MCA ournal January 2015 Volume XXIV/ Number 1 MCA Legislative Report By Paul M. Abosh, DC, CCSP, CCEP, CKTP As we enter the New Year, I sit here and write this winter’s legislative report. I still remember the words of our esteemed president at the Fall Convention Luncheon and the theme of the wolf pack! Sure, it’s easy to howl at the moon in unison at a convention, but how do we continue that spirit in these cold winter months when we’re out on our own in our own practice? The answer is, you are NOT alone! We may not be together physically, but we still need to act in unison, like the wolf pack that acts as one to survive the winter. In other words, united we stand, divided we fall. So how does this relate to legislative concerns? We’ve asked for PAC contributions before while the campaigns and elections were still happening, but political action doesn’t end when the elections are over - now is when things are just beginning. We need your PAC contributions just as much now, if not even more so. We need to meet our elected officials, old and new, and discuss the agendas that are important to our profession. PAC donations get the legislator’s attention. Keep in mind that they are in debt from the last election and want to get reelected in the next campaign. They will always notice where contributions are coming from. Contribute to the PAC. Get out there and meet your Senator and State Delegate(s) from your district. Make friends with them, invite them to your office - maybe they need a good chiropractor! The prime time to get to know them is now while they are getting settled in their office, before they get busy with the 2015 Legislative Session. Many of you may remember Dr. Tyler Cymet, DO. He has done lectures for us at our conventions in the past. He is a friend to chiropractic, and guess what, he has recently been elected as the President of MedChi, the state Medical Association, the MD and DO’s version of the MCA. This is a golden opportunity to build some bridges with our medical counterparts and work together for the betterment of our patients. We may be introducing a bill this year that will propose to eliminate the requirement to register your practice trade name with the Board of Chiropractic & Massage Therapy Examiners. Note, this doesn’t change the requirements for identifying you as a chiropractic office, nor does it eliminate the need to register your trade name/business name, etc with the State of Maryland or the Federal Government. For more information on that, feel free to contact Marc Cohen. As I mentioned in my report at the convention luncheon, we need your help. Each committee, including the legislative committee, needs help. Whether you can help out once in a while or on a regular basis, the MCA board will appreciate it. Feel free to come to any MCA board meeting, listen in and see if something piques your interest. You can always call me or any board member anytime, not just with questions, but also just to say “Hey, I want to help with the Medicaid issue” or “I want to go to Annapolis one day and meet my State Delegate” and we will happily help you out. This February we will most likely be hosting our annual Legislative Luncheon in Annapolis, where we invite all legislators who may have a potential impact on issues affecting chiropractic for a lunch meet and greet with the MCA. The more chiropractors we get there, the better we can relate our concerns. We will send out the date, time and location soon. There may be new Senators and House Delegates attending who have never met us before and may not even know much about Chiropractic care. Do you want them to learn about it from outside sources? Wouldn’t you rather have the opportunity to explain the benefits of chiropractic care to them directly? As always, I send out my thanks to all those who help in our legislative actions, and I thank those of you who send in your contributions to the MCA PAC. If you have any questions regarding any legislative or legal issues (for which I would refer you to our board counsel, Marc Cohen), my door is always open. Please feel free to call me at 410-256-8511 (office) or 301-523-6078 (mobile) or e-mail me at [email protected]. I look forward to helping you and helping all of us in the coming year. Have a great winter! J

MCA Legislative ReportBy Paul M. Abosh, DC, CCSP, CCEP, CKTPAs we enter the New Year, I sit here and write this winter’s legislative report.

Wow! That was fast. It seems like yesterday that we were at the MCA Fall Convention in Turf Valley howling like the wolves that we are. A few blinks of our collective eyes later and the New Year was upon us. I would like to share my New Year’s wish list with you. Of course, this wish list isn’t going to end up in Santa’s hands, but all of ours. I guess it’s another reminder that WE can make our own wishes come true!

I hope to see……

1. The East Coast IPN to not only meets the first goal of 500 members, but to ROCKET past it. This is a once in a lifetime opportunity to fundamentally change our practices for the better. If you have not yet done so, GIVE YOURSELF the gift of joining. Do it today!

2. Our MCA membership to increase dramatically. If you are reading this, THANK YOU for being a member. We are constantly working to stay connected to you. A new website is launching soon along with all the social media tools. If you have any friends or colleagues who are not members or perhaps lapsed members, please urge them to join.

3. To build on recent success in Annapolis with the Hogan Administration. With 40% turnover in the state house including the Governor, there is work to be done establishing new relationships and maintaining our current ones. I am thankful that our new lobbyists, Pitcher and Pitcher, are the perfect choice to help us. Also, please remember a STOCKING STUFFER for our PAC.

4. The CA’s who enroll in the MCA training program to continue their success of high passing rates on the board exam. Also, for their supervising chiropractors to continue their excellent training and to always remember that “doctor” means “teacher”.

5. Our national associations to come together and present a UNIFIED voice to Washington DC and to the citizens United States as a whole. Chiropractic is too special and important for only 7% of the population.

6. Our chiropractic schools to continue to train the chiropractors of the future and train them well. As we all know, the real education begins after graduation, but a house cannot be built on a shaky foundation. If you haven’t done so, please support your ALMA MATER, whoever it may be.

7. MORE intra chiropractic referrals, MORE intra chiropractic relationships, MORE professional courtesy. Let’s get to know each other better.

8. MORE PATIENTS to help. MORE patients who send their friends and families. MORE members of the general population telling the chiropractic story.

Well, that’s my wish list. I know we share some of the same desires for our beloved profession.

JOIN ME and the MCA in making these wishes come true….

Have a healthy New Year!

Where’s Your Backbone?By Dr. Foxworth, president of ChiroHealthUSAIt’s basic chiropractic 101 and something you can probably recite in your sleep: a healthy body depends upon a healthy spine and nervous system. When there are one or more subluxations, the ability to transmit information to and from the brain and body is compromised. Just as we all learned in school, when our spines are out of alignment we can’t function optimally or healthfully.

Ask a few chiropractors what represents the backbone of their practice, and they’re likely to say their relationship with their patients. And there’s truth in that—without patients, a practice is simply a pretty office with unusual furniture.

But patients don’t represent an organized system that allows all the areas of the office to function any more than the blood that flows through our veins is an organizational and communication system that could keep us alive all on its own. The true backbone of your practice is your financial department, with all of its policies and procedures. If something is seriously out of alignment, it can bring your business crashing to its knees faster than a lumbar disc herniation.

What kind of “subluxations” might you find in your practice? Most commonly- inadvertent non-compliance with Medicare and other third-party payers, confusion about what represents a legal fee schedule and poor documentation with resulting billing and coding errors. When anything in your financial department is out of alignment, your practice can’t function normally or healthfully.

Even worse, if the misalignment is severe enough—say you’re

offering a dual fee schedule by giving patients a discount that exceeds the Office of the Inspector General (OIG) limits of 5-15%, or making a Groupon offer that falls under the OIG’s definition of inducement—it can put you at risk of an audit that could cost you big, or even put you out of business altogether.

None of us can afford to put our livelihoods at that kind of risk—and yet we still want to offer our patients the care they want at a price they can afford. That’s why people like you and me became chiropractors in the first place! We are caregivers at heart, first and foremost, not accountants.

I found my solution in ChiroHealthUSA, the Discount Medical Plan Organization (DMPO) I founded that offers me and its other providers a safe, easy and legal way to offer discounts to our underinsured, partially insured and uninsured patients. There is no cost to the practice, and it’s just $49 a year per family per year for patients to become members.

You don’t lose control of your practice—in fact, you strengthen its backbone and gain more control than ever before, as you set the discounts YOU choose based upon your actual fee schedule and reduce your audit risk many times over. You get to have the practice you intended when you graduated from chiropractic college, and your patients save hundreds of dollars a year while still getting the care they deserve.

Remember, pain is not normal—either in the human body, or in a chiropractic practice. We offer a free webinar every Tuesday that will tell you just how easy it is to enroll and put you and your practice back in alignment with your values and with regulatory guidelines at www.chirohealthusa.com.

I’d like to thank all of those who support our Political Action Committee. The PAC and the legislative committee have been busy with our newly elected legislators and our new governor. Julia Pitcher Worcester, our new lobbyist is our guiding voice in all matters political, and I thank her for her hard work. We will be meeting with the Larry Hogan, Maryland’s new Governor Jan. 7, 2015. We will be asking for contributions from the membership to give to Governor Hogan in addition to a PAC contribution. We want to show the Governor that we are a powerful and unified voice. The PAC is here to protect our rights and those of our patients and to secure our future in Maryland. Some of you may have noticed that you name no longer appears on the list of supporters. This list reflects contributions from the previous twelve months only. So please, make a contribution and get back on the list and help protect our profession and your practice. As we head into the legislative session, we should all thank those who have so generously helped our profession. The chiropractic profession is protected everyday by the people who watch the legislation that can impact our livelihoods. These volunteers coordinate the profession’s response to threats and look for legislative opportunities for us to improve our standing in Annapolis. Those generous doctors listed above give the PAC and the MCA the ability to implement our legislative agenda and I thank them. In particular I’d like to thank those at the top tiers whose generosity is an example to us all. Thanks!

ACA ReportLouis S. Crivelli II, DC, MS, CNSNCLC is Feb. 25 – 28, 2015 in Washington D.C. Since Maryland is SO CLOSE to Washington D.C., we should all try to make an effort to get Capitol Hill and meet with state and national representatives. We have begun the process of setting meetings with members of congress and want you to be involved. In addition to the lobbying efforts, NCLC is a great chance to earn over 20 hours of CE.

In November, ACA President Anthony Hamm wrote to Men’s Health magazine and commended them on their article “The Back Pain Pills That Many Doctor’s Won’t Recommend Anymore.” The article outlined various alternative treatments for back pain. Sadly, chiropractic was left out of this article. Dr. Hamm composed a well written and thorough letter to the editor explaining that chiropractic care should indeed be the FIRST option for those with back pain. A copy of the letter is available on ACAToday.com

Head over to www.ACAToday.com for more information about these as well as many other important updates.

ECA-IPNDon’t Wait, Learn the Benefits! The time has now arrived. Over the last four years, your state association leadership has been hard at work building the appropriate infrastructure for YOUR CHIROPRACTIC STATE ASSOCIATION-OWNED Independent Provider Network – the East Coast Associations’ Independent Providers Network (ECA-IPN). The ECA-IPN is a partnership owned by the Virginia, Maryland and Pennsylvania Chiropractic Associations.

The “why” behind this initiative was, and still is, very clear: we can only demonstrate our collective value to the healthcare system at large, and be rewarded for that value, by uniting to build our independent network.

We are very excited to announce that SecureCare, the originators of the most successful chiropractic association-owned IPN in the country, will be our network partner/manager! In addition, Infinedi will be our electronic claims clearinghouse! This is a huge step in the right direction. We now have the know-how and support to build an outstanding association-owned, chiropractor-managed provider network. Your provider network will not be managed by corporations that are only interested in the bottom line.

Please visit http://marylandchiro.com/ for more information and to sign-up for the ECA-IPN.

Immune Activation During the Winter MonthsBy David R. Seaman, DC, MSThe most common view of immune function during winter months is that it weakens and needs “strengthening.” We have been conditioned to think that the cold and flu season is due to immune weakness, which makes us more susceptible to viruses that love to hang out in sub-zero environments. This view is promoted on the television, radio, and in doctor’s offices. Unfortunately, this is actually a simplistic and mostly inaccurate point of view.

Rather than weakening during the cold and flu season, our immune systems actually become activated, which leads to sickness symptoms. Consider for example that many people gain five to ten pounds of fat during the winter months. This is due largely to overeating the calorie-rich holiday foods made from sugar, flour, and fat.

Acute Dietary Inflammation

The mere act of eating these calorie-rich foods leads to postprandial hyperglycemia and lipemia, which stimulates the immune system. In particular, the hyperglycemia leads to an influx of glucose into immune cells, which leads to an excess of free radicals produced by mitochondria. This stimulates a cell-signaling molecule called nuclear factor-kappa B (NF-kB), which enters the nucleus to stimulate the production of pro-inflammatory chemicals that are then released by the immune cell. The extent of postprandial inflammation has been correlated to the extent of postprandial hyperglycemia.

The intake of sugar-flour-fat calories also causes gram-negative bacteria in the small intestine to release lipopolysaccharide (LPS), which is then absorbed into body circulation. LPS is also known as bacterial endotoxin, which means that sugar-flour-fat calories leads to systemic low-grade endotoxemia. Immune cells respond to endotoxin in the same fashion as hyperglycemia; NF-kB is activated and pro-inflammatory chemicals are released.

This acute immune activation may lead to no appreciable symptoms or may promote sickness symptoms, such as malaise. Stress and a lack of sleep have the exact same “immune activating” effect.

Chronic Dietary Inflammation

As we overeat during the holiday-rich winter months, we often pack on extra pounds. When adipocytes swell in size, they begin to attract pro-inflammatory immune cells. In other words, swelling adipocytes are perceived by the body in a fashion that is similar to an antigen that requires an immune response.

As one becomes obese the immune cell population living in concert with adipocytes goes through a transformation. Lean adipose tissue contains adipocytes and anti-inflammatory immune cells, however, obese adipose tissue typically has multiple pro-inflammatory immune cells including cytotoxic T-cells,

pro-inflammatory T-helper cells, mast cells and neutrophils, which continuously release pro-inflammatory chemicals into body circulation. The term “adiposopathy” has been put forth as a way to distinguish sick adipose tissue or sick fat syndrome from normal healthy adipose tissue.

Someone with adiposopathy is chronically inflamed whether they are eating, not eating, or sleeping. When these people consume sugar-flour-fat calories, they have a more robust immune activating response.

Avoiding Acute and Chronic Dietary Inflammation

People often overreact when it comes to the idea that one must give up the calorie sources that taste so good us. Such an overreaction ultimately prevents the development of proper dietary habits. The goal should be to minimize the consumption of foods made of flour, sugar, and fat – that is, eat them in moderation. Replace these calories with healthy animal products and vegetation. It is that simple. Consider also taking supplements that offer anti-inflammatory benefits, such as magnesium, fish oil, vitamin D, probiotics, and anti-inflammatory botanicals such as ginger and turmeric. By taking this approach, we can calm down the immune system and feel better throughout the year, but especially during the dreaded “cold and flu season.”

The information presented in this article is a synopsis of an article I wrote for Practical Pain Management in 2012.

Dr. Seaman is a Professor of Clinical Sciences at the NUHS Florida site in Pinellas Park, where he teaches nutrition and evaluation and management courses for the musculoskeletal and cardiorespiratory systems. Dr. Seaman has authored a book on clinical nutrition for pain and inflammation, and has written several chapters and articles on this topic. His website,www.DeFlame.com, is a source of this information for the general public.
