Physician Duty to Report Stat. 448.115, now requires a physician to promptly report, in writing, to the MEB another physician if:
The other physician is engaging or has engaged in acts that constitute a pattern of unprofessional conduct. The other physician is engaging or has engaged in an act that creates an immediate or continuing danger to one or more patients or to the public. The other physician is or may be medically incompetent. The other physician is or may be mentally or physically unable safely to engage in the practice of medicine or surgery.
To encourage reporting and also protect reporting physicians, the new law prohibits the reporting physician from being held civilly or criminally liable or be found guilty of unprofessional conduct for reporting another physician. Peer Review-QIAOn February 1, 2011, the Wisconsin Health Care Quality Improvement Act (WHCQIA) went into effect. The act effects a number of changes to Wisconsin law which generally broaden protections for health care providers, including:
Strengthening, clarifying, or providing protections against the use of quality improvement investigations and conclusions.
Protecting health care providers who openly and honestly aid regulatory agencies in their good work. Maintaining unintentional medical errors as a matter for civil, not criminal, courts
Physician Re-licensure SurveyAs part of the current re-licensure process, physicians are asked to complete a workforce survey.
Physicians may bypass the survey to complete licensure
Physicians may re-enter the process after licensure to complete the survey.
