Introduction

The Choctaw Nation in Indian Territory maintained its own constitutional government and records for many years in the 19th century, and in limited form after 1906 and Oklahoma statehood. The Choctaw National Constitution was adopted on June 3, 1834 and the government consisted of a Principal Chief, a General Council, composed of a Senate and House of Representatives, and a court system consisting of a Supreme Court and district courts. The Nation was divided into three geographical and political districts. District one, Masholatubbee (Mushalatubbee), consisted of Tobucksy, Gaines, Sans Bois, Skullyville and Sugar Loaf counties. District Two, Apuckshunnubbee (Apuckshunnubbi), consisted of Cedar, Nashoba, Towson, Boktuklo, Eagle, Wade, and Red River counties. District Three, Pushmataha, consisted of Atoka, Jacks Fork, Blue, Jackson, and Kiamichi counties. The district capitols were at Gainse, Alichi, and Mayhew. The national capitol has been at Tushkahomma (Tuchka-Homma) for most of the years of the nation’s existence. In 1893, Congress provided for the creation of the Commission to the Five Civilized Tribes (Dawes Commission), and authorized this body to meet with representatives of the tribes, including the Choctaws. This effort met with resistance and rejection. It was not until Apr. 23, 1897, under the Atoka agreement that the Choctaw finally consented to the provisions of allotment of their lands in severalty. Then in 1898, the Curtis Act, into which the Atoka agreement was incorporated, was made federal law. It provided that a census of each of the Five Tribes, the Choctaw, Cherokee, Creek, Seminole, and Chickasaw, should be taken to determine those individuals who were citizens of each tribe. It was necessary to acquire many of the national records of the tribes involved in order to carry out the responsibilities of the Commission. These records were taken from the various national repositories to Muskogee where the main Commission office was located. The Curtis Act also provided that the five governments be abolished on Mar. 6, 1906 prior to Oklahoma statehood. However, at this time the work of the Commission was not completed, and an Act of Congress, Apr. 26, 1906, provided for the continuance of the tribal government with limited autonomy. The records, dating from 1860-1906, that were later stored in the federal building at Muskogee, caught the attention of Dr. Grant Foreman, who believed that they were of great historical value and should be inventoried and placed in some order and in a place where they would be accessible to historians. He gained the permission of the Indian Office to direct the calendaring of the documents in 1929. Later he and others were instrumental in having the collection placed in the Oklahoma Historical Building in Oklahoma City. An Act of Congress, Mar. 27, 1934, (H. R. 5631 Public No. 133) transferred the records to the Oklahoma Historical Society’s care, although ownership remained with the federal government. Mrs. Rella Watts, later Rella Looney (Archivist, 1929-1974) divided the Choctaw records into

these categories and filed them chronologically within each category. The 483 bound volumes for the Choctaw Nation comprise manuscript entries of proceedings of the National Council, records, criminal and civil dockets, minute books of the district, county, probate, and Supreme Courts, renters’ and laborers’ permit records, treasurers’ records, records of conveyances, marriage records, records of coal leases and operations, records of cattle brands, records of administrators, executors and guardians, records of conveyances of property, records of estray stock, records of county warrants, records of rangers, records of commissions and bonds of officers, records of non-citizens in the nation, records of jurors and witnesses, and auditors’ records. The records of the National Council consist of journals of the House and Senate, acts, resolutions and memorials of the general council, letters of the principal chiefs, and ledger accounts of Armstrong Academy. Of the district courts for the three districts there are auditors’ reports, court dockets, records of marriage licenses and divorces, records of witnesses, execution and minute books, criminal dockets, equity dockets and execution dockets. Of the Supreme Court records there are five volumes of dockets and minutes of court proceedings. The Choctaw volumes, many of which are rebound, sometimes have several different titles; a spine title, a front cover title, an inside page title. There may also be an Indian Archives title. These titles are not always the same. The Archives volume numbered titles is given first in identification, then an original title, or titles, if given. In some cases, one title will be given if there is an agreement between all titles on, in, or assigned to the volume. Choctaw volumes often contain a variety of different entries. These will be briefly outlined on a contents page for each volume filmed.

Another group of Choctaw records is found in Section X of the Indian Archives. These are not part of the accession acquired by the Act of 1934, but are documents which have been gifts to or purchases by the Society since that time. The national records of the Choctaw Nation are considered to be valuable because they represent, along with the national tribal records of the Cherokee, Chickasaw, Creek, and Seminole Nations, the largest group of records of the sovereign Indian Nations known to exist to this date. As such, they give a view of Indian history that is unknown and unavailable for other American Indian tribes who did not have constitutional governments and written records.

Council in 1887. The remainder of the volume contains minutes and dockets of the

Committee of the Choctaw General Council on Disputed Citizenship. Included are names

of petitioners and persons giving testimony and final adjudication of acceptance or

rejection of the claimants.

Manuscript copy of Choctaw and Chickasaw Freedmen who were admitted to

citizenship in the Choctaw Nation. Also includes lists of doubtful citizens and Freedmen

who had left the Nation. Under Article 3 of the Treaty of 1866, approved June 28, 1866

(14 Stats. 769), Choctaw and Chickasaw Freedmen could move from the Choctaw and

Chickasaw Nations and receive a per capita removal allowance. The Freedmen who left

received a per capita payment of $100. This copy was certified by Thompson McKinney,

National Secretary of the Choctaw Nation, and Thomas Ainsworth, Richard Crowder,

and G. W. Thompson, Freemen Commissioners for the Choctaw Nation.

o Contains names of persons admitted to citizenship (heads of families and children), sex,

age, nationality of parents, previous owner of freed slaves, number of livestock, and

annuity was authorized in June, 1893 by President Cleveland for the Leased District

Claim of the Choctaw Nation. Under the Treaty of 1855, the Choctaw Nation leased tract

of land west of the Chickasaw Nation to the United States government for settlement of

other tribes. The land was later ceded to the United States by the Treaty of 1866.
