TO: Board of Trustees FROM: Gregory Haulk Superintendent DATE: June 21, 2016 SUBJECT: LOCAL CONTROL AND ACCOUNTABILITY PLAN (LCAP) RECOMMENDATION: It is requested that the Board of Trustees conduct an official public hearing of the Local Control and Accountability Plan, Education Code section 52062. BACKGROUND: In June, 2013, the Legislature adopted a new funding system for schools in California known as the Local Control Funding Formula (LCFF). The purpose of the new funding formula was to give school districts more local control over how funds are spent. As part of LCFF, the Legislature included an accountability component known as the LCAP. Each school district, in developing its LCAP, must annually update the state priorities and solicit input and consult with parents, teachers, school administrators, school employees, students, and employee organizations. As part of the process, each school district is required to hold at least one public hearing to solicit the recommendations and comments of the members of the public regarding the specific actions and expenditures proposed to be included in the LCAP. At a second board meeting held after the public hearing, the Board is required to adopt the LCAP in a public meeting. The second meeting is required to be the same meeting in which the Board of Trustees adopts the budget for 2016-17.

Archibald Assistant Superintendent DATE: June 21, 2016 SUBJECT: 2016-17 DISTRICT BUDGET ______________________________________________________________________________ Education Code section 42103 requires the Board of Trustees to hold a public hearing on the proposed budget for the district. The hearing needs to be held at least three days following availability of the proposed budget. The budget has been available since June 17, 2016. The county superintendent of schools is required to publish a notification of dates, times, and location of the public hearing in a newspaper of general circulation. The notification needs to be published no less than ten days prior to the date set for the public hearing. The notice was published in the Orange County Register.

BEACH CITY SCHOOL DISTRICT (HBCSD) AGREEMENT FOR CHILD DEVELOPMENT CONTRACT APPROVAL #CSPP-6653.

________________________________________________________________________________ RECOMMENDATION: Approval is recommended for an agreement between the California Department of Education (CDE) and Huntington Beach City School District (HBCSD) to provide early childhood development education funding through the California State Preschool Program (CSPP) for the 2016-17 school year. BACKGROUND: The 2016-17 CSPP will provide critical funding to serve a total of 24 children of income eligible families with 3 and 4 year old children in the city of Huntington Beach. According to the 21st Annual Report on Conditions of Children in Orange County there are 867 children in our community who are income eligible to participate in such a program and agencies currently operating CSPP are only serving 45% of these children. By providing a high-quality, research based, early childhood experience, Huntington Beach City School District will help these families prepare their children for successful transitions into Transitional Kindergarten or Kindergarten programs. The agreement is available for review in the Educational Services office. FISCAL IMPACT: There is no impact on the General Fund. The grant will provide a maximum of $100,251 for the HBCSD State Preschool Program.

BACKGROUND: On March 4, 2008, the Board of Trustees for the district adopted Resolution A-72-07/08 determining that the District Property was not needed for school classrooms and was therefore surplus and declared its intent to sell. On May 17, 2016, the Board of Trustees adopted Resolution A-74-15/16 which reconfirmed and restated its findings of the Initial Resolution that the District Property is not needed for school classroom buildings and is therefore surplus. The district has entered into escrow with the City of Huntington Beach to sell an approximate 6.61 acre portion of District Property consisting primarily of the existing six (6) non-lighted sports fields in accordance with the Naylor Act to be used for recreational and park purposes. The district desires to sell the remaining approximate 3.53 acres for a residential development of 15 single-family homes. The City has already approved the Tentative Tract Map, Zoning Map Amendment, and General Plan Amendment. The successful bidder will be required to design, construct, and install, at its sole cost and expense, certain improvements to the district property and adjacent LeBard Park and public right-of-way owned by the City of Huntington Beach which the district has estimated will cost approximately $838,087.

RESOLUTION NO. A-76-15/16

“RESOLUTION OF THE BOARD OF TRUSTEES OF THE

HUNTINGTON BEACH CITY SCHOOL DISTRICT AUTHORIZING SALE OF SURPLUS REAL PROPERTY”

WHEREAS, the Huntington Beach City School District (the “District”) is the owner of certain real property totaling approximately Ten and One Tenths (10.14) acres, located at 20451 Craimer Lane, in the City of Huntington Beach, County of Orange, State of California, formerly known and used as the LeBard Elementary School, and until recently used as the District’s Education Center (the “District Property”); and WHEREAS, the District Advisory Committee in 2000 reviewed the District Property pursuant to Education Code sections 17387 through 17390, and determined that the District Property was not needed for school classroom buildings and was therefore surplus; and WHEREAS, on March 4, 2008, the Board of Trustees for the District adopted Resolution A-72-07/08, determining that the District Property was not needed for school classroom buildings and was therefore surplus, and declared its intent to sell the District Property (the "Initial Resolution"); and WHEREAS, on May 17, 2016, the Board of Trustees adopted Resolution A-74-15/16 (the "Confirming Resolution") which reconfirmed and restated its findings of the Initial Resolution that the District Property is not needed for school classroom buildings and is therefore surplus; and WHEREAS, in accordance with the Initial Resolution and consistent with Education Code section 17486, the District Property was offered (a) to required public agencies for recreational purposes under the Naylor Act, and (b) to priority entities in accordance with Education Code section 17464 (collectively, the "Priority Entities"); and WHEREAS, the City of Huntington Beach (the "City") was the only Priority Entity which expressed interest in purchasing the District Property; and WHEREAS, the District has entered into escrow with the City to sell an approximate 6.61 acre portion of the District Property consisting primarily of the existing six (6) non-lighted sports fields in accordance with the Naylor Act to be used for recreational and park purposes; and WHEREAS, the City has approved the following entitlements for the District Property (the "Project Site Entitlements"): (a) Tentative Tract Map Number 17801 for a total of fifteen (15) single-family residential lots; (b) Zoning Map Amendment No. 12-001; and (c) General Plan Amendment No. 12-002, in accordance with California Government Code sections 66452 through 66455.9; and

WHEREAS, pursuant to the Confirming Resolution, the District's Board of Trustees declared its intent to sell the remaining approximate 3.53 acres of the District Property described in Exhibit "A" and depicted on Exhibit "B" attached hereto (the "Residential Property"), for the development of single-family residential lots consistent with the provisions of Education Code sections 17455 through 17478 and Project Site Entitlements; and WHEREAS, on May 24, 2016, an Optional Pre-Bid Meeting was held in the District Board Room for the purpose of District staff/consultants to provide a brief summary of the Project Site Entitlements and terms of sale for the Residential Property; and WHEREAS, the District Superintendent or his designee properly posted and published notice of the Board's intent to sell the Residential Property as required by Education Code section 17469; and

WHEREAS, on June 21, 2016, the Board of Trustees held a public hearing for the purpose of receiving and opening all proposals submitted by bidders and calling for oral bids for the sale of the Residential Property;

WHEREAS, of the bid proposals submitted to purchase the Residential Property, the bid

of ___________________ was deemed to be the highest responsive proposal, either written or oral.

NOW, THEREFORE, the Board of Trustees hereby resolves: 1. Pursuant to Education Code section 17475, the Board accepts the bid proposal

submitted by ________________ (the "Successful Bidder") to purchase the Residential Property in the amount of _______________________ Dollars ($________).

2. The Successful Bidder submitted with its bid proposal a certified or cashier's

check made payable to the District in the amount of Fifty Thousand Dollars ($50,000) (the "Bid Deposit") as bid security for entering into the Purchase and Sale Agreement for the Residential Property.

3. No later than July 1, 2016, escrow for the sale of the Residential Property shall be

opened with First American Title Company, 4 First American Way, Santa Ana, California 92707, who shall act as escrow holder and title company for the Residential Property ("Escrow").

4. The District shall pay no commission for the sale of the Residential Property. 5. The Superintendent or his designee is authorized and directed to execute three (3)

original Purchase and Sale Agreements for the Residential Property, together with any other documents required by Escrow and deliver all such documents into Escrow, including the

delivery into Escrow of Forty Thousand Dollars ($40,000) of the Successful Bidder's Bid Deposit within two (2) business days of the opening of Escrow.

6. The President of the Board, consistent with Education Code section 17478, is

authorized and directed to execute the Grant Deed for the Residential Property and cause it to be delivered into Escrow to be released upon performance and compliance by the Successful Bidder of all the terms and conditions of the Purchase and Sale Agreement for the Residential Property.

7. The Successful Bidder for the Residential Property shall have a thirty (30) day due

diligence period from the opening of escrow to review the Project Site Entitlements and approve the condition of the Residential Property and the condition of title (the "Due Diligence Period"). Any such approval shall be in writing delivered to the District.

8. Escrow shall close no later than fifteen (15) days following the sooner to occur of

the expiration of the Due Diligence Period, or the Successful Bidder's written approval of the condition of the Residential Property.

PREVENTATIVE MAINTENANCE OF CEILING FANS ____________________________________________________________________________________________ RECOMMENDATION: Approval is recommended for a contract with Big Ass Solutions for the purchase, installation and preventative maintenance of ceiling fans. BACKGROUND: Student and staff areas in rooms without air conditioning create a challenging learning and work environment during periods of hot and humid weather. A high quality ceiling fan provides a way to move air in a room creating a cooler environment. Perry, Dwyer, Smith, Peterson and Eader schools all have a significant number of rooms without air conditioning. Ceiling fans would be installed in virtually all rooms without air conditioning at those five sites over a three year period. If additional funding is received through donations, the project could be completed in a shorter amount of time. Perry will be fully completed this summer and two or three classrooms at each of the other sites will be completed also. We want students, staff and parents to be able to understand what the impact will be in all classrooms. The district advertised for bids on May 12 and May 19, 2016. A mandatory job walk and conference was held on June, 1, 2016. The bid opening was conducted on June 15, 2016. Big Ass Solutions was the lowest responsible bidder with a bid of $820,304 for the purchase, installation and preventative maintenance (five years) of ceiling fans at Perry, Dwyer, Smith, Peterson and Eader over the next three years. FISCAL IMPACT: Funding designated for facilities in the amount of $820,304 will be used over a three year period to purchase and install ceiling fans.

Archibald Assistant Superintendent DATE: June 21, 2016 SUBJECT: NOTICE OF COMPLETION ______________________________________________________________________________ RECOMMENDATION: Approval is recommended for filing a Notice of Completion for work at all school sites relating to the energy services contract with OpTerra Energy Services, Inc. BACKGROUND: On November 18, 2014, the Board of Trustees approved Resolution No. A-30-14/15 authorizing the execution of an energy services contract with OpTerra Energy Service, Inc. Projects included exterior lighting upgrades at three school sites, photovoltaic (solar) installations at four school sites, heating, ventilation and air conditioning (HVAC) improvements at nine school sites, roof work at three school sites, upgrade and install campus wireless systems and Solatube daylighting at Peterson Elementary School. It is necessary for the Board of Trustees to accept the work as completed and file a Notice of Completion prior to final payment to the contractor. FISCAL IMPACT: There is no fiscal impact.
