Dear Homeowner, Congratulations and welcome as a new owner on Terra Verde Resort. We believe that you’ve made a great decision. You’ll find that we have a very well run Homeowners Association (HOA), under the care of our General Manager, Conrad Ferguson and his team, who are located at the Terra Verde clubhouse. They are there for you and your guests and will be very happy to help with any questions you may have. Conrad is supported by an unpaid Board of Directors, who are all Terra Verde homeowners themselves and bring experience from a broad spectrum of business life, both in the US and abroad. Details of the current Board and much else, can be found on the HOA website at www.terraverdehoa.com You’ll hear more from us all over time, but meantime please just take a moment or two to look through our Welcome Manual. The Clubhouse

The clubhouse at Terra Verde is a modern resort facility designed to make You and your Guest’s stay at Terra Verde relaxing and enjoyable.

The offices of the Terra Verde Homeowners Association are also situated at the clubhouse.

Under 14’s must be accompanied by a responsible 16 year old or above whilst in the clubhouse. Concierge Team Our concierge team provide a friendly and professional service to assist homeowners and guests. They are happy to offer advice and provide directions to attractions and amenities in the Kissimmee and Orlando area.

Hours of Operation: 8am—10pm, 7 days a week.

Clubhouse Lounge

A large lounge is provided where owners and guests can relax and enjoy a cup of complimentary coffee, read a book or check their emails using the free wifi internet access.

Note: Wireless access extends outside to the pool area.

High definition Cable TV is also provided on a number of screens.

No wet clothing is permitted in the lounge.

All Homeowner's Association meetings are held in the lounge.

A separate Cinema room is located in the clubhouse, which shows weekly films.

Business Centre

State of the art PC’s with high-speed internet access and a printer are provided for the use of owners and guests. Use of PC’s is 20¢ per minute and printing 20¢ per page. Payment by cash or credit card. Office Services Photocopying: 25¢ per sheet. Faxing: $1 receiving or sending.

Mail Service Outgoing post can be left at the clubhouse and is collected daily. Stamps are available from the vending machine at the clubhouse.

Post, including parcels can be delivered to the clubhouse and will be held for two weeks without prior arrangement.

Homeowners who have parcels delivered should give the clubhouse prior warning.

Homeowners or Guests are responsible for collecting their own post.

ATM

For convenience an ATM, situated in the room next to the Business centre, is available for cash withdrawals. Fitness Room

Fully equipped air conditioned fitness room with two cycles, two running machines, one elliptical machine and a two station multi-gym.

Rules of use: Under 14’s must be accompanied by

a responsible 16 year old or above. Use of the equipment is at the

homeowner’s or guest’s own risk.

Please note: No fitness instructor provided.

Games Room

Includes Pool and Air hockey table plus a range of arcade games for all ages.

Sauna

De-stress, relax and rejuvenate in our sauna. The sauna experience will leave you feeling very much alive. Your senses will be sharpened, and your tactile sensitivity heightened.

Under 14’s must be accompanied by a responsible 16 year old or above.

Communal Pool

A resort size, heated pool and spa with sunning deck is provided for the use of homeowners and guests between the hours of 8am and 9pm.

It should be noted that no lifeguard is provided and the following rules apply:

Under 14’s must be accompanied by a responsible 16 year old or above.

No glass allowed in the pool area.

No food or drink to be brought in from the outside.

Tiki Bar

Operated on behalf of the HOA by the Lagoon Tiki Bar and Grill, the Tiki Bar serves a range of soft drinks, beers, wine, smoothies, cocktails and food.

Opening Hours: 12am—10pm daily (may be adjusted at peak times, holidays and during promotional events).

Please note only food and drink obtained from the Tiki Bar may be consumed within the pool and lakeside decking area.

Menu is available to download from the HOA Website.

Lakeside Decking Area

The lakeside decking area is provided for adult homeowners or guests who

want to get away from the pool area and enjoy a meal and drink overlooking the lake.

No food or drink to be brought in from the outside.

Please no wet clothing on the cushion seating. Tennis Court

A tennis court is situated at the end of Hideaway Beach Lane. Reservations can be made at the Front Desk of the Clubhouse.

Volley Ball Court

A sandy volley ball court is located amongst the palm trees and close to the poolside Tiki bar for a well-earned cold drink. Balls available from the Concierge.

Half Basketball Court

This is an ideal practice facility for guest attending local basketball competitions and using Terra Verde as their base or groups wanting some leisurely fun. Children's Play Area

A shaded play area with sand pit, providing a safe environment for the little ones to have lots of fun. Table Tennis

Enjoy a game of table tennis in the sun. Situated next to the communal pool area , you can work up a thirst before retiring to the Tiki Bar.

Mini Golf

Mini golf is always popular, particularly with the kids. Situated in the shade of the palm trees, it’s ideal for the little ones. Fishing Lake

Owners and guests can enjoy some relaxing fishing from the bridge or take in the scenic views on the lakeside walk. Lots of local wildlife to be seen. Shuffleboard

While the children entertain themselves in the play are, enjoy a game of shuffleboard situated in a tranquil location by the lake.

The HOA maintain a public website designed to promote the resort to potential renters. Please visit www.terraverderesort.net

Homeowners current in their HOA fees are, if they wish, able to take advantage of this website and receive general rental enquiries collected by the site. Contact the site admin to take advantage of this facility.

The Homeowners Association publish a newsletter, which contains all the latest news from the Board, some important announcements plus ideas and articles from other homeowners. Terra Verde Resort Forum

HOA Documents

If you were not provided with a full set of recorded HOA Declarations and By-laws at the time of purchase they may be downloaded from the HOA website www.terraverdehoa.com

The owner of each unit will be held accountable for any deed restriction

violations by themselves or their guests, which may result in a fine.

The guidance in this document should be read in conjunction with the HOA Declarations and By-laws.

Renting Your Home It is important to note that Terra Verde Resort is designed and zoned for ‘short term rentals’.

Rentals with terms greater than 6 months are no longer accepted or permitted to be issued for residences on Terra Verde resort.

Additionally, no owner may lease to the same tenant for periods, which when combined total more than 6 months, nor may any residential unit be occupied by the same person/people for a period in excess of 6 months, unless they are owner-occupiers.

Rentals with a duration between 3 and 6 months require formal prior approval of the HOA, therefore, if you are considering a rental of this nature, you are required to submit the lease/agreement to the resort General Manager for approval.

Short-term rentals of less than 3 months are unaffected by these changes, as are owners, or their immediate family - where no formal lease is issued - who personally occupy their residential unit.

Useful information and resources on renting your home can be found in the owners section of the HOA Website. It is also worth talking to other homeowners about their experience renting their home. Homeowner Associations Terra Verde contains three associations to which homeowners pay fees. The fees that a homeowner pay is dependent on the property they own. All homeowners will pay fees to

the Masters Association and either the Manors or Villas Association as appropriate.

Assessments (HOA Fees) As an owner you will pay HOA fees to the Masters Association and to either

the Manors or Villas Association depending on the property you own. HOA fees are set annually and due quarterly on the 1st January, April, July, and October. A number of payment methods are available for convenience and are detailed below; however, homeowners are encouraged to use the ACH (Recurring Automatic Direct Debit) where possible.

ACH (Recurring Automatic Direct Debit) If you wish to pay your assessment through direct debit, please complete and return an ACH form (a separate form is required for each payment i.e. Masters and Villas or Manors). The completed form can be downloaded from the HOA website and emailed to [email protected] or faxed to 407-396-8265. If you wish to mail please see address below under Lockbox Service.

Online Payment Service by eCheck or Credit Card (One time and Recurring

Options are available)

You may set up a one time or recurring payment using eCheck, MasterCard, American Express or Discover by going to www.smartstreet.org and select “Pay Assessments,” choose either “One-time Assessment for credit card” or “eCheck,” or click on “Register” under “Recurring Assessment Payment” to set up a recurring payment schedule. If you would like to set up a recurring assessment payment, you will need to obtain a login. This may be accomplished by :

IMPORTANT: All changes of contact details should be reported to the HOA immediately using the Contact Form and email to [email protected] A copy of the contact form can also be found at the back of this manual Exterior Maintenance Manors The paint and exterior finish of single family homes is the responsibility of the homeowner. Villas The paint and any other exterior finish of all townhomes shall be maintained by the HOA. The color of such paint or exterior finish, and the frequency of such painting shall be determined by the Board of Directors.

Exterior Building Repairs Manors

Exterior building repairs of single family homes is the responsibility of the homeowner.

Villas Please refer to the Villas Declarations and Notice on the HOA website regarding the owners’ and HOA’s responsibility for exterior building repairs or maintenance. Also refer to the insurance section below for details of the HOA commercial property coverage. Exterior Alterations

In the event that any owner wishes to carry out any external changes to the property or landscaping, including installation of a satellite dish, they are required to submit an Architectural Review Application Form to the Architectural Review Board for approval. Please refer to the appropriate Declarations on the HOA website for full details.

Insurance Manors Single family homeowners are responsible for securing the appropriate insurance to cover the building and contents.

Villas The Homeowners Association will secure insurance to replace the Villas

properties in the event of a catastrophic claim, such as, fire or storm damage.

Commercial property coverage is provided and intended to cover major claims, particularly where more than one property is involved, and protect homeowners against the risk of uninsured properties.

The policy DOES NOT cover the interior of each individually owned unit. The insurance policy covers each

building from the drywall out, all the way to the exterior of each building.

It should be noted that the deductible on the policy is $5000 (3% wind/hail deductible). Therefore, low cost repair of any damage is unlikely to be covered by the HOA commercial property insurance and these costs will be the responsibility of the homeowner(s) that benefit from those repairs.

It is the responsibility of each Villa owners to provide insurance for the interior of their individual unit. This type of insurance is similar to a homeowner’s policy, but would not normally cover any of the structure of the exterior. This policy should cover drywall decoration, kitchen and bathrooms flooring, carpets, contents etc.

Townhome owners are recommended to consult their insurance agent or

company to ensure they have adequate coverage for any eventuality not covered by the HOA commercial property coverage.

Landscaping The Association will provide full landscaping, lawn care, including mowing, blowing, weeding, edging, fertilization, pest control and irrigation services. NO ADDITIONAL LANDSCAPING MAY BE ADDED TO ANY UNIT without submitting an Architectural Review Application Form to the HOA for approval. Concerns

regarding your landscaping and lawn care should be directed to General Manager. Main Gates Access through the main gates is by a valid swipe card following registration at the clubhouse.

Resident owners - will be required to register at the office and will receive a maximum number (3) of vehicle passes providing HOA fees are up to date. ($10 deposit required). Passes are valid for 3 months.

Visiting owners & guests - will be required to register on arrival (or shortly after) and will be issued with a pass, which will remain valid for the duration of their stay. ($10 deposit will be refunded on return of the card on departure).

For the small number of owners who live locally, let out their property to Guests and require periodic access to the Resort, the rules as per ‘Regular contractors’ will apply.

Regular contractors - will be required to pre-register at the office and will be issued with a coloured ’mirror hanger’ which will be annotated with their business name and vehicle tag and will be valid for up to 3 months. Visitors (business or social) - If owners or guests are expecting visitors whilst staying at Terra Verde, their visitors will be unable to gain entry at the front gate, unless owners or guests have pre-notified the gate attendant.

To avoid inconvenience, therefore, please call the front gate number to advise who is due to arrive and the purpose of their visit e.g. Social, pizza delivery, AC repair etc. Trash Villas Trash collection for townhomes is Monday to Saturday. Trash must be bagged and placed inside the benches located at the entrance to each villa. Excess trash must be placed into the dumpsters. Dumpsters are located on: Pompano Beach Drive Madiera Beach Blvd Manors Trash collection for Manors homes is Tuesday and Friday. Please put bagged trash into containers with lids and place them at the edge of the driveway Monday or Thursday evenings. The empty containers should be returned to storage following pick up. Note:

At the dumpster areas, trash must be inside the dumpster and not on the ground.

The waste company will not pick up trash outside the dumpster containers.

Homeowners must not dump large items at the common dumpster sites. This includes, but is not limited to mattresses, televisions, electronics and furniture.

Items such as propane tanks, pool heaters, pool pumps and air conditioning units must not be put in the dumpsters.

Trash must not be left curbside outside townhomes.

All litter must be placed in the litter bins provided.

It is the responsibility of homeowners to make guests aware of the

arrangements for trash collection. It is recommended that a copy of the trash handouts be placed in the guest information folder in your home — www.terraverdehoa.com/documents/forms/trashhandout_v3.pdf http://www.terraverdehoa.com/documents/resources/manorsrecyclingandtrashflyer.pdf Vehicle Parking Each townhome has space for parking of two (2) vehicles, however spaces are not specifically assigned. Single family homes have private garages and driveways. In accordance with the ‘Declarations’, parking in any areas other than those dedicated for parking is strictly prohibited. Note:

Any vehicle used or parked on the Master Property must be registered, with current tags displayed.

All vehicles must obey the resort-wide speed restrictions.

Vehicles must be parked in a manner such that they do not obstruct walkways or disabled access points.

No vehicles may be parked on or driven over grassed or planted areas of the Master Property.

No truck or van, boat, trailer, recreational vehicle, commercial vehicle or other types of non-passenger vehicles, equipment, implements or accessories shall be parked, stored or otherwise kept on any portion of the property or elsewhere on Terra Verde.

When necessary, additional vehicles may be parked in designated parking areas at the clubhouse.

All vehicles must be parked within marked parking spaces.

No vehicles, trailers or personal passenger vehicles may be parked in a driveway or on the street if such vehicle has a flat tire, is leaking fluids or is otherwise inoperable.

No motor vehicle or trailer of any kind may be disassembled, serviced or repaired on the Master Property, except in an enclosed garage with the garage door remaining closed at all times.

Gate security are instructed to allow no more than 4 vehicles per property, to enter / visit individual properties

Homeowners are responsible for ensuring that guests are fully aware of these restrictions prior to their arrival.

Vehicle Storage facilities are available nearby to Terra Verde.

Nuisances It is the homeowner’s responsibility to ensure that guests are aware of the rules regarding nuisances, particularly in respect of noise after 9pm. Animals Owners are allowed to keep, raise and maintain dogs, cats and aquarium kept fish on the Master Property. Reptiles, livestock, poultry, pets or animals of any kind (other than those above) are not permitted. An Owner may have up to two (2) dogs and two (2) cats within their Residence at any one time. Dogs must be kept on a lead when on common ground and all owners and guests are required to remove deposited dog dirt. Fines may be imposed for violation.

Swimming Pools

All swimming pools must be properly maintained and must have child safety barriers installed.

All pool deck screens and screen doors must be properly maintained and free from visible defects.

The construction of any swimming pool, screening or fencing on any Residential Unit shall be subject to the approval and requirements of the ARB.

Above ground swimming pools are prohibited.

Residential pool decks, patios and courtyards must be kept free of weeds, underbrush, sight obstruction, refuse piles or other unsightly growths or objects. Large storage structures are prohibited.

Signs No signs of any kind are allowed to be displayed either insider or on outside of a property with the exception of one(1) discreet, professionally prepared ‘For Sale’ or ‘For Lease’ sign (maximum of 18 X 24 inches). An owner may display a sign of reasonable size provided by a contractor for security services within 10 feet of any entrance to a home.

Common Property No bicycles, scooters, and/or skateboards are to be left unattended on the Common Property, including but not limited to the sidewalks and around the clubhouse.
