I, David Tzirulnik of Unit 5/1-7 Friars Road, Moorabbin, Victoria, solemnly and sincerely

declare as follows:

1. I am Managing Director of Canon Food Services pty Ltd, of Unit 5/1-7 Friars Road

Moorabbin Victoria Australia (herein after referred to as "the Applicant"). I have been

Managing Director of the Applicant for one year.

2. I make this Statutory Declaration from my own knowledge, and from the records of

the Applicant to which I have full and unrestricted access. I am authorised by the

Applicant to make this declaration on their behalf. Where the statements in this

Declaration are not derived from my own knowledge, I believe those statements to

be true.

3. The Applicant has sought registration of the trade mark CANON FOODS (the "Word

mark") and the logo marks shown below:

("the Logo mark") • 4. The Applicant acquired the business and goodwill in the Word marks from the

predecessors in business in May 2015. The name of the/predecessor in business

was Canon Foods Service Pty Ltd (ACN 009201352) ("the Predecessor"), which has

since changed its name.

5. The trade mark CANON FOODS (the Word mark) was first used by the Predecessor

at least as far back as 1984. I understand that the name CANON FOODS was

chosen by Mr Richard Pace and Mr John Dickenson, who were a director and sales

manager respectively of the Predecessor. l am unaware of the circumstances

surrounding the coining of the trade mark. Given the long-standing history of use of

the mark without complaint from any third parties, I have no reason to believe that

the mark was adopted with anything other than appropriate commercial honesty.

Now shown to me and annexed hereto as Exhibit DT1 is a newspaper article from

1986 describing the early days of the Predecessor's business. As shown to me and

annexed hereto as Exhibit DT2 is an article from Hospitality and Convention News

from 1985 also describing the early days of the Predecessor's business.

6. Use of the Word mark CANON FOODS has been continuous in Australia since its

first use in 1984. Use of the Logo mark first commenced in 2016 when the Applicant

updated its labelling, website and advertising material. Use of both marks has been

continuous in Australia since their respective first uses.

7. The Applicant and the Predecessor have used the Word and Logo marks

continuously in relation to the following goods in Australia:

Meat and meat products; poultry and poultry products including cooked poultry;

sausages and skinless sausages; processed meat; cooked meals consisting

principally of meat or poultry; meat and poultry products incorporating vegetable

and/or dairy ingredients.

("The Goods")

8. The Goods sold under the Word and Logo marks are manufactured by the Applicant

and distributed for sale throughout Australia. The Goods are sold through prominent

Australian supermarkets including Coles, Woolworths, !GA and Aldi. The Goods are

also sold to the food service industry.

9. The Word and Logo marks are used in relation to the Goods in many ways including

but not limited to point of sale material, marking on product packaging, labels and

tags, product catalogues, office stationary, letterhead, invoices, business cards and

other marketing material. Now shown to me and annexed hereto as Exhibit DT3 are

examples of historical use of the Word mark in Australia. Both the Word and Logo

marks are currently used online at the Applicant's website at

www.canonfoods.com.au and on the Applicant's social media pages on Facebook.

10. Sales of the goods in Australia under the Word and Logo marks have been

promoted in Australia by various means including but not limited to newspaper

advertisements and articles, magazine articles, television commercials, radio

commercials, posters, point of sale advertisements, catalogues, pamphlets, and

online including the website and Facebook. Examples of historical newspaper and

magazine promotion are now shown to me and annexed hereto as Exhibit DT4. The

Predecessor has also promoted the Goods sold under the Word mark by a

sponsorship of sporting teams. The Goods are also promoted in catalogues of

various retailers of the goods, including Coles, Woolworths and IGA. Now shown to

me and annexed hereto as Exhibit DT5 are typical examples of such catalogues.

13. I am not aware of any instances where the Word or Logo marks have been confused

with those of any other trader. I am informed that Canon Kabushiki Kaisha has

Australian trade mark registrations for the word CANON (stylised) which have been

raised as citations against the Applicant's applications. I am not aware of any

instances of confusion or deception between the Word or Logo marks and the trade

marks of Canon Kabushiki Kaisha.

- packages released by both major parties? It's not the blatant buying of votes from the people they need to woo to win power -it 's the swing to retrospec­tive legislation.

The Coalition is set to levy a tax of 15 per cent on allocated . pension and annuity funds. without a grandfathering scheme to protect all those retirees who made ~~ments under existing le ion.

Labor has announced it will change the goal posts for the caplta.I gaiJis tax CCGT) legislation it introduced back in 1985 and bring pre-1985 assets under the exist­ing COT system.

Certainly these old assets will be taxable onl;y on gains alter next January but it ls still retrospective.

We let Jolln Howard g~t away with it in the l980s \vhen he introduced retro­spective leg1slatfon t-0 stop the blatant bottom-of-the­harbour tax schemes. Now it seems all pollt1clans are con­ten t t.o legislate retrospec­tive.tv when it suits them.

manufacturk1g process that provides 100 per cent protection against five of the most common c:.auses of food pot. sonlng and spoilage.

The company says that its patent pending process, known as Micro Free, guarantees that cooked chicken products destined for use in sandwich and roll fillings were free of bacteria such as species of Listeria, Salmo­nella and Staphylococci, as well as E.Coli, and Pseudomonas.

Tests conducted by one of Australia's leading food microbiologk:al testing author­ities, back up the Canning Vale company's claims that the Micro Free process rids chicken meat from the bacteria.

Canon Foods is a wholly-owned Western Australian company eStablished in 1984 by Richard Pace. Latest estimates indicate.. that 350,000 people per week eat a Canon Foods product nationally.

Canon Food's chief executive officer, Richard Pace, said the process involved spe-

cial heating and product containment tech­niques and had taken frve years to perfect.

He was confident that ft could also be used to reduce the risk of food poisoning in other sectors of the food manufacturing industry.

Tests conducted by NATA-accredited microbiological consultancy, Pro Micro, showed that the standard Micro Free process destroyed all five bacteria even after the meat had been deliberately spiked with up to 200,000 times the amount of bacteria likely to cause food poisoning and spoilage.

The market for pre-cooked chicken meats - which was pioneered in Australia by Canon Foods in 1986 - is growing at the rate of I 0 per cent and is now estimated to be worth more-than $80 million per year.

Mr Pace said that statistics released by the Australian and New Zealand Food Authority Indicated that contaminated food bought from restaurants and takeaway shops was responsible for poisoning up to 3.6 million Australians at a cost of $26 bil­lion to the national economy each year. · In most cases of food poisoning, con­sumers suffer from doses of diarrhoea,

cramps, nausea. vomiting and fever; howev­er, in recent years there have been several high profile incidents induding the death of a South Australian child who ate contami­nated mettwurtt

'We are still assessing the value of possi­ble sales and licensing agreements for Micro Free, but believe that its true potential will not be fully realised until we enter the export market,'' said Mr Pace.

" Unlike many breakthrough-type devel­opments, our process does not require wholesale plant reconfiguration or retool­ing. thereby making it highly affordable to both small and large industry operators.

"The United States and England are the wotid's largest producers a cooked meat products and we would expect to focus our efforts on these markets over the nen three to five years;· he said.

Cooked chicken meat is predominantly used as a fill ing in rolls, and sandwiches and the risk of bacterial contamination arose during both the manufacwring and shop preparation phases.

Currently, cooked chicken meat leaving manufacturers' premises is randomly tested by independent laboratories. Product testing can take up to five days even though deliver­ies continue to be made to retail outlets.

Cannon Foods' process guarantees that every container of cooked chicken leaving its plant is I 00 per cent free from the five bacteria when d~ivered to shops.
