• In 2018, there were 630 incidents that involved use of force resulting in serious bodily injury or death of a civilian or officer; or the discharge of a firearm. (Table 1)

• Of the 630 incidents, 268 reported a discharge of a firearm. (Table 8A)

• Of the 630 incidents, 51.7 percent (326) occurred during a call for service, 17.9 percent (113) occurred while either a crime was in progress or while officers were investigating suspicious persons or circumstances, and 12.9 percent (81) resulted from a vehicle/bike/pedestrian stop. (Table 2A)

• Of the 630 incidents, 74.1 percent (467) resulted in an arrest. (Table 2B)

Use of Force Incident Reporting 2018 presents a summary overview of use of force and discharge of firearm incidents, as defined in Government Code (GC) section 12525.2.* This report focuses on data reported by California law enforcement agencies for 2018. Due to the narrow definition of this statute, the data contained in this report only represent incidents where use of force resulted in serious bodily injury or death or the discharge of a firearm. Caution should be used in making comparisons or generalizations with this data set as it does not contain the full spectrum of use of force incidents that occurred in California.

• In 2018, 679 civilians were involved in incidents that involved the discharge of a firearm or use of force resulting in serious bodily injury or death. (Table 6A)

• Of the 679 civilians, 93.1 percent (632) were male, 6.5 percent (44) were female, and 0.4 percent (3) fled the scene and their gender was unknown. (Table 7)

• Of the 679 civilians, 46.7 percent (317) were Hispanic, 28.4 percent (193) were white, and 19.1 percent (130) were black. (Table 7)

• Of the 679 civilians, 33.1 percent (225) were hit by the discharge of a firearm, 16.5 percent (112) and 12.1 percent (82) received force by other control hold/takedown tactics and electronic control device, respectively. (Table 8B)

• Of the 679 civilians, 62.3 percent (423) were injured, 15.6 percent (106) were not injured, and 21.6 percent (147) died. (Table 21)

• Of the 679 civilians, officers perceived that 370 civilians were armed. Of the 679 civilians, 285 were confirmed to be armed. (Tables 15 and 16)

• In 2018, 1,562 officers were involved in incidents that involved the discharge of a firearm or use of force resulting in serious bodily injury or death. (Table 6A)

• Of the 1,562 officers, 93.8 percent (1,465) were male and 6.2 percent (97) were female. (Table 7)

• Of the 1,562 officers, 54.8 percent (856) were white, 32.0 percent (500) were Hispanic, 6.3 percent (98) were Asian/Pacific Islander, and 4.6 percent (72) were black. (Table 7)

• Of the 1,562 officers, 50.1 percent (782) did not receive force from a civilian, 22.7 percent (354) received force during physical contact with a civilian, and 10.6 percent (166) received force by the discharge of a firearm from a civilian. (Table 8B)

• Of the 1,562 officers, 16.3 percent (255) were injured, 83.5 percent (1,304) were not injured, and 0.2 percent (3) died. (Table 32)

• Of the 1,562 officers, 1,452 reported use of force. Officers reported they used force to affect arrest/take into custody (834), to overcome resistance (350), in defense of a 3rd party (228), or to prevent escape (40). (Table 29)

In late 2015, the California legislature passed Assembly Bill (AB) 71, adding GC section 12525.2. This new statute mandates law enforcement agencies (LEAs) in California to report use of force incidents that result in serious bodily injury or death or involve the discharge of a firearm. Effective January 1, 2016, all LEAs were required to begin collecting data on use of force incidents for submittal to the Department of Justice (DOJ) beginning January 1, 2017.

THE SYSTEM

The DOJ consulted with LEAs and stakeholders throughout the state in a series of regional meetings. This collaboration resulted in the development of use of force incident data elements and definitions, as well as a web-based data collection system through which LEAs may enter and submit use of force data to the DOJ. This online platform is named URSUS, a tribute to the California state animal. All agencies employing peace officers have the requirement to report even if they have no use of force incidents (zero-reporting).

DATA LIMITATIONS

The data contained in URSUS is narrowly defined and does not represent the totality of use of force incidents that occur in California. LEAs are only required to report use of force incidents that result in serious bodily injury or death of either the civilian or the officer and all incidents where there is a discharge of a firearm. As such, caution must be used when using the data for comparisons or in calculating rates.

2016 represented the first year of data collection and reporting. While every effort was made to provide access to all LEAs in the state, not all agencies reported. There could be inconsistencies in reporting for a few years as training and outreach efforts are ongoing.

FUTURE ENHANCEMENTS

Each year of collection provides an opportunity to refine data elements and add useful contextual information. The DOJ will continue to work with stakeholders to provide a platform for improved data collection over time.

DEFINITIONS

Serious bodily injury is defined in GC section 12525.2. Please see the Legislation section on page 6 for further detail.

Discharge of a firearm - Includes any discharge of a firearm during an interaction between a civilian and an officer, regardless of whether any person was injured. A firearm is defined as a weapon that fires a shot by the force of an explosion, e.g., a handgun, rifle, shotgun, and other such device commonly referred to as a firearm. Not included in this definition are electronic control devices; stun guns; BB, pellet, air, or gas-powered guns; or weapons that discharge rubber bullets or bean bags.

Injury severity - Severity levels below “serious bodily injury” are included in the data set due to the fact that reporting is required for any discharge of a firearm.

LEGISLATION

Effective January 1, 2016, Chapter 462, Statutes of 2015 (AB 71) added GC section 12525.2 pertaining to the collection and reporting of use of force incidents resulting in serious bodily injury, as defined, discharge of firearm, or death. As such, on January 1, 2016, all LEAs were required to begin collecting use of force incidents for submittal to the DOJ beginning January 1, 2017.

GOVERNMENT CODE SECTION 12525.2

(a) Beginning January 1, 2017, each law enforcement agency shall annually furnish to the Department of Justice, in a manner defined and prescribed by the Attorney General, a report of all instances when a peace officer employed by that agency is involved in any of the following:(1) An incident involving the shooting of a civilian by a peace officer.(2) An incident involving the shooting of a peace officer by a civilian.(3) An incident in which the use of force by a peace officer against a civilian results in serious

bodily injury or death.(4) An incident in which use of force by a civilian against a peace officer results in serious bodily

injury or death.

(b) For each incident reported under subdivision (a), the information reported to the Department of Justice shall include, but not be limited to, all of the following:(1) The gender, race, and age of each individual who was shot, injured, or killed.(2) The date, time, and location of the incident.(3) Whether the civilian was armed, and, if so, the type of weapon.(4) The type of force used against the officer, the civilian, or both, including the types of

weapons used.(5) The number of officers involved in the incident.(6) The number of civilians involved in the incident.(7) A brief description regarding the circumstances surrounding the incident, which may

include the nature of injuries to officers and civilians and perceptions on behavior or mental disorders.

(c) Each year, the Department of Justice shall include a summary of information contained in the reports received pursuant to subdivision (a) through the department’s OpenJustice Web Portal pursuant to Section 13010 of the Penal Code. This information shall be classified according to the reporting law enforcement jurisdiction. In cases involving a peace officer who is injured or killed, the report shall list the officer’s employing jurisdiction and the jurisdiction where the injury or death occurred, if they are not the same. This subdivision does not authorize the release to the public of the badge number or other unique identifying information of the peace officer involved.

(d) For purposes of this section, “serious bodily injury” means a bodily injury that involves a substantial risk of death, unconsciousness, protracted and obvious disfigurement, or protracted loss or impairment of the function of a bodily member or organ.

When a use of force incident is reported, a reason for an officer’s use of force must also be reported; one or more reasons that led up to the application of force can be reported per officer.
