6. No onsite parking shall be permitted instead of the minimum one parking space required;

7. The front yard landscaped area shall be a minimum of 30.7% the gross area of the front yard instead of the minimum 50.0% required front yard landscaped area; and,

8. An eave/gutter shall be permitted to be located as close as 0.2m from the southerly side lot line instead of the minimum 0.3m setback required.

The lands are being developed in conjunction with 549 Hughson Street North which is also subject to a concurrent Minor Variance Application (File # HM/A-17:56).

Accessory buildings shall maintain a minimum 0.45m setback from the nearest lot line.The rear accessory building shall be relocated or demolished otherwise, further variances will be required.

The applicant requested a variance to reduce the number of parking spaces to one (1) instead of two (2). However, only one (1) parking space is required per each dwelling unit for a two family dwelling/semi-detached dwelling. It should be noted that the parking space provided is almost entirely within the road allowance; as such, a variance is required to permit no on-site parking instead of the minimum one (1) parking space required.

7. Balconies may project not more than 2.0m into a required front yard and shall be0. 0m from a front lot line (including associated eaves and gutters) instead of the requirement that balconies may not project more than 1,0m into a required front yard and shall be at least 1.5m from the front lot line.

NOTES:

1. Variances to permit eaves and gutters to project into a side yard have been requested by the applicant. However the by-law allows eaves and gutters to project into a side yard not more than half the width of the yard, or 1.0m, whichever is lesser. Based on

this provision, the eaves and gutters conform as shown on the submitted site plan therefore, no variance is required.

2. Parking spaces shall be clearly delineated and bumpers or wheel barriers are required to be provided to prevent the physical encroachment of vehicles beyond the parking area. Please also be advised that two (2) of the eight (8) parking spaces are required to be dedicated for visitors. If the above cannot be complied with, further variances may be required.

3. A maximum building height of 11 .Om is permitted in the current zoning district. Insufficient information has been submitted in order to determine compliance, As such, further variances may be required.

3. A minimum aisle width of 4.5 metres shall be provided instead of the minimum required aisle width of 6.0 metres required for 90° parking;

4. A minimum parking space width of 2.7 metres shall be provided instead of the minimum required parking space width of 3.0 metres; and,

5. A maximum parking space length of 6.3 metres shall be provided instead of the maximum permitted parking space length of 6.0 metres.

NOTES:

1. The subject lands are presently zoned “H” according to Hamilton Zoning By-law 6593. Be advised that By-law 17-240 was passed on November 8, 2017 which changed

the zoning of this property from “H” to “C2” under Hamilton Zoning By-law 05-200. However, By-law 17-240 has been appealed to the Ontario Municipal Board and is therefore not yet final. At present, all proposed development is reviewed under both the existing and proposed Zoning By-laws with the more restrictive zoning regulations of both Zoning By-laws being applied, with the exception of building permits, which are reviewed under the former existing zoning until such time that By-law 17-240 comes into force. If By-law 17-240 is approved at the Ontario Municipal Board, the zoning under this By-law will be applied.

2. A building permit is required for the conversion of the existing building. Be advised that Ontario Building Code regulations may require specific setbacks and construction types.

3. The conversion of the existing building is a conversion under Section 19 “Residential Conversion Requirements” of the Zoning By-law.4. A further variance will be required if the average floor area of the residential dwelling units is not a minimum of 65 square metres.

5. A further variance will be required if the access driveway width does not provide a minimum width of 2.8 metres.

6. Additional parking is not required to be provided for a commercial use within an existing building in an “H” zone, except for a Medical Office use. Further variances will be required if a medical office use is proposed for the commercial unit.

7. Details regarding the commercial use have not been provided. The applicant shall ensure the intended commercial use is permitted at this location. Additionally, a further variance will be required if parking is required to be provided for the intended commercial use.

3. A minimum northerly side yard width of 5.0m shall be provided instead of the minimum required side yard width of 6.0m;

4. A minimum building setback of 5.0m shall be provided from the limits of the Lincoln Alexander Parkway (LINC) instead of the requirement that no structure shall be located within 15.24m of the limits of the Mountain Freeway;

5. A minimum 1.5m wide landscaped area shall be provided along the rear lot line instead of the requirement that a planting strip of not less than 1.5 metres in width shall be provided and maintained along every rear lot line adjoining a residential district or use, except where a building, structure of accessory building is located and except for the area used for access driveways;

No landscaped area shall be provided along the lot line abutting the Lincoln Alexander Parkway (LINC) street line instead of the requirement that where any parking space or manoeuvring space is adjacent to a street line, a landscaped area having a minimum average width of 2.0 metre, but not less than 1.0 metre in width, shall be provided and maintained along the entire street line of the lot, except for the area used for access driveways.

8. Vehicle charging stations, light standards, signs and other similar appurtenances shall be permitted to be located within a planting strip instead of the requirement that planting strips shall only be used as an area of land growing ornamental shrubs or trees or both, suitable to the soil and climatic conditions of the area of land for the sole purpose of providing a visual barrier or buffer.

9. Vehicle charging stations, light standards, signs and other similar appurtenances shall be permitted to be located within a landscaped area instead of the requirement that landscaped area shall be fully and completely open and exposed to natural light and air and unobstructed above the surface and used exclusively for scenic, recreational or like uses.

10. A minimum parallel parking space width of 2.4m shall be provided instead of the minimum required parallel parking space width of 2.5m.

11. No visual barrier shall be required along the westerly 4.52m portion of the north lot line abutting 67 Fortissimo Drive and a visual barrier not less 1.2m and not greater than 2.2m in height shall be provided 4.52m east of the rear lot line instead of a visual barrier being along the boundary of the lot abutting the residential district not less than 1.2m in height and not greater than 2.0m in height.

12. A maximum visual barrier height of 2.2m shall be permitted instead of the maximum required visual barrier height of 2.0m.

13. The parking area shall be permitted within the required front yard instead of the requirement that no part of the required parking area in a residential district shall be located in a required front yard.

14. A loading space having a minimum size of 3.7m wide x 9.0m long x 4.3m high shall be provided for the northerly restaurant building (The Keg) instead of the minimum required size of 3.7m wide x 18.0m long x 4.3m high.

NOTE:

i. The subject lands are presently zoned “AA”, “C”, “HH” and “G-3” according to Hamilton Zoning By-law No. 6593. Be advised that By-law No. 17-240 was passed on November 8, 2017 which changed the zoning of this property from “AA”, “C”, “HH” and “G-3” to “C7” under Hamilton Zoning By-law 05-200. However, By-law No. 17-240 has been appealed to the Ontario Municipal Board and is therefore not yet final. Variances required to pursuant to Hamilton Zoning By-law No. 05-200

1. The proposed northerly building (The Keg) shall be a minimum of 5.0m from the lot line abutting the Lincoln Alexander Parkway (LINC) street line and a minimum of 15.0m from the lot line abutting the Upper James Street street line instead of the minimum building setback of 18.0m from a street line.

2. No visual barrier shall be required along the 118.80m northerly lot line abutting the Lincoln Alexander Parkway (LINC), no visual barrier shall be required along the westerly 4.52m portion of the north lot line abutting 67 Fortissimo Drive and a visual barrier shall be provided 4.52m east of the rear lot line instead of the requirement that a visual barrier shall be required along any lot line abutting a Residential Zone or Institutional Zone property line.

3. No planting strip shall be provided along the 118.80m northerly lot line abutting the Lincoln Alexander Parkway (LINC) and a 1.5m landscaped area shall be provided along the rear lot line instead of the requirement that where a property lot line abuts a property lot line within a Residential Zone or an Institutional Zone and not a Laneway, a minimum 1.5 metre wide planting strip shall be provided and maintained.

4. No maximum parking space size shall be required instead of the maximum required parking space size of 3.0m wide x 6.0m long.

5. A minimum parking space width of 2.7m shall be provided instead of the minimum required parking space width of 3.0m as required by Section 5.2 of By­law 17-240 which amends Hamilton Zoning By-law No. 05-200.

6. A minimum parallel parking space width of 2.4m shall be provided instead of the minimum required parallel parking space width of 2.5m

7. The parking spaces and aisles shall be a minimum of 1.3m from the Upper James Street street line and a minimum 1.3m wide planting strip shall be provided between the parking spaces and aisles and Upper James Street street line, excluding driveways and walkways extending directly from the street instead of the requirement that parking spaces and aisles, giving direct access to abutting parking spaces, excluding driveways extending directly from the street shall not be located within 3.0 metres of a street line and a 3.0m wide planting strip shall be required and permanently maintained between the street line and the said parking spaces or aisles.

8. The parking spaces and aisles shall be a minimum of 0.0m from the lot line abutting the Lincoln Alexander Parkway street line and no planting strip shall be provided between the parking spaces and aisles and the Lincoln Alexander Parkway street line instead of the requirement that parking spaces and aisles, giving direct access to abutting parking spaces, excluding driveways extending directly from the street shall not be located within 3.0 metres of a street line and a 3.0m wide planting strip shall be required and permanently maintained between the street line and the said parking spaces or aisles.

9. Vehicle charging stations, light standards, signs and other similar appurtenances shall be permitted to be located within a planting strip instead of the requirement that planting strips shall mean an area of land growing ornamental shrubs or trees or both, suitable to the soil and climatic conditions of the area of land for the sole purpose of providing a buffer and shall include low level architectural walls or features.

10. No visual barrier shall be required along the lot line abutting the Lincoln Alexander Parkway (LINC) street line, no visual barrier shall be required along the westerly 4.52m portion of the north lot line abutting 67 Fortissimo Drive and a visual barrier shall be provided 4.52m east of the rear lot line instead of the requirement that where a parking lot is situated on a lot which abuts a Residential Zone, a visual barrier shall be provided and maintained along that portion of the lot line that abuts a Residential Zone.

11. The landscaped areas and landscaped parking islands shall have a minimum combined area of 4.9% of the parking lot area instead of the requirement that landscaped areas or landscaped parking Islands with a minimum combined area of 10% of the area of the parking lot and associated access driveway and maneuvering areas shall be provided and maintained.

12. No minimum width or area shall be required for the individual landscaped areas within the parking lot instead of the requirement that each landscaped area shall have a minimum width of 2.8 metres and a minimum area of 10.0m .
