Industrial hemp in Kentucky remains a controlled substance outside the KDA Industrial Hemp Research Pilot
Program. Kentucky law KRS 260.858, Section(3) specifies, "It is unlawful for a person who does not hold a
license issued by the department, or who is not an agent of a licensee, to cultivate, handle, process, or market
living industrial hemp plants or viable seeds, leaf materials, or floral materials derived from industrial hemp.
Penalties for persons who cultivate, handle, process, or market living industrial hemp plants or viable seeds, leaf
materials, or floral materials derived from industrial hemp without a license are the same as those penalties that
are applicable to persons who violate KRS Chapter 218A, relating to marijuana."

2018 Seed and Transplant Providers List
The following companies are some of the current Kentucky Licensed Growers and Licensed Processor/Handlers
in the Kentucky Department of Agriculture (KDA) Industrial Hemp Research Pilot Program. This is not a complete
list of License Holders. The list includes only those License Holders that elected to have their contact
information publicized for the purpose of selling seeds and/or transplants to other License Holders. Listings are
in alphabetical order.
KDA does not recommend or endorse any of these businesses or individuals. Some of these entities may still be
in the planning phase, and none of them are obligated to accept orders. Any contract or transaction is solely
between License Holders. All parties must read the KDA 2018 Transfer Requirements document located on the
Hemp Program website at http://www.kyagr.com/marketing/hemp-restrictions.html, as well as 302 KAR
050:020, Sections 11-14 and Sections 21-22, and 302 KAR 050:030, Sections 10-13 and Sections 16-17.
Please note, if you are seeking seed, transplants, or planting materials from Kentucky License Holders, only
hemp seed or plants grown in the Kentucky Industrial Hemp Research Pilot Program are eligible for transfer
outside of the Commonwealth of Kentucky. Seed imported by the KDA from other countries under a DEA
Import Permit is restricted to cultivation by KDA Hemp License Holders.
Some cautions to both buyers and sellers:
All transfers out-of-state to other research pilot programs are at your own risk. KDA does not regulate
hemp materials outside the Commonwealth of Kentucky.
Any variety or named strain designated as a Variety of Concern in the KDA Summary of Varieties
document is not eligible for sale or transfer outside the Commonwealth of Kentucky. There is no
cultivation, sales, or transfers of Prohibited Varieties allowed. For more information, please refer to the

KDA License Holders planning to purchase planting materials from another state pilot program must
receive pre-approval in writing from KDA by submitting a Domestic Seed/Transplant Request form.
