It is a well-known fact that in order to qualify for a patent, an invention must meet three basic criteria:

    1. the characteristics of the claims must be totally new or novel

    2. the characteristics of the claim must involve inventive step, and

    3. the invention is industrially applicable.

However, some inventions may not meet all these criteria. For example, if the characteristics of the claim are novel but it is clear that there is no inventive step, does the inventor not qualify for any form of ownership?

In Malaysia’s Patents Act 1983, there is an explanation regarding the granting of a Certificate Utility Innovation (CUI) whereby if the characteristic of the claim of an invention is novel but does not involve inventive step, it can be registered.

Utility Innovation (UI) means any innovation which creates a new product or process, or any new improvement of a known product or process, which is capable of industrial application.

The key disparity between a patent and a CUI is that only one claim is allowed for CUI while a patent can have several claims.

The period for a patent is 20 years from the filing date while a CUI is 10 years from the filing date.

However, a CUI owner can, before the expiry of five years from the date of application, apply for an extension period of five years, and before the expiration of the second term of five years, apply for an extension of another five years. It gives a maximum protection of probably 15 years from the filing date.

And, this is subjected to payment of annuity fees.

Also, due to less stringent requirements for CUI, it is easier to get a CUI as compared to a patent. However, it is easier to defend and attack the validity of CUI as compared to defending patents.

The only obstacle is the limit on the number of claims. In a patent, there will be different dependent claims directed to a different embodiment of the invention or its different important features. Whereas in CUI, because only one claim is allowed, an inventor has often declared important characteristics that may be included in products that can be commercialised.

Although it is possible to file a patent and CUI at the same time, a patent or CUI can only be given for the same invention. It is also possible to convert a patent application into an application for CUI during the examination process and vice versa. In practice, the choice to change is done after Substantive Examination Report is received.

Procedures to apply for a CUI are the same as the process to apply for a patent. An UI application can be the original application for an international patent by using PCT or Paris Convention. A national-level application using PCT can be filed as UI application under the PCT Regulations.

Inventors in Malaysia should still be observant when considering getting a CUI if they think that innovative characteristics, although novel, may not be inventive, and do not meet the characteristics of a patent. It is also good to know that a CUI will act as a strong deterrent document against any violations of the law or infringement.

WORKING VISITS TO MARDI, NASUHA HERB FARM AND BOGOR AGRICULTURAL INSTITUTE

    BY: ASDARINA YAHYA

Universiti Malaysia Pahang (UMP)’s land application submitted to the Pahang state government through the State Economic Planning Unit (EPU) in 2011 was approved and following that, a series of visits were planned and carried out by the Research and Innovation Department (JP&I) with the cooperation from the Property Development and Management Department and Vice Chancellor Office.

    BY: MUHAMMAD AZLI SHUKRI

An original work titled, ‘Islam in Pahang’ by Centre For Modern Language & Humanity Science Centre (CMLHS) Dean Professor Dr. Abd. Jalil Borham was announced as the winning entry for Publication Prize (UMP Publisher - The Best Original Work) during the Quality and Innovation Day 2013 held at Bukit Gambang Resort, Kuantan.

A report by the Evaluation Panel Committee stated that the work met all the standards required for a high quality-original work and can be used as an important reference in the research area.

‘Islam in Pahang’ is a work that records development of Islamic influence in the state, covering all aspects of life.

The main purpose was to explore and learn the modus operandi, management methods and ideas/concepts that could be carried out on the land acquired in Kampung Serengkam, Maran.

The first working visit was to Mardi in Kuala Linggi, Melaka on March 15, 2013 to study the model of contract farming concept and methods of extracting essential oils. Mardi also expressed their interest on UMP’s plan to develop the land in Maran.

The next day, the group went to Nasuha Herb Farm in Pagoh, Johor to find out how the farm became successful. Some of the ideas and concepts implemented by the farm’s management were interesting - there was a resort in the middle of the forest, the way the training was conducted and a variety of herbs grown by them.

At the Bogor Agricultural Institute (BAI) in Indonesia, the place was popular for its studies and findings on growing herbs which fascinated UMP. A working visit was scheduled on May 2-4, 2013 and the UMP delegation was shown, hands-on, the teaching and learning method concept on planting.

They were also brought to the herb research farm and given a tour of BAI campus.

Discussions were held between UMP and BAI in sharing the teaching and learning methods in research. BAI also agreed to assist UMP in realising the land development plan in Maran.

The winner took home cash RM1,000, an appreciation certificate and a trophy.

The event was officially opened by UMP Vice Chancellor Professor Dato’ Dr. Daing Nasir Ibrahim.

Also present were Deputy Vice Chancellor (Academic and International) Professor Dato’ Ir Dr.Badhrulhisham Abdul Aziz, Deputy Vice Chancellor (Research and Innovation) Professor Dato’ Dr. Rosli Mohd. Yunus, Deputy Vice Chancellor (Student Affairs and Alumni) Professor Dr. Yuserrie Zainuddin and UMP Registrar Haji Mustafa Ibrahim.

    ‘CENDEKIA BITARA

    AWARD 2012’

    BY: NOOR SYAHIDAH SABRAN

Universiti Malaysia Pahang (UMP)’s Research and Innovation Department (JP&I) organised the ‘Cendekia Bitara Award 2012’ on April 19, 2012.

The theme was ‘Spectrum of Integration’ which was inspired by the prism theory. It is based on the range of colour formed when a beam of white light is dispersed and that reflects the diversity and variation in UMP when moving towards excellence.

UMP Chancellor His Royal Highness Duli Yang Teramat Mulia Tengku Mahkota of Pahang, Tengku Abdullah Al-Haj Ibni Sultan Haji Ahmad Shah Al-Musta’in Billah graced the event held at Hyatt Regency Hotel, Kuantan. Also present was UMP board of members’ Chairman Dato’ Mohd. Hilmey Mohd.

The Tengku Mahkota of Pahang also presented awards to recipients who had brought fame and honour to the university with their wins in the country as well as abroad, and to winners of the University Academic Award.

Tengku Abdullah, in his speech, said the continuous commitment by UMP’s management in having the “Cendekia Bitara Award’ annually was a manifestation of willpower to make acculturation of research, academic publications and innovation as the main representation of this university more significant.

On the University Academic Award, it was an acknowledgment to the commitment and dedication in enriching the academic and teaching activities to produce competent graduates of excellence and commendable personality, as well as mentality.

The ‘Cendekia Bitara Award 2012’ was divided into six categories – Personality, Book Publication, Journal Publication, Research Product, Creativity and Quality.

Recipients of the ‘Cendekia Bitara Award’ were seven from the Research Product Category and 34 from the Journal Publication Category.

16TH INTERNATIONAL SALON OF INVENTION AND INNOVATION TECHNOLOGIES (ARCHIMEDES)

    BY: NOORSYAHIDAH SABRAN

Universiti Malaysia Pahang (UMP) once again triumphed at the international level when two of its research projects won gold medals at the 16th International Salon of Invention and Innovation Technologies (ARCHIMEDES) held at Sokolniki Exhibition Center, Moscow, Russia on April 2-5, 2013.

The winning entries were by Associate Professor Dr. Arun Gupta Faculty of Chemical & Natural Resources Engineering (FKKSA) with his work, ‘Development of Bio

    COST REDUCTION WORKSHOPS

    BY: HAZLINA FAIZAL

Two series of workshop on cost-cutting measures were conducted on December 15-16, 2012 and January 12-13, 2013 with the main objective was to identify prudent practices in managing expenses at all of Universiti Malaysia Pahang (UMP)’s Responsibility Centres (RCs).

This was in line with the targets set in the KRA 2’s Financial Sustainability (Sustainable Operations).

The facilitator was Associate Professor Dr Ahmad Rahman Songip who was also the founding director of Transformation and Risk Management Division, Universiti Teknologi Malaysia (UTM).

In the workshop, he shared a variety of best practices applied by UTM in implementing cost-cutting measures.

Both the workshops were attended by representatives from RCs who were directly

involved in implementing policies and regulations in their respective departments.

The workshop format was different this time as the participants were required to actively contribute ideas and views that did not involved participation from the university’s top management.

They were also encouraged to come up with any suggestions, regardless of its relevance or pertinence.

A total of 53 RC representatives attended the workshops and they came up with 80 projects which were divided among 28 head projects.

They were then given the task to see to it that the ideas were forwarded and implemented accordingly so operational cost could be cut.

The two projects also received a special award, ‘Centrul De Studii Ci Cercetari Psihotronice Si Ufologice, Romania’, a recognition on the excellent work and potentials on the researches done.

The projects, which had been submitted at the Malaysia Technology Expo (MTE) last February, showed that the works conducted were equally competitive and attracted the international community’s attention. It was even more remarkable for UMP was the only participant from Malaysia.

UMP Vice Chancellor Prof. Dato’ Dr. Daing Nasir were among those who attended the exhibition. Others included Deputy Vice Chancellor (Research and Innovation) Prof. Dato’ Dr. Rosli Mohd Yunus, Registrar Tuan Haji Mustafa Ibrahim, and CAIC Director and

Dean of Manufacturing Engineering Faculty Faculty of Manufacturing Engineering (FKP) Associate Prof. Dr. Wan Azhar. Their presence helped to boost the spirit of UMP researchers who took part in the event.

This year marked the 16th times the International Salon of Invention and Innovation Technologies (ARCHIMEDES) was held and the event was among the biggest in Moscow.

We applaud the success attained and hope that more of our reseachers will accomplish success and make their marks at the international level, and at the same time, bring honour to UMP.

    RESEARCH PAPER COMPETITION

    BY: DR. JOLIUS GIMBUN

30th March 2013, Petaling Jaya – Ms Lee Hua Chyn, a master student joint-supervised by Drs. Cheng Chin Kui and Jolius Gimbun from the Faculty of Chemical and Natural Resources Engineering (FKKSA) has won herself a travel grant totaling RM3000 to attend the prestigious 9th World Congress of Chemical Engineering to be held from 18th to 23rd August 2013 at Seoul, Korea. Lee was adjudged the winner for Research Paper Competition organized by Chemical Engineering Technical Division (CETD), The Institution of Engineers Malaysia (IEM).

In total, three UMP research papers have been shortlisted for the oral presentation that was held in Bangunan Ingenieur IEM. The shortlisted research papers were evaluated from the aspects of writing (technical paper), novelty and also innovation. The finalists comprised of “Bio-syngas production from glycerol dry reforming over cement clinker-supported nickel catalyst” by Lee Hua Chyn, “Glycerol dry reforming over La-Ni/Al2O3 catalyst” by Siew Kah Weng and also “Microwave extraction of phenolic acid and flavonoids from Orthosiphon Stamineus” by Pang Sook Fun. Following the presentation, Lee Hua Chyn from UMP won the first prize while the second prize went to Ng Tong Lip, a PhD student from University of Nottingham, Campus Malaysia with the paper entitled “A disjunction modelling approach for synthesis

and optimisation of industrial symbiosis in palm oil industry”.

The paper presented by Lee Hua Chyn is regarding the application of cement clinker-supported nickel catalyst for glycerol dry reforming to produce bio-syngas (H2 and CO). From her work, Lee has discovered that carbon deposition during glycerol reforming was minimized owing to the natural presence of calcium oxide (CaO) in the cement clinker. In addition, syngas suitable for Fischer-Tropsch synthesis can be obtained. Her project is funded by the MTUN-CoE grant (RDU121216) and Sciencefund (RDU130501) respectively, in collaboration with Assoc. Prof. Dr. Suzana Yusup from Mission-Oriented Research, Green Technology at Universiti Teknologi Petronas and Dr. Loh Soh Kheang from Malaysian Palm Oil Board (MPOB).

UMP Publisher made a new record sale at the Kuala Lumpur International Book Fest 2013 that was held from April 26 until May 4 at PWTC.

Sales were up 40% as compared to 2012 which made UMP Publisher among the 10 best Public University Publishers, in terms of sales made during the fest.

The achievement, in some ways, was a translation of UMP’s Sustainable Financial agenda under the KRA 2 that intended UMP Publisher to generate income for the university.

The recent official report from the MAPIM Academic Book Marketing Committee showed that UMP Publisher was at par as other well-known universities such as UKM, UiTM, USM and UPM, in terms of incomes made from publications.

The high earnings generated from UMP Publisher book sales also reflected the level of quality and public acceptance on products by UMP Publisher all this while.
