In organizing the upcoming party, Cupalreached out to potential birdhouse buildersaround the Bay, from carpenters to architects,art students, amateurs and children. One con-tributor is general contractor, Bob Cooper, or“Bob the Builder” of Portola CustomBuilders in Menlo Park and San Mateo.

Last spring, Cooper built the birdhousethat received the highest bid, $1,700, andwon an award for wackiest house.

“Building the birdhouses is addictive. Wefind ourselves adding on until the houses getso heavy we can’t lift them,” he said. Thisyear, Cooper and business partner David Lof-gren have built a total of six birdhouses.

Putting the finishing touches on a bird-house that looks like a barn big enough tohold a cow let alone several hundred birds,Cooper exclaimed, “Oh, I forgot the weathervane!”

Cooper didn’t just wing his birdhouse ven-ture. He diligently referred to the AudubonSociety for design specifications related todimensions, habitation, drainage, entranceholes, accessibility and limited predator ac-cess.

“Nevertheless, the birdhouses come in allshapes and sizes. At last year’s auction, aStanford professor of design declared, ‘thesearen’t birdhouses; they’re lawn sculptures!’”said Cupal.

At Foothill College, students in an artcourse on 3-Dimensional design undertookthe birdhouses as a class project. The stu-

dents worked on the houses in groups ofthree over a two-week period, critiquing eachother’s finished projects.

“We began the project with a conversationabout the houses within the context of theevent and Child Advocates’ work. It was themost important part of the design process andmade the work much more meaningful,” saidHilary Ciment, course instructor.

The finished projects bear out the discus-sion. One birdhouse, called Floating City, ismade of papier-mâché. The bottom half isroots while the top is a city. It is a metaphorfor children being uprooted from one familyto another.

Child Advocates is part of a national or-ganization called Court Appointed SpecialAdvocate Volunteers (CASA). The organiza-tion began in 1976 when Superior CourtJudge David Soukoup of Seattle, Wash.,wanted to ensure that courts had sufficient in-formation to make the right decisions in cas-es involving abused and neglected children.To help keep the most needy kids fromfalling through the cracks, he came up withthe idea to recruit and train community vol-unteers to step into courtrooms on behalf ofchildren.

Today there are more than 400 CASA pro-grams around the country. The branch serv-ing San Mateo and Santa Clara counties isthe biggest, handling about 1,000 childrenper year.

Child Advocates serves children from birthto age 18. The cases they handle are often themost difficult cases in the foster-care system,and because of their caseloads, social work-ers and attorneys often have little time tospend with each case. Advocates help fill thevoid with regular visits, working with theparties involved, and educating families about

available services. They accompany childrento court and present regular reports to thecourt when appropriate, spending an averageof 144 hours per year with a child.

“Advocates are change agents in the chil-dren’s lives. Sometimes the advocate is theonly consistent adult a child knows,” Busheysaid.

The Birdhouse Bash is Child Advocates’second largest fundraiser for the year. “Wewanted to get away from the typical black-tiefunction,” said Cupal. “This will be a won-derful, casual garden party for the wholefamily.”

In addition to the silent auction, the eventwill include a live auction, awards for besthouses in a handful of categories, and a shorttalk on the impact of Child Advocates by aprominent Santa Clara County judge. Kidscan have fun making bird nests with real ma-terials and decorating birdhouses to takehome.

Cupal has advocated for five children overfive years. She is still in touch with her earlycases. “What you don’t realize when you be-gin as an advocate is that when the childrenclimb into your heart, they never climb out,”she said. ■

have had two differ-ent people want tosign rental agree-ments on apartmentsso they can enrolltheir children in PaloAlto schools. Theprospective rentersindicates that theywill not even live in the apartment. Can Irent to these people? Do I have any liabil-ity if I do?

A The prospective renter is commit-ting fraud on the school district.They are representing to the dis-

trict that the apartment is their principalresidence. Residency is a requirement ofthe district to enroll a child in school.Schools are so desirable that parents aretrying to become phantom residents togain enrollment for their children.

However, even if you didn’t get caughtor punished, this is against your interest

as a landowner to rent to this type of ten-ant. Because of the way schools are fund-ed it is a major expense for the school dis-trict if non-residents are enrolled in thelocal schools. Funding and facilities donot increase just because a new studentenrolls. The district has limited resourcesto serve the students that actually reside inthe district. The enrollment of non-resi-

dents would tax thesystem and thequality of the edu-cation that supportsyour high rentalrates. The resultwould surely be adecline in the valueof your property

over time. In short, refuse to rent to some-one who is not being honest.

Q I am buying a home in the areaand I understand that some citieshave transfer taxes that must be

paid on the sale of a property. What citieshave transfer taxes, how much are they,

and who has to pay them?

A Several local cities have transfertaxes including: Palo Alto, Moun-tain View, San Mateo, San Jose

and San Francisco. The rate of tax is basedon so much per $1,000 of the amount paidfor the property. Palo Alto’s transfer tax is$3.30/$1,000 as is Mountain View, SanMateo and San Jose. San Francisco trans-fer tax escalates from $5/$1,000 up to$7.50/$1,000 for properties selling over $1million. This tax is customarily split be-tween the buyer and seller and is a one-time payment made at the close of escrow.

Each county also imposes a transfer taxof $1.10/$1,000 on all sale transactions,and the seller customarily pays this tax.Certain types of transactions are exemptfrom the county tax, but very few are ex-empt from the city transfer tax. The rev-enue from the tax goes to the general fundof the city that collects the tax. As will al-most any cost in a real estate transaction,who pays these taxes may be negotiatedbetween buyer and seller.

Most standard form real estate contracts

allocate these costs according to custom.Costs could be significant. On a$1,500,000 sale in San Francisco thetransfer tax is $11,250. Unfortunately, theportion of this tax paid by the buyer is notdeductible against ordinary income, butmerely increases the buyer’s tax basis inthe property. Those expenses that are im-mediately deductible by the buyer are lim-ited to loan points, interest and real prop-erty taxes.

Given budget shortfalls in many citieswithout transfer taxes, these cities may at-tempt to impose transfer taxes in the fu-ture on a healthy real estate market. ■

St. Elizabeth Seton School is located in Palo Alto on Channing Avenue and isentirely dedicated to the education of children from East Palo Alto and the adjoiningeastside cities. An elementary school with 275 children from kindergarten through8th grade, Seton seeks to give a high academic, Catholic education capable ofsupporting students successfully through high school and into college.

Seton has been educating East Palo Alto children for the last 26 years and is proud ofits graduates who are in most of the local colleges and universities. At present,graduates are at USF, Santa Clara, Notre Dame de Namur, Loyola Marymount, Tufts,Cal Davis, San Francisco State, San Jose State, Canada, and Foothill.

St. Elizabeth Seton has been generously supported by many local residents andorganizations. The “Adopt a Student” program has been a huge source of financialassistance. Many adults come in as volunteers and work with individual students inareas where they are having difficulty. This one-to-one assistance builds lots ofconfidence as students realize how much the community cares about their success.
