which any
officer, trustees or alternate trustees are elected to elect the full authorized number to be voted for at the
meeting, or if any officer, trustee or alternate trustee elected shall refuse to serve.
Section 8. Special Meetings. Special meetings of the Board of Directors shall be held at the call of the
President or at the written request of a majority of the members. Notice of such special meetings, unless waived
by attendance thereat or by written consent to the holding of the meeting, shall be given by written notice, by
hand delivery or notification by telegram at least ten (10) days before the date such meeting is to be held. If
mailed, such notice shall be deemed to be delivered when deposited in the United States mail with postage
thereon addressed to the Director at his or her residence or usual place of business. If notice be given by
telegraph, such notice shall be deemed to be delivered when the same is delivered to the telegraph company.
Notice may also be given electronically using contact information registered on the roster of members.

There were no changes to the Agenda.
Minutes: Minutes were not discussed.
Treasurer’s Report: Deana Scott stated that the expenses for the conference will be around $13,000. Deana was sad to
report that about $1,000 in those expenses were clerks who did not show to the Thursday evening entertainment which
was about 20 people.
Katie Marcum, South Hutchinson made a motion to approve the Treasurer’s Report. Candy Westoff, Girard seconded the
motion. All voted unanimously
Addition: Promotions made $1,155 in sales.
Correspondence: Flowers will be sent to Melanie from Holcomb as her husband just passed away.
Committee Reports
Ambassador/Membership Traci Dockery (Basehor): Traci reported that one Ambassador stepped down from Region 3.
She is in the process of finding another Ambassador.
She will also be contacting all of the Ambassador’s to let them know about a clearer role they will be playing.
Courtesy – Kim Everley (McLouth): Kim submitted a report stating that flowers were sent on September 25th to Adela
Diaz upon the death of her father.
Education – Katie Marcum (South Hutchinson): Katie reported that we had great attendance at the conference and this
year the vendors were able to fill out an evaluation sheet to express any concerns they may have had during the
conference. All evaluation sheets were read. Having a newbies breakout session was also discussed for our next
conference.
Historian – Candy Westhoff (Girard): Candy stated that the pictures that were taken during the conference will be
posted on Facebook.

Hospitality – Bettina Jamerson (Shawnee): Bettina stated that the Hospitality went well; they had snack bags for clerks
with the leftover food so we had no wasted food. She will be returning some beer. She also stated that she had great
helpers.
Legislative – Gail Garrett (Lansing): Gail Garett, who has served as chair since 2009 has stepped down. Nicole
Armstrong, Lenexa, has accepted an appointment to replace Gail.
Manual – OJA Education Committee Member: OJA Education Committee Member stated that there is no new update.
Newsletter – Greg Nickel (Newton): Greg stated that there is no new update.
Past President – Amy Spitler (Hutchinson): Amy said she will be getting a Slate of Officers together for next year.
Also, Traci Dockery received the Outstanding Clerk Award.
Promotion/Sales – Amy Spitler (Hutchinson): Amy reported that the promotions table went well. If we have any ideas
for new things please let her know. She is not sure if we will have a promotional table at the Spring Conference.
Scholarship – Sara Javier (Maize): Sara reported that there were 6 scholarships this year. The 50/50 pot was successful
making $320 and the silent auction made $160 totaling in $493.
Old Business
Role of Ambassadors: It was suggested that the Ambassadors monitor the listserv and be encouraged to have regional
meetings but not have them required. Nothing was finalized.
Code of Ethics: Some have issues with the NACM Code of Ethics. It was discussed the either change the Code of Ethics,
whether to adopt the NACM Code of Ethics or to write our own. Also, should it be in the manual or bylaws. Deana Scott,
Prairie Village motioned for the topic to be tabled until the next meeting in January. Linda Engle, Oakley seconded. The
topic was tabled for further discussion at the January Board meeting.
New Business:
2017 Fall Conference Review: There were some complaints about hot water at the Hampton from clerks. There was a
clerk who would like a refund on her Conference Fees. Clerk submitted a letter that was read. The Board discussed and
decided that a refund would not be given.
2018 Fall Conference: Katie Marcum, South Hutchinson reported that the 2018 Fall Conference will be in Overland Park
on September 27-28, 2018. She is in the process of looking for fun things to do while up there.
Audit: The next audit will be conducted at January’s Board Meeting.
Next Board Meeting Date: The next Board Meeting will be held on Friday, January 19, 2017 at 12:00 p.m.in Wichita,
KS at Scotch and Sirloin. The Education Committee will meet at 10:30 a.m.
