The meeting was called to order at 6:00 p.m. , July 19, 1995, by Walter M. Roufail, MD,President. Board members in attendance were: Harold L. AGENDA - PublicMisadventuresIn a discussion led by Dr. Henry, the Board members and staff discussed several recent news articles regardingmedical misadventures. The Board approved a motion by Dr. Henry and seconded by Dr. Trado requesting the stateMedical Examiners Office to report to the Medical Board those cases dealing with deaths when they are coded amedical misadventure. The investigative analysis of these cases will be promptly carried out and appropriateaction(s) will be taken by the NCMB in accordance with the standard and procedures of the Board.

Miscellaneous - Controlled Drug Symposium

Mr. WaYne VonSe99en will be participating in the NC Academy of Physician Assistants' Third Annual Controlled

Drug Symposium, August 25, 1995, at Myrtle Beach, SC. His role on the panel discussion is to answer questionsregarding the NC Medical Board, the and new controlled substance prescriptive authority. The Board approved hjsattendance.

Meeting with DeansDeans of the North Carolina medical schools (Dr. James A. Hallock, James N. Thompson and Ral h

Snyderman), met with the Board and discussed several topics including: the Federation, the role of CME in

licensure, required post graduate training necessary for licensure, and limited faculty license process.

PodiatryWilliam Breeze reported to the Board the passage of a bill amending the definition of podiatry by Chapter 248;SB 399. This law expands the scope of practice of podiatry to include treatment of all ailments of the foot and

ankle and their related soft tissue structures to the level of the myotendinous junction (except amputation of theentjre foot, the administration of anesthetic other than local, and the surgical correction of clubfoot of an jnfanttwo years of age or less). Except for procedures for bone spurs and sim le soft tissue rocedures any surgeryon the ankle or on the soft tissue structures related to the ankle must be performed in a licensed hospital or amultispecialty ambulatory surgical facility where the podiatrist has privileges. This law establishes a committeecomposed of two members from the North Carolina Board of Podiatry and two members of the North CarolinaIyledical Board which shall define what constitutes "soft tissue procedures" referred to in the statute. Tworepresentatives of the North Carolina Orthopaedic Association Incorporated, Charles H. Classen, MD and Luciuspullen met with the board to offer their assistance to those who will serve on the committee. The Board approveda motjon by Dr. Johnson and seconded by Mr. Saperstein to appoint Dr. Spangler and Dr. Henry to serve on thiscommittee.

Executive Director's Report - 7/95Mr. Bryant D. Paris, Jr. presented the following information in his Executive Director's Report:

Management Retreat - Mr. Paris reported on the administrative staff team management program. The fjrst retreatwas June 23, 1995. Mr. Paris discussed long-term and short-term goals of the administrative staff

professional Corporations - A teleconference with appropriate staff to discuss the trend of professionalcorporations being formed to become negotiation entities with managed care groups. The matter is to be discussed

by the Policy Committee and a report presented to the Board.

AMA pRA - The AMA does not maintain documentation as to which CME courses a phy' '

Article for the Bulletin - Mr. Paris' article regarding the ten most common reasons physician hasons p ysicians ave problems withthe Medical Board, is to be in the next Bulletin.

Management Consultant - Ms. Meelheim and Mr. Paris met again with Dr. John Anderson.

Mr. paris will attend a two week management development course at the University of North Carolina on October15 -27, 1995.

Mr. Paris has been devoting time to the preparation of the Board's history.

Acceptance of the 1975 Examination given by the Canadians ILMCC —Licentiate of the Medical Co 'I f Council of Canada)- At 'the last meeting questions concerning the prior Board decision to accept the LMCC aft 1975a er createdconsiderable discussion. Mr. Paris thoroughly reviewed the Board's minutes through 1980 and f, an ound that thereare notes that indicate consideration of this matter in 1970. However there is no indication 'n thI is no in ica ion in t e minutes thatthe Board accepted the 1975 date, nor is there any reference to the 1975 date. Because the Med I pe ica Practice actnow requires foreign medical graduates to attain three Years of post graduate training prior t I, de raining prior to icensure, andbecause the Board's rules now contain the ten year requirement, Mr. Paris recommended to the Board that nofurther consideration be given to the 1975 date.

Statistics of staff activities since the May Board meeting:Between June 13, 1995 and July 4, 1995 the office has received 7,821 phone calls.

Since the May Board meeting the Board has received and responded to 92 complaints. At the Jule u y meeting of theComplaint Committee 47 complaints and 16 complaint follow-ups were considered.

Verification and Corporation activities - The majority of the 2,000 verifications are routine and are handled by IVlrs.

Norris. Verifications that contain investigative or public information are answered over the E ee xecutive Director'ssignature.

Activities since the May 1995 meeting - Since the last meeting Mr. Paris has conducted 16 interv'I c e in erviews in an effortto assist in the vo'lume of applicants who are unable to meet with Board members or who make u h d I dr w o ma e unsc eduled visitsto the Board's office.

Dale Breaden and Mr. Paris were interviewed by Pat Stith, a health reporter from the News Ik Ob server, regardingthe Board's review of death certificates which have been coded as misadventures.

On June 28, 1995, Mr. Paris attended a meeting at Duke University along with Mr. Howe, Dr. Barrett, and Mr

Breaden. A report of this meeting will be included in Dr. Barrett's Policy Committee report.

Data regarding hiring a Medical Director will be presented with the Policy Committee Report.

Policy Committee ReportPosition Statement - Prescribing of OpiatesThe Board approved a motion by Dr. Barrett, seconded by Dr. Burroughs, to appoint Dr; Trado to serve on a task forcecharged with developing a position statement offering guidance for prescribing opiates for chronic pain. The task forceis to be made up of four persons who are engaged in the area of pain management, including representatives from the DFAor Pharmacy Board, and Board staff.

Medical Coordinator - job descriptionThe Board discussed the job description for the Medical Coordinator position. Mr. Paris will contact each medical boardthat has a medical coordinator on staff. Mr. Paris is to determine if the MC improved the performance of the board andeased the work load of the board. Mr. Paris will present this information to the Board at the September meeting.

FCU Retreat, CME Providers - Dr. Charles Duckett, of East Carolina University School of Medicine asked Dr. Roufail todiscuss an association of on-campus CME providers. ECU is hosting a retreat for this group, and Dr. Duckett requesteda Board representative attend. The Board accepted a motion by Mr. Saperstein, seconded by Dr. Johnson to appoint Dr.Barrett as Board representative at the ECU retreat

Position Statement - Physician-Patient Relationship

A copy of the position statement on PhYsician-Patient Relationship was presented. The Board accepted a motion by Dr

Burroughs, seconded bY Mr. VonSeggen, to accept the Physician-Patient Relationship position statement presented as astated policy of the NC Medical Board (attached p. 23).

Legislative ReportMr. Bill Breeze presented a report on legislation which was ratified during the cururing e current session of legislature. Notablechanges involve the passage of Senate Bill 1017 which changed the name of the B d t th Nme o e oar to the North Carolina MedicalBoard; passage of Senate bill 653 which made various changes in the Medical Practice Act d thica rac ice ct; and the passage of Senate Bill

399 which modified the scope of practice for podiatrists. Mr. Breeze responded to quest f th B d gand other legislative issues.

REPORT OF THE EMERGENCY MEDICAL SERVICES COMMITTEE

Dr. Nicholas Benson has resigned his position of medical director for the Office of Emergice o mergency Medical Services effectiveJune 30, 1995, in order to accept the chair of the ECU Medical School - Emergency Med I Dmergency e ical Department. His successorat OEMS is Dr. Cary McDonald. The Board adopted a motion by Dr. Barrett seconded b D . B, secon e y Dr. Burroughs that the NCMedical Board send a letter of appreciation to Dr. Benson recognizing his leadership and a h'a ers ip an ac ievements as medical directorof the Office of Emergency Medical Services during the past seven years.

The Office of Emergency Medical Services asked for guidance regarding the administrat fa minis ra ion o practical skills and writtenevaluations as well as regarding the use of question data bases. The Board adopted a m t'r a op e a motion presented by Dr. Johnson,seconded by Mr. Howe, that local EMS programs be permitted to administer practical kll der prac ica s i s and written evaluations in

segments throughout the applicant's certification period rather than only in the last yea fe as year o certification. It is the intentof the Board to assure continuous evaluation of skills throughout the approval per od. Th B dova perio . e Board approved a motionpresented by Dr. Johnson, seconded by Dr. Burroughs, stating that the EMS programs beprograms e permitted to use questions fromrecertification examination data bases which are available for purchase by the educatio Ie e uca iona systems.

The Board received a request from Attorney Vance Kinlaw asking if EMS personnel at I Ipersonne at any evel are trained to advisepatients of their patient's diagnosis (assessment). The Board referred Mr. Kinlaw to the OEMS for a response to his inquiry

Datalink - Report reviewed of which entities have responded to subscription fee request.

Mr. Paris is to investigate the option of the Board members taking SPEX.

The committee recommended that the bond for Mr. Paris and Ms. Meelheim be dee eim e re uced to $250,000.

Ms. Meelheim will continue to pursue Insurance for the Board Members. Mr. Pis intended to cover the cost.

The licensing process was reviewed at the Quality Management Meeting 6/23/95.
