1.0 GENERAL INFORMATION

1.1 PROGRAM SUMMARY

The New Jersey State Department of Education (“NJDOE” or “Department”), as part of its plan to change the way adults can earn a State-issued high school diploma, is soliciting qualification proposals for a High School Equivalency Assessment. THIS SOLICITATION WILL NOT RESULT IN A CONTRACT WITH THE STATE DEPARTMENT OF EDUCATION. The NJDOE will use the objective criteria specified within to review such proposals and will prepare a List of Approved High School Equivalency Assessments. The Assessment will be approved for use in Test Centers that contract with one of the Approved Vendors, and these Test Centers must comply with the statutory (N.J.S.A. 18A:18A-4.1 et seq.; 40A:11-4.1 et seq.)and regulatory (N.J.A.C. 5:34-4.1 et seq.) provisions of the competitive contracting process in order to contract with any of the instrument providers on the list.

All approved providers who meet the criteria specified in this Request for Qualifications (RFQ) will be included on this list. The list will be maintained by the NJDOE. No funding is directly associated with this application for approval.

There will be one initial application period. If necessary, there will be a reapplication period for any rejected qualification proposals beginning on November 15, 2013, as described below. Thereafter, there will be biennial (every two years) opportunities for new applicants to demonstrate that their instrument meets the requirements, on a schedule to be determined and published by the NJDOE. Providers of a High School Equivalency Assessment may also be removed from the list subject to the conditions specified within.

The NJDOE will review the Assessments submitted and evaluate them on their alignment with the requirements set forth in this RFQ. If approved, the entity that has submitted the Assessment will be notified of the Assessment’s approved status and their Assessment will be placed on the NJDOE List of Approved High School Equivalency Assessments . It is anticipated that this list of Assessments will be updated again on a schedule identified by the Department.

2.0 SPECIFICATIONS

2.1 ELIGIBLE APPLICANTS

This RFQ solicits submissions of instruments from all interested parties who are seeking to have an Assessment placed on the Department’s list of Approved High School Equivalency Assessment. Test Centers may only contract with a High School Equivalency Assessment Provider on the approved list. Entities proposing that their Assessment be reviewed by the Department must complete the request form found in Appendix C and submit all requisite documentation on behalf of the High School Equivalency Assessment Provider that is needed for the Assessment to be approved.

Entities eligible to submit an Assessment must have a history of providing large scale testing to one or more states of at least 10,000 test administrations.

Any High School Equivalency Assessment Provider will either contract with Test Centers and will be responsible for meeting the terms of its agreement with the Test Center, and/or will document how it will administer testing through its own organization.

2.2 APPROVAL CRITERIA FOR HIGH SCHOOL EQUIVALENCY ASSESSMENTS

The NJDOE shall evaluate an eligible Assessment for inclusion on the Department’s approved list pursuant to this RFQ process. Assessments will be included on the Department’s approved list upon determination that an application satisfies each of the following criteria described below.

Alignment with Overall New Jersey State Accountability System

Respondents to this RFQ shall provide documentation of their high school equivalency assessment with each of the following characteristics:

1. It is research-based or evidence-supported as an appropriate, valid and reliable assessment to measure high school equivalency. Documentation of this requirement shall be provided as appendices in the form of research reports or reports citing evidence of meeting this requirement, including that the test items and passages generate reliable and valid performance data.

2. It incorporates domains of practice and/or performance criteria that align to the Common Core State Standards (CCSS) developed in collaboration with teachers, school administrators, and experts to provide a clear and consistent framework to prepare students for college and the workforce. See http://www.state.nj.us/education/sca/ccss/ . It will also provide plans for future test development as the CCSS evolve. A Table showing the correlation of test scores and their relation to CCSS cut scores and the 2002 GED series test scores shall be provided.

3. It is offered as a computer based test and may also be offered as an optional paper based test for the next five years. Areas to be assessed must include: Writing, Science, Social Studies, Math, and Language Arts. It must include a Spanish Language version and English Proficiency test.

4. It provides the minimum passing score, as well as all possible scores with percentiles for student ranking included.

5. It must be scored and the results provided to the State electronically. Vendor must provide quality control systems to verify accuracy of scoring, processing, and reporting of all test scores

6. It must comply with the Americans with Disabilities Act requirement that any private or public entity that offers examinations relating to certification or credentialing for secondary or post secondary education, shall offer such examinations in a place and manner accessible to persons with disabilities or offer alternative arrangements for such individuals as special accommodations, and be able to evaluate the special accommodation request. See 42 U.S.C.S. § 12189. Accommodations should include, extended testing time based on the disability, supervised breaks, a private room, Braille formats of the test, the use of a scribe, etc.

7. The vendor must show it has the ability to acquire and manage statistical data, i.e. test results and demographics on age, race, disabilities, English language learners and other groups as specified at a later period by the NJDOE.

8. It must come with a Test Administrator’s Manual on how to administer the test and provide technical assistance on the use of the test and on professional development opportunities for teachers. A test shall be provided that chief examiners must pass to administer the test. The vendor must provide the appropriate test preparation materials.

9. It must include a computer and/or paper based test fee which will include all administrative costs. It shall provide the opportunity for existing and new test centers to come to an agreement with the test vendor to cover the administrative cost of testing.

10. It must explain how the respondent’s test fee(s) are calculated and how the fees will allow the Department to maintain or improve its yearly testing total of approximately 13,000 New Jersey students taking the 2002 series GED test in recent years.

11. It must describe test scoring methodology, including how essays are scores.

12. It must describe how tests will be administered and what software / hardware will be used.

13. It must describe the test formatting.

2.3 APPROVAL PERIOD OF INSTRUMENT PROVIDERS

A High School Equivalency Assessment that is placed on the approved list shall remain on the list unless the assessment is disqualified pursuant to Section 2.4 of this RFQ.

If a new version of the assessment or a revision to the assessment is made by the provider, the assessment must be re-submitted for review in the next annual cycle in order to remain on the approved list.

2.4 DISQUALIFICATION OF INSTRUMENT

Approval for inclusion on the Department’s List of Approved High School Equivalency Assessments may be withdrawn for good cause. This may include, but not be limited to, a recommendation to and determination made by the Commissioner that the assessment: is in noncompliance with one or more of the criteria for approval set forth in this RFQ, or is in noncompliance with the Department’s regulations.

2.5 APPLICANT REVIEW PROCESS

General Review and Scoring Process

Applications will each be independently reviewed and evaluated by members of the Review Committee pursuant to the approval criteria specified below.

Applicant responses on Form B of the Technical Proposal (Section 4.0) will be used to determine the provider’s adherence to the established approval criteria. For each established criterion, an applicant will receive either a score of:

3 – Evidence provided exceeds the established criterion; or

2 – Evidence provided meets the established criterion; or

1 – Evidence partially meets the established criterion; or

0 - Evidence provided does not meet the established criterion.

I. High School Equivalency Assessment (Review and Scoring)

In order to be approved as a provider of High School Equivalency Assessments, an applicant must receive a score of 1 for each of the 12 approval criterion, including sub-

criteria, below from assigned reviewers. Stated differently, each assessment must receive a total of 24 points in order to be approved for the Department’s list of Approved High School Equivalency assessment providers. Terms used in the criteria to follow are defined in Appendix A of this document. Approved assessment tests will be placed within the Department’s list of Approved High School Equivalency Assessments.

If a proposed High School Equivalency Assessment is not approved for use, the entity or another may resubmit the High School Equivalency assessment for review by November 15, 2013. At that time, the review panel will review it according to the same criteria outlined in this document. The entity should resubmit all required elements of the application in order for the High School Equivalency Assessment to be reviewed again.

2.6 RESERVATION OF RIGHTS

NJDOE reserves the right to: (1) reject any or all proposals received in response to the RFQ; (2) withdraw the RFQ at any time, at the agency’s sole discretion; (3) seek clarifications of applications; (4) use application information obtained through the state’s investigation of a provider’s qualifications, experience, ability, or financial standing, and any material or information submitted by the provider in response to the agency’s request for clarifying information in the course of evaluation and/or selection under the RFQ; (5) during the application period, amend the RFQ specifications to correct errors or oversights, or to supply additional information, as it becomes available; (6) during the application period, direct providers to submit application modifications addressing subsequent RFQ amendments; (7) change any of the scheduled dates; (8) require clarification at any time during the qualification process and/or require correction of arithmetic or other apparent errors for the purpose of assuring a full and complete understanding of a provider’s application and/or to determine a provider’s compliance with the requirements of the RFQ; (9) request accurate and current estimates of provider costs.

Submission of, or receipt by the NJDOE of applications confers no rights upon the provider nor obligates the State in any manner.

3.0 APPLICATION PROCEDURES

3.1 APPLICATION TIMELINE

All applicants shall submit all required materials. For inclusion in the Department’s list of Approved High School Equivalency Assessment, materials for applicants must be received by the New Jersey Department of Education at the address listed below. The Department will review submissions as follows:

For submissions received by the SEPTEMBER 27, 2013 deadline, notification of status will be provided to submission entities by Friday, November 1, 2013.

3.2 APPLICATION SUBMISSION METHOD

Facsimiles and emailed submissions are not acceptable. Applicants must adhere to the submission method detailed below.

An applicant must present all the information required in this RFQ in order to be considered for the New Jersey State Department of Education’s list of Approved High School Equivalency Assessments.

3.3 APPLICATION PACKAGE FORMAT

All information should be submitted in the order indicated on the forms and in the instructions.

Type size should be no smaller than 12 pt. The total number of pages in the Technical Proposal is limited to 25 pages, single spaced,

if submitted as a stand-alone document (each page can be used in its entirety for your response).

Appendices/Attachments are not included in the page maximums listed above and may contain resumes, letters of reference, printed brochures describing the services provided, certificates of incorporation or other legal documents, fiscal documents, tables, charts, graphs, scanned images, or photocopies.

Additional appendices/attachments, such as CD presentations, videotapes or other multimedia productions should not be included.

The Transmittal Letter and Form C require authorized signatures and therefore MUST be submitted via mail or hand-delivery. The original of each of these documents should be signed in BLACK/BLUE INK.

4.0 TECHNICAL PROPOSAL

In the Technical Proposal, applicants must describe in detail the High School Equivalency Assessment Test they are submitting for approval. The Technical Proposal, which will be reviewed by the New Jersey Department of Education Review Committee, is described below.

The Technical Proposal is divided into four sections:

Section I – Application (Form A)

In this section, the applicant shall complete the Technical Proposal Application Form.

Section II – High School Equivalency Assessment Narrative (Form B)

In this section, the applicant shall describe in detail the nature of the High School Equivalency Assessment and services the applicant will provide.

Section III – Request for Exemption from Disclosure Pursuant to the Open Public Records Act (Form C)

The applicant must complete a Request for Exemption form in order to identify any proprietary materials submitted as part of, or in support of, an applicant’s proposal, which applicant considers confidential or otherwise excemted from disclosure under the Open Public Records Act.

Section IV – Appendices

The applicant shall provide a copy of the assessment test being submitted for approval. The applicant shall also provide any supporting documentation that has been requested in this RFQ or which has been referenced by the provider in the completed Technical Proposal.

7. The vendor must show it has the ability to acquire and manage statistical data, i.e. test results and demographics on age, race, disabilities, English language learners and other groups as specified at a later period by the NJDOE.(0 to 3 points)

8. It must come with a Test Administrator’s Manual on how to administer the test and provide technical assistance on the use of the test and on professional development opportunities for teachers. A test shall be provided that chief examiners must pass to administer the test. The vendor must provide the appropriate student test preparation materials.(0 to 3 points)

9. It must include a computer and/or paper based test fee which will include all administrative costs. It shall provide the opportunity for existing and new test centers to come to an agreement with the test vendor to cover the administrative cost of testing.(0 to 3 points)

Request for Exemption from DisclosurePursuant to the Right to Know Law

New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et. seq., and the common law, require that each agency shall make available all records maintained by said agency, except that agencies may deny access to records or portions thereof that fall within the scope of the exceptions listed in OPRA or established under the common law.

Any proprietary materials submitted as part of, or in support of, an applicant’s proposal, which applicant considers confidential or otherwise excepted from disclosure under the OPRA or the common law, must be specifically so identified, and the basis for such confidentiality or other exception must be specifically set forth.

Please list all such documents for every portion of the proposal on the form below, and include a copy of this document with each separate portion of the proposal. Materials which are not indicated below may be released in their entirety upon request without notice to you.

The submission of any information to the NJDOE by a vendor puts the risk of disclosure on the vendor. Submission of this form does not guarantee that a request for exemption from disclosure will be granted. If necessary, NJDOE will make a determination regarding the requested exemptions, in accordance with the process set forth in OPRA and common law.
