Downs, Jr., CitiMortgage, Inc. successor by reason of merger to CitiFinancial Mortgage Company Inc. and Toyota Federal Credit Union nka Western Federal Credit Union, Defen-dants, the Master Commissioner of the Harrison Circuit Court will sell at public auction to the highest and best bidder at the front door of the Harrison County Courthouse, in Cynthiana, Kentucky, on Friday, March 16, 2012, at 10:00 a.m., the fol-lowing described property:

Being all of Lot No. 16, of the Connersville Road Land Divi-sion Subdivision, Harrison County, as shown on the plat re-corded at Plat Cabinet 5, Slide 177A, of the Harrison County Clerk’s Offi ce; the improvements thereon being known and designated as 5287 Ky. Hwy. 32W, Cynthiana, Kentucky.

Subject to any and all easements, restrictions, conditions and legal highways of record and/or in existence.

Being the same property conveyed from Randall H. Kloss and Bobbie Kloss, husband and wife, to Gary E. Downs, Jr. and Kelly A. Downs, husband and wife, by virtue of a deed dated 03/30/2005 and recorded 04/07/2005 at Deed Book 282, Page 763 of the Harrison County, Kentucky real estate records.

The property is being sold to produce a sum suffi cient to sat-isfy the judgments and liens as follows: (a) The costs of this action, including the Master Commissioner’s fee, appraiser’s fee and advertising costs; and (b) Judgment for the Plaintiff, The Bank of New York Mellon fka The Bank of New York as successor to JPMorgan Chase Bank, N.A., as Trustee for the benefi t of the Certifi cateholders of Popular ABS, Inc. Mort-gage Pass-Through Certifi cates Series 2005-3, in the amount of $174,882.28 plus interest at the rate of 6.59000% per an-num from August 27, 2011 until paid, plus any additional costs expended by Plaintiff to protect or preserve the property until sale date. (c) Real Estate taxes, plus interest and penalties, if any, for taxes assessed for the year 2011 and previous years. (d) Plaintiff’s Court costs and attorney fees.

The property shall be sold upon the following terms and condi-tions: (1) The property shall be sold free and clear of all liens and claims of the parties to this action; (2) The purchaser shall be required to pay the sum of 10% of the purchase price in cash, certifi ed funds or by other immediately verifi able collect-able medium of exchange acceptable to the Commissioner, on the day of sale to apply on the purchase price; (3) The balance of the purchase price shall be due and payable within thirty (30) days after the day of sale; (4) The purchaser shall be required to execute a bond with good and suffi cient surety thereon as

approved by the Commissioner to secure the unpaid portion of the purchase price, the bond to bear interest at the rate of 12% per annum from the day of sale until paid, the bond to have the same force and effect as a judgment and shall remain a lien on the property as additional security until the purchase price is paid in full; (5) In the event that the Plaintiff is the success-ful purchaser, it shall be entitled to a credit on its judgment against the purchase price and shall only be obligated to pay court costs, the fees and costs of the Master Commissioner, and any real estate taxes payable pursuant to this order, and in that event, no bond shall be required; (6) The purchaser shall have the privilege of paying all or any part of the purchase price or paying the bond before maturity by paying the balance of the principal together with all accrued interest thereon until the date of payment; (7) The purchaser shall obtain posses-sion of the property upon confi rmation of the sale by the Court and payment of the purchase price in full; (8) All ad valorem taxes on the property for calendar year 2012 and all subse-quent years shall be assumed and paid by the purchaser. All real property taxes due and owing to Harrison County or the City of Cynthiana for 2011 and prior years will be paid from the proceeds of sale. If any tax bills have been sold to third parties under a Certifi cate of Delinquency under KRS Chapter 134, the purchaser of the property will receive a credit against the purchase price for an amount equal to the sum paid to the County Clerk by the third party for the tax bill with the pur-chaser then being responsible for redemption of the Certifi cate of Delinquency including any additional interest, costs, fees or charges allowed by law; (9) The property shall be sold subject to any assessment for public improvements levied against the property and subject to all rules and regulations enforced by the Cynthiana-Harrison County-Berry Joint Planning and Zon-ing Commission, all applicable health and safety regulations, all restrictions and easements thereon appearing of record in the Harrison County Court Clerk’s Offi ce, governmental laws and regulations affecting the property, and shall be subject to any unrecorded easements, discrepancies or confl icts in bound-ary lines, shortage in area and encroachments, if any there be, which an accurate and complete survey or an inspection of the property would disclose; (10) The purchaser shall bear the risk of loss on the improvements on the property and the risk of loss shall pass to the purchaser as of the day and time of sale; (11) The property shall be sold with any improvements thereon “as is”; and (12) The property shall be sold subject to such right of redemption as may exist in favor of the United States of America pursuant to 28 USC Section 2410, and the right of redemption of the Defendants.

Pursuant to a Judgment and Order of Sale entered by the Har-rison Circuit Court on February 8, 2012 in Civil Action No. 11-CI-00220 Wells Fargo Bank, N.A., Plaintiff vs. Richard Cox, Tracy Cox, Heritage Acceptance Corporation and Arrow Financial Services LLC, Defendants, the Master Commissioner of the Harrison Circuit Court will sell at pub-lic auction to the highest and best bidder at the front door of the Harrison County Courthouse, in Cynthiana, Kentucky, on Friday, March 16, 2012, at 10:00 a.m., the following described property:

Being on Dutch Chapel Road and on Highway 1054, said tract also being part of a 187.798 acre tract owned by RJK Partner-ship as recorded in Deed Book 206, Page 299, and Lot 25 be-ing bounded and described as follows:

NAP application closing datesfor crops fast approaching

The deadline to file an application for natural disaster protection under the Noninsured Assistance Program (NAP) are March 1 and March 15.

The crops for the March 1 deadline are alfalfa, clover, grass, mixed grass intend-ed for grazing, hay or seed and TEFF.

The crops for the March 15 deadline are beans, beets, broccoli, cabbage, cantaloupe, carrots, cauliflower, corn, corn-hybrid seed, cucumbers, eggplant, gourds, greens, herbs, lettuce, onions, peas, peppers, popcorn, potatoes, pump-kins, radish, sorghum, sorghum-grain, soybeans, squash, strawberries, sunflow-ers, sweet potatoes, tobacco-burley, tobac-

co-dark air, tobacco-fire cured, tomatoes, turnips and watermelons.

NAP helps producers reduce their risk when growing food and fiber crops, specialty crops, and crops for livestock feed. These benefits are only available for crops for which crop insurance is not available.

Producers filing for coverage under the NAP are required to pay a $250 service fee per crop per county not to exceed $750 per producer per county or $1,875 per producer in all counties.

Contest starts March 1 and all entries must be received by March 30 at the Harrison County Extension office. The winning design will be

used in signs, t-shirts and other avenues of adver-tising. The winner will receive a prize worth $50, t-shirt with the winning design and will be a spe-cial guest on opening day of the market on April 21.

•Must show use of vege-tables, fruits, etc in draw-ing.
