Note change for 2009: As a result of the global economic situation, Imerys have been forced to look at ways of controlling costs. In light of this at Fowey, Saturday mornings will no longer be classed as a normal working shift. This means that whilst the Port is still able to cover an 06:00 – 14:00 shift on a Saturday, it will be at Owners’ request via Agents and subject to an overtime payment. Price on application. Any request for overtime received before 21:00 on the preceeding Thursday will be accommodated (subject no congestion issues). Cancellation of overtime before midday on the preceeding Friday will not incur any charge, but later cancellations may.

Fowey

Harbour Characteristics Location: Latitude 50° 19’ N Longitude 04° 38’ W on South coast of Cornwall in English Channel approaches. Fowey is a deep water port accessible in all weather and all states of the tides. The harbour entrance lies between St. Catherine’s castle on the West side and the Polruan headland on the East side All vessels in excess of 37.5 metres require a compulsory pilot. Watch is kept when vessels are due as advised in an estimated time of arrival to the port agent South Coast UK. Vessels are recommended to anchor one mile south of the harbour entrance to await Pilot. Fowey Pilots call sign is “Fowey Pilots” calling on VHF channel 16 and working on channel 9. The Port is under the control of Fowey Harbour Commissioners (VHF channel 12), who are also the Pilotage Authority for Fowey, Par and Charlestown. Ships over 92 metres (depending on construction and length over all) are required to swing in the lower harbour, using one tug, towed astern to the loading berths whilst dragging the vessels anchor. The loading berths are situated on the western bank of the channel approx. 2 km from the Harbour entrance. Vessels in excess of 102 metres (depending on construction and length over all) require two tugs for this operation. The tug/s will stand-by off the harbour entrance running alongside the vessel to make fast the tow-ropes prior to turning the vessel around in the swinging ground. The rise and fall of the tide varies between 2.0 and 6.0 metres and the ebb tide can be in excess of 1.75 knots. Because of tidal movement larger ships are moved in slack water. The Ship channel is 6.50 metres low water on spring tides. High Water full and change is 6 hours and 14 minutes Lay-by berths at buoys in the river can cater for two vessels. Owners proposing to load vessels over 120 metres LOA and/or cargo over 7,000mt are advised to contact the port agent South Coast UK as there may be restrictions to overcome. The largest ship brought into the port was over 165 metres and 17,000 tonnes deadweight. In recent years, Fowey has become a popular port of call for cruise liners, the largest visiting the harbour being the Crystal Harmony with a length of 248 metres and of 48,000 tonnes gross. Other vessels include the Black Prince, Hanseatic, Sun Bay II, Seabourn Pride and Spirit, Silver Wind and Cloud, Le Diamant, Sea Cloud II, and Pan Orama, also RFA vessel Sir Galahad.. There are two landing points designated for this business; one in the centre of Fowey Town at Albert Quay and the other adjacent to South Coast UK’s offices giving access to a coach park area on IMERYS’ property. A mobile crane is available for certain operations, and stores, water, repairs and bunkers can be arranged through the port agent South Coast UK (Denholm Barwil Ltd). China clay is transported to Fowey by road and rail and is either loaded direct to vessel or tipped to a store. The store can hold up to 22,000 tonnes in 14 separate bays. A 4-mile long private road links the Port of Fowey with Par. At Fowey in 2008, around 260 vessels loaded 850,000mt of china clay, the majority in bulk but some 12,000 tonnes of break-bulk. Secondary aggregates and rock salt were also handled and it is hoped this trade will continue to grow through Fowey in 2009. Normal operating times are from 06:00 to 22:00 Monday to Friday. Saturday working from 06:00 to 14:00 is available subject to payment overtime. Other weekend and Public holiday work is on application and subject to overtime.

Harbour Characteristics The Port of Par has been closed to commercial shipping since January 2008. St Austell Bay Boat Club continue to use the slip way facilities. Occasional project cargoes have been handled at Par in 2008. The below info is taken from: www.claycountryvision.imerys.com

Introduction This site is located at Par docks, south of St Blazey and within easy access of St. Austell. The site’s setting, with an existing dock, coastal views to the south and the steep rising ground to the north, gives it a unique character that is currently concealed by the industrial nature of the site. The primary objective for the development is the introduction of a marina which will generate associated activities, including retail and leisure opportunities and a 5-star hotel. A hub of activity will be created around the water’s edge providing a vibrant and bustling place for local people and tourists. The coastal footpath flanks the site providing links to the wider footpath network and stunning sea views. Residential development will offer a mix of housing and create year round vitality on the site. Business, light industrial units and a local boatyard will ensure a mixed use development providing employment opportunities as well as tourism facilities.

China Clay General Information China Clay is loaded at Fowey, whilst Ball Clay is loaded at Teignmouth, Bideford, Poole and Plymouth (Victoria Wharf). For further information relating to the China Clay Industry and its products see publication “China Clay from Cornwall & Devon - The modern China Clay Industry” by Charles Thurlow available on request. Most clays are loaded in bulk with a small percentage in bags. Slurry is no longer exported. China Clay is a weather working cargo subject to Receivers requirements. The loading turn is counted according to strict regulations and Owners and masters are required to give accurate ETA’s to the port agent South Coast UK in order to avoid any loss of turn or berth. Most cargoes are fixed under voyage charters using the China Clay Association Approved Form of charter party - Adopted 27th January 1908 Amended layout 1983 - Code Name “Claychart” - [See enclosed specimen]. Most Shippers accept vessels according to the recognised loading Scale for the number of hours allowed and the daily rate of demurrage if incurred - [See Chartering Practices and Loading & Demurrage Scales enclosed].

SECTION 1- STEMMING PROCEDURE 1.1 The Charterers of any cargo to be loaded on an “F.O.B.” basis at Fowey must apply for confirmation

of stem and cargo availability from the Shippers, IMERYS, using the Contact details shown in Box A of this document.

1.2 To avoid potential delay in obtaining stem confirmation, the Shippers will need to know the following

information: Vessel’s name and dates of proposed laydays/cancelling. Customer’s identity, product/s required, order numbers (if any) and quantity required. Intended discharging port/s.

1.3 Shippers will endeavour to respond without undue delay to stem requests when they are received.

1.4 Shipper’s confirmation of stem and cargo availability is necessary before finalising any “F.O.B.” fixture

involving the loading of any IMERYS products.

Summary of the Process of stemming, Chartering and Presenting Vessels for loading a cargo on an FOB basis Fowey (Cont.) SECTION 2- CHARTERING CRITERIA 2.1 The maximum spread of Laydays/ Cancelling should be 5 days at the time of fixing, although a narrower spread of 3 or 2 days is preferable. 2.2 It is advised that Charterers and vessel operators should be in possession of, or obtain, a copy of the Shipper’s document “HOLD INSPECTION- CODE OF PRACTICE FOR CLAY CARGOES”, in order to minimise potential delays due to unsatisfactory hold condition on arrival for loading. FOOTNOTE: It is also suggested that the CHINA CLAY ASSOCIATION APPROVED FORM OF CHARTER PARTY (1983) is the most suitable form of Charter Party for this type of traffic. SECTION 3- NOTICE AND NOMINATION PROCEDURE 3.1 Performing vessels should be nominated to both Shippers and Load Port Agents, upon presenting a minimum of 5 days initial notice of expected loadreadiness within the agreed laydays. 3.2 At this stage, the previous 2 cargoes carried by the performing vessel should be declared. 3.3 Upon nomination of performance and presentation of 5 day’s notice, the laydays should be narrowed to 3 days. 3.4 At the time of nomination of performing vessel, the Load Port Agents will need to know the following information:

Vessel’s name, previous port, previous port agent, position and provisional ETS from previous port and provisional ETA PAR/FOWEY.

SECTION 4- COMMUNICATION 4.1 The Load Port Agent will need to be informed of the following further information:

Owner’s full style; full description of vessel; details of shipboard communication systems, such as telex, telephone or telefax.

4.2 Subsequent to the initial 5 day’s notice of readiness, the vessel’s position and ETA should be updated regularly but in any case once per day thereafter. 4.3 Before leaving previous port, the Master should declare to the load Port Agent whether the vessel will be clean on arrival, or if time for cleaning/ positioning of bulkheads will be required, and if so, an estimate of the time required. 4.4 While on passage from previous port, vessels should report any change of ETA to the Load Port Agent. SECTION 5- EXCEPTIONAL SITUATIONS 5.1 Exceptions to the foregoing procedures may be possible, but only by specific agreement with the Shippers. 5.2 In the absence of 5 day’s notice of readiness, or in the event of a vessel arriving without any notice, the Shipper’s may have to apply 5 day’s notice from the time of the first advice of the vessel’s ETA. This will be in their discretion. SECTION 6- NOTICE OF READINESS 6.1 Shippers can accept Notice of Readiness for loading during normal office hours, which are 0800/1700 Monday to Friday; 0900/1200 Saturday.

IMERYS Hold Inspection Code of Practice for Clay Cargoes

IMERYS Quality policy We are committed to the operation of quality systems that will provide products and services that satisfy the quality expectations of our customers, both external and internal. These quality systems will comply with ISO 9000 (2001) and they will ensure that everyone in the organisation is both aware of and is capable of making their individual contribution to the overall system. We will promote customer confidence by prompt and effective response to their enquiries and concerns and, through partnership with our customers and suppliers, we will develop products, technologies and services to meet their evolving needs. Section A: Requirements Careful inspection of vessel’s hold/holds, hatch/hatches and the cargo area generally, so as to identify areas which may present a risk of contamination or damage to the intended cargo during loading, whilst on passage or during discharge. In the event that an area of risk is identified, the Hold Inspector may refuse to pass the vessel’s hold/holds for loading and shall recommend appropriate remedial action to be taken by the vessel’s Master/crew in order to rectify the problem/problems. In the event of a vessel failing the Hold Inspector’s inspection, the Hold Inspector shall make an estimate of the time required for the remedial action to be carried out, and this shall be communicated to the local authority. The Hold Inspector shall ensure that the remedial action has been carried out prior to passing the vessel’s hold/holds for loading. The inspection is primarily to assess the condition for the immediate cargo intended, but the Hold Inspector may also record on the Hold Inspection report comments or recommendations in respect of further cargoes. Section B: Inspection Criteria 1. The Hold Inspector shall carry out an inspection of the cargo area with special emphasis on the following:- Deckheads, overhead bems, hatch beams, hatch boards, hatch covers, hatch runners, coamings, sides of holds generally including exposed frames, pipework, trunking, ventilators, ladders, tweendecks and pontoons, ceilings and tanktops, bulkheads and any other area considered to present a risk to the cargo. 2. All cargo areas are to be free from the residues of previous cargoes, loose materials of any kind including flaking rust, paint or other coatings, damage to the ceiling, or any other condition likely to present a risk to the cargo, for instance the presence of excess moisture, oil or other potential contaminants. It should be noted that the presence of moisture does not necessarily hinder the commencement of loading. 3. It is recognised that certain parts of the cargo hold, including bilge system may not be readily accesible for close inspection or cleaning. If it is considered that there is a serious risk of contamination from this, the Hold Inspector may, at his discretion, refuse to pass the vessel’s hold/holds. 4. The Hold Inspector shall pay attention to the integrity of the hatches and a water test may be required. 5. It is recommended that ceilings and tank-tops should NOT be painted.
