According to the ap-pellate court, Fedoruk had a long history of mental illness in the years leading up to his brother-in-law’s death. He was diagnosed with schizophrenia and bipolar disorder and was twice admitted to a psychiatric hospital. In 2008, he was found not guilty by reason of insanity of robbery, as-sault, theft and criminal trespass charges filed by Clark County.

The higher court said defense attorneys should have looked at presenting a defense of not guilty by reason of insanity sooner than it did.

The Court of Appeals also found fault with the prosecutor’s of-fice, especially in how closing arguments were presented to the jury. The court said Deputy Prosecutor Amie Hunt used inflammatory images that were not based on evidence and encouraged jurors to make decisions based on things other than “evidence and sound reason.”
