2) Your prices should be door delivery basis. Basic material cost, packing &forwarding charges, duties, taxes, freight shall be clearly indicated in yourquotation. If vendor does not quote prices for delivery up to BPCL warehouse(freight & octroi), the same shall be loaded suitably or maximum freightcharges quoted by the bidder for price evaluation.

3) Octroi: We shall reimburse the Octroi charges as per prevailing rateagainst the original octroi receipt alongwith B-form.

4) Any variation in Govt. duties and taxes like Excise Duty, Sales Tax andOctori shall be paid at actual prevailiing at the time of despatch ofMaterial.

5) If EXCISE is applicable,Please ensure to indicate the Excise tariffno/Chapter ID NO under which the goods are being cleared.

6) PLEASE CONFIRM TO ALL OUR POINTS IN 'TERMS & CONDITIONS' OR ELSE WE WILLPRESUME THAT ALL OUR TERMS & CONDITIONS MENTIONED IN THIS TENDER AREACCEPTABLE TO YOU.

7) No advance payment is permitted as per BPCL conditions. Suppliers notaccepting payment as per BPCL terms are solely rejected.

8) Delay in receiving Invoices or failure of delay or failure in providingcopies of dispatch documents/original MTC/ etc and any demurrage or wharfageor any loss resulting thereby shall be borne by the vendor.

9) Price evaluation will be done on total landed cost for supply andsupervision charges including all taxes, duties, freight less cenvatcredit/input tax credit available to BPCL.

2.DeadlinesDelivery period : All the material as per tender shall be supplied at sitewithin 04 (Four) weeks from the date of Purchase Order/LOI whichever isearlier.



3.Terms of deliveryThe above material is to be delivered to our Refinery Warehouse at Mahul,Chembur, Mumbai 400 074.

Supply of part quantities will be acceptable only at the discretion of BPCL.In all other cases vendor shall supply the entire quantity at a time.

4.Terms of payment100% within 30 days after receipt and acceptance of materials at site and onsubmission of a performance bank guarantee for 10% of total order value, validtill the full guarantee period plus three months# claim period.

You shall submit Performance Bank Guarantee [As per BPCL Format] for 10% oforder value for a period of 18 months from the date of despatch or 12 monthsfrom the date of commissioning whichever is earlier, with claim period of 6Months beyond expiry of guarantee period.

5.Penalty for breach of contractContractual delivery date for dispatches F.O.R. destination/F.O.R. Site, thedate of delivery shall be the date on which the goods/material are deliveredto nearest destination railhead or owner's warehouse at site. The time anddate of delivery of stores/material/ equipment as stipulated in the ordershall be deemed to be the essence of the contract. In case of delay inexecution of the order beyond the date of delivery as stipulated in the orderor any extensions sanctioned, BPCL may at its option:1. Accept delayed delivery at prices reduced by a sum equivalent to one halfof one percent(1/2%) of the value of any goods not delivered for every week ofdelay or part thereof, limited to a maximum of 5% of the total order value.2. Cancel the order in part or full and purchase such cancelled quantitiesfrom elsewhere on account and at the risk of the vendor, without prejudice toits right under (1) above in respect of goods delivered.

6.GuaranteesThe material shall be guaranteed for its design, good workmanship, size,capacity and operation and satisfactory performance for a minimum period of12 months from the date of commissioning or 18 months from the date ofdespatch whichever is earlier.



7.Contract riders (clauses)1)Bidder are requested to strictly adhere to the tender condition, otherwisetheir offer may be liable for rejection.

2) Your offer should be valid for a period of 120 days from the bid due date.

3) Your quotation must be Firm, inclusive of all packing & forwarding charges,taxes, duties, levies, transportation upto BPCL Warehouse. However, basicmaterial cost, packing & forwarding charges, duties, taxes, transportationcharges shall be indicated in the quotation. Vendor shall indicate the Excisetariff no. under which the goods are being cleared.

4) A) Party shall be bound to supply the material according to thespecifications given by BPCL. In the event of the party failing to supply,BPCL shall be at liberty to make the purchases from the market at the ratesavailable in the market at that particular time in respect of those items atthe risk and expenses of the party. The amount if any spent in excess of thecontract rates as also the expenditure of transport, labour & packingmaterials incurred in respect of such Purchases will be debited to Partyaccount and shall be liable to reimburse the same to BPCL.

B) Supply of the material shall be effected at the premises of BPCL(Refinery) Mahul, As specified by the Company. In case the party supply isrejected and not replaced within stipulated time, BPCL shall be at liberty topurchase or procure the same from other sources at the risk and cost of theparty.

5) It is the sole discretion of BPCL to increase/decrease the tenderedquantity/items and to award all or some of the quantities/items tendered whileplacing Purchase order.

6) Certificates : All supplies shall carry a certificate declaring that"Material supplied is exactly as per BPCL requirement". should accompany thesupplies when required. Without this your material may not be accepted at ourwarehouse.

7) Packing : The material shall be packed in accordance with therule, in weatherproof, shipment worthy, eco-friendly packing and labeled,indicating clearly the description of the item, hazardous nature if any,precaution and care to be taken.

8) If not bidding, please return enquiry documents alongwith Regret letterwithin due date.

9) BPCL reserves the right to give purchase preference to Public enterprisesas admissible under existing policy of Govt. of India.

11) Your quotation should indicate all charges for delivery up to BPCL MainWarehouse, Refinery Site, Mahul, Mumbai -400 074, and exact incidence ofapplicable duty, Tax and other charges etc.

12) Preferably indicate only one price for all components except taxes andduties.

13) Excise duty and octroi shall be paid as per Invoices, Bidder shallindicate exact percentage in their offer which will be considered inevaluation.

14) Any statutary variation shall be on BPCL account upto CDD, beyond CDD anyincrease shall be borne by bidder, whereas any decrease shall be pass on toBPCL.

15) You should not supply any excess quantity than indicated in PurchaseOrder. In case of excess receipt of quantity, payment of such excess quantitywill not be made.

16) Please note that we are eligible for "MODVAT" benefit. You to furnishdocumentary evidence of excise duty payment. Supplies should be accompaniedwith "Transporter's copy of the Invoice" complete with all informationregarding BPCL(R)'S Central Excise Registration NO., Permanent Income TaxNo., and Sales Tax Registration NO., Etc. As mentioned in the Annexure/Printed on the Format without which excise duty shall not be payable byBPCL or without the above information, we reserve the right not to accept thematerial at our Warehouse.

17) PAYMENT TERMS :- All incidental payment till the delivery of the materialto our Warehouse shall be Bidder's responsibility. No payment shall be madeto Third Party for any kind of charges.

18) Material if rejected shall be replaced free of cost on F.O.R. BPCLWarehouse basis.

19) THIRD PARTY INSPECTION(TPI) will be carried out by our TPI agengy.TPIcharges will be paid by BPCL to Third party inspection agency directly.In caseof IBR items IBR inspection is required and same shall be inspected by ourTPI.

20) CLAUSE REGARDING PURCHASE PREFERENCE TO MICRO AND SMALL ENTERPRISES

OWNER RESERVES ITS RIGHT TO ALLOW MICRO AND SMALL ENTERPRISES (MSES) AND MSESOWNED BY SCHEDULED CASTE (SC) OR THE SCHEDULED TRIBE (ST) ENTREPRENEURS,PURCHASE PREFERENCE AS ADMISSIBLE/APPLICABLE FROM TIME TO TIME UNDER THEEXISTING GOVT. POLICY. PURCHASE PREFERENCE TO A MSE AND A MSE OWNED BY SC/STENTREPRENEURS SHALL BE DECIDED BASED ON THE NET EVALUATED PRICE QUOTED BY THESAID MSES AS COMPARED TO L1 VENDOR AT THE TIME OF EVALUATION OF THE PRICE BID.BIDDERS CLAIMING PURCHASE PREFERENCE AS MSE NEED TO SUBMIT THE FOLLOWING
