Harbours Board Annual Report June 2013 The Harbours Board is now responsible for Truro, Penryn, Newquay, St Ives and Penzance Harbours with an updated Memorandum of Understanding in the process of amendment following Full Council approval for Penzance Harbour to come within the Harbour Boards remit in October 2012. Councillor Jim Currie stepped down from the Harbours Board in 2013 and was replaced by Councillor John Fitter. Over the last twelve months the Harbours Board has considered the following issues: Business Plan This is a written document that describes the business, its objectives, strategies, the market it is in and its financial forecasts. It is a living document that will require updating and modifying as circumstances change. It has been updated in September 2012 and will be reviewed again later this year. Port Masterplan A Port Masterplan has been adopted for Truro & Penryn which reflects the physical but flexible expression of the future vision for the harbours. The goal has been to develop a vision that is consistent with the Sustainable Strategy and permit the harbours to be managed in a financially self-sustainable way in the long term. Consideration is now being given to updating the Sustainable Strategy which will include all ports and developing this further with a new single Harbour Revision Order.

The Harbours Board is now responsible for Truro, Penryn, Newquay, St Ives and Penzance Harbours with an updated Memorandum of Understanding in the process of amendment following Full Council approval for Penzance Harbour to come within the Harbour Boards remit in October 2012. Newquay Harbour has been awarded a substantial European Fisheries Grant in order to rebuild some Fishermen’s Stores as well as creating some office space and providing other facilities for the harbour users. Planning consent for the building has now been approved and building works have commenced. Port Marine Safety Code The Port Marine Safety Code is primarily aimed for the ‘Duty Holder’ i.e. the Full Council of Cornwall Council – who are directly accountable for marine safety in harbour waters. The Code establishes the principle of a national standard for every aspect of port marine safety and aims to enhance safety for those who work in ports, their ships, passengers and the environment. It applies to port marine operations the well established principles of risk assessment and safety management systems. It provides a measure by which harbour authorities can be accountable for the legal powers and duties which they have to run their harbours safely and help to discharge their obligations effectively. This Code was updated in December 2012 and the Government’s policy for marine safety in ports places the onus of responsibility on harbour authorities (the duty holder) to manage safety in their harbour waters and the approaches. Using their statutory powers, harbour authorities have the necessary tools to fulfil their duties and maintain a safe port. The Formal Safety Assessment for Truro and Penryn which was undertaken in October 2010 can now be viewed on the website www.portoftruro.co.uk . Penzance Harbour underwent a Formal Safety Assessment in April 2011, Newquay Harbour in March 2012 and St. Ives Harbour in March 2013 with all marine hazards in the harbour assessed to be ‘as low as reasonably practicable’ (ALARP) or below. Pilotage The Harbours Board as the Competent Harbour Authority (CHA) has a duty to keep the need for pilotage under review (Section 2(1) of the Pilotage Act 1987). It also has to consider the authorisation of pilots, employment arrangements for its authorised pilots, the approval of pilot launches, the issue of pilotage directions and the issue of exemption certificates. As a result of this the Pilotage Agreement with Falmouth Harbour Commissioners for the provision of pilotage services within the Ports of Truro and Penryn has been extended for a further period of five years from 2009.

Pilotage Directions applicable to the Ports of Truro & Penryn are those for vessels over 60metres loa, carrying dangerous or polluting goods, using the services of harbour tugs, having chart deficiencies and/or when directed by the harbour master in the interests of safety of the vessel, other vessels, persons, the port or its infrastructure. A member of the Harbours Board sits on the Pilotage Standards Committee and is involved directly with the authorising and re-authorising of pilots. In addition, the Harbour Master attends relevant Pilotage Assessment Panels and chairs the Fal Estuary Marine Safety Committee. St Ives is covered by the St Ives (Pilotage) Harbour Revision Order 1988 and is able to make pilotage compulsory for ships within the area covered by the Order. This will be reviewed by the Harbours Board at a later date. Penzance Harbour issues Pilotage Exemption Certificates (PEC’s) and maintains a vessel monitoring system through cameras looking at vessel approaches to the harbour and again this will have to be reviewed especially now that the Marine Navigation Act has been made into law. Port Facility Security Plan Regulation (EC) No. 725/2004 of the European Parliament, together with the Ship and Port Facility (Security) Regulations 2004 and the Ship and Port Facility (Security) (Amendment) Regulations 2005 are the principal pieces of legislation that have relevance to the International Ship and Port Security (ISPS) Code in the UK. Compliance with this legislation is required by virtue of the Ports of Truro and Penzance handling vessels greater than 500 GT engaged in international voyages. The Port Facility Security Plan for Truro was revised in February 2010 following statutory requirements and is valid until 2015. The Port Facility Security Plan for Penzance is currently being revised. In addition there is a requirement to have a Port Facility Security Officer (PFSO) for each of the Ports together with regular training. An inspection of the Port Facility in Truro was undertaken in April 2012 and it was shown to be compliant with the regulations. An inspection of the facility at Penzance was undertaken in May 2013, the results of which are expected soon.

Oil Spill Contingency Plans This plan is a requirement under the Merchant Shipping (Oil Pollution Preparedness, Response and Co-operation Convention) Regulations 1998 which requires contingency plans for any harbour or oil handling facility offering berths alongside, on buoys or at anchor, to ships of over 400 GT or tankers (oil or chemical) of over 150 GT. There is a further need to be capable of responding to a Tier 1 oil spill, together with holding the appropriate stock of equipment, have a formal agreement in place for a Tier 2 response together with adequate training and exercising of the plan. This plan for Truro has been amended, submitted and approved for a period of five years until July 2017. The Harbour Master currently chairs the Oil Pollution Response Standing Committee. Penzance Harbour is currently updating their Oil Spill Contingency Plan Port Waste Management Plan The Merchant Shipping and Fishing Vessels (Port Waste Reception Facilities) Regulations 2003 are applicable to any harbour or terminal within the UK. Every harbour authority and terminal operator has to provide waste reception facilities adequate to meet the needs of ships normally using the harbour or terminal in question, without undue delay to ships. There is also a requirement to produce a Port Waste Management Plan for the various ports and harbours. The Truro and Penryn plan is currently being updated, Newquay Harbour plan has been submitted to the Department for Transport and is awaiting sign off, St. Ives Harbour had their plan approved in November 2011 and Penzance Harbour had their plan approved in December 2012. Maritime Emergency Plan This plan for Falmouth Bay and Estuaries, which includes Truro and Penryn, was reviewed and updated in February 2013. It has been developed by the Harbour Authorities controlling the River Fal, including St Mawes Harbour and the Percuil River in conjunction with the Local Authorities and the emergency services to ensure that all maritime emergencies occurring in, or having an effect on, the Fal and Helford areas receive an effective and speedy response. This updated version of the plan now includes Restronguet Creek, which does not fall under the jurisdiction of any Harbour authority; and also takes into consideration public health and terrorist emergencies occurring within the defined area.

The plan has been prepared in accordance with the legal obligations placed on the authorities including: 1. The Dangerous Substances in Harbour Areas Regulations 1987 (Regulations 26, 27 & 28)

2. Control of Industrial Major Accident Hazard Regulations 1984 3. Public Health (Ships) Regulations 1979

Consideration will be given to developing a similar plan for Penzance Harbour at a later stage. Inspection of Local Aids to Navigation An inspection of the aids to navigation under the management of the harbour authorities for:- Truro and Penryn – 29 August 2012 Newquay Harbour – 28 August 2012 St Ives Harbour - 16 May 2013 Penzance – 13 May 2013 Was/will be carried out by an officer from Trinity House and any deficiencies will be corrected. Commercial Facilities Bulk cement imports and scrap metal exports are the two principle cargoes handled at Lighterage Quay, Truro. The import of bulk cement was curtailed during the re-piling of Lighterage Quay last year when it proved difficult for the shipper to handle the cargoes at the quay and had to resort to road transport. Increased volumes of baled scrap will be handled following the upgrading of the scrap site together with improved interceptor facilities in order to comply with Environment Agency permitting regulations. The warehouse on Lighterage Quay and office block at Newham, have been leased to Braemar Howells who specialise in counter pollution and incident response. Negotiations are currently taking place with regard to leasing out the open area at the south of Lighterage Quay. Penzance Harbour continues to offer facilities for the handling of passengers and freight to and from the Isles of Scilly as well as passenger landings by the occasional cruise liner. A submission has been made in April 2013 to the Department for Transport in order to seek funding for dredging and rock armour in the harbour.

Both Newquay and St. Ives are used by the fishing industry for the landing of fish and shellfish. Newquay Harbour is currently in the process of having new storage and offices being built and which will be completed by September 2013. Leisure Facilities Fees and charges for Truro, Penryn Newquay and St Ives have bee considered by the Harbours Board and then recommended to Full Council for 2013/2014. The policy is to make the harbours financially self sustaining. New pontoons for Woodbury Reach, Truro have been purchased and await instalment, which will complete the visitor pontoon replacement programme. We continue to take over moorings, as they are given up and install the equipment ourselves which generally results in a better standard of mooring maintenance. New managed moorings are being created at St Ives Harbour as demand for these facilities increases. An extra two bridles were replaced in Newquay Harbour in 2013 from the Island across to the North Quay and in the harbour gap between the South and North Quay. This completes the ground chain refurbishment programme. Stakeholder Groups To ensure that the Harbours Board has strong and direct links with other harbour users, local communities and other external organisations with an interest in the Ports of Truro, Penryn, Newquay and St Ives a formal consultation mechanism has been established. The Harbours Forum is the recognised stakeholder group for the Ports of Truro and Penryn together with the Newquay Harbour Stakeholder Group for Newquay Harbour. St. Ives Harbour is in the process of organising a Stakeholder Group as are Penzance. The respective Harbour Masters and where possible Board Members attend their meetings. Leading Lights Award & ISO Accreditation In October 2007 the Council as harbour authority were awarded this status in recognition of the successful implementation of the Municipal Ports Review and its recommendations for best practice in decision making, accountability, strategy and business planning and review of performance and finance in relation to the Ports of Truro & Penryn.

This award has continued to be in place following the transition into a new single unitary authority. Leading Lights status for all Cornwall Council ports and harbours managed by the Harbours Board has been re-applied for and awaiting approval from the Department for Transport, Department for Communities and Local Government and the British Ports Association. Following internal checks together with an assessment by an independent outside verifier the management of the Ports of Truro and Penryn have been awarded ISO 9001 (Quality Management) and ISO 14001 (Environmental Management) in January 2010. In April 2012 the Ports of Truro, Penryn and Newquay successfully reapplied for ISO 14001 for ‘the provision of port and harbour management services at Truro, Penryn and Newquay harbours’ through its operation of an Environmental Management System. This required a revision of the Environmental Management System which was completed in February 2012 and which is available on the website www.portoftruro.co.uk . A visit by our accreditation body on 29 January 2013 confirmed the ISO 14001 certification which will be extended to cover St Ives from next year. Special Area of Conservation (SAC) Management Plan The Conservation (Natural Habitats &c) Regulations 1994 require relevant authorities (those organisations with statutory powers and duties for the marine environment) within, or adjacent to a European marine site to be responsible for the management of the site. The publication of a management scheme, which includes the ports of Truro and Penryn, is based on voluntary co-operation and partnership between the relevant authorities. The existing plan is currently being considered for review. Municipal Ports Review This refers to the study of ports under local government ownership that was undertaken by the Department for Transport and the Department for Communities and Local Government in May 2006 which identified what was considered to be best practice for ports governance. Key findings from this review revolved around accountability and decision making, strategy and business planning, management and performance review together with municipal ports finances. The review considered the way forward for local authority ports and the Council as Harbour Authority for the Ports of Truro, Newquay, Penryn, St Ives and Penzance has positively responded.

This will need to be updated and will need to include Newquay, Penzance and St Ives Harbours.

Harbours Board

Councillor Loic Rich is the Chairman of the Harbours Board. He is an Independent Member for the Truro Tregolls Electoral Division. Other committees that he sits on are:

• Cornwall Council • Health and Social Care Scrutiny

Committee • Transport and waste Portfolio Advisory

Committee His term of office commenced in May 2013 and he is also the current Deputy Mayor for Truro.

Councillor Geoff Brown is also the Portfolio Holder for Homes and Communities. He is a Liberal Democrat for the Newquay Central Division. Other committees that he sits on include:

Independent Board Members

Simon Hendra is responsible for the continuing expansion and development of GJ Hendra in Truro, Penryn and the Isles of Scilly. As a pharmacist he has seen the business expand from a dual site pharmacy business to nine different businesses. He has spent his working life based in Truro and is also a founder and Past Chairman of the Working for Truro Association, Director of the Totally Truro Board and Director of Truro Cathedral Ltd.

Michael Brougham completed a full career as an Engineer Officer in the Royal Navy in 2001, retiring in the rank of Commodore. In his final appointment he was the Royal Navy’s senior chartered aerospace engineer. In 2002/03 he built up the Cornwall Marine Network which has since grown to over 300 members. He now works as an independent consultant currently supporting the Cornwall Aerospace and Defence Initiative (CADI). He is a keen sailor, and has lived near the Carrick Roads since 1983.

Garrick Royle is the Operations Manager for Cornwall Ferries Limited responsible for ensuring the smooth and safe operation of this service whilst also assisting in developing plans for its sustainability and development. Educated at the Camborne School of Mines he graduated with a degree in Environmental Science and has an active interest in the local environment. He is a member of the Institute of Waste Management and sits on the Falmouth Traffic Infrastructure Group.

Geoff Wilson followed a career at sea rising to Captain E (Engineer) in the Royal Fleet Auxiliary and is now the Managing Director and Principal Surveyor of a Marine Surveying and Consultancy business based in Penryn. He is a fellow of the Society of Consulting Engineers and Ship Surveyors and is a surveyor for a number of Classification Societies, Foreign Ship Registries and MECAL. He is also on the Committee of the West Cornwall Branch of the Federation of Small Businesses, Treasurer of Penryn Community Development Trust and sits on the Maritime and Coastguard Agency South West District Marine Safety Group.

Martin Gilbert has been a fisherman for over 30 years and has experience of working in most of the harbours around Cornwall. He is a member of the Cornish Fish Producers Organisation and has been a volunteer crew member for the RNLI. He works his own vessel from Newquay Harbour and takes a keen interest in the environment, both local and further afield.
