    JOE LYONS SEES OPPORTUNITY IN IMPERIAL BEACHIn November, the Imperial Beach Chamber of Commerce welcomed Joe Lyons

    of McMillian Realty to the Imperial Beach community.

    Joe Lyons, after retiring from the U.S. Navy, has become a real estate agentwith McMillin Realty. He lives in Imperial Beach and is quite bullish on theImperial Beach real estate market. Pier South Resort and Sea 180, a CohnRestaurant, have started a renaissance in IB, along with the other restaurants:Filippis Pizza Grotto, Coronado Brewing Company, and Barrels Wine and Beer.The change is already reflected in the Imperial Beach condo market, which has

    experienced a 47% appreciation in the past 12 months.

    Joe is committed to the Imperial Beach community. Imperial Beach remindsme of the beach that I went to a lot while growing up... Myrtle Beach. Fordecades, it was a back in the day community and had the 50s-vibe, and thengrew and modernized to what Myrtle Beach is today. Imperial Beach has asimilar vibe and is now on-the-grow to its future.

    Outgoing Mayor Jim Janney and his wife Deb areseen here putting up the annual Triangle ChristmasTree. The Janneys have been donating their timedoing this for 8 years and plan to continue theircommunity involvement. There was significant timeinvolved in sorting out the lights the night beforeand about four hours to put the Christmas lightsup. Volunteers; Donna Alsum, Jaymie Paldi,Krystopher Paldi and Danny Compos also showedup to assist. The Janneys have also been involvedin setting up the Christmas tree at the Pier Plaza.

    To Editor I.B. Local News

    You can't exactly call it a "mandate". When 37% of eli-gible voters (out of x % of residents registered) are splitdown the middle, that is no mandate. But with a winneremerging, I would like to set down a few of my hopesand views for him to consider, and maybe a few of myneighbors will consider them also, and add their own ideas.

    I'm a long time Imperial Beach resident who is lucky enoughto have made it out of the work force alive, and who getsto travel a bit, and who gets to come home to this greattown here on the south end of our California coast. Thisis a part of the world I love very much, and so it was withsome optimism that I viewed the candidacy of an envi-ronmentalist vying for the job of mayor.

    Let me start by congratulating both candidates for a fairlyclean, civil and transparent campaign, unlike that othersqueaker of a contest played out by a couple of mud-slinging congressional runners that tortured us TV view-ers with their hatred. No mandate there either.

    Much was made of Serge Dedina's lack of political expe-rience. I heard, "Why does he not seek a councilman'sseat first and gain some experience?" This is a valid point,

    but maybe a completely fresh point of view is what isneeded here. I would like to see this newcomer to CityHall, approach his new empty desk, un-beholden to ANY

    of the entrenched special interests in this town. That meansa reset of every relationship this city has, with audits, wherenecessary. I'm talking about not just the realtors, develop-ers, and contractors but SANDAG, the Navy, the Port,the County, the Sheriff, MTS, and all the utilities.

    I especially would like to see the new Mayor use his en-vironmental bonafides to help correct what I see as manyshortfalls in the way the various utilities do business inour town, and how they do not always serve the bestinterests of the people and our environment, yet they aregranted monopoly status.

    We used to say "IB is OK". I believe it still is plenty OK.But being OK doesn't have to mean not being better. Wehave ourselves a new Mayor to start the new year offwith. Lets help him! And let's do it with a thorough housecleaning and a new spirit in our great little Classic South-ern California town. And let's talk about it here. Let's get a

    new community dialogue going, that is respectful and fullof ideas. Thanks a lot for reading some of mine.

    1919 to assist those service men and women coming home from the front and we continue to assistthem today. As an organization we are here for Veterans and their families. The Post consists of

    duty. It is serving during conflicts that make this organization so worthy to belong to. The

    Auxiliary are those women and girls that are Wifes, daughters, mothers, grandmothers and stepdaughters eligible to be members. The Sons of the American Legion or SALs are those sons,

    grandsons and stepsons who have had a parent who is in the American Legion. Come on down to

    the Post home if you fall into any one of these categories. We have Karaoke every Fri, Sat and Sun

    The City of Imperial Beach and its consultant team is continuing its work the PalmAvenue Mixed-Use & Commercial Corridor Master Plan which has built upon theMaster Plan Study approved by the City Council in February 2009. After receivingsignificant feedback, comments and input during the First Community Workshop

    held on April 29, 2014, from the City's website, and at subsequent community out-reach presentations on May 15th, May 20th, May 22nd and May 27th, the City andits consultant team have completed 30% drawings for the project and will soon

    begin the environmental phase of the project. Additionally, City Council Briefingswere provided on April 16th, May 21st and August 6th during the regular City Coun-cil meetings.     PUBLISHERS NOTES: THE CHANGING OF THE GUARDByEd Kravitz

    With pomp and circumstance, Mayor Jim Janney took one final performance and a bow.Now he will move on to a new chapter in his life, while a new Mayor gets ready to take

    Make sure all the money you will be paid or credited is per your expectations.

    The HUD-1 provides a picture of the monetary side of the property closing.

    It shows all of the money transfers between you, as the buyer, and the homeseller, and all of your closing costs, including the escrow and title fees, andthe costs of your loan, if you have one. It's a standardized form that yoursettlement agent or escrowee will complete at the closing, as required forall closings involving a federally insured lender under the Real Estate Settle-ment Procedures Act (RESPA) (12 U.S.C. 26012617).

    The HUD-1 is an important document, which you should carefully reviewprior to the closing, if possible, or at the closing. The form shows whereyour purchase money was spent. If you're financing your purchase, you cancompare the HUD-1 to the Good Faith Estimate (GFE) given to you byyour lender when you applied for your loan to make sure you were notovercharged for any loan, title, document recording, or escrow fees. To readmore about comparing your HUD-1 with the GFE see below.

    It's very important to save your HUD-1 for your tax preparer. You'll need it inthe year of your purchase and also in the year you sell the property.

    The HUD-1 form, itself, was created by the U.S. Department of Housing andUrban Development (HUD), and is updated by HUD periodically. The latest

    version can be found at the following HUD link: http://www.hud.gov/of-fices/adm/hudclips/forms/hud1.cfm

    What Does the HUD-1 Show?

    The HUD-1 is a multi-part form, divided into sections by topic, as describedbelow. It's also divided into the buyers side and the sellers side. When yourlender or escrowee talk about the HUD-1 at the closing, you'll often hearthem refer to various line numbers and costs and credits.

    The buyer is referred to as the borrower on the form because the HUD-1was created to explain closings involving lender financing. However, theHUD-1 is sometimes used in cash-only deals when closed by a title insurancecompany or separate escrow company.

    Comparing the HUD-1 to Your Good Faith Estimate

    As noted earlier, you can use the HUD-1 to confirm that the actual loan andclosing charges havent jumped from the estimated charges you were shownon the Good Faith Estimate (GFE). To make this task easier, the law requiresthe escrowee to reference line items on the GFE within the corresponding

    line items on the HUD-1.Page 3 of the HUD-1 shows the detailed comparison. The law also prohibitsincreases in the loan origination fees, points, and transfer taxes from theamounts shown on the GFE, and requires that government recording charges,and charges for third-party services where the third-party is selected by thelender or the seller, such as appraisal fees, credit reporting fees, tax servicefees, flood certifications, prepaid mortgage insurance, and title insurance

    premiums, never increase greater than 10% from the estimate.

    The Good Faith Estimate (GFE) Form, including an explanation of whichcharges cannot change, can be found on the HUD website.

    Unless your closing is a witness-only closing, your escrowee (or attorney, ifpresent) can explain the HUD-1 to you at the closing.

    You can ask your escrowee for a draft of the HUD-1 prior to the closing andthe final HUD-1 should be presented to you for signature before the finalclose of escrow. If you find an unexpected charge or fee increase, or amistake in your HUD-1 at or prior to the closing, tell your escrowee (and/orattorney if you have one there with you). That person will inform the seller,

    or the sellers attorney, if the error is from the sellers figures, or contactyour lender if the error is on the lenders side.

    With all the stress that involves closing and moving, you may not notice anerror in the HUD-1, or an unexpected fee, or fee increase from the GFE, untilafter it's over. In that case, do not hesitate to contact the escrowee and/orattorney who assisted you at your closing or even the lender directly. Yourlender should address any concerns about unlawful increases in settlementfees right away, because the lender is legally obligated to reimburse you forthese. If your loan or closing officer does not help you, ask to speak to theirLoan Manager or General Manager.

    Mr. Dedina has his work cut out for him becoming Mayor of Imperial Beachat this particular time. The challenges that await are monumental. Whetherone man can change an entire system overnight remains to be seen. Mr. Dedinawill have an opportunity to hone his leadership skills amid a whirlwind of

    projects both currently underway and planned in the near future.To be sure there will be a learning curve for the new Mayor, however CityManager Andy Hall will no doubt keep things moving along at City Hall regard-less. What remains to be seen is whether Dedina can engage the public in a

    positive way and get all parties to work together for the future good of Impe-

    rial Beach?

    NEW TEMPORARY ROUND-A-BOUT 9TH & DONAXIf you have driven on 9th Street and Donax lately, you would have had the opportunityto experience the new round-a-bout. Its the first of its kind in Imperial Beach and itreally has people talking. After speaking to many local residents, I have learned onething; not everyone agrees about it. The opinions are split directly down the middle.

    Neighborhood residents are really for it or against it. Whos idea was this and where did

    it come from? How much did it cost and why? After some digging and asking around,I learned some pretty interesting facts. At the City Council meeting on July 17, 2013,Councilman Bilbray made the motion and the Council voted unanimously for the appro-

    priation of $10,000 for the design and installation of the demonstration round-a- boutproject on 9th & Donax. The concept of a temporary round-about was obtained fromCoronado. The round-about is Temporary however, I couldnt find out when they planto remove it. You should go see it and try it out for yourself. Decide if you love or hatethe idea and let your City Council know how you feel and what you think.- Jeannette Shambaugh

    Someday in the future, you may visit Imperial Beach and not realize you arereally here. That is due in part to the many changes planned by the City to localstreets and highways.

    A number of projects are in progress or in the pipeline that many people in thepublic are not fully aware of. Sometimes after these projects are built, its nearlyimpossible to go back and put things back the way they were. That is why it isvery important for locals to learn about these changes to roadways and becomeinvolved in the public input process. If citizens do not become engaged and

    express their opinions at workshops or through the Citys website (commentssection), then they really have little to complain about after these projects havestarted or are completed. Whered that come from?

    A Public Workshop will be held on Wednesday December 10th regarding thePalm Avenue Master Plan progress and more news from CALTRANS. As oneof two main arteries in Imperial Beach, property and business owners should

    be concerned about the future plans for SR-75 and how it will impact them ifthey actually occur.

    Areas of town that will be changing significantly if these plans move aheadinclude but, are not limited to the following:

    PALM 7TH to 13TH. Much material is available on the Palm Avenue MasterPlan on the citys website including a link for comments. This will be thesubject of a special meeting Dec 10th.

    This was the proposal that would narrow lanes; build a planter and local accesslanes for parking and biketrail while reducing traffic lanes between 9th and 13th.

    PALM/SR-75 DELAWARE INTERSECTION (BERNARDO SHORES GATEAND SIGNALS)

    This was discussed briefly at the December 3rd presentation made to CityCouncil by the developer. It will also be discussed at the workshop December10. If you commute from Imperial Beach, you should be aware that thesechanges will impact you. Attend the meeting.

    OLD PALM AVE. We have previously written about the impacts of reducinglanes in a Tsunami Evacuation Route and creating additional hazards for bus-ses, bicycles and cars at westbound Palm and Rainbow. This is a design thatmany citizens still want to see put back the way it was with no right turn laneWestbound that would only take you back to SR-75 you just turned off of. Theonly reason for a right turn lane there is, so people can drive in circles!

    Also mentioned at the December 3rd meeting in the Bernardo Shores Developerspresentation are que times and traffic signal changes and lanes. Street parkingon Rainbow would also be reduced by at least 2 spaces. This will be discussed

    The Palm Avenue Master Plan project has been discussed previously in thispublication. The public, up until now has been minimally involved and aware.Its high time that the public start to pay attention and give elected leaders andstaff some input before the local streets are transformed into something unfa-miliar and possible worse than what exists now.

    The city is holding this next workshop for your education. If you dont attendand learn what is planned, you have nothing to complain about after the changesare done and over. As residents, business owners and taxpayers, you deserveto be included in the process but, you must make the first step and actuallyattend a meeting; make a comment and educate yourself and your neighbors.That is whats called being involved in your community.

    December 3rd Council Meeting started just like mostother Council Meetings. The Boy Scouts lead the Pledgeof Allegiance and the City Attorney announced that theClosed Session Item had been pulled from the Agendaand there was no reportable action.

    The Consent Agenda items except the Warrant Registerwere approved with no discussion. According to packetdetails, one of the items was a review of City ManagerHall and a pay increase as well as about $1.8 million to

    be spent at this meeting. Ed Spriggs asked the WarrantRegister be pulled and discussed at the end of the meeting.

    Councilwoman Bragg spoke about MTS and their Di-rector Paul Jablonski getting an APTA Award. She men-tioned future changes which would allow South Baymembers of the Transit Board an opportunity to sit onthe Executive Board of the Transit Agency.

    Councilman Spriggs reported on Port Workshops andthe vision for development of Port property around the

    bay. Spriggs indicated that there were big changes andrenovations coming to the end of the pier in the not toodistant future.Spriggs said he supported the concept ofEnvironmental and Natural uses of the southern por-tions of the bay.

    Councilman Patton commented that Imperial Beach wasthriving because of Jim Janney.

    Mayor Janney spoke briefly about SANDAG GRANTS,Transportation and bikes.

    PUBLIC COMMENTS

    Assembly Speaker Toni Atkins sent aid Shanel Noel witha commendation of acheivement.

    Captain Chris Sund Commanding Officer North Islandcommended Mayor Janney on a Job Well Done.

    County Supervisor Greg Cox was next at the podium andcongratulated Ed Spriggs and Lorie Bragg on their recentre-elections. He said that he and Deb Janney had a lot incommon since they were both married to South Bay May-ors. Cox reminisced about Janneys many accomplish-ments in office and proclaimed December 3rd Jim JanneyDay in San Diego County. Cox also reported that JimJanney has been appointed to the Airport Authority!

    Congressman Juan Vargus office sent aid Eddie Meyerwith a proclamation for outstanding service.

    Port Commisisoner Dan Malcolm gave testimonials toboth Deb and Jim Janney. He said Big Dreams WerePut Into Realty. Told Jim Janney; Job Well Done!

    The SANDAG Chairman Jack Dale reminisced abouttheir accomplishments together and joked that they alsolost a couple lawsuits together but, did not elaborate.

    Cheryl Cox, outgoing Mayor from Chula Vista and wifeof Supervisor Greg Cox was next. Talked about howthe Janneys helped them out once with storage spacefor books. She warned Jim Janney that even formerMayors can get in trouble. She said Jim exemplified thefriendship of southbay cities.

    Councilman Richard Baily from Coronado was next topay tribute to Jim Janney and sent his regards fromMayor Tanaka.

    Andy Yuan from U.S. Fish and Wildlife Service ws nextto pay tribute and thank Janney for supporting the Ref-uge Complex over the years. He mentioned their part-nership with the City over the years and the Friends ofthe Refuge group.

    Next up was former Mayor and Port CommissionerMike Bixler. He claimed he only had a small cadre ofspies and minions left in Imperial Beach and gave writ-ten remarks to the clerk and asked they be put into therecord.Bixler remarked that if Janney had been re-electedMayor, he would have become the Chair of SANDAG.Bixler joked about being in the ex-Mayors Club.

    Former Mayor Diane Rose was next and asked Bixler ifhe had shown Jim Janney the secret handshake yet?She commented that they had a unique relationship ashe was a Councilperson when she was Mayor and shewas a Councilperson while he was Mayor.

    Mayor Janney responded that it was Diane Rose whogot him to run in the first place. He said he didnt knowwhether to say,Thank You or not?

    Brian Bilbray Senior was next and commented that allthe living ex-Mayors are here tonight to pay tribute toJim Janney. Bilbray told Janney the good side is thatnow he can have time to be with the people he wants to

    be with and do what he wants to do.

    Former Councilwoman and Successor Agency Advi-sory Board Chairperson Mayda Winter was next. Win-ter said Janney would be missed and it was a privilegeto serve with him on City Council.

    Ms. Graves from the South Bay Economic Concil wasnext and told a couple of anecdotal stories about Jimand gave him a parting gift.

    Lilian Leopold from South West College District was next.

    Manny Rubio from Sweetwater Union High School was next.

    Librarian June Engel gave anecdotal short stories ofmeeting Janney. She said, Janney put a Smile On MyFace!

    Kathryn Hill of League of Calfornia Cities thankedJanney for his legislative advocacy and helping repre-

    sent the 482 member cities in California and especiallythe 18 San Diego County c ities.

    Joann Barrows and Candy Unger representing the Cham-ber of Commerce were next to pay tribute and wipe atearful eye or two.

    Nancy Dayton from the Womens Club was next to say thank

    you and pay tribute to Jim Janney. She told Jim he is invited tolunch the 2nd Tuesday of the month no matter where they areeating. Janney reminded everyone the Womens Club had do-nated the first bench to the Veterans Park.

    Pastor Jones who has been in Imperial Beach for 30 yearswas not available when they called his name.

    Esteen Levon from Sudberry Properties gave a long ora-tory about their partnership with Imperial Beach. Aboutthe demise of the RDA and the ROP process with theState Department of Finance. Says the 9th and PalmProject has been going on now for 5 -6 years sinceSudberry first got involved. He mentioned GOOD NEWSFROM CALTRANS without going into details but it prob-ably relates to Relinquishment of SR-75 right of way.

    Janney thanked Esteen for Lunch with Rosie Greer.Next up was Dick Pilgrim.

    Next was Gary Brown, the former City Manager. Browncommented on the American Legion project and quotedsomeone who said if we can see farther now, its be-cause were standing on the shoulders of giants.

    City Manager Andy Hall was next and presented a plaquesigned by all City Staff and flowers to Deb Janney.

    Greg Wade gave a mock Staff Report.

    Jim Janney thanked his wife Debbie and said it was anhonor to serve. Proud to call Imperial Beach Home and

    proud to be your neighbor. Thank you!

    STANDING OVATIONCouncilman Patton said Jim Janney was Class Act

    Pat Bilbray kept his comments short as the meeting wasnow running late.

    Ed Spriggs stated that he thought it was important forJim Janney to stay involved in the community.

    Councilwoman Bragg said they had been through badtimes and good times and that she wished Jim and DebJanney,NO BAD DAYS. That was Janneys campaignslogan 12 years ago.

    Councilman Patton presented Janney with a ceremonialgavel and made a motion to recess and bid Janney farewell.

    The meeting went into recess and a reception with re-freshments was held at the community room before thecouncil meeting reconvened.

    Most of the remaining meeting was taken up by presen-tations by Integral Communities regarding the proposedBernardo Shores Condo project. We will go into that inour next edition at greater length.

    The last item of the evening was the Warrant Register orCitys Check Register. Councilman Spriggs had askedthat this item be pulled for discussion because of several

    large items that had no explanation. He enquired fromstaff about a $35,668 expendature for Atkins NorthAmerica and also a large check for La Posta MarketFaade. The last item was a $10,000 check for a sign!
